Licence for the Ashram client software. Applies to the version distributed through Steam and to any other official download channel.

1. PARTIES AND ACCEPTANCE
This End User Licence Agreement ("EULA") is an agreement between you and Brainsoft Games ("Brainsoft"), owner of the rights in the video game Ashram (the "Software").
By installing, copying or using the Software you agree to be bound by this EULA. If you do not accept it, do not install it and request a refund through the store from which you obtained it.
If you obtained the Software through Steam, this EULA applies in addition to Valve Corporation's Steam Subscriber Agreement. In the event of conflict between the two as regards the relationship between you and Valve, Valve's agreement prevails.

2. LICENCE GRANT
Brainsoft grants you a personal, limited, non-exclusive, revocable and non-transferable licence to install and use the Software for private, non-commercial entertainment purposes, on the devices permitted by the store from which you acquired it.
The Software is licensed, not sold. Brainsoft and its licensors retain all rights not expressly granted to you in this document.

3. RESTRICTIONS
Except to the extent mandatorily permitted by law, you may not:

• Copy, distribute, rent, lend, sublicense or make the Software available to the public.
  
• Reverse engineer, decompile or disassemble the Software, or attempt to obtain its source code.
  
• Modify, adapt or create derivative works of the Software, or alter its data files to gain an in-game advantage.
  
• Circumvent, disable or interfere with technical protection measures, account verification or cheat detection.
  
• Use the Software to develop or distribute cheats, bots, unauthorised servers or tools that alter the online service.
  
• Remove or obscure the intellectual property notices included in the Software.

European law recognises the right of decompilation in the cases and within the limits of Article 6 of Directive 2009/24/EC on computer programs. This EULA does not restrict that right.

4. BACK-UP COPY
You may make a back-up copy of the Software for strictly personal use, in accordance with Article 5(2) of Directive 2009/24/EC. That copy is subject to this same EULA.

5. ONLINE COMPONENT
Ashram is an online game: the Software requires a connection to our servers and a valid account. Use of the online service is additionally governed by the Terms of Use and the Privacy Policy.
The online service may evolve, be interrupted for maintenance or, in due course, cease. We will announce a permanent shutdown with reasonable notice. The licence over the Software does not guarantee perpetual availability of the online service.

6. CONTENT GENERATED WITH ARTIFICIAL INTELLIGENCE
Part of the artistic assets in the Software has been produced with the assistance of generative artificial intelligence tools, always under human review and editing. Details are set out in the Generative AI Use notice, which forms an integral part of this agreement by reference.

7. UPDATES
Brainsoft may release patches, fixes and new versions of the Software. Some updates are mandatory in order to keep accessing the online service, for compatibility and security reasons. This EULA applies equally to all of them, unless an update is accompanied by specific terms.

8. TERM AND TERMINATION
The licence remains in force for as long as you comply with this EULA. It terminates automatically if you materially breach its conditions, in particular the restrictions in clause 3.
Upon termination you must stop using the Software and uninstall it. Termination of the licence does not entitle you to a refund, without prejudice to the rights granted to you by consumer law.

9. REFUNDS AND RIGHT OF WITHDRAWAL
If you acquired the Software on Steam, refunds are handled under Steam's refund policy.
If you are a consumer in the European Union, you have fourteen calendar days to withdraw from the purchase of digital content. That right lapses once performance has begun with your prior express consent and your acknowledgement that you thereby lose the right of withdrawal, in accordance with Article 16(m) of Directive 2011/83/EU.

10. WARRANTY AND LIABILITY
The Software is provided "as is". Brainsoft does not warrant that it will operate without interruption or error, or that it will be compatible with any given hardware configuration.
To the extent permitted by law, Brainsoft's total liability to you for any claim relating to the Software is limited to the amount you paid for it.
Liability for wilful misconduct, gross negligence, death or personal injury, or arising under product liability legislation, is neither excluded nor limited. If you are a consumer, the statutory guarantee of conformity for digital content under Directive (EU) 2019/770 applies on its own terms.

11. GOVERNING LAW
This EULA is governed by Spanish law, without prejudice to the mandatory consumer protection rules of the user's country of habitual residence within the European Union.
Valve Corporation is not a party to this EULA but is a third-party beneficiary of it as regards distribution of the Software through Steam.
