END USER LICENSE AGREEMENT (EULA)

PLEASE READ THIS END USER LICENSE AGREEMENT ("EULA") CAREFULLY BEFORE INSTALLING OR PLAYING THE SOFTWARE. BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE SOFTWARE.
1. Grant of License
Subject to your compliance with this EULA, mako Studio ("Licensor", "we", "us") grants you a limited, non-exclusive, non-transferable, revocable license to install and use one copy of electric strategy (the "Software"), including any related documentation, updates, and patches, for your own personal, non-commercial, single-player entertainment use.
2. Ownership
The Software is licensed, not sold. mako Studio retains all right, title, and interest in and to the Software, including all associated intellectual property rights (copyrights, trademarks, trade secrets, and other proprietary rights). This EULA does not grant you any ownership interest in the Software.
3. Restrictions
You agree not to:
copy, sell, rent, lease, sublicense, distribute, or otherwise transfer the Software or any part of it to any third party;
reverse engineer, decompile, or disassemble the Software, except to the extent such restriction is expressly prohibited by applicable law;
modify, adapt, or create derivative works based on the Software;
remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the Software;
use the Software for any commercial purpose, including streaming or content creation carried out for direct commercial gain in a way that circumvents this license.
4. Distribution via Steam
The Software is distributed through Valve's Steam platform. Your use of Steam is separately governed by the Steam Subscriber Agreement. In case of a conflict between this EULA and the Steam Subscriber Agreement regarding the operation of the Steam platform itself, the Steam Subscriber Agreement shall control; in all other respects, this EULA governs your use of the Software.
5. Updates
mako Studio may, at its discretion, provide updates, patches, or other modifications to the Software. Such updates are covered by this EULA unless accompanied by separate terms.
6. Termination
This license is effective until terminated. It will terminate automatically, without notice, if you fail to comply with any term of this EULA. Upon termination, you must stop all use of the Software and destroy or uninstall all copies in your possession.
7. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAKO STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE. MAKO STUDIO'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SOFTWARE. NOTHING IN THIS EULA LIMITS ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
9. Governing Law
This EULA shall be governed by the laws of Germany, without regard to its conflict of law principles. Mandatory consumer protection rights under the laws of your country of residence, where applicable, remain unaffected.
10. Miscellaneous
If any provision of this EULA is found unenforceable, the remaining provisions will remain in full force and effect. This EULA constitutes the entire agreement between you and mako Studio regarding the Software and supersedes any prior agreements on this subject.
