Alpha draft v1 · Effective 2026-07-12. This agreement covers the alpha testing period only. It will be revised — probably more than once — as the game moves toward release; the current version always lives at the URL above.

1. What this is

This Alpha Test Agreement is between you (a "steward" — our word for the people who play and test) and Retro Hub AI Inc. ("we," "us"), a corporation incorporated in British Columbia, Canada, the developer of Oblivions.Garden ("the game"). By installing or playing an alpha build you accept this agreement.

It supplements — and does not replace — our Terms of Service and Privacy Policy. If you joined the closed testing program, the Beta Tester Agreement also still applies to that program's specific obligations.

2. What alpha honestly is

You are playing an unfinished game, on purpose, to help us finish it. Expect:

- Bugs and crashes — including ones that cost you a session's progress.
- Incomplete features — placeholder art, systems that end abruptly, tools that change shape between builds.
- Downtime without notice — the shared world restarts for fixes and updates whenever it needs to.
- Performance that does not represent the finished game.

The world may be wiped. During alpha we may reset a shard — or every shard — to nothing, and we may do it more than once. Your claims, structures, memories, and progression can all be erased in a wipe. We will say so when it happens, but we do not promise warning, migration, or restoration. If losing everything would ruin alpha for you, alpha is not ready for you yet.

3. Your license to play

We grant you a limited, personal, non-transferable, revocable license to install and play alpha builds of the game for the duration of the alpha, for playing and testing. That license is the whole of what you receive.

Nothing in the game is your property. Hexes you claim, structures you raise, memory you earn, paths you walk, chronicle entries written about you — all of it is game data we operate, not goods you own. Your claims are memories in our world, not property. They carry no monetary value, cannot be sold or transferred, and do not survive a wipe as any kind of entitlement. All game content, code, art, and trademarks remain the property of Retro Hub AI Inc.

4. What we collect while you test

Testing only works if we can see what broke. During alpha we collect:

- Session data — sign-ins, session and connection records tied to your steward account.
- Gameplay events — the world records what happens in it (claims, tending, zoning, structures, progression) in its permanent event ledger, tied to your steward id. That ledger is the game state.
- Bug reports you file — what you write, the optional screenshot you choose to attach, and a system inventory from the diagnostic reporter (OS, CPU/GPU model, memory, drivers, game build) so we can reproduce your issue.
- Crash and error reports — collected automatically when the game or service fails.

5. Conduct

The world is shared. While testing you agree to:

- Not exploit other stewards — no harassment, no griefing, no scamming, no using bugs against the people you share a shard with.
- Report exploits instead of using them — if you find a bug that gives an unfair advantage, file it through the in-game reporter; farming it is grounds for removal.
- Not cheat or automate — no cheats, no unauthorized automation of gameplay to gain advantage.
- Not attack or reverse-engineer the service — no probing, overloading, or disrupting the servers, and no reverse-engineering the service's network protocols or authentication.

6. Termination

You may stop testing at any time — just stop playing, or ask us to delete your account via the data deletion page. We may suspend or revoke alpha access at any time, with or without notice, for breach of this agreement or where we judge it necessary to protect the test or the other stewards in it. Because alpha access is free and provisional, neither wipes nor revocation nor the end of the alpha entitle anyone to compensation.

7. We can change this during alpha

Alpha is exactly the period in which the game — and therefore this agreement — is still being worked out. We may change this agreement during alpha. Changes are posted at the canonical URL with a new draft version number and effective date; material changes will also be flagged in the game or by email where practical. Continuing to play an alpha build after a change means you accept the changed agreement.

8. No warranty, limited liability

Alpha builds are provided "as is", without warranty of any kind. To the maximum extent permitted by law, Retro Hub AI Inc. is not liable for lost data, lost progress, lost time, or other harm arising from alpha participation. Playing alpha is voluntary and at your own risk.

9. Governing law

This agreement is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Disputes are resolved in the courts of British Columbia.
