END USER LICENSE AGREEMENT (EULA) FOR TRAKS

This End User License Agreement ("Agreement" or "EULA") is a legal agreement between you (the "User" or "Player") and Gabor Alberti, a solo software developer based in Hungary ("Developer"), for the video game titled Traks ("the Game"), which includes all associated software, media, and online services.

By installing, copying, or otherwise using the Game via Steam, you agree to be bound by the terms of this Agreement. If you do not agree, do not install or use the Game.

  • 1. Grant of License

The Developer grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and play one (1) copy of the Game on a personal device via your Steam account strictly for your personal, non-commercial entertainment use.

  • 2. User-Generated Content (The Track Editor)

The Game includes a block-based track editor that allows you to create, upload, and share custom tracks ("User Content").

Ownership: You retain ownership of any original intellectual property inherent in the custom tracks you build.

License to Developer: By creating, uploading, or sharing User Content within the Game or via the Steam Workshop, you grant the Developer a worldwide, perpetual, royalty-free, irrevocable, sublicensable right to use, copy, modify, distribute, publicly display, and perform your User Content solely in connection with operating, promoting, and improving the Game.

Content Restrictions: You agree not to create or share any custom tracks that infringe on third-party intellectual property, contain offensive/illegal material, or malicious code. The Developer reserves the right to remove any User Content at his sole discretion.

  • 3. Online Conduct, Text, and Voice Chat

Traks features online multiplayer components, including text and voice chat functionalities. To keep the community safe and fair, you agree not to:

Harass, abuse, threaten, or defame other players via text or voice chat.

Use profanity, hate speech, or racially, ethnically, or otherwise offensive language.

Cheat, automate gameplay (bots), hack, modify Game files to gain an unfair advantage, or exploit bugs.

Disrupt the normal flow of gameplay or multiplayer matchmaking.

The Developer reserves the right to suspend or permanently terminate your access to multiplayer features and online services if you violate these conduct rules.

  • 4. Global Leaderboards, Data Collection, and Telemetry

The Game collects limited technical and gameplay data to support online functionality, fix errors, and improve overall performance:

Global Leaderboards: The Game utilizes epicleaderboard.com to manage competitive scores. By playing timed or scored modes, your public Steam username, unique identifier, and gameplay metrics (such as completion times) will be transmitted to and displayed publicly on epicleaderboard.com.

Game Analytics & Diagnostics: The Game incorporates GameAnalytics (a service provided by GameAnalytics Ltd.). GameAnalytics automatically collects pseudonymous technical and usage data, including device specifications, operating system details, session duration, error/crash logs, performance stats, and a pseudonymous player identifier.

Purpose of Processing: This data is processed strictly to diagnose technical issues, balance gameplay, and optimize the performance of the Game. Neither the Developer nor GameAnalytics uses this data to identify you personally.

Third-Party Terms & Control: Data collected by GameAnalytics is handled in accordance with the GameAnalytics Privacy Policy. You can opt out of analytics data collection at any time via the Game's settings menu.

By playing the Game and participating in timed tracks or competitive modes, you acknowledge and agree that your public Steam username, unique identifier, and gameplay statistics (such as track completion times and scores) will be transmitted to and displayed publicly on epicleaderboard.com.

No highly sensitive personal data is collected or transmitted by the Game. Any data handling is strictly limited to maintaining leaderboard integrity and multiplayer connectivity.

  • 5. Limitations on Use

You may not:

Reverse engineer, decompile, or disassemble the Game, except to the extent permitted by applicable law.

Rent, lease, sublicense, distribute, or commercialize the Game or any part of it.

Remove or alter any copyright, trademark, or proprietary notices contained within the Game.

  • 6. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Game is provided "AS IS" and "AS AVAILABLE," with all faults and without warranty of any kind. The Developer does not warrant that the Game will be error-free, uninterrupted, or compatible with all hardware and software configurations.

  • 7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Gabor Alberti be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, data loss, or business interruption) arising out of the use of or inability to use the Game, even if advised of the possibility of such damages.

  • 8. Governing Law and Jurisdiction

This Agreement is governed by and construed in accordance with the laws of Hungary. Any legal disputes or claims arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the competent courts of Hungary.

  • 9. Termination

This Agreement is effective until terminated. Your rights under this License will terminate automatically without notice from the Developer if you fail to comply with any term(s) of this EULA. Upon termination, you must cease all use of the Game and destroy all copies in your possession.
