MistWindow End User License Agreement

This Agreement governs your use of MistWindow (the "Software"), provided by
nasumon (the "Author"). By accepting this Agreement on Steam, or by installing
or using the Software, you agree to be bound by this Agreement. If you do not
agree, do not install or use the Software.
This English text is a reference translation. In case of any discrepancy
between this text and the Japanese original, the Japanese text prevails.
1. Definitions
1.1 "Software" means the MistWindow executable, its data files, the assets
bundled with it, and any updates to them.
1.2 "Submitted Content" means wallpapers, pet assets, and other content that
you publish through Steam Workshop.
1.3 "Subscribed Content" means content published by third parties that you
obtain through Steam Workshop.
2. License Grant and Permitted Use
2.1 Subject to this Agreement, the Author grants you a non-exclusive,
non-transferable right to use the Software on devices under your control.
2.2 The Author imposes no device limit in addition to restrictions under the
Steam Subscriber Agreement. This does not permit multiple people to share
a single license. If multiple people use the Software, each user must obtain
the rights required under Steam's terms and this Agreement.
2.3 You may use the Software for business purposes, including use by a company,
organization, or sole trader.
2.4 You may show the Software's interface in videos, live streams, recordings,
screenshots, articles, reviews, and tutorials, and may monetize them. No
application to the Author, license fee, or attribution is required.
2.5 Sections 2.3 and 2.4 apply only to portions in which the Author holds the
necessary rights. Submitted Content, Subscribed Content, website icons, and
other third-party content remain subject to the applicable rightsholders'
terms.
3. Restrictions
Except as permitted by this Agreement, Steam functionality, or applicable law,
you may not, without the Author's prior written permission:
3.1 reproduce, distribute, redistribute, or publicly transmit the Software's
installer, executable, or bundled files beyond what is necessary to install,
run, or make your own backup of the Software;
3.2 sell, resell, lend, rent, transfer, sublicense, or permit a third party to
use the Software;
3.3 modify the Software or distribute a modified version;
3.4 decompile, disassemble, or otherwise reverse engineer the Software, except
to the extent expressly permitted by applicable law;
3.5 remove or alter copyright or other proprietary notices, or circumvent a
technical protection measure of the Software; or
3.6 use the Software for any purpose that violates applicable law.
4. Steam Workshop and User-Generated Content
4.1 Copyright and other rights in Submitted Content remain with you or the
applicable rightsholder and are not transferred to the Author.
4.2 You represent and warrant that you hold the rights necessary to publish
Submitted Content and to grant the licenses described in this Section and
by Valve Corporation. You may not submit content that infringes another
person's copyright, trademark, likeness, privacy, or other rights.
4.3 You grant the Author a royalty-free, non-exclusive license to use Submitted
Content solely as necessary to provide the Software's features. This use
includes retrieving, reproducing, storing on a device, displaying,
generating thumbnails, converting formats, and performing other necessary
technical processing. This license continues while the Submitted Content is
available through Steam Workshop and to the extent necessary for existing
subscribers to continue using it under Steam's terms.
4.4 Subscribed Content is provided under the responsibility of its submitter or
another third party. If you use, publish, or commercially exploit Subscribed
Content outside the Software, you are responsible for confirming that you
have the necessary rights. The Author does not grant rights in third-party
content that the Author does not hold.
4.5 The Author may refuse or stop handling Submitted Content within the
Software if it raises compatibility, security, legal, or contractual issues.
The Author has no duty to monitor Submitted Content continuously. Listings
and removals on Steam Workshop are also subject to Valve Corporation's
procedures.
4.6 Use of Steam and Steam Workshop is separately governed by the Steam
Subscriber Agreement and other terms established by Valve Corporation. The
relationship between you and Valve Corporation is governed by those terms.
5. Intellectual Property and Third-Party Software
5.1 Except for Submitted Content, Subscribed Content, and third-party software,
copyright and other intellectual property rights in portions of the
Software created by the Author belong to the Author.
5.2 Rights in third-party software and assets included in the Software belong
to their respective rightsholders and are governed by the applicable
licenses and other terms.
5.3 The list of bundled third-party software and its license texts is available
under Settings > About in the Software.
6. Data and External Connections
6.1 Software settings, registered tiles, selected wallpapers and pets, and
similar application settings are normally stored on your device. Content,
titles, descriptions, preview images, and other information required for a
Steam Workshop submission are sent to Valve Corporation through Steam.
6.2 The Software does not use a server controlled by the Author to provide its
features and does not send your application settings directly to the
Author.
6.3 The Software makes external connections to use Steam and Steam Workshop,
retrieve icons from websites registered as URL tiles, and connect to the
OBS address specified by you.
6.4 Data handling by Steam, Steam Workshop, destination websites, and OBS is
also subject to the terms established by their respective providers or
administrators.
7. No Warranty and Limitation of Liability
7.1 To the maximum extent permitted by applicable law, the Software is provided
"as is." The Author does not warrant uninterrupted or error-free operation
or fitness for a particular purpose. This Section does not affect any right
that cannot lawfully be excluded or limited.
7.2 Where the Author is liable for reasons other than willful misconduct or
gross negligence, liability is limited to actual, ordinary, and direct loss
arising from the Software, and aggregate liability is capped at the amount
you actually paid to obtain the Software. This Section applies only in cases
of the Author's ordinary negligence.
7.3 The preceding limitation does not apply to the Author's willful misconduct
or gross negligence, or where applicable law does not permit the limitation.
8. Termination and Changes
8.1 If you materially breach this Agreement and fail to cure the breach within
a reasonable period after notice from the Author, the Author may terminate
the license granted under this Agreement. No cure period is required where
immediate termination is reasonably necessary due to the nature of the
breach, including unauthorized redistribution, circumvention of technical
protection measures, or infringement of third-party rights.
8.2 Upon termination, you must stop using and uninstall the Software. Licenses
under Section 4 that continue for the period stated there, and Sections 5,
7, and 9, survive termination.
8.3 The Author may amend this Agreement where the change benefits users
generally, or where the change is consistent with the purpose of this
Agreement and is reasonable in light of its necessity, appropriateness, and
other relevant circumstances.
8.4 The Author will announce the amended terms and their effective date through
Steam, the Software, or another appropriate method before they take effect.
The amended Agreement applies when you use the Software on or after its
effective date. If you do not agree, stop using the Software before that
date.
9. Relationship with Steam, Governing Law, and Contact
9.1 Purchases, distribution, refunds, and other transactions through Steam are
separately governed by the Steam Subscriber Agreement and other terms
established by Valve Corporation. This Agreement does not replace the
agreement between you and Valve Corporation.
9.2 This Agreement is governed by and construed in accordance with the laws of
Japan.
