By installing or using ProximaClient (the "Software") you accept this Agreement. If you do not agree with it, do not install or use the Software.


The Licensor grants you a non-exclusive, royalty-free licence to use the Software:

• territory — worldwide; term — for the entire term of the Licensor's exclusive right to the Software;
  
• you may install and run it on one or more of your devices and use its functionality for its intended purpose;
  
• you may use it for both personal and commercial purposes, provided you comply with the licences of third-party software (for Minecraft servers — the Minecraft End User License Agreement, Mojang Studios).

The Software remains the property of the Licensor; this licence transfers no exclusive rights to you.


You may not:

• decompile, disassemble or otherwise reverse-engineer the Software, except where expressly permitted by law;
  
• modify the Software or distribute modified versions of it;
  
• use the Software to create derivative products competing with ProximaClient or ProximaTunnel;
  
• remove or alter the Licensor's copyright and trademark notices.

The Software works together with the Licensor's online services. You may not use the Software or the services to host illegal content, infringe intellectual property rights, carry out DDoS attacks or phishing, distribute malware, send spam, circumvent third-party software licences, or for any activity that breaches applicable law.

In case of a breach, the Licensor may restrict or terminate access to the services unilaterally and without prior notice.


Some functionality requires a ProximaMP account; registration requires an email address, which is confirmed with a one-time numeric code. You are responsible for keeping your password safe and for actions taken under your account.

Individual services are provided free of charge or on a paid basis; their scope, limits and prices are published by the Licensor.

Processing of personal data is described in the Privacy Policy.


The Software and the services are provided "as is". The Licensor does not warrant uninterrupted operation or 24/7 availability, absence of errors or vulnerabilities, compatibility with any particular hardware or software configuration, or preservation of your data, including server contents and backups.


To the maximum extent permitted by applicable law, the Licensor is not liable for lost profits, indirect or incidental damages, loss of data, acts of third parties, or the operation of third-party services and products. The Licensor's aggregate liability is limited to the amount you actually paid for the last paid period. These limitations do not apply where the law does not allow them.


The licence terminates if you breach this Agreement, by decision of an authorised state authority, or if the project is discontinued — with at least 30 days' notice. You may stop using the Software and remove it from your devices at any time.


The Software is intended for persons aged 16 and over. Persons under 16 may use the Software only with the consent and under the supervision of a parent or legal guardian.


This Agreement is governed by the law of the Russian Federation. Disputes are settled through negotiation and, failing that, by the court at the Licensor's place of registration, except where the law provides otherwise (including consumers' right to choose the venue).
