Spiroshader End-User License Agreement
Last updated: 2026-10-05. Version 1.1.This End-User License Agreement (the "Agreement") is a legal agreement between you and WiderUp LLC, 2909 S Wayzata Boulevard #1019, Minneapolis, MN 55405, United States ("WiderUp", "we", "us") for Spiroshaderâ„¢, including its updates, its add-ons and its documentation (together, the "Software").
You accept this Agreement by selecting an acceptance control when it is presented to you, or by otherwise affirmatively accepting it through the store or platform through which you obtained the Software. If you do not accept it, do not use the Software.
If you use the Software on behalf of a company or another organization, "you" means that organization, you confirm that you have the authority to bind it, and it is responsible for everyone who uses the Software under its license.
If you obtained the Software through Steam, the Steam Subscriber Agreement and other applicable Steam terms also apply; where they conflict with this Agreement about your Steam account, purchases, refunds, entitlements or the Steam platform, the applicable Steam terms prevail. If you obtained the Software through the Apple App Store, Section 9 also applies. If you obtained the Software through another store or platform, its applicable terms also apply.
1. License and permitted use
WiderUp grants you a non-exclusive license to install and use the Software for your own purposes - private, professional or commercial - on devices and through accounts permitted by the store or platform through which you obtained it, subject to this Agreement.The license is non-transferable except where applicable law gives you a right to transfer it despite that restriction or where the applicable store or platform expressly permits a transfer.
- Copies and devices. Each actively used copy must be covered by a valid license or entitlement under the applicable store's or platform's rules. This Agreement does not expand the account, device, sharing or organizational-use rights granted by that store or platform.
- Add-ons. Add-ons for the Software, including downloadable content, are licensed under this Agreement unless terms presented with the add-on say otherwise. Each add-on requires its own valid license or entitlement, and its features are licensed only while you hold a valid license or entitlement to both the add-on and the Software.
- Professional and commercial use. You may use the Software and its output for professional or commercial purposes, including events, installations, production work, performances, streams, broadcasts and recordings. You may also use the Software's output as part of a service you provide to others. This permission does not authorize you to provide, rent, sublicense, host or otherwise make the Software itself available to customers or other third parties.
- Steam Families, trials and free periods. Use through Steam Families, a free weekend, trial or similar store or platform program is licensed under this Agreement for as long as the applicable store or platform permits it.
- Public performance and output. You may show the Software's output publicly and may record, stream and distribute that output. WiderUp claims no rights in that output merely because it was produced using the Software. Third-party presets, images, video, music and other material used in the output may be subject to separate rights or licenses. This Agreement does not grant rights in third-party material that you do not otherwise have.
- Networked and remote use. Each copy of the Software that renders output must be separately licensed. A licensed copy may lead one other licensed copy at a time over any network you are authorized to use, unless an add-on or other license that covers that copy permits it to lead more. You may control the Software using other devices, other copies of the Software or compatible third-party software through the network and remote-control features and documented protocols the Software provides. You are responsible for securing networks and devices that you connect to the Software.
2. Restrictions and ownership
Except as expressly permitted by this Agreement or by applicable law that cannot validly be excluded or restricted, you may not:- distribute, host, make available, rent, lease, lend, sublicense, sell or otherwise transfer the proprietary Software or your license to anyone else, or otherwise commercially exploit the Software itself as opposed to its output;
- modify, adapt, translate or create derivative works of the proprietary Software, except where applicable law permits those activities despite this restriction or a separate license permits them for a particular component;
- remove, alter or hide copyright, trademark or license notices in the Software or its documentation;
- reverse engineer, decompile or disassemble the proprietary Software, except to the extent applicable law permits those activities despite this restriction, including non-waivable rights concerning interoperability, observation, study or testing;
- circumvent or disable the Software's license or entitlement verification, or the limits that apply to copies not covered by an add-on, including the networking limit described in Section 1; or
- use the Software to infringe anyone's rights or to violate applicable law.
Nothing in this Agreement restricts rights that applicable law gives you and does not permit WiderUp to exclude or restrict by contract.
The Software is licensed, not sold. Except for components and content governed by separate licenses, WiderUp and its licensors retain all rights, title and interest in the Software, including its proprietary code, design, artwork and documentation and all applicable copyrights, trademarks and other intellectual property rights.
Open-source and third-party components
The Software contains open-source and other third-party components. Their licenses and notices are provided under Licenses and third-party notices (user guide, "licenses").Those licenses govern the components to which they apply. Where an applicable open-source or third-party license gives you broader rights in a component than this Agreement does, that license controls for that component. Nothing in this Agreement restricts rights granted directly to you under such a license.
3. Presets, packages and your content
- Your content. As between you and WiderUp, WiderUp claims no ownership of presets, playlists, images, screenshots, recordings or other material that you create with or for the Software. You retain whatever rights you have in that material, and WiderUp receives no copy of it merely because you create, open or use it with the Software. Presets and other content you create, including any shader or expression code they contain, are not derivative works of the proprietary Software for purposes of Section 2. Your material may contain or incorporate third-party works; this Agreement does not give you rights in third-party material that you do not otherwise have.
- WiderUp's presets. The presets WiderUp ships with the Software are released under the CC0-1.0 public-domain dedication or, at your option, the Zero-Clause BSD license (0BSD); you may rely on whichever of the two you prefer.
- Third-party presets and packages. Presets and packages obtained from third parties are works provided by their respective authors or rights holders and are governed by whatever licenses or permissions those authors or rights holders provide. The fact that the Software can load third-party content does not mean that WiderUp owns, licenses, endorses or has verified that content. You are responsible for determining whether your intended use is permitted.
- Third-party content risks. WiderUp does not warrant third-party presets or packages. Third-party content may contain errors or cause crashes, excessive resource use or other unexpected behavior. To the fullest extent permitted by applicable law, you use third-party content at your own risk.
- Cameras and shared video. Video from cameras and other applications stays on your device unless you independently transmit or record it using functionality you choose to use. You are responsible for complying with applicable privacy, publicity/image, recording and venue rules and for obtaining any notice, consent or other permission required when you capture, process, display, stream or record other people or third-party material.
4. Online services, updates and privacy
The current Software works without an online service operated by WiderUp and does not require transmission of your presets, images, camera input or other content to WiderUp. Preset packs WiderUp publishes on its website are separate downloads and are governed by the licenses stated with them and by the website's applicable terms.The store or platform through which you obtained the Software may separately provide account authentication, entitlement or license verification, installation, downloads, updates, cloud functionality or other services under its own terms. Those are services of that store or platform, not WiderUp online services.
Subject to applicable law, WiderUp may provide updates that add, change or remove features. Updates are licensed under this Agreement or under terms presented with them.
Nothing in this Agreement obliges WiderUp to continue distributing the Software or to provide updates, upgrades, new features or support indefinitely, except where applicable law requires otherwise. Nothing in this Agreement limits any mandatory right to updates, conformity or remedies under applicable consumer law.
What the Software does and does not do with personal data is described in the Privacy policy (user guide, "privacy").
5. Health warning
WARNING — Photosensitive seizure warning: This visualizer produces strong contrast, rapid flashes, and flickering patterns synchronized to audio. A very small percentage of people may experience seizures, blackouts, or other symptoms when exposed to such visual stimuli, even with no prior history of epilepsy. Stop immediately and consult a doctor if you experience dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, or any involuntary movement or convulsion. Use in a well-lit room and sit a comfortable distance from the screen. Lighting devices driven by the ambient lighting output follow the picture, flashes included, and can fill a whole room; this warning applies to everyone in that room.The Software shows this warning when it is first started and asks you to confirm it before continuing; it can be read again at any time from the Help tab.
6. Warranty
To the fullest extent permitted by law, the Software is provided "as is" and "as available", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement.WiderUp does not warrant that the Software will be uninterrupted or error-free, that it will work with every graphics device, graphics driver, audio device, camera or network configuration, or that it will produce any particular visual result.
Nothing in this section limits rights you have as a consumer under applicable law, including rights concerning conformity, quality, description, performance, updates, repair, replacement, price reduction, refund or other remedies. In jurisdictions with mandatory digital-content protections, those protections remain unaffected.
Where you obtained the Software through Steam, the Apple App Store or another store or platform, refunds may be administered by that store or platform under its terms, without limiting additional rights you have under mandatory law.
7. Limitation of liability
To the fullest extent permitted by law, WiderUp and its suppliers will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or business, arising out of or related to the Software or this Agreement, however caused, even if advised of the possibility of such damages.To the fullest extent permitted by law, WiderUp's total liability arising out of or related to the Software or this Agreement will not exceed the greater of the amount you paid for the Software, including any add-ons, or USD 50.
These limitations do not apply to liability that applicable law does not permit WiderUp to limit or exclude, including, where applicable, liability for death or personal injury caused by negligence, fraud, gross negligence or wilful misconduct, or liability for breach of an essential contractual obligation to the extent applicable law requires liability for the foreseeable, typical damage.
Nothing in this section limits or excludes any repair, replacement, refund, price reduction, compensation or other remedy that applicable consumer law does not permit WiderUp to limit or exclude.
Nothing in this Agreement limits or excludes liability under mandatory product-liability law to the extent that such liability cannot lawfully be limited or excluded, including applicable national law implementing Directive (EU) 2024/2853 where that regime applies.
8. Term and termination
This Agreement takes effect when you accept it and remains in effect until it is terminated under this section. You may terminate it at any time by uninstalling the Software and deleting all copies in your possession or control.WiderUp may terminate your license if you materially breach this Agreement and, where applicable law requires an opportunity to cure the breach, you fail to cure it within a reasonable period after notice.
If your license terminates because of your breach, you must stop using the proprietary portions of the Software and delete copies in your possession or control, except where applicable law permits otherwise.
Discontinuation of the Software's sale, distribution, development, updates or support does not by itself terminate a valid license previously granted to you.
Termination does not affect rights granted directly to you under an applicable open-source or third-party license, rights you have in your own content, or rights that applicable law does not permit WiderUp to terminate.
Sections 2 (other than its restrictions on use of the Software, which cease to matter once you stop using it), 3, 6, 7, 8, 9 and 10 survive termination, together with any other provision that by its nature is intended to survive.
9. Apple App Store terms
This section applies if you obtained the Software through the Apple App Store. Where it conflicts with another provision of this Agreement, this section prevails for Software obtained that way.- Parties. This Agreement is concluded between you and WiderUp only, and not with Apple Inc. ("Apple"). WiderUp, not Apple, is solely responsible for the Software and its content.
- Scope of license. Your license to use the Software is limited to Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the Software may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
- Maintenance and support. WiderUp is solely responsible for any maintenance and support of the Software, as specified in this Agreement or as required by applicable law. Apple has no obligation to provide any maintenance or support services for the Software.
- Warranty. WiderUp is solely responsible for any product warranties, whether express or implied by law, to the extent they have not been effectively disclaimed. If the Software fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Software to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Software, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are WiderUp's sole responsibility.
- Product claims. WiderUp, not Apple, is responsible for addressing any claims by you or a third party relating to the Software or your possession or use of it, including product-liability claims, claims that the Software fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- Intellectual property claims. If a third party claims that the Software or your possession and use of it infringes that third party's intellectual property rights, WiderUp, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Questions and complaints. Questions, complaints or claims regarding the Software should be directed to WiderUp at the contact details in Section 10.
- Third-party terms. You must comply with applicable third-party terms of agreement when using the Software.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this Agreement. Once you accept this Agreement, Apple will have the right, and will be deemed to have accepted the right, to enforce this Agreement against you as a third-party beneficiary.
10. General
- Governing law and venue. This Agreement is governed by the laws of Minnesota, United States, without regard to its conflict-of-laws rules. If you are a consumer, this choice of law does not deprive you of mandatory protections of the law of the country in which you habitually reside that would apply in the absence of this choice. Except where applicable law permits or requires proceedings elsewhere, the state and federal courts located in Hennepin County, Minnesota have exclusive jurisdiction. If applicable law gives you a non-waivable right to bring proceedings in your local courts, that right is not affected.
- Entire agreement. This Agreement, together with applicable store or platform terms, constitutes the agreement between you and WiderUp concerning your license to and use of the Software. Third-party and open-source components and content remain governed by their applicable licenses. The Privacy policy is a separate notice describing WiderUp's handling of personal data.
- Severability. If a provision is held unenforceable, the rest of the Agreement remains in force and, to the extent permitted by applicable law, the provision will be interpreted or limited as necessary to make it enforceable while preserving its lawful intent as closely as possible.
- Changes. WiderUp may update this Agreement for future versions or updates of the Software. Publishing a revised Agreement does not by itself change the terms that already apply to you. A materially revised Agreement applies only if you affirmatively accept it, or to the extent applicable law otherwise permits the change.
- Language. This Agreement is drafted in English. Translations may be provided for convenience; to the extent permitted by applicable law, if a translation conflicts with the English text, the English text prevails. This does not override any mandatory right concerning the language in which contractual information must be provided.
