PITWAL END USER LICENSE AGREEMENT

This End User License Agreement ("Agreement") is a legal agreement between you ("You") and Christian Mitchell ("Author") covering the PitWal software, its executable, bundled data, and any updates (the "Software"). By installing or using the Software you accept this Agreement. If you do not accept it, do not install or use the Software.
1. LICENSE GRANTED
The Author grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on computers you own or control, for your own personal or internal business use.
The Software is licensed to you, not sold. Your purchase buys this license. It does not transfer ownership of the Software.
2. WHAT YOU MAY NOT DO
You may not:
a) resell, rent, lease, sublicense, or redistribute the Software;
b) use a hub key or access credential issued to another person without that person's permission;
c) reverse engineer, decompile, or disassemble the Software, except where that right cannot lawfully be restricted;
d) remove or alter any copyright, trademark, or attribution notice;
e) use the Software to break the terms of any game, service, or platform you use it alongside (see section 5);
f) reverse engineer, replicate, study for reimplementation, or derive the Software's methods, models, or algorithms, whether by hand or by automated means (including AI agents, bots, or scrapers), or use the Software's data, API, agent interfaces, or outputs to build, train, or supply any product or service that competes with the Software. Connecting your own AI assistant to the Software to help YOU drive better is expressly permitted. Using that access to extract or reproduce how the Software works is not.
Permitted purpose: the Software and everything it produces are licensed to help YOU drive better. They are not licensed as a source of methods, data, or components for building other tools.
3. OWNERSHIP
The Author retains all right, title, and interest in the Software, including all intellectual property rights. No rights are granted except those stated here expressly.
4. YOUR DATA
The Software records telemetry that your own games produce on your own machine, and stores it locally on that machine by default. That data is yours.
Optional peer sync: PitWal can sync sessions directly between you and another driver you choose, over a network connection the two of you set up yourselves (for example, Tailscale). When you enable it, the session data you select is sent directly to that driver's machine, peer to peer, using a pairing key you control. It is not routed through or stored on any server operated by the Author. Sync is off unless you turn it on. How PitWal handles synced data is described in the PitWal Privacy Policy.
You may stop syncing at any time. Session data you have already sent to another driver resides on that driver's machine and is subject to their control.
5. THIRD PARTY GAMES AND SERVICES
PitWal is an independent product. It is not affiliated with, endorsed by, or sponsored by Microsoft, Xbox, Turn 10 Studios, Playground Games, or any game publisher, nor by any vehicle or track trademark owner. All product and company names are trademarks of their respective owners and appear here only as factual compatibility references.
PitWal reads telemetry that a game outputs through that game's own documented data output feature. It does not modify any game, inject code into any game, or extract art, models, textures, audio, or other assets from any game.
PitWal includes track recognition data and vehicle name references that the developer measured from their own driving, using the game's documented telemetry output. This data lets PitWal identify which track and car you are using so you do not have to enter them by hand. This bundled recognition data consists of numeric position measurements and factual names. It contains no artwork, no 3D models, no textures, and no racing lines.
Your own driving line is the only line PitWal displays. Detailed track maps are built on your machine from your own laps, and a track is treated as unknown until you have driven it.
You remain responsible for complying with the terms of any game or service you use PitWal alongside.
6. UPDATES
The Author may provide updates at their discretion. This Agreement covers any update unless that update ships with its own terms.
7. TERMINATION
This license ends automatically if you breach it. On termination you must stop using the Software and remove it from your machines. Your locally stored data remains yours and is unaffected.
8. NO WARRANTY
The Software is provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The Author does not warrant that the Software will be uninterrupted, error free, or that any analysis it produces is accurate.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by law, the Author is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or business interruption, arising from your use of or inability to use the Software. The Author's total liability under this Agreement will not exceed the amount you paid for the Software.
Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you.
10. STEAM
If you obtained the Software through Steam, the Steam Subscriber Agreement also applies. Where this Agreement conflicts with the Steam Subscriber Agreement, the Steam Subscriber Agreement takes precedence. Refunds for Steam purchases are handled under Valve's refund policy.
11. GOVERNING LAW
This Agreement is governed by the laws of the State of California, USA, without regard to its conflict of law rules.
12. ENTIRE AGREEMENT
This Agreement, together with the PitWal Privacy Policy, is the entire agreement between you and the Author regarding the Software.
