End User Licence Agreement

Important — read carefully
This End User Licence Agreement (the "Agreement") is a legally binding contract between you ("You", the "User") and Simone Filippini, trading as "lampersandl", of Naples, Italy, contactable at support@lampersandl.games (the "Licensor", "we", "us"), governing your use of the video game The Fable of the Unlucky Clover, including its executable code, data files, artwork, music, sound effects, text, documentation and any updates, patches or downloadable content (collectively, the "Game").
By installing, downloading, accessing or using the Game, you accept this Agreement in full. If you do not accept this Agreement, do not install or use the Game.
1. Definitions
"Content" means all audiovisual, textual, musical and software elements comprised in the Game.
"Platform" means the digital distribution service through which you obtained the Game, including Valve Corporation's Steam service.
"User Generated Content" or "UGC" means any modification, level, asset, configuration file, translation, script or other material created by you that is designed to operate with or alter the Game.
"Steam Subscriber Agreement" means the agreement between you and Valve Corporation governing your use of Steam.
2. Grant of licence
Subject to your compliance with this Agreement, the Licensor grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use one copy of the Game on the devices permitted by the Platform, for your own private, non-commercial entertainment purposes.
The Game is licensed to you, not sold. No title or ownership in the Game or the Content is transferred to you. All rights not expressly granted in this Agreement are reserved by the Licensor.
3. Restrictions
Except to the extent that the following restrictions are prohibited by mandatory applicable law, you must not, and must not permit any third party to:
- distribute, sell, rent, lease, lend, sublicense, host, or otherwise commercially exploit the Game or any part of it, in whole or in part;
- copy or reproduce the Game, except for a single back-up copy for your personal use as permitted by law;
- reverse engineer, decompile, disassemble, or attempt to derive the source code of the Game — provided that nothing in this clause restricts the acts of decompilation, observation, study or testing permitted under Articles 5(3) and 6 of Directive 2009/24/EC and the national provisions implementing it, which rights cannot be excluded by contract;
- remove, obscure or alter any copyright, trade mark, licence or other proprietary notice contained in the Game;
- extract, rip, re-use or redistribute the Game's assets — including models, textures, sprites, shaders, animations, music, sound effects, fonts, dialogue or narrative text — in any other product, project or work;
- circumvent, disable or interfere with any digital rights management, anti-cheat, licensing check or security feature of the Game or the Platform;
- use the Game in connection with any cheat, exploit, automation tool, bot or unauthorised third-party software in a way that disrupts other users' experience or the integrity of leaderboards, achievements or online features;
- use the Game for any unlawful purpose, or in a manner that infringes the rights of any third party;
- use the Game, its name, or its Content to train, fine-tune or otherwise develop machine learning or artificial intelligence models, or to build any generative dataset, without our prior written consent.
4. Intellectual property
The Game and all Content are protected by copyright, trade mark and other intellectual property laws and international treaties. The Licensor and its licensors own all right, title and interest in and to the Game.
The title The Fable of the Unlucky Clover, the name lampersandl, the associated logos, and the names and likenesses of characters, locations and elements appearing in the Game are the trade marks or unregistered marks of the Licensor.
5. Third-party components
The Game incorporates third-party software components distributed under their own licence terms, including but not limited to the Godot Engine (MIT Licence) and additional plugins, libraries, fonts and assets identified in the credits and/or in the THIRD-PARTY-NOTICES file distributed with the Game.
Those components remain governed by their respective licences, which prevail over this Agreement in respect of those components only. Nothing in this Agreement limits any right granted to you under an applicable open-source licence.
6. User generated content and modifications
The Licensor does not endorse or support UGC. If the Game permits modification and you create UGC:
- you must not distribute UGC commercially, or in a manner that requires payment, donation, subscription or any other consideration to access it;
- your UGC must not contain unlawful, defamatory, hateful, or infringing material, and must not incorporate the Game's proprietary assets in a way that allows the Game to be played without a valid licence;
- you grant the Licensor a worldwide, non-exclusive, royalty-free, perpetual and irrevocable licence to use, reproduce, adapt, publish and distribute your UGC in connection with the Game and its promotion, without obligation of compensation. You retain ownership of your original contributions;
- you use UGC at your own risk. The Licensor is not responsible for damage, data loss or instability caused by UGC, and no warranty or support obligation applies to a modified installation of the Game.
7. Video, streaming and content creation
You are permitted to record, broadcast, stream and publish audiovisual footage of your own gameplay ("Videos"), including on monetised channels, provided that:
- the Videos contain substantial original commentary, editing or creative contribution and are not merely a full unedited reproduction of the Game's narrative, cutscenes or soundtrack;
- you do not present the Videos as official, sponsored or endorsed by the Licensor unless expressly agreed in writing;
- you do not distribute the Game's soundtrack, art or other assets as standalone downloadable files;
- the Videos are not used in connection with unlawful, hateful or discriminatory content.
This permission is revocable at any time in respect of specific content or specific persons. Nothing in this section grants you rights in the Game's Content beyond those necessary to publish the Videos.
8. Updates, availability and online features
The Licensor may, but is not obliged to, provide updates, patches, bug fixes or additional content. Such updates form part of the Game and are governed by this Agreement.
Certain features — including cloud saves, achievements, statistics and any online functionality — depend on services provided by the Platform and by third parties. The Licensor does not control those services and does not guarantee their continued availability. The Licensor may discontinue online features with reasonable notice where such discontinuation is within its control.
9. Save data and privacy
The Game stores progress data locally on your device and, where enabled, through the Platform's cloud save service. The Game does not collect, transmit or process personal data for the Licensor's own purposes. It contains no analytics, advertising or telemetry systems.
Where you contact the Licensor directly, for example by email, the Licensor will process the information you provide solely to respond to your request, will not use it for any other purpose, and will not disclose it to third parties except where required by law.
Your use of the Platform is governed by the Platform's own terms and privacy policy, over which the Licensor has no control. Any data collected by the Platform in connection with your purchase, playtime, achievements or cloud saves is processed by the Platform operator as data controller.
10. Health and safety warning
A very small percentage of people may experience seizures, loss of awareness or other symptoms when exposed to certain flashing lights, patterns or images, including those that may appear in video games. If you or anyone in your family has a history of epilepsy or photosensitive seizures, consult a physician before playing. Stop playing immediately and consult a physician if you experience dizziness, altered vision, eye or muscle twitching, disorientation, involuntary movement or convulsions.
Take regular breaks. Discontinue use if you experience eye strain, fatigue or discomfort in your hands, wrists or arms.
11. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Game is provided "as is" and "as available", without warranty of any kind. The Licensor does not warrant that the Game will be uninterrupted, error-free, free of vulnerabilities, or compatible with any particular hardware or software configuration, nor that defects will be corrected.
Nothing in this section affects your mandatory statutory rights as a consumer, including the legal guarantee of conformity for digital content and digital services under Directive (EU) 2019/770 and the national provisions implementing it. Those rights are not excluded, restricted or limited by this Agreement.
12. Limitation of liability
To the maximum extent permitted by applicable law, the Licensor shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profit, revenue, data, goodwill or business opportunity, arising out of or in connection with the Game or this Agreement.
Where liability cannot be excluded, the Licensor's aggregate liability arising out of or in connection with this Agreement shall not exceed the amount you actually paid for the Game.
These limitations do not apply to:
- liability for death or personal injury caused by negligence;
- liability arising from wilful misconduct or gross negligence, which cannot be excluded or limited by contract under applicable law;
- liability for fraud or fraudulent misrepresentation;
- any other liability that cannot be excluded or limited under applicable mandatory law, including consumer protection law.
13. Indemnity
You agree to indemnify and hold harmless the Licensor from any claim, demand, loss or expense (including reasonable legal fees) arising from your breach of this Agreement, your unlawful use of the Game, or any UGC you distribute — save to the extent such claim arises from the Licensor's own act or omission. This provision does not apply where you act as a consumer and applicable consumer law prohibits it.
14. Termination
This Agreement is effective until terminated.
The Licensor may terminate this licence with immediate effect if you materially breach any of its terms, and where the breach is capable of remedy, only after giving you notice and a reasonable opportunity to remedy it.
You may terminate at any time by uninstalling the Game and destroying all copies in your possession.
Upon termination, the rights granted in Section 2 cease and you must cease all use of the Game. Sections 3, 4, 6, 11, 12, 13, 15 and 16 survive termination.
Termination does not affect your rights in respect of purchases already made, or any refund entitlement you may have under the Platform's refund policy or applicable law.
15. Refunds
Purchases made through the Platform are subject to the Platform's refund policy (for Steam, the Steam Refund Policy). Your statutory withdrawal and refund rights as a consumer under applicable law remain unaffected.
16. Governing law and jurisdiction
This Agreement is governed by the laws of Italy, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.
The courts of Naples, Italy, shall have jurisdiction over any dispute arising out of or in connection with this Agreement.
If you are a consumer, the foregoing does not deprive you of the protection afforded by the mandatory provisions of the law of your country of habitual residence, and you may bring proceedings before, and may only be sued before, the courts of your place of domicile in accordance with Regulation (EU) No 1215/2012. Consumers resident in the European Union may also use the European Commission's Online Dispute Resolution platform.
17. Relationship with the Platform
This Agreement is between you and the Licensor only. The Platform operator is not a party to it and is not responsible for the Game.
Where you obtained the Game through Steam, this Agreement supplements and does not replace the Steam Subscriber Agreement. In the event of a conflict between this Agreement and the Steam Subscriber Agreement, the Steam Subscriber Agreement prevails in respect of the matters it governs.
18. Changes to this Agreement
The Licensor may amend this Agreement to reflect changes in the Game, in applicable law or in its business practices. Material changes will be notified through the Platform or within the Game before they take effect. Continued use of the Game after the effective date constitutes acceptance. If you do not accept the amended terms, you may terminate this Agreement under Section 14; amendments do not apply retroactively to the detriment of rights already accrued to you.
19. Export compliance
You may not use or export the Game in violation of applicable export control laws of the European Union, Italy, or any other applicable jurisdiction.
20. General
Severability. If any provision of this Agreement is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary, or severed, and the remaining provisions shall remain in full force and effect.
No waiver. Failure to enforce any provision does not constitute a waiver of it.
Assignment. You may not assign this Agreement. The Licensor may assign it in connection with a merger, acquisition or transfer of the Game, provided your rights are not diminished.
Entire agreement. This Agreement, together with any applicable open-source licences and the Platform's terms, constitutes the entire agreement between you and the Licensor concerning the Game.
Language. This Agreement is drafted in English. Where a translation is provided and a discrepancy arises, the English version prevails, except where mandatory consumer law provides otherwise.
