End User License Agreement for Junkyard Saints: Scrapstorm

This End User License Agreement ("Agreement") governs your access to and use of Junkyard Saints: Scrapstorm (the "Game"), including Early Access builds, updates, patches, local saves, Steam integration, online features, backend services, LiveOps events, support tools, virtual currencies, virtual items, downloadable content, and other digital content. By installing, launching, accessing, or using the Game, you agree to this Agreement.
The Game is distributed through Steam as a free-to-play title. Your use of Steam, Steam Wallet, Steam Cloud, Steam accounts, Steam achievements, Steam leaderboards, Steam refunds, Steam support, and other Steam services is also governed by Valve's own terms, policies, and technical rules. This Agreement is between you and the Operator, not Valve. Steam-specific payment, account, platform, and refund functions are handled by Steam unless stated otherwise.
1. License to use the Game
Subject to your compliance with this Agreement, the Operator grants you a personal, limited, revocable, non-exclusive, non-transferable license to install and use the Game for your private entertainment purposes through Steam and in accordance with Steam's rules. The Game is licensed to you, not sold.
You may not copy, distribute, sell, rent, lease, sublicense, commercially exploit, host, emulate, reverse engineer, decompile, disassemble, modify, or create derivative works from the Game, except where this is expressly allowed by this Agreement, by Steam, by a separate written permission from the Operator, or by mandatory law. You may not remove copyright, trademark, technical protection, ownership, or attribution notices from the Game.
2. Ownership and intellectual property
The Game, including its code, systems, artwork, characters, enemies, UI, text, balancing, audio, music, logos, names, databases, virtual economies, game design, and other content, is owned by the Operator or its licensors and is protected by intellectual property laws. No ownership rights are transferred to you.
Steam, Steamworks, Steam Wallet, Steam Cloud, and related names or features are the property of Valve or its affiliates. All other third-party names, trademarks, libraries, and components remain the property of their respective owners. Open-source components, if any, are subject to their applicable open-source licenses and notices, which may be provided in the Game files, credits, or a separate notice file.
3. Early Access and active development
The Game is offered as a free-to-play Early Access product. Early Access means that the Game is playable but still in active development and may contain bugs, missing content, unfinished systems, balancing issues, placeholder assets, technical problems, or incomplete features. You should install and play the Game based on its current state, not based on promises about future features, dates, content, modes, or updates.
The Operator may add, change, rebalance, rename, replace, reset, remove, disable, or discontinue content, features, enemies, rewards, characters, items, shops, prices, game modes, progression systems, currencies, leaderboards, backend systems, or LiveOps events for testing, balancing, technical, legal, security, operational, or gameplay reasons. Save files, progression, inventories, currencies, leaderboards, statistics, or character data may be adjusted or reset where reasonably necessary for development, balancing, bug fixing, exploit correction, abuse prevention, or service integrity.
4. Steam account, character slot, and saves
The Game uses your Steam identity to connect your Game profile, progress, entitlements, purchases, inventory, support requests, moderation records, and abuse-prevention measures to your Steam account. By default, each Steam account receives one character slot, unless the Game provides additional slots, reset features, or other account-management features.
The character name may be automatically derived from your Steam persona name. If your Steam persona name contains personal information, that information may also appear as your in-game character name or in connected features such as leaderboards, support tools, or admin tools, where such features are enabled. You are responsible for choosing an appropriate Steam persona name.
Local save files and settings may be stored on your device. If Steam Cloud is enabled for the Game and your account, save files or settings may also be synchronized through Steam. The Operator is not responsible for Steam Cloud conflicts, local file corruption, device failure, player-side deletion, unsupported manual edits, or loss caused by third-party software.
5. Online features, backend services, and availability
Some features may require an internet connection, a Steam account, Steam authentication, backend services, or a current Game version. Online features may include account linking, entitlements, purchases, virtual currency balances, inventory, leaderboards, news, LiveOps, events, support tools, moderation, anti-abuse systems, diagnostics, or balancing data.
Online features, backend services, Steam services, Supabase Inc. as hosting and database processor, leaderboards, cloud synchronization, shop systems, events, or support tools may be unavailable, interrupted, limited, changed, or discontinued from time to time for maintenance, updates, outages, security, legal, gameplay, cost, operational, or technical reasons. Updates may be required to continue using the Game or certain features.
Where reasonably practical, the Operator will try to avoid unnecessary disruption and may provide notice of major service changes. However, continuous availability, uninterrupted access, specific server locations, permanent online features, permanent item availability, permanent prices, or permanent compatibility with every device or software configuration are not guaranteed. Mandatory consumer rights remain unaffected.
6. Virtual currencies, virtual items, and digital content
The Game may offer virtual currencies, virtual items, upgrades, cosmetics, boosts, bundles, downloadable content, event rewards, or other digital content ("Digital Content"). Digital Content is licensed for use inside the Game only. It has no cash value, cannot be exchanged for money, cannot be paid out, and cannot be transferred, sold, gifted, traded, or exchanged outside the Game unless the Game expressly supports that feature.
The Game is free to play. All real-money purchases within the Game are made exclusively through Steam Wallet via Steam's microtransaction and store systems. Steam Wallet is the sole supported payment method. The Operator does not operate any independent payment system, does not collect payment directly from you, and does not receive your payment card details or complete payment credentials at any point. Steam processes all transactions, retains its applicable platform share, and is solely responsible for Steam Wallet handling, tax handling, payment authorization, fraud checks, chargebacks, and purchase confirmation, all subject to Steam's rules and applicable consumer law.
Paid offers should clearly show their price, content, and essential properties before purchase. Prices, bundles, shop rotations, availability, discounts, and balancing may change over time. Because all purchases are processed exclusively by Steam, all refund requests must be submitted through Steam support. The Operator has no ability to process, authorize, or issue refunds directly. Whether a refund is granted is determined by Steam's refund policy and applicable consumer law. This does not affect mandatory consumer rights that cannot be waived or limited by contract.
The Operator may correct, reverse, revoke, or adjust Digital Content, virtual currency balances, entitlements, rewards, or purchases where reasonably necessary due to refunds, chargebacks, fraud, payment failure, technical errors, duplication bugs, exploits, unauthorized access, account compromise, moderation decisions, or breach of this Agreement.
If applicable consumer law gives you a withdrawal right for paid Digital Content, Steam may ask for your consent to immediate performance and your acknowledgement that the withdrawal right may expire once the Digital Content is delivered or made available, where legally permitted. Steam's purchase flow, refund rules, and mandatory consumer law apply to such transactions.
7. Fair play, security, and prohibited conduct
You agree not to cheat, exploit, manipulate, disrupt, or abuse the Game, Steam integration, backend services, purchases, virtual currency systems, leaderboards, support systems, or other players. Prohibited conduct includes, without limitation:
- cheats, bots, automation, macros, memory editing, packet manipulation, unauthorized overlays, trainers, or external tools that affect gameplay or progression;
- save manipulation, inventory manipulation, currency manipulation, leaderboard manipulation, or unauthorized changes to local or cloud files;
- exploiting bugs, duplicating items, abusing refunds or chargebacks, payment fraud, or attempting to obtain illegitimate benefits;
- circumventing access controls, authentication, security measures, anti-abuse systems, rate limits, technical protections, or regional restrictions;
- using unauthorized APIs, scraping, probing, scanning, overloading, attacking, reverse engineering, or interfering with backend services;
- selling, buying, trading, gifting, or transferring accounts, virtual currency, items, services, or progression outside approved Game or Steam systems;
- harassment, threats, hate speech, impersonation, unlawful content, disruptive behavior, or misuse of support, reporting, or community features;
- using the Game in a way that violates applicable law, Steam rules, third-party rights, or this Agreement.
8. Enforcement, restrictions, and appeals
If the Operator reasonably believes that you violated this Agreement, Steam rules, platform rules, applicable law, or service integrity requirements, the Operator may take proportionate action. This may include warnings, removal of illegitimate benefits, adjustment of balances, leaderboard removal, account or character restrictions, suspension of online features, permanent bans from online features, purchase restrictions, support review, or other moderation measures.
Enforcement decisions may consider severity, repeat behavior, evidence, exploit impact, payment status, risk to other players, and service integrity. Some security or abuse-prevention details may not be disclosed if disclosure would compromise detection methods, investigations, or the security of the Game. You may contact contact@frapstery.de if you believe an enforcement action was made in error.
If a refund, chargeback, payment reversal, fraud finding, or purchase cancellation occurs, related Digital Content, virtual currency, inventory items, or entitlements may be revoked or adjusted. This does not affect rights you may have under mandatory consumer law.
9. Feedback, support, and user submissions
If you submit feedback, bug reports, ideas, suggestions, balance comments, support messages, screenshots, logs, or other materials to the Operator, you grant the Operator a worldwide, royalty-free license to use, reproduce, modify, analyze, publish, and otherwise process that material solely as reasonably necessary for operating, improving, marketing, supporting, and developing the Game, without compensation to you. This license is limited to those purposes and does not transfer ownership of your materials to the Operator. This does not transfer ownership of personal data and does not limit your privacy rights under the Privacy Notice.
The Game is not intended to be a general user-generated content hosting platform unless the Operator expressly adds such features. If chat, public profiles, user-generated content, modding, trading, forums, or similar features are added later, additional rules may apply. You must not submit content that is unlawful, infringing, harmful, abusive, malicious, deceptive, or otherwise violates this Agreement or third-party rights.
10. Health and safety
The Game may contain flashing lights, fast movement, screen shake, bright effects, repeated inputs, or intense action. Stop playing and seek medical advice if you experience dizziness, seizures, loss of awareness, eye strain, nausea, repetitive strain pain, or other discomfort. Use appropriate breaks and settings. Players who are sensitive to flashing lights or visual patterns should use caution.
11. Third-party services and external rules
The Game may depend on third-party services, software, SDKs, platforms, hosting providers, payment systems, analytics, crash reporting, or infrastructure. These third parties may have their own terms and privacy notices. The Operator is not responsible for third-party services that are outside the Operator's control, including Steam outages, Steam account restrictions, Steam payment decisions, Steam Cloud conflicts, third-party hosting outages, or internet service provider issues.
12. Termination
You may stop using the Game at any time by uninstalling it. The Operator may terminate or suspend your license or access to online features if you materially breach this Agreement, if required by law or platform rules, or if necessary to protect the Game, other users, the Operator, Steam integration, payment systems, or backend services.
Upon termination, you must stop using the Game and any affected online features. Sections that by their nature should survive termination, including ownership, license restrictions, virtual currency rules, enforcement, liability, governing law, and privacy-related provisions, will continue to apply. Termination does not automatically entitle you to a refund. Refund rights are handled under Steam rules and mandatory law.
13. Warranty and mandatory consumer rights
Mandatory consumer rights, including statutory rights for digital content and digital services, remain unaffected. Nothing in this Agreement limits rights that cannot legally be limited or excluded under the laws of your country of residence.
Subject to those mandatory rights, the Game is provided in its current state and may contain bugs, interruptions, balancing changes, compatibility issues, or unfinished features, especially during Early Access. The Operator does not guarantee that the Game will be error-free, uninterrupted, compatible with every hardware or software setup, or that specific content, features, prices, events, rewards, or online services will remain available permanently.
14. Liability
Nothing in this Agreement excludes or limits liability for intent, gross negligence, injury to life, body, or health, fraud, guarantees, product liability, or any other liability that cannot legally be excluded or limited.
Where permitted by law, the Operator is not liable for damage caused by improper use, manipulation, cheats, third-party software, unsupported modifications, player-side file deletion, account sharing, lost credentials, platform outages, internet failures, force majeure, or events outside the Operator's reasonable control.
For slight negligence, and where such limitation is permitted by applicable law, the Operator is liable only for breach of material contractual obligations whose fulfillment is necessary for proper performance of this Agreement and on which you may reasonably rely. In such cases, liability is limited to typical, foreseeable damage. These limitations also apply to the Operator's legal representatives, employees, contractors, and agents.
15. Changes to this Agreement
The Operator may update this Agreement where reasonably necessary, for example due to changes in the Game, Steam integration, legal requirements, business operations, security, backend services, or virtual economy systems. Material changes will be communicated in a reasonable manner, such as through the Game, Steam, the website, or a legal notice screen. For material changes that affect your rights or obligations, the Operator will provide reasonable notice in advance where practical. Where required by applicable law, you will be asked to provide explicit consent before the updated Agreement applies to you. Continued use of the Game after the effective date of an updated Agreement means that you accept the updated Agreement only where this form of acceptance is legally permitted.
16. Governing law and dispute resolution
This Agreement is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection laws in your country of residence provide otherwise. If you are a consumer, this choice of law does not deprive you of mandatory protections granted by the laws of your habitual residence, including the right to bring proceedings before the courts of your country of residence.
Courts and venues are determined by applicable law. If you are not a consumer and are a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction, where legally permitted, is the Operator's registered seat.
The Operator is not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board, unless legally required.
17. Final provisions
If any provision of this Agreement is invalid, unlawful, or unenforceable, the remaining provisions remain effective. The invalid provision will be replaced by the applicable statutory rule or, where permitted, by an enforceable provision that comes closest to the original economic and legal purpose.
If this Agreement is made available in multiple languages, the English version controls to the extent permitted by law, unless mandatory law requires otherwise.

- harassment, threats, hate speech, impersonation, unlawful content, disruptive behavior, or misuse of support, reporting, or community features;
- using the Game in a way that violates applicable law, Steam rules, third-party rights, or this Agreement.

14. Liability
Nothing in this Agreement excludes or limits liability for intent, gross negligence, injury to life, body, or health, fraud, guarantees, product liability, or any other liability that cannot legally be excluded or limited.
Where permitted by law, the Operator is not liable for damage caused by improper use, manipulation, cheats, third-party software, unsupported modifications, player-side file deletion, account sharing, lost credentials, platform outages, internet failures, force majeure, or events outside the Operator's reasonable control.
For slight negligence, and where such limitation is permitted by applicable law, the Operator is liable only for breach of material contractual obligations whose fulfillment is necessary for proper performance of this Agreement and on which you may reasonably rely. In such cases, liability is limited to typical, foreseeable damage. These limitations also apply to the Operator's legal representatives, employees, contractors, and agents.
15. Changes to this Agreement
The Operator may update this Agreement where reasonably necessary, for example due to changes in the Game, Steam integration, legal requirements, business operations, security, backend services, or virtual economy systems. Material changes will be communicated in a reasonable manner, such as through the Game, Steam, the website, or a legal notice screen. For material changes that affect your rights or obligations, the Operator will provide reasonable notice in advance where practical. Where required by applicable law, you will be asked to provide explicit consent before the updated Agreement applies to you. Continued use of the Game after the effective date of an updated Agreement means that you accept the updated Agreement only where this form of acceptance is legally permitted.
16. Governing law and dispute resolution
This Agreement is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection laws in your country of residence provide otherwise. If you are a consumer, this choice of law does not deprive you of mandatory protections granted by the laws of your habitual residence, including the right to bring proceedings before the courts of your country of residence.
Courts and venues are determined by applicable law. If you are not a consumer and are a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction, where legally permitted, is the Operator's registered seat.
The Operator is not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board, unless legally required.
17. Final provisions
If any provision of this Agreement is invalid, unlawful, or unenforceable, the remaining provisions remain effective. The invalid provision will be replaced by the applicable statutory rule or, where permitted, by an enforceable provision that comes closest to the original economic and legal purpose.
If this Agreement is made available in multiple languages, the English version controls to the extent permitted by law, unless mandatory law requires otherwise.
