End User License Agreement

This End User License Agreement ("Agreement") sets out the terms under which Pancake Studios ("we", "us", "the Publisher") licenses the game Sensory Overload and its related software, updates, and content (together, the "Game") to you ("you", "the User"). Publisher details are at the end of this Agreement.
By clicking "I Agree" on the in-game acceptance screen, or by otherwise installing, launching, or using the Game, you agree to be bound by this Agreement. If you do not agree, do not install or use the Game.
This Agreement does not affect your mandatory rights as a consumer under the laws of Slovenia or the European Union. Where any clause of this Agreement conflicts with those mandatory rights, the mandatory rights prevail.

1. Licence Grant
Pancake Studios grants you a personal, non-exclusive, non-transferable, revocable, and limited licence to install and play the Game for your own private, non-commercial use, on devices you own or control, in accordance with the terms of the platform through which you obtained the Game (e.g. Steam).
All rights not expressly granted to you under this Agreement are reserved by us.
2. Purchase, Refunds, and Distribution
The Game is distributed through digital storefronts (e.g. Steam). All purchases, payments, taxes, and refunds are handled by the storefront under that storefront's own terms.
Refund requests should be made through the storefront where you purchased the Game. Your statutory right of withdrawal under EU consumer law (Directive 2011/83/EU) and any equivalent Slovenian law apply, subject to the exceptions for digital content that has begun to be supplied with your prior consent.
3. Restrictions
You may not, and may not allow any third party to:
(a) copy, modify, translate, or create derivative works of the Game, except as expressly permitted by this Agreement or by applicable law;
(b) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Game, except to the extent such activity is expressly permitted by applicable law (including Articles 5 and 6 of Directive 2009/24/EC on the legal protection of computer programs);
(c) rent, lease, sublicense, sell, or commercially exploit the Game or any part of it;
(d) remove, alter, or obscure any copyright, trademark, or other proprietary notice;
(e) use the Game to develop a competing product;
(f) circumvent, disable, or interfere with any security, anti-tamper, or licensing features.
4. Fair Play and Leaderboards
The Game includes online leaderboards. To keep them fair, you agree not to:
(a) use cheats, trainers, memory editors, scripts, bots, macros, automation, or any third-party software that modifies how the Game runs or how scores are produced;
(b) tamper with game files, save data, or network traffic in order to influence a leaderboard submission;
(c) submit scores you know to be the result of (a) or (b).
The Game performs local validation of leaderboard submissions. Submissions that fail validation are rejected client-side and never reach the leaderboard. We may also remove entries from leaderboards if we have reasonable grounds to believe they were obtained in breach of this section.
5. User-Generated Content (Level Editor)
The Game includes a level editor that lets you create custom levels and other content ("User Content").
You retain ownership of the User Content you create. By using the editor and any sharing features the Game provides, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute your User Content for the purpose of operating and promoting the Game.
You are responsible for your User Content and confirm that it does not infringe any third party's rights and does not contain unlawful, defamatory, or otherwise objectionable material. We may remove User Content that we reasonably believe breaches this Agreement or applicable law.
6. Updates
We may release updates, patches, and additional content for the Game. Some updates may be required in order to continue playing. We are not obliged to provide updates or to maintain the Game indefinitely.
7. Privacy and Data
The Game collects limited data needed to operate features such as crash reporting, anonymous gameplay analytics, and (when you choose to opt in) detailed analytics. The Game also lets you submit bug reports to us directly.

You can change your analytics consent at any time in Settings → Gameplay → Privacy.
8. Photosensitive Seizure Warning
Sensory Overload contains rapidly changing visuals, flashing lights, high-contrast patterns, and strobing effects.
A very small percentage of people may experience epileptic seizures or blackouts when exposed to certain visual patterns or flashing lights, even with no prior history of epilepsy. If you, or anyone in your family, has an epileptic condition or has experienced seizures of any kind, consult your doctor before playing.
Stop playing immediately and consult a doctor if you experience any of the following symptoms while playing: dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, involuntary movements, or convulsions.
To reduce risk: play in a well-lit room, sit at a reasonable distance from the screen, take regular breaks, and do not play when tired.
9. Intellectual Property
The Game, including all code, art, music, sound, text, characters, design, and trademarks, is owned by us or our licensors and is protected by Slovenian, EU, and international copyright and other intellectual property laws.
Except for the limited licence granted in Section 1 and your retained ownership of User Content under Section 5, no rights to the Game are transferred to you.
10. Disclaimer and Limitation of Liability
To the maximum extent permitted by applicable law, and subject to the consumer rights protections referred to below:
(a) the Game is provided "as is" and "as available", without warranty of any kind;
(b) we do not warrant that the Game will be uninterrupted, error-free, or compatible with all hardware or software configurations;
(c) we are not liable for any indirect, incidental, special, or consequential damages, or for loss of data, profits, or save progress.
Nothing in this Agreement limits or excludes our liability for:
(i) death or personal injury caused by our negligence;
(ii) fraud or fraudulent misrepresentation;
(iii) any liability that cannot be limited or excluded under Slovenian or EU consumer protection law.
If you are a consumer resident in the EU, your statutory rights under the Consumer Protection Act and Directive (EU) 2019/770 on contracts for the supply of digital content and digital services remain unaffected.
11. Termination
This Agreement remains in effect until terminated. You may terminate it at any time by uninstalling the Game and ceasing to use it.
We may terminate or suspend your licence under this Agreement if you materially breach it, in particular Sections 3 (Restrictions) or 4 (Fair Play). On termination, the licence granted in Section 1 ends and you must stop using the Game. Sections 9, 10, 12, and 13 survive termination.
12. Changes to This Agreement
We may update this Agreement from time to time, for example to reflect changes in the Game or in applicable law. The current version is made available with the Game and on the Steam store page. When the Agreement changes materially you will be asked to accept the updated version on the next launch of the Game. Continued use of the Game after acceptance means you accept the updated Agreement.
13. Governing Law and Jurisdiction
This Agreement is governed by the laws of the Republic of Slovenia, excluding its conflict-of-laws rules and excluding the UN Convention on Contracts for the International Sale of Goods.
The courts of Slovenia have non-exclusive jurisdiction over any dispute arising out of or in connection with this Agreement. If you are a consumer resident in another EU Member State, you may also bring proceedings in the courts of that Member State, and you retain the protection of the mandatory consumer-law provisions of your country of residence.
Consumers in the EU may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
