SCHIZM — END USER LICENSE AGREEMENT

This End User License Agreement ("Agreement") is a legal agreement between
you ("you" or "User") and Strombo Games ("Licensor", "we", "us") governing
your use of the video game Schizm, including all related software,
updates, patches, downloadable content, and documentation (collectively,
the "Game").
By installing, copying, or playing the Game, you agree to be bound by this
Agreement. If you do not agree, do not install or play the Game.
If you obtained the Game through Steam, your use of the Game is also
subject to the Steam Subscriber Agreement. If you obtained the Game
through another storefront (such as itch.io or Google Play), that
storefront's terms also apply. In the event of a conflict between this
Agreement and a storefront's terms, the storefront's terms control with
respect to purchase, refund, and platform matters.
1. LICENSE GRANT
Subject to your compliance with this Agreement, Licensor grants you a
personal, limited, non-exclusive, non-transferable, revocable license to
install and play the Game on devices you own or control, solely for your
private, non-commercial entertainment use.
The Game is licensed, not sold. You own the media or storage on which the
Game resides (if any), but Licensor retains all right, title, and interest
in and to the Game itself.
2. RESTRICTIONS
You may not, and may not permit others to:
a. copy, distribute, sell, rent, lease, sublicense, or otherwise
transfer the Game or your license to it, except as expressly
permitted by the storefront through which you obtained it;
b. reverse engineer, decompile, or disassemble the Game, except to the
extent such activity is expressly permitted by applicable law
notwithstanding this limitation;
c. modify, adapt, or create derivative works of the Game, except for
personal, non-commercial modifications that are not distributed;
d. remove or alter any copyright, trademark, or other proprietary
notices;
e. use the Game, or any part of it, for any commercial purpose without
Licensor's prior written consent;
f. use cheats, automation software, bots, hacks, or any unauthorized
third-party software designed to modify the Game experience or to
gain an unfair advantage on leaderboards or in any online feature; or
g. exploit bugs or unintended behavior to corrupt leaderboard data or
interfere with other players' use of online features.
3. OWNERSHIP
The Game — including its code, artwork, music, sound effects, characters,
level designs, names, and all other content — is owned by Licensor and is
protected by copyright and other intellectual property laws. All rights
not expressly granted to you in this Agreement are reserved by Licensor.
Content streaming and video creation: you may create, stream, and monetize
videos of Game gameplay (for example on YouTube or Twitch) through the
standard partner or ad-revenue programs of those platforms, provided you
do not misrepresent the Game or imply endorsement by Licensor.
4. ONLINE FEATURES AND SERVICES
The Game may include online features such as leaderboards, achievements,
and cloud saves, provided through platform services (such as Steam or
Google Play Games Services). These features:
a. require a network connection and a platform account, and are subject
to that platform's terms and privacy policy;
b. may be modified, suspended, or discontinued by Licensor or the
platform at any time without liability; and
c. may be unavailable in some regions or on some devices.
Licensor may remove leaderboard entries that it reasonably believes were
obtained through cheating, exploits, or unauthorized software.
5. UPDATES AND EARLY ACCESS
Licensor may provide patches, updates, and content changes at its
discretion, and may require them for continued use of online features.
If you are playing a beta, demo, or Early Access version of the Game, you
acknowledge that the Game is a work in progress: content, balance, saved
progress, and features may change or be removed before final release, and
saved data may not carry forward.
6. USER DATA AND PRIVACY
The Game stores gameplay progress and settings locally on your device and,
where you have enabled it, in your platform's cloud save service. Platform
versions of the Game may use platform or third-party services (such as
analytics and crash reporting) as described in the applicable store
listing and privacy policy. The Game does not sell your personal data.
7. TERMINATION
This Agreement is effective until terminated. It terminates automatically
if you fail to comply with any of its terms. Upon termination you must
stop using the Game and delete all copies in your possession. Sections 3
and 8 through 11 survive termination.
8. DISCLAIMER OF WARRANTIES
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY
KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES
OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE GAME WILL BE
UNINTERRUPTED OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION
OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO
YOU; YOU MAY HAVE OTHER RIGHTS THAT VARY BY JURISDICTION.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL
LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL,
OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, SAVED GAME PROGRESS, PROFITS, OR
GOODWILL, ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE GAME, EVEN IF
ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LICENSOR'S TOTAL AGGREGATE
LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE GAME WILL NOT
EXCEED THE AMOUNT YOU PAID FOR THE GAME.
10. GOVERNING LAW
This Agreement is governed by the laws of the United States and of the
state in which Licensor resides, without regard to conflict-of-law
principles. Nothing in this Agreement limits any non-waivable consumer
protection rights you hold under the laws of your place of residence.
11. GENERAL
This Agreement is the entire agreement between you and Licensor regarding
the Game and supersedes any prior agreements on that subject. If any
provision of this Agreement is held unenforceable, the remaining
provisions remain in full force. Licensor's failure to enforce any right
is not a waiver of that right. Licensor may update this Agreement for
future versions of the Game; the version accompanying your copy of the
Game applies to that copy.
