SOFTWARE END USER LICENCE AGREEMENT AND LIMITED WARRANTY
DEVILS : THE BORUTA REVENGE (the "Software")
NOTICE - Before installing the Software, please read this End User Licence Agreement ("EULA") carefully. By installing, copying, and/or otherwise using the Software, you agree to be bound by the terms of this EULA. The license to use the Software may only be granted to you under the terms of this EULA. Before installing the Software, ensure that your computer device meets the minimum technical requirements for the proper operation of this Software.

BY ACCEPTING THE TERMS OF THIS EULA AND INSTALLING THE SOFTWARE, YOU CONSENT TO OUR COLLECTION, STORAGE, USE, AND PROCESSING OF THIS INFORMATION AND DATA IN ACCORDANCE WITH THE PROVISIONS OF OUR PRIVACY POLICY AND COOKIES POLICY. RESPECTING YOUR PRIVACY IS A MATTER OF UTMOST IMPORTANCE TO B16 ENTERPRISE (AS DEFINED BELOW), THEREFORE WE ASK YOU TO CAREFULLY READ THE PRIVACY POLICY AND COOKIES POLICY APPLICABLE IN YOUR REGION (identified in section 1) AND TO PERIODICALLY CHECK FOR ANY UPDATES MADE TO THEM.

IF YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA, CLICK "I AGREE" BELOW THIS AGREEMENT, AFTER WHICH THE SOFTWARE WILL BE INSTALLED ON YOUR COMPUTER'S HARD DRIVE. IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS OF THIS EULA, CLICK "CANCEL", AS A RESULT OF WHICH THE SOFTWARE WILL NOT BE INSTALLED ON YOUR COMPUTER'S HARD DRIVE AND NO LICENSE WILL BE GRANTED TO YOU IN CONNECTION WITH THIS SOFTWARE. IF YOU ARE A "MINOR", THE CONSENT TO THIS EULA BY YOUR PARENT OR LEGAL GUARDIAN IS REQUIRED. FOR THE PURPOSES OF THIS EULA, A "MINOR" IS A PERSON AGED 13-17 IN THE AMERICAS REGION AND IN THE EMEA REGION, AND A PERSON UNDER 20 YEARS OF AGE IN THE ASIA REGION (EACH "REGION" IS DEFINED BELOW).

IMPORTANT INFORMATION REGARDING PRODUCT ACTIVATION:
If a CD key, activation key, or registration code (collectively: "CD Key") is required to install the Software or access any online or multiplayer game, this CD Key cannot be reproduced or replaced. It is the responsibility of the original purchaser of the Software to store the CD Key in a safe place. In the event of loss, theft, or damage to the CD Key, the CD Key will not be replaced, you will not receive a refund for the Software, and the Software will not be subject to exchange. If you wish to transfer the Software in accordance with the provisions of section 2(b) or 2(c), using the Software on another hard drive may require re-registration of the Software, which will require the original CD Key.
1. Legal Agreement
This EULA constitutes a legal agreement between you and B16 ENTERPRISE. This agreement sets forth the terms and conditions for your use of the Software. This applies to the entire period of using the Software. Note: if B16 ENTERPRISE determines that you have knowingly provided incorrect information, for example by registering in the wrong region, B16 ENTERPRISE reserves the right to (i) transfer your account to the correct region and subject it to the rules, agreements, and fees applicable in that region, or (ii) irrevocably terminate your account.
(a) You are in the "Americas region" if you acquired the Software while present in the following territories: North America, South America, Central America, American Samoa, Guam, United States Minor Outlying Islands, or the Caribbean (excluding Cuba).

(c) You are in the "Asia region" if you acquired the Software while present in the following territories: Japan, Mongolia, South Korea, Taiwan, Laos, Thailand, Hong Kong, Vietnam, Philippines, Brunei, Malaysia, Singapore, Indonesia, Cambodia, or Macau.
For the purposes of this EULA, references to the Software include computer software owned by B16 ENTERPRISE or its third-party suppliers/licensors and the media comprising the Software; any printed materials; user manuals; any "on-line" or electronic documentation; and – to the extent not distributed under a separate license agreement – any updates or patches to the original game software provided to you or made available for download via the B16 ENTERPRISE website or other source authorized by B16 ENTERPRISE, including software required to access and/or use any online elements and features that may be associated with such computer game software (subject to any additional terms of use applicable to such online mode). The terms of this EULA do not prejudice the terms of your use of any proprietary third-party software. Such proprietary software may be included on the medium containing this Software or downloaded in any other way along with the software package containing the Software, and may be required to use certain features of this Software, which use may be subject to an additional third-party end user license agreement and may be contingent upon acceptance of and compliance with such agreement.
This Software is protected by copyright law and other intellectual property laws and treaties. This Software is licensed, not sold.
2. Grant of a Limited Non-Exclusive License
As long as you comply with the terms of this EULA, B16 ENTERPRISE grants you a non-exclusive right and limited license to:
(a) install one (1) copy of the Software solely for personal, domestic use and use it on a single hard drive owned by and under your control, meeting the requirements specified in the user manual;
(b) transfer the Software from one hard drive to another, PROVIDED that at any single time the Software is used on only one (1) hard drive, which is owned by and under your control at the time of using the Software;
(c) transfer the Software (complete with all components and documentation) together with this EULA to another person, PROVIDED that this person has accepted the terms of this EULA, while you simultaneously transfer to this person all permitted copies of the Software that you may have made, or destroy any non-transferred copies of the Software. If the person receiving the Software does not accept the above terms of the agreement, this EULA automatically terminates. Upon such transfer, you must delete the Software from your hard drive, and the license granted to you under this EULA will terminate automatically with immediate effect.
All rights not expressly granted below are reserved by B16 ENTERPRISE and its licensors to the maximum extent permitted by applicable law. Your rights to use the Software under this EULA are strictly contingent upon your continuous compliance with the terms set forth in this EULA.
In certain cases, your rights to use the Software may be subject to a limited number of activations or registrations of the Software, as informed at the time of purchase or indicated on the Software packaging. In such an event, transferring the Software as described in sections 2(b) and 2(c) above may be impossible if the maximum permitted number of Software activations has been exhausted.
3. Restrictions
You are prohibited from:
(a) any commercial use or exploitation of the Software;
(b) uploading or using the Software on a network server, making the Software available to other users remotely, or in any other way to distribute the Software to one (1) or more other computers on that network or to enable such distribution, or making copies of the Software in any way or via any media so that it can be used by multiple users;
(c) using the Software or permitting the use of the Software concurrently on more than one personal central processing unit (CPU), game console, mobile device, smart phone, or handheld computer without a separate license from B16 ENTERPRISE;
(d) renting, leasing, sublicensing, lending, exploiting for profit, copying, modifying, adapting, merging, translating, using, reproducing, distributing, publishing, publicly displaying, storing in a retrieval system, or dealing with the Software or any part thereof in any other way, except as expressly permitted under the terms of this EULA and in accordance with and to the extent expressly permitted by applicable law;
(e) reverse engineering, deriving source code, modifying, decompiling, disassembling, or creating derivative works based on all or part of the Software, except as expressly permitted by applicable law. Where applicable law expressly permits such acts, any lawful modifications, adaptations, and improvements created, and all copyright therein, shall be assigned to, vest in, and remain the exclusive property of B16 ENTERPRISE and/or its licensors upon creation to the extent expressly permitted by applicable law, and you hereby waive any and all moral rights in such works;
(f) removing, disabling, or circumventing any security protections of the Software and technical measures controlling access to the Software and/or designed to prevent or inhibit the infringement of any copyright or other intellectual property rights associated with the Software;
(g) removing, modifying, destroying, or circumventing any proprietary notices or trademarks contained on or within the Software;
(h) exporting or re-exporting the Software or any copy or adaptation thereof in violation of applicable laws and regulations; or
(i) creating data or executable programs that mimic data or functionality of the Software.
Furthermore, you agree to comply with all safety warnings, usage instructions, or other relevant notices contained in the user manual accompanying this Software.
4. Online and Multiplayer Features
This Software allows the use of services offered by B16 ENTERPRISE and/or its affiliates and/or authorized third parties. Such services provide users of the Software with access to certain online or multiplayer features and functions included in the Software ("Online Features"). Such services and Online Features may require payment. Furthermore, access to and use of such online services/features and other elements and information may require completing a registration process and accepting additional terms, including but not limited to a privacy policy defining the rules for the use and processing of your personally identifiable information. Please note that not all purchasers of the Software will be able to complete the registration process and use these services (including the Online Features included in the Software). Such services and Online Features may not be available in your location, and there is no guarantee they will be available for any specific period (they may also be suspended or withdrawn at any time). Additionally, such services and Online Features may be subject to further restrictions (e.g., related to the user's age). An internet connection is required to access the Online Features.
During your use of the Online Features, B16 ENTERPRISE and its affiliates may collect, store, process, distribute, and publish certain data regarding your gameplay. This data may include your username, gamertag, scores achieved, rankings, results, achievements, profile picture, and other personal data from your profile that you have made available to other players. Without prejudice to any permissions you may have granted under any other agreement between you and B16 ENTERPRISE concerning such data, any personally identifiable data will be collected, stored, used, processed, and distributed in accordance with the B16 ENTERPRISE privacy policy as set forth in section 5 below.
5. User's Consent to the Use of Certain Data by B16 ENTERPRISE
Without prejudice to the provisions of section 4 above, B16 ENTERPRISE may from time to time during your gameplay collect anonymous, non-personally identifiable information (i.e., data that does not identify you, is not associated with you, and cannot be linked to you or used to identify you), including how the Software is used (including information about successful installation and removal of the Software). This information may also relate to your IP address (the number assigned by your Internet Service Provider to identify your internet-enabled device), which in some jurisdictions may be treated as personally identifiable information. This information may improve your experience using the Software over the Internet (if the Software contains Online Features), but also helps B16 ENTERPRISE better understand how users interact with the Software, their behavior, and preferences, allowing B16 ENTERPRISE to improve its products and services in the future.
In the event of a direct conflict between the terms of (i) this EULA and (ii) any of the aforementioned provisions of the B16 ENTERPRISE privacy policy, terms of service of the Software, or cookies policy, the terms of this EULA shall prevail.
By purchasing, activating, or using the Software, you unconditionally and irrevocably agree to the terms of the applicable: privacy policy, terms of service of the Software, and cookies policy, as amended and/or updated from time to time.
In the event of a conflict between the provisions of the applicable: privacy policy, terms of service of the Software, or cookies policy and the provisions of this section 5, the provisions of the applicable: privacy policy, terms of service of the Software, or cookies policy shall prevail.
6. Termination
Without prejudice to any other rights, B16 ENTERPRISE may terminate this EULA without notice with immediate effect if you fail to comply with the terms and conditions of this EULA. In the event of termination, you must destroy all copies of the Software and all of its component parts, including the Software stored on the hard drive of any computer device in your possession, custody, or control. You may terminate the EULA at any time by destroying the Software and uninstalling it from your hard drive or other media. When you uninstall the Software, certain data, such as folders, files, registry entries, and cookies may remain on your device. All provisions of this EULA relating to disclaimers of warranties, limitation of liability, remedies, damages, B16 ENTERPRISE's proprietary rights, as well as choice of law and jurisdiction, indemnity, and other aspects shall survive termination.
8. Title/Ownership
You own only the physical medium on which the Software is recorded. B16 ENTERPRISE and/or its licensors remain the owners of the Software as recorded on the medium and all subsequent copies regardless of the form in which they are stored.
9. Limited Warranty and Exclusions
9.1 LIMITED WARRANTY
This limited warranty does not affect and is in addition to statutory rights which cannot be excluded or limited in any way under applicable law.
In the event the Software is recorded on a physical medium provided by B16 ENTERPRISE, B16 ENTERPRISE warrants to the original purchaser of the Software that, when used properly and under normal conditions, the physical medium on which the Software is recorded will be free from mechanical defects and defects in workmanship for a period of ninety (90) days from the date of purchase. B16 ENTERPRISE's entire liability under this limited warranty will be, at B16 ENTERPRISE's sole discretion, either (a) to refund the purchase price of the Software; or (b) to repair or, at B16 ENTERPRISE's discretion, to replace free of charge the Software that does not meet the said limited warranty, provided the following procedures and conditions are met. All claims under this limited warranty must be made by returning the original physical medium in its original condition and packaging to the point of purchase, along with a copy of the original receipt or other dated proof of purchase, and a statement describing the reported defects and providing a return address ("Required Materials"). If for any reason this is not possible (and provided the return period from the date of purchase has not expired), the defective medium should be returned to B16 ENTERPRISE at the address provided in the user manual accompanying the Software, along with the Required Materials and the address of the point of purchase where the Software was bought.
9.2 The limited warranty referred to in section 9.1 above does not apply and does not cover media that have been subject to misuse, accident, damage, or excessive wear. Any replacement Software will be warranted for the remainder of the original warranty period or for a period of thirty (30) days, whichever is longer.
9.3 THE LIMITED WARRANTY REFERRED TO IN SECTION 9.1 DOES NOT APPLY TO THE SOFTWARE ITSELF, WHICH IS PROVIDED "AS IS" AND WITHOUT ANY WARRANTY WHATSOEVER. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, B16 ENTERPRISE AND ITS LICENSORS DISCLAIM ALL OTHER REPRESENTATIONS, WARRANTIES, CONDITIONS, AND ANY OTHER TERMS, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED CONDITIONS AND/OR WARRANTIES OF MERCHANTABILITY, WARRANTIES OF QUALITY AND FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS REGARDING THE SOFTWARE AND ANY OF ITS COMPONENTS. WITHOUT PREJUDICE TO THE GENERALITY OF THE FOREGOING, B16 ENTERPRISE DOES NOT WARRANT THAT THE SOFTWARE IS ERROR-FREE OR THAT IT WILL OPERATE WITHOUT INTERRUPTION, NOR THAT B16 ENTERPRISE WILL REPAIR ANY ERRORS IN THE SOFTWARE. FURTHERMORE, B16 ENTERPRISE DOES NOT WARRANT THAT THE SOFTWARE WILL OPERATE ON ALL TYPES OF COMPUTER DEVICES. THE MINIMUM TECHNICAL REQUIREMENTS ARE SET FORTH IN THE USER MANUAL.
9.4 ADDITIONALLY, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
(A) IN NO EVENT SHALL B16 ENTERPRISE OR ITS LICENSORS BE LIABLE FOR ANY DAMAGES (INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, OR ANY PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THIS SOFTWARE, EVEN IF B16 ENTERPRISE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE ENTIRE RISK OF USE (INCLUDING WITHOUT LIMITATION (A) ANY DAMAGE TO THE HARDWARE OR SOFTWARE OF YOUR COMPUTER DEVICE OR (B) DAMAGES ARISING FROM FAILURE TO COMPLY WITH THE USAGE WARNINGS CONTAINED IN THE USER MANUAL) IS BORNE BY YOU.
(B) IN ANY EVENT, THE MAXIMUM AGGREGATE LIABILITY OF B16 ENTERPRISE AND ITS LICENSORS UNDER THIS EULA, RELATING TO THIS AGREEMENT OR TO THE USE OR ATTEMPTED USE OF THIS SOFTWARE, SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR THE PURCHASE OF THE SOFTWARE.
9.5 Nothing in this EULA limits or excludes B16 ENTERPRISE's liability to you for negligence causing death or personal injury, to the extent that such exclusion or limitation is unlawful, unenforceable, or void under applicable law.
9.6 Certain jurisdictions do not allow the exclusion or limitation of the warranty referred to in section 9. Nothing in this section 9 affects your statutory rights as a consumer which, under applicable law, cannot be excluded or limited. Said statutory rights may vary depending on the jurisdiction.
9.7 You understand that the Software may be subject to updates or patches at any time, and there is no obligation to provide such updates or patches to you under this EULA or otherwise.

10.1 Software acquired regardless of region - all claims or disputes of any nature (including any non-contractual disputes) arising out of or relating to this EULA or the Software shall be governed by and construed in accordance with Polish law. Each party irrevocably submits to the exclusive jurisdiction of the Polish courts in any matter relating to this EULA or the Software (including any dispute or claim), provided that nothing in this EULA limits B16 ENTERPRISE's right to bring any proceedings against any party in any other court of competent jurisdiction, nor shall the bringing of such proceedings in one or more jurisdictions preclude the bringing of any other proceedings in any other jurisdiction (whether concurrently or not) to the extent permitted by the law of such jurisdictions.
10.4 The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this EULA regardless of the territory or jurisdiction in which the claim is brought.

11. Injunctions
Given that B16 ENTERPRISE would suffer irreparable damage if the terms of this EULA were not specifically enforced, you agree that B16 ENTERPRISE shall be entitled, without bond, other security, or proof of damages, to take such actions as it deems appropriate, including without limitation the right to seek injunctions and other equitable remedies, in addition to any other remedies available under applicable law.
12. Indemnity
You agree to indemnify, defend, and hold harmless B16 ENTERPRISE, its partners, affiliates, contractors, licensors, officers, directors, employees, and agents from and against all claims, damages, costs, and expenses (including reasonable legal fees) arising directly or indirectly from your acts or omissions in connection with the use of the Software or your breach of the terms of this EULA.
13. Miscellaneous
13.1 If you acquired the Software in the United States of America, you may not export or re-export it except as permitted and authorized under the laws and regulations of the United States.
13.2 Without prejudice to the provisions of section 9.6, this EULA, together with any other agreement, policy, or other document to which this EULA expressly refers, constitutes the entire agreement between B16 ENTERPRISE and you regarding the license and use of the Software, and supersedes all prior or contemporaneous understandings. Without prejudice to sections 13.4 and 13.5, no amendment or modification of this EULA will be binding unless made in writing and signed by a duly authorized representative of B16 ENTERPRISE.
13.3 You agree and acknowledge that all title, ownership rights, and intellectual property rights in and to the Software and any and all copies thereof (including without limitation any derivative works, titles, computer code, themes, objects, characters, character names, stories, dialog, catchphrases, locations, concepts, artwork, graphics, animation, sounds, musical compositions, audio-visual effects, text, screen displays, methods of operation, moral rights, and any related documentation incorporated into the Software) are owned by B16 ENTERPRISE or its licensors.
13.4 B16 ENTERPRISE reserves the right to amend this EULA at any time, at its sole discretion, and will provide notice of such changes on the B16 ENTERPRISE website and/or send notifications to you via the digital rights management system used to protect the Software's content. If you are unable to accept any newly introduced changes to this EULA and as a result cannot comply with the terms of this EULA, you may terminate this EULA in accordance with the termination provisions above. Your installation and/or continued use of any updates or modifications to the Software, or your continued, uninterrupted use of the Software following notice of changes to this EULA, will constitute your acceptance of any and all such changes to the terms of this EULA.
13.5 If any court or competent authority finds that any provision of this EULA (or part of any provision) is invalid, illegal, or unenforceable under applicable law, that provision or part-provision shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this EULA shall not be affected.

IMPORTANT INFORMATION REGARDING PRODUCT ACTIVATION:
If a CD key, activation key, or registration code (collectively: "CD Key") is required to install the Software or access any online or multiplayer game, this CD Key cannot be reproduced or replaced. It is the responsibility of the original purchaser of the Software to store the CD Key in a safe place. In the event of loss, theft, or damage to the CD Key, the CD Key will not be replaced, you will not receive a refund for the Software, and the Software will not be subject to exchange. If you wish to transfer the Software in accordance with the provisions of section 2(b) or 2(c), using the Software on another hard drive may require re-registration of the Software, which will require the original CD Key.
1. Legal Agreement
This EULA constitutes a legal agreement between you and B16 ENTERPRISE. This agreement sets forth the terms and conditions for your use of the Software. This applies to the entire period of using the Software. Note: if B16 ENTERPRISE determines that you have knowingly provided incorrect information, for example by registering in the wrong region, B16 ENTERPRISE reserves the right to (i) transfer your account to the correct region and subject it to the rules, agreements, and fees applicable in that region, or (ii) irrevocably terminate your account.
(a) You are in the "Americas region" if you acquired the Software while present in the following territories: North America, South America, Central America, American Samoa, Guam, United States Minor Outlying Islands, or the Caribbean (excluding Cuba).

(c) You are in the "Asia region" if you acquired the Software while present in the following territories: Japan, Mongolia, South Korea, Taiwan, Laos, Thailand, Hong Kong, Vietnam, Philippines, Brunei, Malaysia, Singapore, Indonesia, Cambodia, or Macau.
For the purposes of this EULA, references to the Software include computer software owned by B16 ENTERPRISE or its third-party suppliers/licensors and the media comprising the Software; any printed materials; user manuals; any "on-line" or electronic documentation; and – to the extent not distributed under a separate license agreement – any updates or patches to the original game software provided to you or made available for download via the B16 ENTERPRISE website or other source authorized by B16 ENTERPRISE, including software required to access and/or use any online elements and features that may be associated with such computer game software (subject to any additional terms of use applicable to such online mode). The terms of this EULA do not prejudice the terms of your use of any proprietary third-party software. Such proprietary software may be included on the medium containing this Software or downloaded in any other way along with the software package containing the Software, and may be required to use certain features of this Software, which use may be subject to an additional third-party end user license agreement and may be contingent upon acceptance of and compliance with such agreement.
This Software is protected by copyright law and other intellectual property laws and treaties. This Software is licensed, not sold.
2. Grant of a Limited Non-Exclusive License
As long as you comply with the terms of this EULA, B16 ENTERPRISE grants you a non-exclusive right and limited license to:
(a) install one (1) copy of the Software solely for personal, domestic use and use it on a single hard drive owned by and under your control, meeting the requirements specified in the user manual;
(b) transfer the Software from one hard drive to another, PROVIDED that at any single time the Software is used on only one (1) hard drive, which is owned by and under your control at the time of using the Software;
(c) transfer the Software (complete with all components and documentation) together with this EULA to another person, PROVIDED that this person has accepted the terms of this EULA, while you simultaneously transfer to this person all permitted copies of the Software that you may have made, or destroy any non-transferred copies of the Software. If the person receiving the Software does not accept the above terms of the agreement, this EULA automatically terminates. Upon such transfer, you must delete the Software from your hard drive, and the license granted to you under this EULA will terminate automatically with immediate effect.
All rights not expressly granted below are reserved by B16 ENTERPRISE and its licensors to the maximum extent permitted by applicable law. Your rights to use the Software under this EULA are strictly contingent upon your continuous compliance with the terms set forth in this EULA.
In certain cases, your rights to use the Software may be subject to a limited number of activations or registrations of the Software, as informed at the time of purchase or indicated on the Software packaging. In such an event, transferring the Software as described in sections 2(b) and 2(c) above may be impossible if the maximum permitted number of Software activations has been exhausted.
3. Restrictions
You are prohibited from:
(a) any commercial use or exploitation of the Software;
(b) uploading or using the Software on a network server, making the Software available to other users remotely, or in any other way to distribute the Software to one (1) or more other computers on that network or to enable such distribution, or making copies of the Software in any way or via any media so that it can be used by multiple users;
(c) using the Software or permitting the use of the Software concurrently on more than one personal central processing unit (CPU), game console, mobile device, smart phone, or handheld computer without a separate license from B16 ENTERPRISE;
(d) renting, leasing, sublicensing, lending, exploiting for profit, copying, modifying, adapting, merging, translating, using, reproducing, distributing, publishing, publicly displaying, storing in a retrieval system, or dealing with the Software or any part thereof in any other way, except as expressly permitted under the terms of this EULA and in accordance with and to the extent expressly permitted by applicable law;
(e) reverse engineering, deriving source code, modifying, decompiling, disassembling, or creating derivative works based on all or part of the Software, except as expressly permitted by applicable law. Where applicable law expressly permits such acts, any lawful modifications, adaptations, and improvements created, and all copyright therein, shall be assigned to, vest in, and remain the exclusive property of B16 ENTERPRISE and/or its licensors upon creation to the extent expressly permitted by applicable law, and you hereby waive any and all moral rights in such works;
(f) removing, disabling, or circumventing any security protections of the Software and technical measures controlling access to the Software and/or designed to prevent or inhibit the infringement of any copyright or other intellectual property rights associated with the Software;
(g) removing, modifying, destroying, or circumventing any proprietary notices or trademarks contained on or within the Software;
(h) exporting or re-exporting the Software or any copy or adaptation thereof in violation of applicable laws and regulations; or
(i) creating data or executable programs that mimic data or functionality of the Software.
Furthermore, you agree to comply with all safety warnings, usage instructions, or other relevant notices contained in the user manual accompanying this Software.
4. Online and Multiplayer Features
This Software allows the use of services offered by B16 ENTERPRISE and/or its affiliates and/or authorized third parties. Such services provide users of the Software with access to certain online or multiplayer features and functions included in the Software ("Online Features"). Such services and Online Features may require payment. Furthermore, access to and use of such online services/features and other elements and information may require completing a registration process and accepting additional terms, including but not limited to a privacy policy defining the rules for the use and processing of your personally identifiable information. Please note that not all purchasers of the Software will be able to complete the registration process and use these services (including the Online Features included in the Software). Such services and Online Features may not be available in your location, and there is no guarantee they will be available for any specific period (they may also be suspended or withdrawn at any time). Additionally, such services and Online Features may be subject to further restrictions (e.g., related to the user's age). An internet connection is required to access the Online Features.
During your use of the Online Features, B16 ENTERPRISE and its affiliates may collect, store, process, distribute, and publish certain data regarding your gameplay. This data may include your username, gamertag, scores achieved, rankings, results, achievements, profile picture, and other personal data from your profile that you have made available to other players. Without prejudice to any permissions you may have granted under any other agreement between you and B16 ENTERPRISE concerning such data, any personally identifiable data will be collected, stored, used, processed, and distributed in accordance with the B16 ENTERPRISE privacy policy as set forth in section 5 below.
5. User's Consent to the Use of Certain Data by B16 ENTERPRISE
Without prejudice to the provisions of section 4 above, B16 ENTERPRISE may from time to time during your gameplay collect anonymous, non-personally identifiable information (i.e., data that does not identify you, is not associated with you, and cannot be linked to you or used to identify you), including how the Software is used (including information about successful installation and removal of the Software). This information may also relate to your IP address (the number assigned by your Internet Service Provider to identify your internet-enabled device), which in some jurisdictions may be treated as personally identifiable information. This information may improve your experience using the Software over the Internet (if the Software contains Online Features), but also helps B16 ENTERPRISE better understand how users interact with the Software, their behavior, and preferences, allowing B16 ENTERPRISE to improve its products and services in the future.
In the event of a direct conflict between the terms of (i) this EULA and (ii) any of the aforementioned provisions of the B16 ENTERPRISE privacy policy, terms of service of the Software, or cookies policy, the terms of this EULA shall prevail.
By purchasing, activating, or using the Software, you unconditionally and irrevocably agree to the terms of the applicable: privacy policy, terms of service of the Software, and cookies policy, as amended and/or updated from time to time.
In the event of a conflict between the provisions of the applicable: privacy policy, terms of service of the Software, or cookies policy and the provisions of this section 5, the provisions of the applicable: privacy policy, terms of service of the Software, or cookies policy shall prevail.
6. Termination
Without prejudice to any other rights, B16 ENTERPRISE may terminate this EULA without notice with immediate effect if you fail to comply with the terms and conditions of this EULA. In the event of termination, you must destroy all copies of the Software and all of its component parts, including the Software stored on the hard drive of any computer device in your possession, custody, or control. You may terminate the EULA at any time by destroying the Software and uninstalling it from your hard drive or other media. When you uninstall the Software, certain data, such as folders, files, registry entries, and cookies may remain on your device. All provisions of this EULA relating to disclaimers of warranties, limitation of liability, remedies, damages, B16 ENTERPRISE's proprietary rights, as well as choice of law and jurisdiction, indemnity, and other aspects shall survive termination.
8. Title/Ownership
You own only the physical medium on which the Software is recorded. B16 ENTERPRISE and/or its licensors remain the owners of the Software as recorded on the medium and all subsequent copies regardless of the form in which they are stored.
9. Limited Warranty and Exclusions
9.1 LIMITED WARRANTY
This limited warranty does not affect and is in addition to statutory rights which cannot be excluded or limited in any way under applicable law.
In the event the Software is recorded on a physical medium provided by B16 ENTERPRISE, B16 ENTERPRISE warrants to the original purchaser of the Software that, when used properly and under normal conditions, the physical medium on which the Software is recorded will be free from mechanical defects and defects in workmanship for a period of ninety (90) days from the date of purchase. B16 ENTERPRISE's entire liability under this limited warranty will be, at B16 ENTERPRISE's sole discretion, either (a) to refund the purchase price of the Software; or (b) to repair or, at B16 ENTERPRISE's discretion, to replace free of charge the Software that does not meet the said limited warranty, provided the following procedures and conditions are met. All claims under this limited warranty must be made by returning the original physical medium in its original condition and packaging to the point of purchase, along with a copy of the original receipt or other dated proof of purchase, and a statement describing the reported defects and providing a return address ("Required Materials"). If for any reason this is not possible (and provided the return period from the date of purchase has not expired), the defective medium should be returned to B16 ENTERPRISE at the address provided in the user manual accompanying the Software, along with the Required Materials and the address of the point of purchase where the Software was bought.
9.2 The limited warranty referred to in section 9.1 above does not apply and does not cover media that have been subject to misuse, accident, damage, or excessive wear. Any replacement Software will be warranted for the remainder of the original warranty period or for a period of thirty (30) days, whichever is longer.
9.3 THE LIMITED WARRANTY REFERRED TO IN SECTION 9.1 DOES NOT APPLY TO THE SOFTWARE ITSELF, WHICH IS PROVIDED "AS IS" AND WITHOUT ANY WARRANTY WHATSOEVER. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, B16 ENTERPRISE AND ITS LICENSORS DISCLAIM ALL OTHER REPRESENTATIONS, WARRANTIES, CONDITIONS, AND ANY OTHER TERMS, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED CONDITIONS AND/OR WARRANTIES OF MERCHANTABILITY, WARRANTIES OF QUALITY AND FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS REGARDING THE SOFTWARE AND ANY OF ITS COMPONENTS. WITHOUT PREJUDICE TO THE GENERALITY OF THE FOREGOING, B16 ENTERPRISE DOES NOT WARRANT THAT THE SOFTWARE IS ERROR-FREE OR THAT IT WILL OPERATE WITHOUT INTERRUPTION, NOR THAT B16 ENTERPRISE WILL REPAIR ANY ERRORS IN THE SOFTWARE. FURTHERMORE, B16 ENTERPRISE DOES NOT WARRANT THAT THE SOFTWARE WILL OPERATE ON ALL TYPES OF COMPUTER DEVICES. THE MINIMUM TECHNICAL REQUIREMENTS ARE SET FORTH IN THE USER MANUAL.
9.4 ADDITIONALLY, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
(A) IN NO EVENT SHALL B16 ENTERPRISE OR ITS LICENSORS BE LIABLE FOR ANY DAMAGES (INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, OR ANY PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THIS SOFTWARE, EVEN IF B16 ENTERPRISE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE ENTIRE RISK OF USE (INCLUDING WITHOUT LIMITATION (A) ANY DAMAGE TO THE HARDWARE OR SOFTWARE OF YOUR COMPUTER DEVICE OR (B) DAMAGES ARISING FROM FAILURE TO COMPLY WITH THE USAGE WARNINGS CONTAINED IN THE USER MANUAL) IS BORNE BY YOU.
(B) IN ANY EVENT, THE MAXIMUM AGGREGATE LIABILITY OF B16 ENTERPRISE AND ITS LICENSORS UNDER THIS EULA, RELATING TO THIS AGREEMENT OR TO THE USE OR ATTEMPTED USE OF THIS SOFTWARE, SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR THE PURCHASE OF THE SOFTWARE.
9.5 Nothing in this EULA limits or excludes B16 ENTERPRISE's liability to you for negligence causing death or personal injury, to the extent that such exclusion or limitation is unlawful, unenforceable, or void under applicable law.
9.6 Certain jurisdictions do not allow the exclusion or limitation of the warranty referred to in section 9. Nothing in this section 9 affects your statutory rights as a consumer which, under applicable law, cannot be excluded or limited. Said statutory rights may vary depending on the jurisdiction.
9.7 You understand that the Software may be subject to updates or patches at any time, and there is no obligation to provide such updates or patches to you under this EULA or otherwise.

10.1 Software acquired regardless of region - all claims or disputes of any nature (including any non-contractual disputes) arising out of or relating to this EULA or the Software shall be governed by and construed in accordance with Polish law. Each party irrevocably submits to the exclusive jurisdiction of the Polish courts in any matter relating to this EULA or the Software (including any dispute or claim), provided that nothing in this EULA limits B16 ENTERPRISE's right to bring any proceedings against any party in any other court of competent jurisdiction, nor shall the bringing of such proceedings in one or more jurisdictions preclude the bringing of any other proceedings in any other jurisdiction (whether concurrently or not) to the extent permitted by the law of such jurisdictions.
10.4 The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this EULA regardless of the territory or jurisdiction in which the claim is brought.

11. Injunctions
Given that B16 ENTERPRISE would suffer irreparable damage if the terms of this EULA were not specifically enforced, you agree that B16 ENTERPRISE shall be entitled, without bond, other security, or proof of damages, to take such actions as it deems appropriate, including without limitation the right to seek injunctions and other equitable remedies, in addition to any other remedies available under applicable law.
12. Indemnity
You agree to indemnify, defend, and hold harmless B16 ENTERPRISE, its partners, affiliates, contractors, licensors, officers, directors, employees, and agents from and against all claims, damages, costs, and expenses (including reasonable legal fees) arising directly or indirectly from your acts or omissions in connection with the use of the Software or your breach of the terms of this EULA.
13. Miscellaneous
13.1 If you acquired the Software in the United States of America, you may not export or re-export it except as permitted and authorized under the laws and regulations of the United States.
13.2 Without prejudice to the provisions of section 9.6, this EULA, together with any other agreement, policy, or other document to which this EULA expressly refers, constitutes the entire agreement between B16 ENTERPRISE and you regarding the license and use of the Software, and supersedes all prior or contemporaneous understandings. Without prejudice to sections 13.4 and 13.5, no amendment or modification of this EULA will be binding unless made in writing and signed by a duly authorized representative of B16 ENTERPRISE.
13.3 You agree and acknowledge that all title, ownership rights, and intellectual property rights in and to the Software and any and all copies thereof (including without limitation any derivative works, titles, computer code, themes, objects, characters, character names, stories, dialog, catchphrases, locations, concepts, artwork, graphics, animation, sounds, musical compositions, audio-visual effects, text, screen displays, methods of operation, moral rights, and any related documentation incorporated into the Software) are owned by B16 ENTERPRISE or its licensors.
13.4 B16 ENTERPRISE reserves the right to amend this EULA at any time, at its sole discretion, and will provide notice of such changes on the B16 ENTERPRISE website and/or send notifications to you via the digital rights management system used to protect the Software's content. If you are unable to accept any newly introduced changes to this EULA and as a result cannot comply with the terms of this EULA, you may terminate this EULA in accordance with the termination provisions above. Your installation and/or continued use of any updates or modifications to the Software, or your continued, uninterrupted use of the Software following notice of changes to this EULA, will constitute your acceptance of any and all such changes to the terms of this EULA.
13.5 If any court or competent authority finds that any provision of this EULA (or part of any provision) is invalid, illegal, or unenforceable under applicable law, that provision or part-provision shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this EULA shall not be affected.
