END USER LICENSE AGREEMENT (EULA)
FOR THE GAME: BEYOND YARDWORK SIMULATOR

This End User License Agreement (hereinafter: the "Agreement" or "EULA") is a legally binding agreement between you (an individual, hereinafter: "User" or "Player") and JoyDev, located in [City, Country], (hereinafter: the "Licensor"), the creator and owner of all rights to the game Beyond Yardwork Simulator. The Game is published by PlayWay S.A. (hereinafter: the "Publisher").
By installing, launching, copying, or otherwise using the Game on digital distribution platforms (including but not limited to Steam, Epic Games Store, GOG, WeGame) and consoles, you acknowledge that you have read this Agreement, understand it, and fully accept its terms. If you do not agree to the following terms, you are not authorized to use the Game and should immediately remove it from your device.
1. DEFINITIONS AND SCOPE OF LICENSE
1.1. The Game: Refers to the "Beyond Yardwork Simulator" software, including all executable files, source code, graphics, animations, 3D models (including branded tools), soundtrack, text, user interface, and all accompanying documentation, updates, and virtual assets.
1.2. Grant of License: The Licensor grants the User a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Game solely in object code form.
1.3. Purpose of License: This license is granted solely for personal, non-commercial, entertainment use on devices legally owned by the User.
2. DETAILED USAGE RESTRICTIONS
The User agrees to comply with the following restrictions. Violation of any of these will result in the automatic termination of the license:
● Reverse Engineering: You may not decompile, disassemble, or attempt to derive the source code.
● Distribution: You may not sell, rent, or publicly distribute the Game files.
● Technical Integrity: Prohibited use of "cheats," bots, or automation scripts.
● AI Training: Strictly prohibited use of Game assets (including models of sponsored tools) to train AI/ML models.
● Export Controls: You represent that you are not in a country subject to a U.S. or EU Government embargo.
3. INTELLECTUAL PROPERTY AND THIRD-PARTY BRANDS
3.1. Ownership: All title and intellectual property rights in and to the Game are owned by JoyDev or its partners.
3.2. Sponsored Tools and Branded Content: The Game features digital representations of real-world tools, equipment, and brands (hereinafter: "Branded Content") used under license from third-party sponsors ("Sponsors").
● All trademarks, logos, and designs associated with the Branded Content are the property of their respective owners.
● Your license to use the Branded Content is limited strictly to your personal use within the Game.
● You are prohibited from extracting, modifying, or using these 3D models or trademarks for any purpose outside the Game (e.g., 3D printing, use in other software, or commercial promotion).
3.3. No Endorsement: The inclusion of Branded Content in the Game does not imply that the Sponsors endorse, sponsor, or are affiliated with any specific gameplay actions or user-generated content unless explicitly stated.
4. CONTENT RESTRICTIONS AND COMPLIANCE
4.1. Prohibited Content: You agree not to use the Game to create or transmit any content that:
● Promotes illegal activities or violence.
● Is defamatory, obscene, or violates public order.
● Infringes on the intellectual property rights of others.
● Violates national unity, sovereignty, or territorial integrity.
4.2. Censorship Compliance: The Licensor reserves the right to modify or remove any user-generated names or references that violate local laws.
5. SPECIAL PROVISIONS FOR THE PEOPLE'S REPUBLIC OF CHINA (PRC)
If you are accessing the Game from the People's Republic of China, the following terms apply:
5.1. Real-Name Registration: You may be required to register with your real identity as per PRC regulations.
5.2. Anti-Addiction Systems: The Game may implement systems for minors that limit play time or features as mandated by the NPPA.
5.3. Compliance with Socialist Values: You agree to use the Game in a manner that complies with the "Core Socialist Values" of the PRC.
6. PRIVACY AND DATA COLLECTION
6.1. Technical Data: The Game may collect anonymous technical data for optimization.

8.2. Limitation of Liability: NEITHER JOYDEV NOR PLAYWAY S.A. SHALL BE LIABLE FOR ANY INDIRECT OR CONSEQUENTIAL DAMAGES.
8.3. Simulation Disclaimer: The Game is a simulation. Do not attempt to mimic gardening techniques or use real-world machinery based on the Game's representation. The Licensor is not responsible for real-world injuries.
9. BINDING ARBITRATION AND CLASS ACTION WAIVER (US USERS ONLY)
If you are a resident of the United States, all disputes shall be resolved through individual binding arbitration. You waive your right to participate in class action lawsuits.
10. STATUTORY RIGHTS
Nothing in this EULA shall exclude or limit your statutory rights as a consumer in jurisdictions where such rights cannot be waived by contract.
11. INDEMNIFICATION
You agree to indemnify and hold harmless JoyDev, PlayWay S.A., and the Sponsors from any claims or damages resulting from your violation of this Agreement.
12. GOVERNING LAW AND TERMINATION
12.1. Governing Law: This Agreement is governed by the laws of the Republic of Poland.
12.2. Termination: Your rights terminate automatically if you fail to comply with any terms of this EULA.
