PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT" OR "EULA") CAREFULLY BEFORE INSTALLING, ACCESSING, LAUNCHING, OR USING "A STORY OF QUESTIONS" (THE "GAME"). BY INSTALLING, ACCESSING, LAUNCHING, OR USING THE GAME, YOU AGREE TO BE BOUND BY THIS AGREEMENT.

This Agreement is a legal agreement between you ("User," "you," or "your") and Under the Bridge Games by Tim Hertel ("Developer," "we," "us," or "our"), an independent solo game developer and German small business (Kleingewerbe) based in Germany.
Subject to your compliance with this Agreement, the Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
Except as explicitly permitted in the Community Content & Media section below, this license is for non-commercial use only.
This license does not transfer ownership of the Game or any intellectual property rights to the User.
You agree that you will not:
The Game, including but not limited to all code, visual assets, music, dialogue, characters, writing, trademarks, logos, and other content, is owned by Under the Bridge Games by Tim Hertel or its respective licensors and is protected by copyright and intellectual property laws.
All rights not expressly granted in this Agreement are reserved.
The Developer encourages players and content creators to engage with the Game. You are granted a non-exclusive, royalty-free license to create and share content related to the Game, including but not limited to:
Third-Party Audio Disclaimer (IMPORTANT): The Game includes music and sound assets licensed from third-party stock providers. While the Developer grants you permission to feature Game footage, the Developer does not own the underlying copyrights to the music and cannot grant a sub-license for its use in videos or streams. Use of the Game’s audio in your content may result in "Content ID" flags or copyright claims from the original rights holders. You are solely responsible for managing any such claims on your platform.
Other Restrictions:
The Developer may provide patches, updates, bug fixes, balance changes, or additional content at any time.
You acknowledge that the Game may evolve over time and that features, mechanics, content, or technical requirements may change.
The Developer is not obligated to continue supporting the Game for any specific period of time.

Specific Provisions for Users in Germany and the EU: If you are a consumer based in Germany or the European Union, the following applies:
Certain individuals may experience discomfort, motion sickness, dizziness, eye strain, or seizures when playing video games. You should stop using the Game immediately if you experience any adverse physical symptoms.
The Game may include integrations, middleware, or services provided by third parties (e.g., Steam/Valve Corporation, Epic Games, or analytics providers).
This Agreement and the license granted hereunder will terminate automatically if you fail to comply with any of its terms.
Any collection or processing of personal data shall be handled in accordance with applicable privacy laws and any separate Privacy Policy provided by the Developer.
This Agreement shall be governed by and interpreted in accordance with the laws of Germany, excluding conflict of law principles.
If you are a consumer residing in the European Union, you may also benefit from mandatory consumer protection laws in your country of residence.
If any provision of this Agreement is found to be unenforceable or invalid by a court, that specific provision will be limited or eliminated to the minimum extent necessary. The rest of the Agreement will remain in full force and effect.
This Agreement constitutes the entire agreement between you and the Developer regarding the Game and supersedes all prior or contemporaneous understandings regarding its subject matter.

2. LICENSE GRANT
Subject to your compliance with this Agreement, the Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

- Use the Game
Except as explicitly permitted in the Community Content & Media section below, this license is for non-commercial use only.
This license does not transfer ownership of the Game or any intellectual property rights to the User.
3. RESTRICTIONS
You agree that you will not:
- Redistribute, resell, rent, sublicense, or commercially exploit the Game or substantial parts of the Game without permission from the Developer;
- Use the Game for unlawful, fraudulent, harmful, abusive, hateful, or malicious purposes;
- Upload, distribute, or attach viruses, malware, harmful code, or other malicious software to the Game or related files;
- Attempt to compromise, damage, disrupt, or unlawfully access systems, accounts, services, or data related to the Game.
4. OWNERSHIP
The Game, including but not limited to all code, visual assets, music, dialogue, characters, writing, trademarks, logos, and other content, is owned by Under the Bridge Games by Tim Hertel or its respective licensors and is protected by copyright and intellectual property laws.
All rights not expressly granted in this Agreement are reserved.
5. COMMUNITY CONTENT AND MEDIA
The Developer encourages players and content creators to engage with the Game. You are granted a non-exclusive, royalty-free license to create and share content related to the Game, including but not limited to:
- Livestreams;
- Let’s Plays;
- Walkthroughs;
- Reviews;
- Video essays;
- Fan art;
- Fanfiction;
- Mods;
- Fan translations; and
- Other community creations.
Third-Party Audio Disclaimer (IMPORTANT): The Game includes music and sound assets licensed from third-party stock providers. While the Developer grants you permission to feature Game footage, the Developer does not own the underlying copyrights to the music and cannot grant a sub-license for its use in videos or streams. Use of the Game’s audio in your content may result in "Content ID" flags or copyright claims from the original rights holders. You are solely responsible for managing any such claims on your platform.
Other Restrictions:
- No Raw Distribution: You may not re-upload the Game’s soundtrack or raw gameplay assets as standalone downloads. Content must be "transformative" (e.g., including your own commentary or creative edits).
- No False Endorsement: You must not falsely claim official endorsement by or authorship of Under the Bridge Games by Tim Hertel.
- Illegal/Harmful Content: You may not use Game assets in content that is unlawful, hateful, or violates the rights of third parties.
6. UPDATES AND PATCHES
The Developer may provide patches, updates, bug fixes, balance changes, or additional content at any time.
You acknowledge that the Game may evolve over time and that features, mechanics, content, or technical requirements may change.
The Developer is not obligated to continue supporting the Game for any specific period of time.
7. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE." THE DEVELOPER EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY;
- FITNESS FOR A PARTICULAR PURPOSE;
- NON-INFRINGEMENT; AND
- FREEDOM FROM ERRORS, BUGS, OR INTERRUPTIONS.

- MERCHANTABILITY & FITNESS FOR A PARTICULAR PURPOSE;
- NON-INFRINGEMENT AND TITLE;
- ACCURACY, COMPLETENESS, AND SECURITY;
- SYSTEM INTEGRATION AND QUIET ENJOYMENT;
- LACK OF NEGLIGENCE AND WORKMANLIKE EFFORT;
- VIRUS-FREE OPERATION; AND
- UNINTERRUPTED OR ERROR-FREE FUNCTIONALITY.
- The Epic Materials will function properly as integrated into the Game;
- The Epic Materials will meet your requirements or expectations;
- The Game or Epic Materials will operate uninterrupted, secure, bug-free, or error-free;
- Defects can or will be corrected; or
- The Epic Materials comply with any platform requirements.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR COMPUTER DAMAGE ARISING OUT OF THE USE OF THE GAME.
Specific Provisions for Users in Germany and the EU: If you are a consumer based in Germany or the European Union, the following applies:
- Unlimited Liability: The Developer is liable without limitation for damages caused by intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), as well as for injury to life, body, or health.
- Simple Negligence: In cases of simple negligence, the Developer is only liable for the breach of an essential contractual obligation (Kardinalpflicht). An essential contractual obligation is one whose fulfillment is necessary for the proper execution of the contract and on which the User may regularly rely.
- Limited Liability: In the event of simple negligence, liability is limited to the foreseeable damage typical for this type of contract.
- Liability Cap: To the extent permitted by law, the total liability of the Developer shall not exceed the amount you paid for the Game.
10. HEALTH AND SAFETY
Certain individuals may experience discomfort, motion sickness, dizziness, eye strain, or seizures when playing video games. You should stop using the Game immediately if you experience any adverse physical symptoms.
- Content Warning: This Game is a psychological horror experience and may contain intense imagery, flashing lights, or themes that some players may find distressing.
- Disclaimer: The Developer is not responsible for health-related issues arising from the use of the Game. Use of the Game is at your own risk.
11. THIRD-PARTY SERVICES
The Game may include integrations, middleware, or services provided by third parties (e.g., Steam/Valve Corporation, Epic Games, or analytics providers).
- No Responsibility: The Developer is not responsible for the availability, functionality, or security of these third-party services.
- Separate Terms: Your use of the Game is also subject to the terms of service and privacy policies of the platform on which you purchased or play the Game (e.g., the Steam Subscriber Agreement). Any interaction with third-party websites or services linked within the Game is at your own risk.
12. TERMINATION
This Agreement and the license granted hereunder will terminate automatically if you fail to comply with any of its terms.
- Effect of Termination: Upon termination, you must cease all use of the Game and delete all copies of the Game in your possession.
- Developer’s Rights: The Developer reserves the right to terminate access to any optional online features or services if you engage in fraudulent, unlawful, or harmful conduct.
13. PRIVACY
Any collection or processing of personal data shall be handled in accordance with applicable privacy laws and any separate Privacy Policy provided by the Developer.
14. GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of Germany, excluding conflict of law principles.
If you are a consumer residing in the European Union, you may also benefit from mandatory consumer protection laws in your country of residence.
15. SEVERABILITY
If any provision of this Agreement is found to be unenforceable or invalid by a court, that specific provision will be limited or eliminated to the minimum extent necessary. The rest of the Agreement will remain in full force and effect.
16. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and the Developer regarding the Game and supersedes all prior or contemporaneous understandings regarding its subject matter.
