This End User License Agreement ("Agreement") is between SDShepard ("we," "us," or "the developer") and the individual or entity ("you") who purchases or uses PhonePlay ("the Software"). By installing, downloading, or using the Software, you agree to this Agreement.
1. License grant. We grant you a non-exclusive, non-transferable, revocable license to install and use one copy of the Software on devices you own or control, for personal or commercial use. You may not redistribute, resell, sublicense, or commercially exploit the Software itself.
2. Bundled open source software. The Software includes Scrcpy, an open source project distributed under the Apache License 2.0. Scrcpy's copyright remains with its original authors and contributors. The Software's bundling of Scrcpy is permitted under that license, and the Scrcpy license text is included in the installation.
3. User responsibilities. You are responsible for your own use of the Software, including:
4. Provided as-is. The Software is provided "AS IS" without warranty of any kind, express or implied. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by law.
5. Limitation of liability. To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Software, including loss of data, loss of profit, or device damage. Our total liability for any claim relating to the Software is limited to the amount you paid for the Software.
6. Updates. We may release updates to the Software. Updates are provided under the same terms as this Agreement unless an updated agreement is presented to you.
7. Termination. This Agreement is effective until terminated. You may terminate it by uninstalling the Software. We may terminate it if you materially breach its terms. Sections 4, 5, and 8 survive termination.
8. Governing law. This Agreement is governed by the laws of the State of Connecticut, United States, without regard to conflicts of law principles. Any dispute arising from this Agreement is subject to the exclusive jurisdiction of the state and federal courts located in Connecticut.
