SPACEJUNK — END USER LICENSE AGREEMENT
Version 1.1 — 2026-09-15

Please read this agreement carefully. By installing, accessing or playing Spacejunk (the "Game"), you agree to be bound by it. If you do not agree, do not install or play the Game.

1. Parties

This agreement (the "Agreement") is between you and Fax3D Games, Italy (the "Licensor", "we", "us"). Contact: faxtred@gmail.com.

The Game is distributed through Steam, operated by Valve Corporation ("Valve"). Your use of Steam is governed by the Steam Subscriber Agreement, which this Agreement does not replace. Where this Agreement and the Steam Subscriber Agreement conflict on a matter concerning the Steam platform itself (accounts, purchases, refunds, Steam features), the Steam Subscriber Agreement prevails.

2. License

Subject to this Agreement, we grant you a personal, non-exclusive, non-transferable, revocable license to install and play the Game on devices you own or control, for your personal, non-commercial entertainment. The Game is licensed, not sold. You own the copy of the data on your device; we and our licensors retain all rights in the Game.

3. Restrictions

You may not, and may not allow others to:

- copy, sell, rent, lease, lend, sublicense, or otherwise distribute the Game or any part of it, other than through the sharing features Steam itself provides;
- modify, adapt or create derivative works of the Game, including through unofficial patches, mods or trainers;
- decompile, disassemble or reverse engineer the Game, except to the extent that applicable law expressly permits this despite this restriction (for example, Article 6 of Directive 2009/24/EC on decompilation for interoperability, and its national implementations);
- extract, export or reuse the Game's assets — models, textures, fonts, text, music, sounds, code — outside the Game, in any form;
- use cheats, automation software, bots or any tool that alters the Game's behaviour or the Steam achievements and statistics attached to it;
- remove or alter any copyright, trademark or other proprietary notice;
- use the Game, its name or its artwork to suggest that any product, service or content is made, sponsored or endorsed by us, when it is not.

4. Ownership

The Game, including its code, design, story, characters, names, artwork, sounds, music and text, is protected by copyright and other intellectual property laws and is owned by the Licensor or by the third parties listed in Section 6. "Spacejunk" and "Fax3D Games" are names and marks of the Licensor. Nothing in this Agreement transfers ownership of any of these to you.

5. Videos, streams and other content you create

We want you to make videos, streams, screenshots, guides and similar content about the Game ("Player Content"), and we grant you a non-exclusive, worldwide, royalty-free license to use footage, images, sounds and music from the Game in your Player Content, including for commercial purposes — for example monetised videos, sponsored streams and ad-supported platforms — provided that:

- your Player Content is your own work about the Game, not a redistribution of the Game or of its assets on their own (a video of you playing is fine; an archive of the Game's textures is not);
- you do not present your Player Content as official, or suggest that we made, sponsor or endorse it;
- your Player Content does not infringe the rights of others, and is not used in a way that is unlawful, defamatory or misleading.

We may withdraw this permission for specific content that breaches these conditions. This license does not apply to trademarks of third parties that may appear in the Game.

6. Third-party software and content

The Game incorporates software and content owned by third parties and used under their own licenses, including: the Unity engine (Unity Technologies); Steamworks.NET (MIT License); the fonts Press Start 2P and Chakra Petch (SIL Open Font License 1.1); 3D models and textures licensed from the Unity Asset Store and used under the Asset Store End User License Agreement; rock textures by ambientCG released under Creative Commons Zero; planet textures by Solar System Scope, licensed under Creative Commons Attribution 4.0; and Earth imagery from NASA, which is in the public domain and does not imply NASA endorsement. The full notices and license texts are in the file THIRD_PARTY_NOTICES.txt distributed with the Game. Those licenses apply to those components; this Agreement does not grant you any additional right to them.

7. Updates

We may update, patch or change the Game at any time, including its balance, content and features, and Steam may install updates automatically. We do not guarantee that any particular feature will remain in the Game, but we will not make changes that remove your ability to play the Game you purchased, except as required by law or by Section 10.

8. Data and files on your device

The Game has no online services of its own. The Game writes files to your device that are needed to function: save games, settings, its technical log and, in the playtest edition, local gameplay logs used for balancing. These files stay on your device.

To find and fix crashes and errors, the Game uses Unity Diagnostics, a service of Unity Technologies: every time the Game starts, and when it crashes or runs into an error, it sends Unity technical data about the session, your device and the problem, linked to a random identifier of the installation. We are the controller of this data. What is sent, why, for how long it is kept and how to exercise your rights is explained in the Privacy Notice (PRIVACY.txt), distributed with the Game and published on its Steam page.

The Game uses Steam features provided by Valve — achievements, statistics, leaderboards, and (where enabled) Steam Cloud synchronisation of save files. Any data processed by those features is processed by Valve under the Steam Subscriber Agreement and Valve's Privacy Policy, not by us; we do not receive personal data from them beyond what Steam shows publicly (for example achievement rates and leaderboards).

9. Warranty and liability

If you are a consumer, nothing in this Agreement affects your statutory rights, including your rights under the law of your country of residence regarding the conformity of digital content (in the European Union, Directive (EU) 2019/770 and its national implementations; in Italy, the Codice del Consumo). Those rights cannot be excluded, and where this Section conflicts with them, they prevail.

Subject to the paragraph above, the Game is provided "as is" and we make no warranty that it will be free of errors, that it will run on any particular hardware or software configuration, or that it will be available without interruption. To the fullest extent permitted by law, we are not liable for indirect or consequential losses, loss of data, loss of profits, or losses caused by circumstances beyond our reasonable control, and our total liability to you under this Agreement is limited to the amount you paid for the Game. Nothing in this Agreement excludes or limits our liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or for any other liability that cannot be excluded by law.

10. Termination

This Agreement is effective until terminated. It terminates automatically if you breach it materially and, where the breach can be remedied, you fail to remedy it within a reasonable time after we notify you. On termination you must stop playing the Game and delete all copies. You may terminate this Agreement at any time by deleting the Game. Sections 4, 6, 9, 11 and 12 survive termination. Termination does not by itself entitle you to a refund; refunds are handled by Steam under its refund policy.

11. Governing law and disputes

This Agreement is governed by the laws of Italy. If you are a consumer, you also benefit from any mandatory provisions of the law of the country in which you reside, and you may bring proceedings in the courts of that country; if you reside in Italy, the competent court is the one of your place of residence or domicile, as provided by the Codice del Consumo. Before starting proceedings, we ask you to contact us at faxtred@gmail.com: most problems can be solved directly. Consumers in the European Union may also use an accredited alternative dispute resolution body in their country.

12. Changes to this Agreement

We may revise this Agreement for future versions of the Game, for example when we add features. The version in force is the one shown on the Game's Steam page and distributed with the Game, identified by its version number and date. Material changes will be notified through the Game's Steam page. If you do not accept a revised Agreement, you may stop using the Game; your rights in the version of the Game you already purchased are not affected.

13. General

If any provision of this Agreement is found invalid or unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign this Agreement. This Agreement, together with the Steam Subscriber Agreement for matters concerning the Steam platform, is the entire agreement between you and us regarding the Game.

This Agreement is provided in English and Italian. Both versions are authentic; for users residing in Italy the Italian version prevails in case of discrepancy.
