J.A.C.K. END USER LICENSE AGREEMENT

This End User License Agreement ("Agreement") governs your use of J.A.C.K.
(the "Software") when the Software is provided as a standalone application,
including free, donation-supported, demo, paid, Steam, or other standalone
editions.
Please read this Agreement carefully. By installing, copying, launching, or
using the Software, you agree to be bound by this Agreement. If you do not
agree to this Agreement, do not install or use the Software.
1. LICENSE GRANT
Subject to this Agreement, Crystice Softworks grants you a limited,
non-exclusive, non-transferable, non-sublicensable license to install and use
the Software for personal, educational, non-commercial, or commercial purposes,
in accordance with this Agreement and any applicable documentation.
The Software is provided under license, whether obtained for free or purchased
through Steam or another authorized distribution channel. Purchasing the
Software grants you a license to use it under this Agreement; it does not
transfer ownership of the Software, its source code, trademarks, or other
intellectual property.
All rights not expressly granted under this Agreement are reserved by Crystice
Softworks and its licensors.
2. EDITIONS AND DISTRIBUTION CHANNELS
The Software may be distributed in free, donation-supported, demo, paid, Steam,
or other editions. Different editions may include different features,
limitations, update channels, platform integrations, or distribution methods.
Unless stated otherwise, all standalone editions are subject to this Agreement.
Free or Donation-Supported Edition. Some standalone editions of the Software
may be made available free of charge and may include notices requesting or
encouraging donations. Donations are voluntary and do not create any additional
license rights, support obligations, warranty, ownership interest, or
entitlement to future features, unless expressly stated otherwise in writing by
Crystice Softworks.
Steam Edition. If you obtain the Software through Steam, your use of the Steam
edition is also subject to the Steam Subscriber Agreement and other applicable
Steam terms. Steam may provide installation, updates, reviews, achievements,
cloud features, community features, or other platform services. This Agreement
governs your license to the Software itself as between you and Crystice
Softworks.
VDK / Volatile SDK Distribution. If J.A.C.K. is provided to you as part of
Volatile Development Kit ("VDK"), Volatile SDK, or another Volatile Engine
development package, your use of that copy of J.A.C.K. is governed by the
applicable VDK License, Volatile SDK license, or other applicable Volatile
Engine development package license terms, and not by this Agreement, unless
those terms expressly state otherwise.
3. USER-CREATED CONTENT
As between you and Crystice Softworks, you retain all rights you may have in
maps, levels, scripts, configuration files, and other content that you create
using the Software ("User-Created Content"). Crystice Softworks claims no
ownership rights in your original User-Created Content solely because it was
created using the Software.
You may use, copy, modify, publish, distribute, sell, license, or otherwise
commercially exploit your User-Created Content, including as part of free,
paid, commercial, or non-commercial games, mods, projects, and other products,
without paying any royalty or fee to Crystice Softworks.
Your rights in your User-Created Content under this Section survive termination
of this Agreement, provided that your continued use or distribution of such
User-Created Content does not require continued use of the Software after
termination.
This Agreement does not grant you any rights to third-party games, engines,
assets, textures, trademarks, file formats, tools, SDKs, or other materials
that may be required to use, build, run, or distribute your User-Created
Content. You are responsible for ensuring that your User-Created Content and
its distribution comply with any applicable third-party licenses, platform
terms, and laws.
4. RESTRICTIONS
Except as expressly permitted by this Agreement or by applicable law, you may
not:
(a) copy, redistribute, sell, rent, lease, sublicense, or otherwise make the
Software itself available to any third party, except as expressly permitted by
this Agreement. For clarity, this restriction applies to the Software and does
not limit your rights in User-Created Content under Section 3;
(b) modify, adapt, translate, reverse engineer, decompile, disassemble, or
create derivative works of the Software;
(c) use the Software, its source code, object code, binaries, libraries,
resources, user interface, documentation, proprietary data, or included assets
to train, fine-tune, evaluate, validate, improve, or develop any machine
learning model, artificial intelligence system, dataset, or similar automated
system, except with the prior written permission of Crystice Softworks;
(d) remove, alter, or obscure any copyright notices, trademarks, license
notices, or other proprietary notices in the Software;
(e) circumvent, disable, bypass, or interfere with any technical restrictions,
license checks, Steam integration, access controls, or security features of the
Software;
(f) use the Software in a manner that violates applicable law or the rights of
any third party.
For clarity, the restriction on artificial intelligence and machine learning
use applies to the Software itself and materials provided by Crystice Softworks.
It does not restrict your use of your own original User-Created Content,
subject to Section 3 and any applicable third-party rights.
The restrictions above do not limit any rights that cannot be excluded or
restricted under applicable law.
5. THIRD-PARTY SOFTWARE
The Software may include or be distributed with third-party software,
libraries, SDKs, models, data files, or other components. Such components are
licensed by their respective owners under their own license terms.
Third-party license notices are provided in the accompanying third-party
notices or licenses file, where applicable.
Nothing in this Agreement limits any rights you may have under applicable
third-party open-source or third-party license terms.
6. UPDATES, SERVICES, AND SUPPORT
Crystice Softworks may provide updates, fixes, modifications, or new versions
of the Software at its discretion. Updates may add, change, or remove features.
Crystice Softworks is not obligated to provide any particular update, feature,
service, or support, unless expressly stated otherwise in writing.
Some features may depend on third-party services, platforms, SDKs, online
services, or external content. Crystice Softworks is not responsible for the
availability, operation, or continued support of third-party services.
7. DISCLAIMER OF WARRANTY
The Software is provided "as is" and "as available", without warranties of any
kind, whether express, implied, or statutory, including without limitation any
implied warranties of merchantability, fitness for a particular purpose, title,
and non-infringement, to the maximum extent permitted by applicable law.
Crystice Softworks does not warrant that the Software will be uninterrupted,
error-free, secure, compatible with any particular system, game, engine, file
format, or third-party tool, or that defects will be corrected.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Crystice Softworks shall not
be liable for any indirect, incidental, special, consequential, exemplary, or
punitive damages, or for any loss of profits, revenue, data, content, goodwill,
business opportunities, or other intangible losses, arising out of or related
to the Software or this Agreement.
To the maximum extent permitted by applicable law, Crystice Softworks' total
liability for any claim arising out of or related to the Software or this
Agreement shall not exceed the amount you paid for the Software, if any, during
the twelve months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability or exclusions
of warranties. In such jurisdictions, the limitations and exclusions in this
Agreement apply only to the maximum extent permitted by applicable law.
9. TERMINATION
This Agreement remains in effect until terminated.
Your rights under this Agreement terminate automatically if you violate its
terms. Upon termination, you must stop using the Software and delete all copies
of the Software in your possession or control, except where continued retention
is required by applicable law or platform rules.
Termination of this Agreement does not transfer to Crystice Softworks any
rights in your User-Created Content and does not, by itself, terminate your
rights under Section 3 to use, copy, modify, publish, distribute, sell, license,
or otherwise commercially exploit User-Created Content that you created using
the Software before termination, subject to applicable third-party rights,
platform terms, and laws.
Sections concerning ownership, User-Created Content, restrictions, third-party
software, warranty disclaimers, limitation of liability, termination, and
governing law survive termination of this Agreement.
10. GOVERNING LAW
This Agreement is governed by the laws of the Province of Ontario and the laws
of Canada applicable therein, without regard to conflict of law principles,
unless applicable consumer protection laws require otherwise.
11. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and Crystice
Softworks regarding the standalone Software and supersedes any prior or
contemporaneous understandings regarding the standalone Software.
If any provision of this Agreement is found to be unenforceable, the remaining
provisions will remain in full force and effect.

governs your license to the Software itself as between you and Crystice
Softworks.
VDK / Volatile SDK Distribution. If J.A.C.K. is provided to you as part of
Volatile Development Kit ("VDK"), Volatile SDK, or another Volatile Engine
development package, your use of that copy of J.A.C.K. is governed by the
applicable VDK License, Volatile SDK license, or other applicable Volatile
Engine development package license terms, and not by this Agreement, unless
those terms expressly state otherwise.
3. USER-CREATED CONTENT
As between you and Crystice Softworks, you retain all rights you may have in

using the Software ("User-Created Content"). Crystice Softworks claims no
ownership rights in your original User-Created Content solely because it was
created using the Software.

paid, commercial, or non-commercial games, mods, projects, and other products,
without paying any royalty or fee to Crystice Softworks.
Your rights in your User-Created Content under this Section survive termination

User-Created Content does not require continued use of the Software after
termination.

(f) use the Software in a manner that violates applicable law or the rights of
any third party.
For clarity, the restriction on artificial intelligence and machine learning
use applies to the Software itself and materials provided by Crystice Softworks.
It does not restrict your use of your own original User-Created Content,
subject to Section 3 and any applicable third-party rights.
The restrictions above do not limit any rights that cannot be excluded or
restricted under applicable law.
5. THIRD-PARTY SOFTWARE
The Software may include or be distributed with third-party software,
libraries, SDKs, models, data files, or other components. Such components are
licensed by their respective owners under their own license terms.
Third-party license notices are provided in the accompanying third-party
notices or licenses file, where applicable.
Nothing in this Agreement limits any rights you may have under applicable
third-party open-source or third-party license terms.
