# END USER LICENSE AGREEMENT (EULA)
## Pieps Fruit Catch

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and Pieps Soft ("we," "us," or "our") regarding your use of the game Pieps Fruit Catch, including all related software, content, updates, and documentation (collectively, the "Game").
By installing, accessing, or using the Game, you agree to be bound by the terms of this Agreement. If you do not agree, do not install or use the Game.

### 1. License Grant
Subject to your compliance with this Agreement, Pieps Soft grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Game for your personal, non-commercial entertainment purposes, on devices that you own or control.
This license does not constitute a sale of the Game. Pieps Soft retains all right, title, and interest in and to the Game, including all intellectual property rights therein.

### 2. Restrictions
You agree that you will NOT:
- Copy, modify, adapt, translate, or create derivative works of the Game, except where expressly permitted (see Section 3, Modding);
- Reverse engineer, decompile, or disassemble the Game, except to the extent such restriction is prohibited by applicable law;
- Rent, lease, lend, sell, redistribute, or sublicense the Game;
- Remove or alter any proprietary notices or labels on the Game;
- Use the Game for any commercial purpose without prior written consent from Pieps Soft;
- Use cheats, automation software (bots), hacks, mods (except as permitted), or any other unauthorized third-party software designed to modify the Game experience, unless explicitly permitted by us;
- Use the Game in any way that violates applicable local, national, or international law.

### 3. Modding & User-Generated Content
Pieps Soft permits user-created modifications ("mods") for the Game, subject to the following conditions:
- Mods may only be used for personal, non-commercial purposes.
- You may not distribute mods that include copyrighted assets from the Game (e.g., artwork, sprites, music) without our prior written permission.
- Mods must not contain illegal, offensive, or infringing content.
- We are not responsible for any mods created by third parties, and use of mods is at your own risk. We do not guarantee compatibility between mods and future updates of the Game.
- We reserve the right to withdraw permission for modding at any time, for example if it is being misused.

### 4. Ownership & Intellectual Property
The Game, including but not limited to its code, artwork, characters, music, sound effects, and the "Pieps Soft" name and branding, is the intellectual property of Pieps Soft and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you in this Agreement are reserved by Pieps Soft.

### 5. Updates & Changes to the Game
We may, at our discretion, provide updates, patches, or modifications to the Game. We are under no obligation to provide ongoing support, updates, or maintenance. We reserve the right to modify or discontinue the Game, in whole or in part, at any time.

### 6. Third-Party Platforms
The Game is distributed via Steam and is also subject to the Steam Subscriber Agreement and any applicable terms of the platform through which you obtained the Game. In the event of a conflict between this Agreement and the platform's terms, the platform's terms shall govern with respect to platform-specific matters (e.g., purchasing, refunds, account management).
If you are a consumer within the EU, please note that your statutory right of withdrawal for the purchase of the Game as a digital product is handled through Steam's own purchasing process, in accordance with the Steam Subscriber Agreement and applicable consumer protection law. By completing your purchase through Steam, you acknowledge the terms under which that right of withdrawal applies or, where applicable, ends upon commencement of performance (e.g., download/access to the Game).

### 7. Disclaimer of Warranty
We provide the Game with the quality and functionality that can reasonably be expected of comparable digital products, and we make reasonable efforts to ensure the Game functions as described. However, we do not guarantee that the Game will be free of errors or interruptions at all times, or that it will be compatible with every device or system configuration.
Nothing in this Agreement limits or excludes any statutory warranty rights you have as a consumer under the law of your country of residence, including but not limited to the statutory warranty for digital products under German law (ยงยง 327 ff. BGB) or equivalent EU consumer protection provisions. Where any part of this Agreement conflicts with such mandatory statutory rights, your statutory rights take precedence.

### 8. Limitation of Liability
We are liable without limitation for damages resulting from intent or gross negligence, and for damages resulting from injury to life, body, or health.
For damages caused by ordinary negligence, we are only liable if we have breached a material contractual obligation (an obligation whose fulfillment is essential to the proper performance of this Agreement and on whose compliance you may regularly rely, "Kardinalpflicht"). In such cases, our liability is limited to the foreseeable, typically occurring damage.
Liability under the German Product Liability Act (Produkthaftungsgesetz), and any other liability that cannot be limited or excluded under applicable mandatory law, remains unaffected.
Any further liability, in particular for indirect damages, loss of profit, or consequential damages, is excluded, except in the cases described above.

### 9. Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Game and destroy all copies in your possession.

### 10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law principles. This does not deprive you of any mandatory consumer protections under the law of your country of residence, where applicable.
