IMPORTANT — READ CAREFULLY
This End User License Agreement ("Agreement") is a legal agreement between you
("you" or "User") and Dams-Labs ("Licensor", "we", "us"), the developer and
publisher of the video game BARYUM, including its executable code, data
files, artwork, models, textures, shaders, music, sound effects, text and any
updates or additional content supplied by us (collectively, the "Software").
By installing, copying, downloading or otherwise using the Software, you agree
to be bound by this Agreement. If you do not agree, do not install or use the
Software; you may request a refund in accordance with the Steam Refund Policy.
This Agreement supplements, and does not replace, the **Steam Subscriber
Agreement** between you and Valve Corporation. Where this Agreement conflicts
with the Steam Subscriber Agreement, the Steam Subscriber Agreement prevails in
respect of your Steam account, your purchase and its delivery.
1. LICENSE GRANT
Subject to your compliance with this Agreement, Licensor grants you a personal,
non-exclusive, non-transferable, revocable, worldwide license to install and use
one copy of the Software at a time, for your own private, non-commercial
entertainment purposes, on devices you own or control, for as long as the
Software remains in your Steam library.
The Software is licensed, not sold. You acquire no ownership interest in the
Software.
2. RESTRICTIONS
Except to the extent that applicable law expressly permits it notwithstanding
this Agreement, you may not:
a) distribute, sell, rent, lease, sublicense, lend or otherwise transfer the
Software or copies of it, in whole or in part, to any third party;
b) reproduce the Software except for a single backup copy for your personal use;
c) reverse engineer, decompile or disassemble the Software, or attempt to derive
its source code, save as set out in Section 3 below;
d) remove, obscure or alter any copyright, trademark or other proprietary notice
contained in or displayed by the Software;
e) extract, repackage or redistribute the Software's assets (including models,
textures, shaders, fonts, music and sound effects) as standalone files or as
part of another product;
f) use the Software, or any part of it, to train, fine-tune or otherwise develop
any machine learning or artificial intelligence model or dataset;
g) circumvent, disable or tamper with any technical protection measure in the
Software, including the encryption applied to save files, or use the Software
with unauthorised third-party software intended to alter gameplay in a manner
not permitted by us;
h) use the Software for any unlawful purpose or in breach of the Steam
Subscriber Agreement.
3. PERMITTED ACTS AND MANDATORY EXCEPTIONS
Nothing in Section 2 restricts any act which you are entitled to perform under
mandatory provisions of applicable law, and in particular:
- your right, under Articles 5 and 6 of Directive 2009/24/EC and Articles
L.122-6-1 of the French Intellectual Property Code, to observe, study or test
the functioning of the Software, to make a back-up copy, and to decompile the
Software where indispensable to obtain interoperability information, in each
case subject to the conditions laid down in those provisions.
4. VIDEO, STREAMING AND SCREENSHOTS
You are granted permission to capture, publish and broadcast screenshots, video
recordings and live streams of your gameplay, including on monetised channels
(for example YouTube, Twitch or similar platforms), provided that:
- the content is your own creative work and not a substantial reproduction of
the Software's assets, cinematics or soundtrack presented on their own;
- you do not imply that such content is produced, endorsed or sponsored by
Dams-Labs; and
- you do not use the content in a manner that is unlawful or that disparages
the Software or Licensor.
This permission may be withdrawn at any time in respect of specific content that
breaches these conditions. It does not grant you any trademark rights in the
name "BARYUM" or "Dams-Labs" beyond identifying the Software.
Please note: the Software's soundtrack is licensed from third-party
composers (see Section 6). Automated content-identification systems operated by
video platforms may flag recordings containing that music, notwithstanding the
permission granted above. Licensor does not control such systems, cannot resolve
claims on your behalf, and gives no warranty that your content will be free of
them. If this is a concern, the in-game music volume can be set to zero in the
Options menu before recording.
5. OWNERSHIP AND INTELLECTUAL PROPERTY
The Software, including all its code, audiovisual elements, characters, titles,
narrative and artwork, and all intellectual property rights therein, is owned by
Dams-Labs or its licensors and is protected by French and international
copyright law and treaties. The Software as a whole constitutes an original
audiovisual work of Dams-Labs, irrespective of the third-party components
identified in Section 6, which remain the property of their respective authors.
All rights not expressly granted to you under this Agreement are reserved by
Licensor.
6. THIRD-PARTY SOFTWARE AND ASSETS
The Software incorporates third-party components, each licensed under its own
terms, which prevail over this Agreement in respect of those components. Their
inclusion does not grant you rights in the Software as a whole beyond those in
Section 1.

Music and sound effects:
The musical works forming the Software's soundtrack are licensed from their
respective composers through Pixabay (https://pixabay.com) under the **Pixabay Content License**. Those works remain the property of their respective authors and are not owned by Dams-Labs. They are incorporated into the Software as
constituent parts of a larger audiovisual work.
No right to extract, reuse, redistribute, sell or make available the soundtrack
or any individual track as a standalone audio file is granted to you under this
Agreement, whether or not such use would otherwise be permitted by the Pixabay
Content License between Pixabay and Dams-Labs. Section 2(e) applies in full to
these works.
A complete list of the tracks used, with their composers, is provided in the
in-game credits.
The Dams-Labs identity sound is an original work of Dams-Labs.
Scientific data and models:
Certain three-dimensional models and planetary surface imagery used in the
Software are derived from materials published by the National Aeronautics and
Space Administration (NASA), the U.S. Geological Survey (USGS) and the European
Space Agency (ESA). Such materials are used in accordance with the media usage
guidelines of the respective agencies. **NASA, USGS and ESA do not endorse,
sponsor or approve the Software, Dams-Labs, or any of its products.** Orbital
element data used to compute body positions is derived from publicly available
ephemeris parameters.
7. SAVE DATA, SETTINGS AND PRIVACY
The Software stores save files and settings locally on your device. Save files
are encrypted; this is a technical measure to preserve game integrity and is not
represented as a security measure protecting personal information.
The Software operates entirely offline. It does not require an internet
connection, and it does not collect, transmit, store or share any personal data,
usage statistics, telemetry or analytics. No data of any kind is sent to
Dams-Labs or to any third party by the Software.
Your purchase, ownership record and playtime are handled by Valve Corporation
through the Steam platform and are governed by the Steam Subscriber Agreement
and Valve's Privacy Policy, to which Dams-Labs is not a party.
Local save data may be rendered unreadable by future updates to the Software.
While we will make reasonable efforts to preserve compatibility, we do not
warrant that save files will remain compatible across versions.
8. UPDATES AND AVAILABILITY
Licensor may, at its discretion, provide patches, updates or additional content
for the Software. Such material is governed by this Agreement unless accompanied
by separate terms. Licensor is under no obligation to provide updates or to
maintain the Software indefinitely, and may cease support at any time. This does
not affect your continued right to use any version already installed in your
Steam library, nor your statutory rights.
9. TERM AND TERMINATION
This Agreement takes effect when you first install or use the Software and
continues until terminated.
It terminates automatically if you materially breach any of its terms. Upon
termination you must cease all use of the Software and destroy all copies in
your possession. Sections 5, 6, 10, 11, 12 and 13 survive termination.
Termination of this Agreement does not, of itself, terminate your Steam account
or your rights under the Steam Subscriber Agreement.
10. LIMITED WARRANTY AND STATUTORY RIGHTS
If you are a consumer, you benefit from mandatory legal guarantees which
this Agreement does not and cannot exclude or limit, including in France the
statutory guarantee of conformity (garantie légale de conformité, Articles
L.217-1 et seq. of the French Consumer Code) and the guarantee against hidden
defects (garantie des vices cachés, Articles 1641 et seq. of the French Civil
Code). Consumers resident elsewhere in the European Union or the United Kingdom
retain the equivalent mandatory rights under their own national law. Nothing in
this Agreement affects those rights.
Subject to the foregoing, and to the maximum extent permitted by applicable law,
the Software is provided "AS IS" and without warranty of any kind, whether
express, implied or statutory, including any implied warranty of
merchantability, fitness for a particular purpose, or non-infringement.
Licensor does not warrant that the Software will be uninterrupted or error-free,
that defects will be corrected, or that the Software is compatible with any
particular hardware or software configuration.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Licensor shall not be liable
for any indirect, incidental, special, consequential or punitive damages, nor
for any loss of profit, data, goodwill or opportunity, arising out of or in
connection with the Software or this Agreement, even if advised of the
possibility of such damages.
To the maximum extent permitted by applicable law, Licensor's total aggregate
liability arising out of or in connection with the Software or this Agreement
shall not exceed the amount you actually paid for the Software.
Nothing in this Agreement excludes or limits Licensor's liability for: death
or personal injury caused by negligence; fraud or fraudulent misrepresentation;
gross negligence (faute lourde) or wilful misconduct (faute dolosive); or
any other liability which cannot lawfully be excluded or limited.
12. REFUNDS
Purchases of the Software made through Steam are subject to the Steam Refund
Policy, administered by Valve Corporation. Requests for refunds must be
addressed to Valve. Where you are a consumer in the European Union, this does
not affect any statutory right of withdrawal you may have, subject to the
exceptions applicable to digital content supplied with your prior express
consent.
13. GOVERNING LAW AND DISPUTES
This Agreement is governed by the laws of France, excluding its conflict of
law rules and the United Nations Convention on Contracts for the International
Sale of Goods.
If you are a consumer, this choice of law does not deprive you of the
protection afforded by mandatory provisions of the law of your country of
habitual residence, and you may bring proceedings before the courts of that
country. Where permitted, disputes may be submitted to the European Commission's
Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/ .
If you are not a consumer, the courts of France shall have exclusive
jurisdiction.
14. GENERAL
Severability. If any provision of this Agreement is held invalid or
unenforceable, that provision shall be modified to the minimum extent necessary
to make it enforceable, and the remaining provisions shall remain in full force.
No waiver. Failure by Licensor to enforce any provision is not a waiver of
that or any other provision.
Entire agreement. This Agreement, together with the Steam Subscriber
Agreement, constitutes the entire agreement between you and Licensor concerning
the Software, superseding any prior understanding.
Assignment. You may not assign this Agreement. Licensor may assign it in
connection with a merger, acquisition or sale of assets relating to the
Software.
Changes. Licensor may update this Agreement for future versions of the
Software. Material changes will be notified through the Steam store page or in
the Software. Continued use of an updated version after such notice constitutes
acceptance.
