END USER LICENSE AGREEMENT FOR BRINGERS OF DARKNESS

This End User License Agreement (“Agreement”) is a legal agreement between you (“User”, “you”) and Arcane Celestia, operated by Individual Entrepreneur Denis Glazunov (“Developer”, “we”, “us”, or “our”), regarding your access to and use of the video game Bringers of Darkness, including any related software, updates, patches, downloadable content, documentation, media, and other materials associated with the game (collectively, the “Game”).
By installing, downloading, accessing, launching, or using the Game, you agree to be bound by this Agreement. If you do not agree to this Agreement, do not install, access, or use the Game.
1. Steam and Third-Party Platform Terms
The Game is distributed through Steam and may also be subject to the Steam Subscriber Agreement, Steam Rules of Use, refund rules, and other applicable Steam terms and policies.
If there is a conflict between this Agreement and mandatory rules of Steam or applicable consumer protection laws, those rules or laws will apply to the extent required.
2. License Grant
Subject to your compliance with this Agreement, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Game for your personal, non-commercial entertainment purposes.
This Agreement does not transfer ownership of the Game or any part of it to you. You receive only a license to use the Game under the terms of this Agreement.
3. Ownership
The Game, including but not limited to its code, gameplay systems, characters, names, logos, artwork, animations, music, sounds, text, user interface, visual effects, designs, and other content, is owned by us or our licensors and is protected by applicable copyright, trademark, and other intellectual property laws.
All rights not expressly granted to you under this Agreement are reserved by us.
4. Restrictions
You may not, directly or indirectly:
a) copy, reproduce, distribute, sell, rent, lease, sublicense, or commercially exploit the Game or any part of it, except as expressly permitted by this Agreement;
b) reverse engineer, decompile, disassemble, derive source code from, modify, adapt, or create derivative works based on the Game, except where such restriction is prohibited by applicable law;
c) remove, alter, or obscure any copyright, trademark, or other proprietary notices;
d) use cheats, exploits, bots, automation tools, unauthorized third-party software, or other methods intended to alter the intended operation of the Game;
e) use the Game or any part of it for unlawful, harmful, fraudulent, or abusive purposes;
f) extract, copy, or reuse Game assets, including artwork, icons, characters, music, sounds, visual effects, logos, or other materials, outside of the permissions expressly provided in this Agreement;
g) use the Game in a way that infringes the rights of us, other users, or third parties.
5. Early Access Notice
Bringers of Darkness is released in Early Access.
This means the Game is still in active development and may contain bugs, unfinished content, missing features, balance issues, performance issues, placeholder elements, or other limitations.
The Game may change significantly over time. Features, content, balance values, progression systems, user interface elements, save data, achievements, and other parts of the Game may be changed, added, removed, reset, or reworked during development.
Any roadmap, future development plan, public statement, store description, community post, or announcement represents our current development intentions and does not create a binding obligation to deliver any specific feature, content, update, or release date.
You should purchase and use the Game based on its current state at the time of purchase, not solely based on future plans.
6. Updates and Changes to the Game
We may provide patches, updates, bug fixes, balance changes, content updates, or other modifications to the Game at our discretion.
Some updates may be required in order to continue using the Game through Steam or another platform. We are not obligated to provide updates on any specific schedule.
7. Save Data and Progress
The Game may create local and/or platform-based save data.
Because the Game is in Early Access, updates may affect save files, progression, balance, character data, settings, achievements, or other stored information. We will try to avoid unnecessary loss of progress, but we cannot guarantee that save data will always remain compatible with future versions of the Game.
8. User-Created Videos, Streams, and Screenshots
You are allowed to create, publish, stream, and monetize videos, livestreams, screenshots, reviews, previews, commentary, and similar content featuring gameplay from Bringers of Darkness, including on platforms such as YouTube, Twitch, TikTok, X, Reddit, Discord, and other social media or video platforms.
This permission applies only to content that uses the Game for commentary, review, streaming, entertainment, criticism, educational, or promotional purposes.
This permission does not allow you to separately extract, sell, redistribute, or repackage Game assets such as music, artwork, icons, character models, textures, animations, sound effects, or other materials outside of gameplay-related content.
9. Mods and User-Generated Content
The Game does not currently provide official modding tools or official mod support.
You may not distribute modified versions of the Game, unauthorized tools, hacks, cheats, or other modifications that interfere with the intended operation of the Game.
If official mod support is added in the future, additional rules may apply.
10. Feedback and Suggestions
You may provide feedback, suggestions, bug reports, ideas, comments, or other input regarding the Game.
By submitting feedback to us through Steam, Discord, email, social media, community forums, or any other communication channel, you grant us the right to use, modify, implement, publish, and otherwise exploit that feedback without restriction or compensation to you.
You acknowledge that we may develop features, mechanics, systems, content, or ideas that are similar to feedback submitted by users.
11. Online Features and Third-Party Services
The Game may use Steam features or other platform services, such as achievements, cloud saves, controller support, community features, or other services provided by Valve or third parties.
Your use of such services may be subject to separate terms, policies, and privacy practices of the relevant third-party provider. We are not responsible for third-party services, outages, account issues, platform restrictions, or changes made by third-party providers.
12. Privacy
The Game does not intentionally collect personal data directly from you outside of data processed by Steam or other platforms through which the Game is distributed.
Steam and other platforms may collect and process data according to their own privacy policies and terms.
If we add features in the future that collect additional personal data, we will update our policies or provide additional information as required by applicable law.
13. Termination
This Agreement is effective until terminated.
Your rights under this Agreement will automatically terminate if you breach its terms. Upon termination, you must stop using the Game and uninstall or delete any copies of the Game in your possession, where applicable.
Termination of this Agreement does not limit any rights or remedies available to us under applicable law.
14. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Game is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory.
We do not warrant that the Game will be uninterrupted, error-free, secure, compatible with all systems, free from bugs, or that any defects will be corrected.
Nothing in this Agreement limits any mandatory consumer rights that cannot be excluded under applicable law.
15. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, loss of goodwill, business interruption, hardware or software issues, or loss of enjoyment arising out of or related to your use of or inability to use the Game.
To the maximum extent permitted by applicable law, our total liability for any claim related to the Game or this Agreement shall not exceed the amount you actually paid for the Game.
Some jurisdictions do not allow certain limitations of liability. In such cases, these limitations apply only to the maximum extent permitted by applicable law.
16. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Arcane Celestia, Individual Entrepreneur Denis Glazunov, and their representatives from and against any claims, damages, losses, liabilities, costs, and expenses arising from your breach of this Agreement or misuse of the Game.
17. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of Georgia, without regard to conflict of law principles.
Nothing in this section limits any mandatory consumer protection rights that may apply in your country of residence.
18. Changes to This Agreement
We may update this Agreement from time to time.
If we make material changes, we may notify users through Steam, the Game, our community channels, or other reasonable means. Your continued use of the Game after changes become effective means that you accept the updated Agreement.
19. Severability
If any part of this Agreement is found to be invalid, illegal, or unenforceable, the remaining parts will continue in full force and effect.
20. Entire Agreement
This Agreement represents the entire agreement between you and us regarding the Game and supersedes any prior agreements or understandings related to the Game, except for applicable Steam or third-party platform terms.
