Unless expressly identified otherwise, all proprietary and otherwise protectable parts of the game developed by Studio Justin Braun, including the game concept, source code, game mechanics, texts, user interfaces, graphics, animations, characters, level designs, audiovisual presentation and other original content, are owned by or otherwise protected for Studio Justin Braun.

This does not include music, open-source software, third-party libraries, platform components, trademarks or other third-party content. The rights and license terms of the respective rights holders apply to such components.
2. LICENSE TO USE THE GAME
Upon lawful acquisition of the game, the user receives a personal, non-exclusive and generally non-transferable right to install and use the game in accordance with the rules of the respective distribution platform.

Purchasing the game does not transfer any copyrights, trademark rights or other intellectual property rights in the game or any of its components.

Use is permitted in particular for private entertainment purposes.

Unless expressly permitted by these terms, users may not:
  • independently resell, rent, publicly offer for download or otherwise distribute the complete game or substantial parts of it;
  • extract executable files, music, graphics, source code or other components from the game and publish or exploit them independently from the game;
  • distribute copies of the game outside the mechanisms provided by the relevant distribution platform;
  • use game content as the basis for a separate commercial product;
  • unlawfully circumvent protection mechanisms or technical access restrictions.
Mandatory statutory rights remain unaffected. This applies in particular to actions expressly permitted by law in connection with interoperability, error analysis, backup copies, decompilation or other legally permitted uses.
3. MODDING
The creation of modifications (“mods”) for Didgeridoo Man – The Legend Of The Hill is expressly permitted.

Mods may be modified, published and shared with other players provided that:
  • a lawfully acquired version of the original game remains required for use;
  • the complete original game or substantial parts of it are not redistributed;
  • third-party content is not used unlawfully;
  • the mod is not presented in a way that suggests it is an official release by Studio Justin Braun;
  • the mod is not used for unlawful purposes.
Free distribution of mods is permitted.

Commercial exploitation of original game components, for example by selling extracted graphics, music tracks, program components or other game assets, is not permitted without prior consent from Studio Justin Braun or the respective rights holder.

Content created by mod authors remains, in principle, their own property.

Studio Justin Braun assumes no responsibility for the functionality, security or content of third-party modifications.
4. SCREENSHOTS, VIDEOS, STREAMING AND FAN CONTENT
Studio Justin Braun expressly permits the creation and publication of:
  • screenshots,
  • gameplay videos,
  • Let’s Plays,
  • livestreams,
  • reviews,
  • tutorials,
  • guides,
  • journalistic coverage,
  • memes and other fan content
on platforms such as YouTube, Twitch, TikTok, Instagram and comparable services.

Monetization of such content through the ordinary monetization systems of the relevant platform is expressly permitted.

This permission includes music contained in normal gameplay, provided that the music appears as part of an actual gameplay recording, gameplay video or livestream.

This permission does not include the isolated extraction and publication of complete music tracks, soundtracks, graphics or other assets without substantial connection to an original gameplay recording.

Permission to create fan content does not transfer ownership or rights in the game.

Fan content must not misleadingly be presented as official Studio Justin Braun content.
5. MUSIC
All songs and music tracks contained in the game originate from the artist KTNKT.

The music is used in Didgeridoo Man – The Legend Of The Hill with the consent of the rights holder and is licensed accordingly for use in the game.

Use of the music within gameplay recordings, Let’s Plays, reviews and livestreams is permitted within the scope described under “Screenshots, Videos, Streaming and Fan Content”.

Independent reproduction, extraction, publication, redistribution, editing or commercial use of the music outside the game or outside corresponding gameplay recordings is not permitted without separate permission from the rights holder.

Purchase of the game does not include a standalone license to use the music outside the context of the game.
6. SOUND EFFECTS
The sound effects used in the game are predominantly or entirely generated programmatically and are not taken from external sound libraries.

Didgeridoo sounds, percussion, applause and additional sound effects are synthesized at runtime using the Web Audio API; corresponding external WAV or MP3 sound files are not used.
7. GENERATIVE ARTIFICIAL INTELLIGENCE
Tools based on generative artificial intelligence were used during the development of Didgeridoo Man – The Legend Of The Hill.

This applies in particular to:

Music:

Parts of the music created for the game were generated or edited with the use of generative AI tools.

Programming:

Individual parts of the source code were created, supplemented, revised or analyzed with the assistance of generative AI.

Generative AI was used as a development and production tool.

Where certain purely AI-generated content does not qualify for independent copyright protection under applicable law, no additional copyright protection beyond what legally exists is claimed by these notices.

Copyright and other rights in human-created or human-edited elements, the specific compilation of the game, proprietary source code and other protectable components remain unaffected.
8. GRAPHICS, ICONS AND FONTS
The game primarily uses proprietary or programmatically generated graphical elements.

Symbols displayed in the game are rendered, among other things, through Unicode characters or SVG graphics generated at runtime.

The user interface references system fonts installed on the respective operating system. Fonts such as Segoe UI, Tahoma, Verdana, Impact, Arial Black, Georgia and Times New Roman are referenced through CSS only and are not distributed as font files with the game.

The respective fonts and their names may be subject to rights of their respective owners.
9. MICROSOFT WINDOWS XP – PARODY AND REFERENCES
Certain visual representations, user interfaces or design elements within the game may intentionally evoke computer operating systems and software designs of the early 2000s.

This includes humorous or parodic references to Microsoft Windows XP.

These elements are intended for humorous, artistic or parodic purposes.

Microsoft, Windows, Windows XP and related product names, trademarks and identifiers are the property or protected marks of their respective rights holders.

Microsoft is neither the developer nor publisher of Didgeridoo Man – The Legend Of The Hill and has not sponsored or endorsed the game.

Unless expressly identified otherwise, no original graphic files, system files or other original Microsoft Windows XP components are distributed with the game.

References to corresponding trademarks are made solely for descriptive or contextual purposes.
10. TRADEMARKS AND THIRD-PARTY RIGHTS
All trademarks, product names, company names, logos or other identifiers mentioned within the game or these notices are the property of their respective rights holders.

The mere mention or technical support of a product, platform or service does not create any broader commercial relationship, partnership, recommendation or endorsement unless expressly stated.

This applies in particular to Microsoft, Windows, Steam, Steamworks, Valve and Discord.
11. STEAM AND STEAMWORKS
The primary distribution platform for Didgeridoo Man – The Legend Of The Hill is Steam.

The game uses functions of the Steamworks SDK and may use, in particular:
  • Steam Achievements,
  • Steam user profiles,
  • avatars or user images,
  • global leaderboards,
  • Steam Cloud,
  • player identification through the Steam platform,
  • additional platform functions provided by Steam.
Steam and Steamworks are provided by Valve. Use of these services may also be subject to Valve’s terms and privacy policies.
12. DISCORD RICH PRESENCE
The game supports Discord Rich Presence.

If the Discord client is installed and running, information about the current game status may be displayed through the technical interfaces provided by Discord.

The software library <code>discord-rpc</code> is used for this purpose.

Discord is an independent third-party service. Use of Discord is subject to the terms of the respective provider.
13. ONLINE MULTIPLAYER
Didgeridoo Man – The Legend Of The Hill may provide online multiplayer functionality.

Servers operated by Studio Justin Braun or commissioned technical service providers may be used for this purpose.

To conduct a multiplayer session, technically necessary data may be processed, including:
  • player or session identifiers,
  • Steam ID,
  • display name,
  • game status,
  • connection information,
  • multiplayer events,
  • technical network data.
The multiplayer servers use, among other things, WebSocket technology.

A claim to uninterrupted availability of online services exists only within the scope of applicable statutory and contractual provisions.

Maintenance, technical faults, security measures, changes to third-party platforms or other technical circumstances may temporarily restrict online functionality.
14. LEADERBOARDS AND PLAYER PROFILES
The game may provide global leaderboards.

This may involve processing or displaying a player name, Steam ID, avatar, score, level or gameplay progress and other data required for the relevant leaderboard.

Other players may therefore be able to see a player’s public display name, profile image and achieved scores.

Where functions are provided directly through Steam, processing is also subject to Valve’s terms.
15. CLOUD STORAGE
The game may use Steam Cloud or comparable cloud services to synchronize save data, settings or other game data between devices.

Availability, transmission and processing by an external platform provider are additionally subject to the terms of that provider.

Studio Justin Braun cannot guarantee uninterrupted availability of an external cloud service.

Statutory rights remain unaffected.
16. PRIVACY
Online features of the game may require the processing of personal data or data relating to an identifiable person.

This may include in particular:
  • Steam ID,
  • username or display name,
  • avatar,
  • IP address,
  • technical connection data,
  • multiplayer session data,
  • leaderboard values,
  • achievement data,
  • cloud save data,
  • technical error and security information.
Processing takes place only where required to provide the respective function or where otherwise legally permitted.

Where external services such as Steam or Discord are used, those services may process data independently under their own privacy policies.

These legal and license notices do not replace any separately required privacy policy.
17. OPEN-SOURCE SOFTWARE AND THIRD-PARTY COMPONENTS
Didgeridoo Man – The Legend Of The Hill contains or uses third-party software components.

These include in particular:

Open-source software licensed under the MIT License.
<h3>Steamworks SDK</h3>
The game uses components of Valve’s Steamworks SDK in accordance with the applicable terms.

The respective copyrights remain with the original developers and rights holders.

The open-source components are expressly not owned by Studio Justin Braun.

They are governed exclusively by their respective license terms.

The complete copyright and license notices for third-party components form part of the third-party license information distributed with the game.
18. NO RESTRICTION OF OPEN-SOURCE RIGHTS
Nothing in these terms is intended to restrict rights granted directly to a user under the license of any open-source component used in the game.

Where these terms conflict with an applicable open-source license, the respective open-source license governs the relevant component.
19. REVERSE ENGINEERING AND TECHNICAL ANALYSIS
Reverse engineering, decompilation or disassembly of proprietary parts of the game is permitted only to the extent expressly allowed by mandatory applicable law or with prior consent from Studio Justin Braun.

Rights arising from open-source licenses for individual components remain unaffected.

Likewise, mandatory statutory rights, including those relating to interoperability or other legally protected purposes, remain unaffected.
20. CHEATS, MANIPULATION AND ONLINE PLAY
Technical modifications or mods for personal use are generally permitted.

However, manipulation of online features is not permitted where it:
  • interferes with other user accounts,
  • intentionally falsifies leaderboards,
  • disrupts servers or network services,
  • enables unauthorized access,
  • circumvents security measures,
  • manipulates data of other players, or
  • interferes with proper multiplayer operation.
Studio Justin Braun may, where legally permitted, restrict or block access to its own online services in cases of misuse.
21. UPDATES AND CHANGES
The game may be updated, expanded or modified over time.

Updates may include bug fixes, security updates, technical adjustments, new functions, changes to online services or adaptations required by changes to third-party platform requirements.

Statutory update obligations and consumer rights relating to digital products remain fully unaffected.
22. AVAILABILITY OF THIRD-PARTY SERVICES
Certain functions of the game depend on third-party services such as Steam or Discord.

Studio Justin Braun does not have full control over their permanent availability or technical design.

Changes, restrictions or discontinuation of such services may require individual game functions to be modified or discontinued.

Any statutory rights arising in such cases remain unaffected.
23. WARRANTY
Statutory warranty and defect rights apply to the acquisition and use of the game.

In particular, consumer rights relating to digital products are not restricted by these terms.

Outside mandatory statutory obligations, Studio Justin Braun does not guarantee that the game will function without errors on every conceivable hardware or software configuration or that third-party services will always remain available.

Any expressly granted guarantees remain unaffected.
24. LIABILITY
Studio Justin Braun is liable without limitation for damage caused intentionally or through gross negligence.

Liability also remains unaffected, in particular:
  • in the event of injury to life, body or health;
  • under mandatory statutory liability provisions;
  • under product liability law;
  • on the basis of expressly assumed guarantees;
  • in any other case where limitation of liability is not legally permitted.
In the event of a slightly negligent breach of essential contractual obligations, liability is limited, where legally permitted, to the typically foreseeable damage.

Further mandatory statutory claims remain unaffected.
25. SAVE DATA AND DATA LOSS
Despite technical safeguards, technical errors, hardware failures, faulty mods, operating system problems, cloud service outages or other circumstances may result in damaged or lost save data.

Users should create their own backups of important data where technically possible.

Liability for data loss is governed by applicable law and the liability provisions above.
26. DISTRIBUTION PLATFORMS
The game is distributed primarily through Steam but may in the future also be offered through other digital or physical distribution platforms.

In addition to these terms, the contractual, usage and payment terms of the respective distribution platform may apply.

Where mandatory platform terms or statutory provisions take precedence over these terms, they remain unaffected.
27. GOVERNING LAW
The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), to the extent such a choice of law is legally permitted.

For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the country in which they have their habitual residence.

Mandatory statutory rules on jurisdiction remain unaffected.
28. FINAL PROVISIONS
If any individual provision of these notices is wholly or partially invalid or unenforceable, the remaining provisions remain unaffected.

The relevant statutory provisions apply in place of any invalid provision.

Mandatory consumer rights, copyright exceptions, rights arising from open-source licenses and other non-waivable statutory rights are not restricted by these terms.
