CoasterWorks Professional Commercial Licence Addendum

This CoasterWorks Professional Commercial Licence Addendum ("Addendum") is between you and Double Check Media Limited ("we", "us" or "Licensor").

This Addendum applies when you purchase or otherwise lawfully obtain the CoasterWorks Professional Upgrade. It supplements the CoasterWorks End User Licence Agreement ("Main EULA"), which continues to apply.

Terms defined in the Main EULA have the same meaning in this Addendum.

1. Professional licence

While you hold a valid licence to the Professional Upgrade through your Steam account and comply with this Addendum and the Main EULA, we grant you a limited, non-exclusive, non-transferable and non-sublicensable licence to use eligible Outputs commercially.

This licence applies only to Outputs created through features intentionally provided by CoasterWorks. It does not permit extraction of internal data or assets through external tools, reverse engineering or other unintended methods.

2. Permitted commercial uses

You may commercially use eligible Outputs that you create, including:

  • rendered images and videos;
  • marketing and promotional media;
  • client presentations and visualisations;
  • track data exported through the Game's provided track-export features (for example CSV exchange formats);
  • track geometry exported through supported Professional features;
  • terrain meshes exported through the provided terrain-export feature; and
  • Outputs created using the custom train and custom track tools.

You may use eligible Outputs:

  • for your own business;
  • as part of paid design or visualisation services;
  • in commercial videos, advertisements and presentations;
  • in another project or application where permitted by this Addendum; and
  • as a deliverable supplied to a client.

Commercial permission only applies to the information, data and geometry intentionally included by the relevant export feature.

3. Client work

You may provide eligible Outputs to a client as part of a commercial project.

A client may use the delivered Output for the project for which it was supplied. This does not give the client ownership of CoasterWorks, access to its internal technology or permission to extract or redistribute bundled CoasterWorks Content.

Editable CoasterWorks project files may only be supplied to someone who has their own lawful CoasterWorks licence and any DLC required by the project.

4. Licence scope

The Professional Upgrade is licensed to the Steam account that purchased it.

One licence covers one individual user, including use by that individual while working as a sole trader, employee or contractor.

If multiple people within a company actively use the Professional features, each user must have their own lawful copy of CoasterWorks and the Professional Upgrade unless we agree otherwise in writing.

The licence may not be shared between users or transferred independently of the associated Steam entitlement.

5. Ownership

You retain ownership of the original creative elements of the parks, layouts and other User Content you create.

You may own the resulting Output as a whole, subject to any underlying rights in CoasterWorks Content and third-party content included in it.

We and our licensors retain ownership of:

  • the CoasterWorks software;
  • its procedural systems and internal data formats;
  • bundled models, textures, materials, audio and animations;
  • stock layouts and demonstration content;
  • internal spline, force, support and runtime representations; and
  • all other CoasterWorks Content identified in the Main EULA.

This Addendum grants permission to use eligible Outputs. It does not transfer ownership of the underlying software or bundled assets.

6. Restrictions

The Professional Upgrade does not permit you to:

  • redistribute, sell, sublicense or provide CoasterWorks itself;
  • extract or redistribute bundled models, textures, materials, animations, audio or source files;
  • sell bundled assets individually or as part of an asset pack;
  • distribute stock layouts, examples or templates as standalone products;
  • redistribute exported track or terrain geometry on a standalone basis as a 3D asset, asset pack, template or library (an export must form part of a broader project or deliverable that adds substantial value beyond the exported geometry itself);
  • use external extraction, memory-inspection or reverse-engineering tools to obtain internal data;
  • remove copyright, trade mark or attribution notices;
  • share your Professional licence or Steam account with another user;
  • represent CoasterWorks Content as being created or owned entirely by you;
  • use an Output primarily as a substitute for purchasing CoasterWorks or its DLC; or
  • use CoasterWorks Content to train a machine-learning or generative model.

These restrictions do not prohibit anything that applicable law expressly allows and does not permit us to restrict.

7. Third-party content

The Game includes some models, textures and other content licensed to us by third parties ("Bundled Third-Party Content").

Your renders, videos and other visual Outputs may include Bundled Third-Party Content as it appears in the Game, and the commercial permissions in this Addendum cover that use. Export features are designed so that exported data and geometry do not include Bundled Third-Party Content. Bundled Third-Party Content may not be extracted from the Game or used outside your Outputs.

Content that you import into CoasterWorks is different: the Professional Upgrade does not grant commercial rights to imported content, and imported models, textures, audio and other content remain governed by their original licences. This includes content obtained through Fab, Megascans or another asset marketplace.

You are responsible for confirming that you have the necessary rights before using imported third-party content commercially.

8. Engineering and safety

The Professional Upgrade provides export and visualisation tools. It does not turn CoasterWorks into certified engineering software.

Outputs are not certified for:

  • manufacturing;
  • construction;
  • structural analysis;
  • safety assessment;
  • regulatory approval;
  • ride commissioning; or
  • controlling real machinery.

Before an Output is used for a real ride, structure or safety-related purpose, it must be independently checked and approved by appropriately qualified professionals.

You are responsible for ensuring that a commercial use complies with applicable laws, standards, contracts and professional requirements.

9. Existing Outputs

If your Professional licence ends because it is refunded, revoked or terminated:

  • you must stop creating new commercial Outputs using Professional features; and
  • commercial rights for Outputs lawfully created and delivered before termination will continue, unless those Outputs were created through a breach of this Addendum or the Main EULA.

Where the Professional Upgrade is refunded, commercial rights do not continue for Outputs created during the refunded purchase period. A client who received an Output in good faith before the refund may continue to use it for the project for which it was supplied, but you may make no further commercial use of it.

Termination does not legalise extracted or unlawfully distributed CoasterWorks Content.

10. Liability

Nothing in this Addendum excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

We are not responsible for engineering, safety, manufacturing or construction decisions made using an Output.

To the extent permitted by law, we are not liable for loss of profits, revenue, business, contracts, goodwill or anticipated savings, or for loss or corruption of data, whether direct or indirect, arising from business or commercial use of the Game.

Subject to the first paragraph of this section, our total aggregate liability arising out of or in connection with this Addendum and business or commercial use of the Game, whether in contract, tort (including negligence) or otherwise, will not exceed the greater of (a) 100 GBP and (b) the total amounts you paid for the Game, DLC and the Professional Upgrade in the 12 months before the event giving rise to the claim.

The exclusions and cap above apply to claims arising from business or commercial use. If you use the Game as a consumer, the liability provisions of the Main EULA continue to govern, and nothing in this section reduces your rights under the Main EULA or applicable consumer law.

The Unreal Engine and third-party technology disclaimers in section 16 of the Main EULA apply equally to use under this Addendum.

Any liability terms in the Main EULA continue to apply except where this Addendum expressly states otherwise.

11. Changes and termination

The update and termination provisions in the Main EULA also apply to this Addendum.

We will not retroactively remove commercial rights from Outputs lawfully created under an active Professional licence unless required by law.

A serious breach involving unauthorised asset extraction, redistribution or licence sharing may result in termination as described in the Main EULA.

12. Priority and governing law

If this Addendum conflicts with the Main EULA regarding permitted commercial use, this Addendum takes priority.

All other provisions of the Main EULA remain in effect.

The governing-law and dispute provisions of the Main EULA also apply to this Addendum.
