DraFG — End User Licence Agreement
1. Parties and relationship with Steam
This supplemental End User Licence Agreement (the Agreement) is between you and MB "Minimum labs", a Lithuanian company operating under the Draske brand. In this Agreement, that legal entity is called Draske, we, us, or our. Draske publishes DraFG.
This Agreement applies to the DraFG application and its included models, resources, documentation, patches, and updates (collectively, DraFG).
The Steam Subscriber Agreement (https://store.steampowered.com/subscriber_agreement/) (the Steam Agreement) already governs your Steam account and Subscription to DraFG. In particular, its general licence, ownership, copying, resale, distribution, modification, and reverse-engineering terms apply to DraFG. This Agreement is additional Subscription Terms for DraFG and adds only the DraFG-specific terms below. Valve is not a party to this Agreement, and purchases and refunds are handled through Steam under the Steam Agreement and the Steam Refund Policy.
By accepting this Agreement through Steam, or by installing or using DraFG, you agree to it. If you do not agree, do not install or use DraFG.
2. Licence and how DraFG runs
While you hold a valid DraFG entitlement through Steam, you may install and use DraFG for your personal purposes and for the content creation permitted in Section 4. For business, institutional, or volume licensing, contact contact@draske.com.
DraFG runs locally on your device. Apart from Steam's own entitlement and delivery systems, DraFG does not depend on Draske-operated servers to function.
Some features, models, or content packs may be offered as separate purchases or optional downloads with their own terms.
3. DraFG models, trade secrets, and protection measures
DraFG's non-public models, model parameters, weights, configurations, and authenticated asset packages are confidential and, to the extent they satisfy applicable legal requirements, constitute Draske's trade secrets. Draske uses encryption, access controls, and this Agreement to preserve their confidentiality. They are supplied solely to enable DraFG's ordinary operation.
In addition to the Steam Agreement's restrictions, you must not:
- bypass or defeat DraFG's Steam entitlement check, encryption, authentication, integrity check, or other access-control measure;
- extract, decrypt, dump, convert, publish, distribute, or use DraFG's models, model parameters, weights, authenticated asset packages, or non-public resources outside DraFG's ordinary operation; or
- use DraFG or its outputs to extract or reconstruct DraFG's non-public models, or to train or fine-tune a substantially equivalent substitute for them.
The final restriction does not prohibit good-faith product reviews or comparative performance benchmarks.
Reservation of rights for text and data mining. To the extent permitted by applicable law, Draske expressly reserves all rights in DraFG and its components, models, and resources for text and data mining within the meaning of Article 4(3) of Directive (EU) 2019/790, including use for training machine-learning or artificial-intelligence models.
These restrictions apply only to the extent permitted by law. They do not exclude mandatory statutory rights, including rights concerning interoperability, security research, or reverse engineering that applicable law does not allow us to restrict. Information obtained through such a right may be used only as applicable law permits. For permission to conduct other security research, contact contact@draske.com before beginning.
Separate third-party or open-source licences supplied with DraFG control for their respective components where they conflict with this Agreement.
4. Recordings, streams, and user content
As an express commercial-use permission under the Steam Agreement, you may capture, edit, publish, and monetise screenshots, videos, tutorials, reviews, and live streams showing your lawful use of DraFG. You may truthfully identify DraFG and Draske but must not imply our endorsement without written permission.
Draske does not claim ownership of your recordings or other content merely because DraFG processed or displayed frames used in them. This permission does not grant rights in any game, artwork, audio, video, trademark, or other third-party material. You are responsible for obtaining the necessary rights and following the applicable game's, platform's, and recording service's terms.
This permission does not allow redistribution of DraFG, its models, or its resources.
5. Privacy, diagnostics, and feedback
DraFG processes the capture source you select locally on your device. DraFG does not automatically send captured frames, telemetry, analytics, or crash reports to us. Its settings and diagnostic logs remain on your device unless you deliberately share them, including through DraFG's optional in-app feedback feature. That feature transmits only the message you write and, if you enable its diagnostics option, the diagnostic details shown to you in its preview — and only when you choose to submit.
If you voluntarily send a diagnostic report, support message, or attachment through DraFG's in-app feedback feature, email, our contact form, the Draske Discord community, or Steam community pages, Draske will use it to respond, investigate and improve DraFG, protect the service, and meet legal obligations. Review files before sharing them, especially in public channels. Steam and Discord process information separately under their own terms and privacy policies.
The Draske Privacy Policy at https://draske.com/privacy explains our handling of support submissions, website data, retention, and data-protection rights.
You grant Draske a worldwide, perpetual, royalty-free, sublicensable, and transferable licence to use, reproduce, modify, publish, and commercialise feedback, suggestions, and ideas you intentionally provide about DraFG, in connection with Draske's products and services, without attribution, confidentiality, or an obligation to implement them. Do not submit confidential material or anything you are not authorised to share.
6. Product characteristics you accept
The following are inherent characteristics of DraFG and of frame-generation and upscaling software generally. They are described here, and before purchase on DraFG's store page, so that you can take them into account when deciding to buy. By purchasing and using DraFG you expressly accept them:
- Per-game and per-system variation. DraFG's results depend on your system, hardware, GPU, drivers, operating system, capture configuration, and the specific game or application. DraFG is not promised to work, or to work equally well, with any particular game, application, hardware, or configuration. The system requirements on DraFG's store page are minimums needed for DraFG to have a reasonable chance of operating; they are not a guarantee that DraFG will run, or perform in any particular way, on your specific system.
- Generated frames are approximations. Frame generation and upscaling synthesise images and can introduce visual artefacts, ghosting, blur, interface distortion, or added input latency. The extent varies by content and settings and cannot be eliminated.
- Environment changes can affect DraFG. Updates to games, operating systems, drivers, GPUs, or anti-cheat systems made by their vendors can degrade or stop DraFG's operation with particular titles or hardware at any time. Such third-party changes are outside Draske's control.
Anti-cheat and game platforms. DraFG uses operating-system capture, presentation, and display facilities and is not designed to inject into games or bypass or interfere with anti-cheat systems. Compatibility with any particular game or anti-cheat system is not guaranteed. Games, platforms, and anti-cheat providers control their own blocking and enforcement decisions. You decide whether to use DraFG with a particular game and accept the risk that a game, platform, or anti-cheat provider may block, restrict, or penalise its use. Do not use DraFG to gain an unfair advantage in multiplayer play. You remain responsible for complying with each game's and platform's terms.
Draske is not affiliated with, and DraFG is not sponsored or endorsed by, Valve Corporation or any game publisher or anti-cheat provider. All third-party names and marks belong to their owners.
Back up important data and do not use DraFG where failure could cause significant harm.
7. Updates, support, and product lifecycle
DraFG is sold as the version available at the time of your purchase, with the characteristics described in Section 6.
No entitlement to new functionality. Your purchase does not entitle you to new features, new models, improved quality, support for additional games, hardware, drivers, or operating systems, or any particular roadmap. Draske may release, change, or discontinue features, models, and validated configurations at its discretion. Updates that Draske does release may add, change, or remove functionality.
Support is voluntary. Technical support, troubleshooting, Discord and community assistance, and the compatibility listings are provided as a courtesy, without commitment to availability, response, or outcome, and may be reduced, changed, or ended at any time.
End of development or sale. Draske may stop developing DraFG, stop selling it, or wind down the product at any time. Because DraFG runs locally (Section 2), ending development or sale does not by itself prevent you from running builds you have already installed, although without updates DraFG's operation with future games, drivers, and operating systems will degrade over time.
Statutory floor. Nothing in this Section limits updates, remedies, or conformity obligations that applicable mandatory law requires of Draske or of your seller for the period it prescribes, including under national laws implementing Directive (EU) 2019/770 where they apply to your purchase.
8. Warranty and liability
To the maximum extent permitted by applicable law, DraFG is provided as is and as available, with all faults and without express, implied, or statutory warranties. Draske disclaims implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, availability, reliability, uninterrupted or error-free operation, compatibility, security, and non-infringement.
To the maximum extent permitted by applicable law, Draske will not be liable for indirect, incidental, special, punitive, or consequential loss, or for loss of profits, revenue, business, opportunity, goodwill, or data, arising from DraFG. Our total aggregate liability arising from DraFG or this Agreement will not exceed the greater of the amount you paid for DraFG during the twelve months preceding the event giving rise to the claim and EUR 50.
Nothing in this Agreement excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence where applicable, or any warranty, guarantee, conformity right, remedy, or consumer right that applicable law does not allow us to exclude or limit. If you are a consumer in the European Union or the United Kingdom, you have statutory rights concerning the conformity of digital content that this Agreement does not reduce.
9. Ending the Agreement, disputes, and governing law
Your right to use DraFG ends when your Steam entitlement ends, you stop using and remove DraFG, or we terminate access because you materially breach this Agreement and, where the breach can be remedied, you fail to remedy it within a reasonable time after notice. When access ends, you must stop using DraFG. Sections 3 through 9 continue where their nature requires.
This Agreement is governed by Lithuanian law. If you are a consumer, this choice does not remove mandatory protections provided by the law of the country where you habitually reside, and you may bring a claim in any court available under mandatory consumer law. Otherwise, the courts of Lithuania have exclusive jurisdiction.
If you are a consumer, contact us in writing first so we can try to resolve your complaint. We will provide a written response within the period required by applicable law, normally no later than 14 days after receiving your request.
If a provision is invalid, the rest remains effective. Failure to enforce a provision is not a waiver. We may transfer this Agreement with DraFG or its related business without reducing your mandatory rights.
We may update this Agreement and will request renewed acceptance where required. If you do not agree to an updated version, stop using DraFG.
