Terms of Use - Springplay Studio: RISE99

These Terms of Use govern your use of VR game RISE99, including its releases, demos, early-access versions, downloadable content, updates, virtual items and related services, collectively the “Game.”

By downloading, installing or using the Game, you agree to these Terms. If you do not accept them, do not use the Game.
If you are not legally able to accept these Terms yourself, your parent or legal guardian must accept them on your behalf. You must also follow the age requirements and terms of the store, VR headset and other platforms you use.
1. Licence to use the Game
Springplay Studio Oy grants you a limited, personal, non-exclusive, non-transferable and non-sublicensable licence to install and use the Game for private, non-commercial entertainment on supported devices and authorised platforms.
The Game is licensed, not sold. Springplay Studio Oy and its licensors retain all rights in the Game, including its software, characters, story, artwork, music, sounds, dialogue, designs and trademarks.
You may publish and monetise ordinary gameplay videos, livestreams and screenshots. You may not redistribute Game files or assets separately or present your content as official Springplay Studio content.
Commercial exhibitions, VR arcades and other location-based entertainment uses require our prior written permission.
2. Restrictions
Except where applicable law expressly allows it, you must not:
- copy, sell, rent, distribute or sublicense the Game;
- reverse engineer, decompile, disassemble or modify the Game;
- extract or redistribute its software, music, artwork or other assets;
- bypass security, licensing or technical protection measures;
- use cheats, exploits or unauthorised software that interferes with the Game; or
- use the Game unlawfully or in a way that harms other users, systems or services.
3. DLC, skins and in-game purchases
The Game may offer optional purchases, including downloadable content, additional levels, music, skins, cosmetic items, item packs, virtual currency and other digital content. These are collectively called “Virtual Items.”
Virtual Items may be purchased, earned through gameplay or provided without charge. Purchased Virtual Items are licensed digital content. They are not real money, financial instruments or physical property, and they cannot be exchanged for money or transferred outside the Game unless the relevant platform expressly permits it.
The content and price of a purchase will be shown before payment. Purchases are processed by the relevant platform, such as Steam or Meta, and are also subject to that platform’s payment terms.
Do not make purchases without the permission of the person responsible for the platform account or payment method. Parents and guardians should use the parental controls provided by the relevant platform.
We may reasonably adjust gameplay balance, rewards and the availability or characteristics of Virtual Items for technical, security, legal or gameplay-related reasons. We will not remove or materially reduce separately purchased content in a manner that violates applicable consumer law.
4. Payments and refunds
Refund requests should normally be submitted through the distribution platform where the purchase was made, according to the regulations and guidelines provided by the platform.
The platform’s refund rules do not replace any mandatory consumer rights that apply to you. Statutory information concerning digital-content purchases and any applicable right of withdrawal will be provided during the purchase process.
5. Community
Springplay Studio Oy may operate official RISE99 community spaces, including a Discord server and other social media channels, collectively the “Community.”
Participation in the Community is voluntary. Discord is a third-party service, and your use of it is also governed by Discord’s own terms, privacy policy and community guidelines.
When participating in the Community, you must not:
- harass, threaten, bully or discriminate against others;
- publish hateful, sexually exploitative, violent or otherwise unlawful content;
- share another person’s private information without permission;
- impersonate another person or Springplay Studio Oy;
- publish malware, scams, spam or misleading links;
- promote cheats, exploits or unauthorised copies of the Game;
- infringe copyrights, trademarks or other rights; or
- disrupt discussions or repeatedly ignore moderator instructions.
We may remove content and issue warnings, time-outs, mutes, kicks or bans where reasonably necessary to enforce these Terms, Community rules, Discord rules or applicable law. Serious matters may be reported to Discord or the relevant authorities where appropriate.
Moderation decisions may be based on the context, seriousness and repetition of the conduct. You may contact us through email: tiainen.e@gmail.com if you believe a moderation decision was made in error.
We do not guarantee that Community services will always be available, secure or free from content posted by other users.
6. Community content and feedback
You remain the owner of content you create and post in the Community, such as messages, screenshots, videos, fan art and suggestions.
By posting content publicly in an official RISE99 Community, you grant Springplay Studio Oy a non-exclusive, worldwide and royalty-free licence to display, reproduce and share that content where reasonably necessary to:
- operate and moderate the Community;
- respond to your feedback;
- improve the Game; and
- promote the Game or Community.
This licence does not transfer ownership of your content to us. You confirm that you have the necessary rights to post the content and grant this permission.
Ideas and feedback may be used to develop or improve the Game without payment or an obligation to implement them.
7. Privacy and platform data
RISE99 does not normally require a separate Springplay Studio account.
We do not intentionally request additional personal data directly through the Game beyond what is reasonably necessary to provide, secure, support and improve it.
Depending on the platform and features used, Steam, Meta, Discord or another service provider may make limited information available to us, such as:
a platform user ID or display name;
- Game ownership and purchase entitlement information;
- achievements, scores or gameplay statistics;
- device, performance, crash or diagnostic information;
- Community messages and moderation reports; and
- support requests or feedback you choose to send.
We may use this information to operate and support the Game, verify purchases, fix technical problems, prevent misuse, moderate the Community, improve the player experience and comply with legal obligations.
Steam, Meta, Discord and other platform providers separately process information under their own terms and privacy policies. More information about Springplay Studio Oy’s processing of personal data is provided in the RISE99 Privacy Policy.
8. Health and VR safety
Virtual reality may cause motion sickness, dizziness, nausea, eye strain, loss of balance or other discomfort. Flashing lights and visual patterns may trigger seizures in susceptible persons.
Before playing:
- follow the safety instructions supplied with your VR headset;
- clear your play area of furniture, obstacles, people, pets and other hazards;
- stay away from stairs, windows, balconies and fragile objects;
- use the headset boundary system and controller straps;
- make sure you have enough room to move safely; and
- keep the sound at a level that allows awareness of your surroundings.
Take regular breaks. Stop playing immediately if you experience discomfort, disorientation, altered vision, involuntary movements, loss of awareness or other concerning symptoms. Seek medical advice when appropriate.
Do not play while intoxicated, extremely tired or otherwise unable to move and react safely. Children must be appropriately supervised.
9. Updates, early access and compatibility
We may update the Game where reasonably necessary to:
- fix bugs or security problems;
- maintain compatibility with supported hardware, software or platforms;
- comply with legal or platform requirements;
- prevent cheating or misuse;
- balance gameplay; or
- improve, replace or add content and features.
An update may be required to continue using certain features.
Demo, testing and early-access versions may be incomplete, contain bugs and change during development. The store page will describe the main content and development status of the version being offered.
Online and platform-dependent features may be changed or discontinued for valid technical, security, legal or platform-related reasons. Where required by law, we will provide reasonable notice of material changes and information about any related consumer rights.
The Game is intended for the supported systems described on its store page. We cannot guarantee compatibility with unsupported hardware, operating systems, modifications or third-party software.
10. Suspension and termination
You may stop using the Game at any time by uninstalling it.
We may suspend access to Community or online features where reasonably necessary because of:
- a serious or repeated breach of these Terms;
- fraud, unlawful conduct, harassment or harmful cheating;
- a security risk; or
- a legal or platform requirement.
Where appropriate, we will provide notice and a reasonable opportunity to correct the breach.
Termination of access to the Community does not normally terminate your licence to use a separately purchased copy of the Game. However, some online or Community features may no longer be available.
11. Liability and consumer rights
We will provide the Game with the conformity and care required by applicable law. However, no software can be guaranteed to operate without every interruption, error or compatibility issue.
To the extent permitted by law, Springplay Studio Oy is not responsible for loss or damage caused by:
- unsupported or incompatible equipment;
- unauthorised modifications, cheats or third-party software;
- failure to follow Game or headset safety instructions;
- unsafe use of the VR play area;
- content posted by Community members; or
- third-party platforms or services outside our reasonable control.
The Game is intended for private entertainment. To the extent permitted by law, we are not responsible for business losses arising from its use.
Nothing in these Terms excludes or limits mandatory consumer rights or liability that cannot legally be excluded or limited, including liability for personal injury caused by negligence where such liability cannot be excluded.
12. Third-party platforms
The Game and Community may use services provided by Steam, Meta, SideQuest, Discord or other third parties.
You must comply with the applicable platform terms. Platform terms govern matters such as your platform account, payment processing and the operation of the platform itself. These Terms govern your licence to use RISE99 and your participation in official RISE99 Community spaces.
We are not responsible for interruptions, account actions or changes made independently by third-party platform providers.
13. Governing law and disputes
These Terms are governed by Finnish law.
If you are a consumer living in another country, this choice of law does not remove any mandatory consumer protection provided by the laws of your country.
Please contact Springplay Studio Oy first so that we can try to resolve the matter.
Consumers in Finland may contact the Finnish Competition and Consumer Authority’s Consumer Advisory Services. If the dispute cannot be resolved, the consumer may submit it to the Finnish Consumer Disputes Board.
A consumer may bring legal proceedings before any court that has jurisdiction under applicable consumer law.
14. Changes to these Terms
We may update these Terms for legal, security, technical or service-related reasons.
We will provide reasonable notice of material changes through the Game, relevant platform, Community or another appropriate method. Changes will not retroactively remove rights already granted to you without a valid legal basis.
Where required by law, we will request your acceptance before revised Terms become binding.
15. General provisions
If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply. A failure to enforce a provision immediately does not waive the right to enforce it later.
These Terms, the RISE99 Privacy Policy and applicable platform terms form the agreement governing your use of the Game and official Community spaces.
