STORYSMITH END USER LICENSE AGREEMENT

This End User License Agreement ("Agreement") is between you ("User") and BigD Games ("Licensor," "we," "us") and governs your use of the Storysmith software application ("Software").
BY INSTALLING, ACCESSING, OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE SOFTWARE.
1. License Grant
Subject to your compliance with this Agreement, BigD Games grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software for personal, non-commercial entertainment purposes on devices you own or control.
2. Ownership
The Software, including its code, design, and original narrative systems, is owned by BigD Games and protected by copyright and other intellectual property laws. This Agreement does not transfer any ownership rights to you. All rights not expressly granted are reserved.
3. Third-Party Components and Services
The Software incorporates or connects to third-party software and services, each governed by its own terms:
- Local AI inference: The Software downloads and runs a third-party AI model (Phi-4) and inference engine (llama.cpp) on your device to generate story content. These components are subject to their respective licenses and are not owned by BigD Games.
- Cloud AI providers (optional): If you choose to connect a third-party AI provider (Anthropic, OpenAI, or Google) using your own API key, that provider processes your requests under its own terms of service and privacy policy. BigD Games is not a party to that relationship and is not responsible for those providers' availability, costs, or content output.
- Twitch integration (optional): If you connect the Software to Twitch chat, your use of Twitch is governed by Twitch's own Terms of Service. BigD Games does not control Twitch's platform or your channel's compliance with Twitch's policies.
You are responsible for complying with the terms of any third-party service you choose to use through the Software.
4. AI-Generated Content
Story content in the Software is dynamically generated by an AI system based on inputs from you and, if enabled, your Twitch chat audience. Generated content:
- Varies based on the genre, tone, and settings you configure, and may include mature themes (e.g., horror, violence, peril) if you select them.
- Is not pre-written or manually reviewed by BigD Games prior to display.
- Is filtered by automated safety rules built into the Software's AI system, but BigD Games does not guarantee that generated content will always be free of errors, inconsistencies, or content some users may find objectionable.
You are responsible for supervising use of the Software's live-audience features if your audience may include minors.
5. Restrictions
You agree not to: (a) reverse engineer, decompile, or disassemble the Software except to the extent expressly permitted by applicable law; (b) redistribute, sell, sublicense, or rent the Software; (c) circumvent any technical protection or distribution measures (including Steam's); or (d) use the Software to generate or distribute unlawful content.
6. Disclaimer of Warranty
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BIGD GAMES DOES NOT WARRANT THAT THE SOFTWARE, INCLUDING AI-GENERATED CONTENT OR THIRD-PARTY SERVICES IT CONNECTS TO, WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR EXPECTATIONS.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIGD GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SOFTWARE OR ANY THIRD-PARTY SERVICE ACCESSED THROUGH IT.
8. Termination
This Agreement terminates automatically if you fail to comply with its terms. Upon termination, you must stop using the Software and delete all copies in your possession.
9. Governing Law
This Agreement is governed by the laws of the State of Michigan, United States, without regard to conflict-of-law principles.
