This End User License Agreement ("Agreement") is entered into between
あど ("Developer") and the individual ("User") who downloads, installs, uses, or plays the game "異常監視" ("Game").
By downloading, installing, using, or playing the Game, User agrees to be bound by all terms of this Agreement. If User does not agree to the terms of this Agreement, User must not download, install, use, or play the Game.
Section 1 — Grant of License Subject to compliance with this Agreement, Developer grants User a non-transferable, non-exclusive license to use the Game solely for personal, non-commercial purposes. Ownership of the Game remains with Developer and is not transferred to User.
Section 2 — Restrictions User shall not:
Copy, modify, or create derivative works of the Game, in whole or in part;
Reverse engineer, decompile, or disassemble the Game, except to the extent expressly permitted by applicable law;
Redistribute, rent, sublicense, or provide the Game to third parties for commercial purposes;
Circumvent or disable any technical protection measures included in the Game;
Use cheats, exploits, or unauthorized third-party software that interferes with fair use of the Game.
Section 3 — Intellectual Property All copyrights, trademarks, and other intellectual property rights in the Game belong to Developer or its rightful owners. This Agreement does not transfer any such rights to User.
Section 4 — Disclaimer of Warranty Developer does not warrant that the Game will operate without interruption or that it will be fit for any particular purpose. To the maximum extent permitted by law, Developer shall not be liable for any damages arising from the use or inability to use the Game, except where such damages result from Developer's willful misconduct or gross negligence.
Section 5 — Termination Developer may terminate this Agreement and User's right to use the Game without prior notice if User breaches any provision of this Agreement.
Section 6 — Use by Minors If User is a minor, User must obtain consent from a parent or legal guardian before using the Game.
Section 7 — Governing Law and Jurisdiction This Agreement shall be governed by the laws of Japan. Any dispute arising under this Agreement shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
Section 8 — Modification Developer may modify this Agreement at any time without prior notice. Any such modification becomes effective upon posting on the Game's store page or an equivalent location.
