END USER LICENSE AGREEMENT (EULA)
Rising Above It
1. Introduction
This End User License Agreement (“Agreement”) governs your use of the software application Rising Above It (“Game”), developed and published by the Developer. By installing, accessing, or using the Game, you agree to be bound by the terms of this Agreement. If you do not agree, do not install or use the Game.
2. License Grant
The Developer grants you a personal, non‑exclusive, non‑transferable, revocable license to install and use the Game for private, non‑commercial entertainment purposes. All rights not expressly granted remain with the Developer.
3. Ownership
The Game, including all code, assets, artwork, audio, gameplay systems, and documentation, is owned by the Developer and protected by copyright, trademark, and other intellectual property laws. You receive a license to use the Game — you do not own the Game itself.
4. Restrictions
You agree not to:
Modify, translate, reverse engineer, decompile, or disassemble any part of the Game.
Circumvent or attempt to bypass security, anti‑cheat, or DRM systems.
Use the Game for commercial purposes without written permission.
Distribute, sell, rent, sublicense, or publicly display the Game or its assets.
Create derivative works based on the Game.
5. Online Features
Some features may require an internet connection. The Developer may modify, disable, or discontinue online services at any time without notice.
6. User‑Generated Content
If the Game allows you to create or upload content, you retain ownership of your creations but grant the Developer a non‑exclusive, worldwide license to use, display, and distribute that content within the Game or related services.
7. Updates and Changes
The Developer may provide patches, updates, or new versions that may modify gameplay, features, or performance. You agree that the Game may update automatically.
8. Privacy
The Game may collect technical or gameplay‑related data to improve performance, stability, or player experience. No personally identifiable information is collected without your consent. See the Developer’s privacy policy for details.
9. Termination
This Agreement remains in effect until terminated. The Developer may terminate this Agreement if you violate any terms. Upon termination, you must uninstall and cease all use of the Game.
10. Disclaimer of Warranty
The Game is provided “AS IS,” without warranties of any kind. The Developer does not guarantee uninterrupted gameplay, error‑free performance, or compatibility with all hardware configurations.
11. Limitation of Liability
To the fullest extent permitted by law, the Developer is not liable for any damages arising from your use or inability to use the Game, including loss of data, hardware damage, or other indirect or consequential losses.
12. Governing Law
This Agreement is governed by the laws of the jurisdiction in which the Developer operates, without regard to conflict‑of‑law principles.
