This End User License Agreement ("Agreement") is between you and Five Cats Game Studios ("we," "us," or "our") and governs your use of the game Just Cribbage, including its software, updates, and online services (together, the "Game").
By installing or playing the Game, you agree to this Agreement. If you do not agree, do not install or play the Game.
If you obtained the Game through Steam, your use of Steam itself is governed separately by the Steam Subscriber Agreement. Where this Agreement and the Steam Subscriber Agreement conflict regarding the Steam platform, the Steam Subscriber Agreement controls.
1. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play the Game for your own non-commercial entertainment. The Game is licensed to you, not sold. We and our licensors retain all rights, title, and interest in the Game, including all software, artwork, audio, and other content.
2. What You May Not Do
You agree not to:
copy, distribute, sell, rent, lease, or sublicense the Game, except as expressly permitted by the platform you obtained it from;
reverse engineer, decompile, or disassemble the Game, or create derivative works from it, except to the extent applicable law expressly permits despite this limitation;
cheat, or attempt to cheat, in any online mode — including using bots, automation, exploits, modified clients, or tampering with match data, replays, scores, or network traffic;
interfere with or disrupt the Game's servers or other players' use of the Game;
use the Game for any unlawful purpose.
3. Online Features and Fair Play
The Game includes optional online features such as accounts, multiplayer, leaderboards, and daily challenges. These features depend on servers and services we operate or use, and we cannot guarantee they will always be available. We may modify, suspend, or discontinue online features at any time.
The Game uses automated systems to verify the fairness of submitted games and scores. If these systems detect cheating, tampering, or manipulated results, we may reject scores, remove leaderboard entries, and suspend or permanently restrict your access to online features. We may also take these actions manually where we reasonably believe this Agreement has been violated.
4. Updates
We may provide patches, updates, and modifications to the Game, which may be applied automatically. This Agreement covers those updates unless they come with their own terms.
5. Termination
This Agreement is effective until terminated. It terminates automatically if you breach it. Upon termination, you must stop playing and uninstall the Game. Sections 2 and 6 through 9 survive termination.
6. Disclaimer of Warranties
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE GAME. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE GAME WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE GAME. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU. NOTHING IN THIS AGREEMENT LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
8. Governing Law
This Agreement is governed by the laws of the State of Iowa, USA, without regard to its conflict-of-law rules. If you reside in a jurisdiction whose consumer protection laws give you additional non-waivable rights, nothing in this Agreement affects those rights.
9. General
If any part of this Agreement is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. This Agreement is the entire agreement between you and us regarding the Game and supersedes any prior agreements about it.
10. Changes to This Agreement
We may update this Agreement from time to time. If we make material changes, we will update the "Last updated" date above and make the revised Agreement available where the Game is distributed. Continued play after a change takes effect constitutes acceptance of the revised Agreement.
