END USER LICENSE AGREEMENT ("EULA")

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "You") and Sailboat Games ("Developer," "We," "Us," or "Our") regarding your use of the software application known as StarFighter ("Application" or "Game").
By installing, copying, or otherwise using the Application, You agree to be bound by the terms and conditions of this EULA. If You do not agree to these terms, do not install or use the Application.
1. LICENSE GRANT
Subject to the terms of this EULA, Sailboat Games grants You a limited, non-exclusive, non-transferable, and revocable license to use the Application on a single device or account, as permitted by Steam’s terms of service.
2. RESTRICTIONS
You shall not, under any circumstances:
- Resell, transmit, host, or otherwise commercially exploit the Application or any part of it.
- Modify, decrypt, reverse compile, or reverse engineer the Application or any of its files.
- Use the Application in any manner that violates applicable laws or regulations.
- Create or distribute derivative works that incorporate or modify the Application’s code, assets, or proprietary content, except as explicitly permitted below.
You may create derivative works such as videos, streams, or other content that displays or showcases the Application, provided such content does not infringe on the intellectual property rights of Sailboat Games and complies with applicable laws.
3. INTELLECTUAL PROPERTY
The Application, including all its files, code, content, and related materials, is the exclusive intellectual property of Sailboat Games. You acknowledge that no ownership or intellectual property rights are transferred to You under this EULA.
4. UPDATES
Sailboat Games reserves the right to provide updates, patches, or new versions of the Application at its sole discretion. You agree to accept such updates as part of Your use of the Application. However, Sailboat Games is under no obligation to provide updates or support.
5. USER DATA AND PRIVACY
Sailboat Games does not operate any servers for data storage or collection. All save files and game data are stored locally on your device.
The Application uses Steam’s built-in statistics and achievement system, which stores defined progress and achievements on Steam’s servers. Networking is handled exclusively through Steam’s Peer-to-peer infrastructure, and Sailboat Games does not collect, access, or store any user data beyond what is provided by Steam’s services.
6. USER CONTENT
You may create and share additional content related to the Application exclusively through Steam Workshop, in accordance with Steam’s terms of service. You are permitted to create derivative works such as videos, streams, or other content that displays or showcases the Application, provided such content does not infringe on the intellectual property rights of Sailboat Games and complies with applicable laws.
7. FEEDBACK AND SUGGESTIONS
You acknowledge that Sailboat Games may use, modify, or implement any feedback, suggestions, or ideas You provide regarding the Application without obligation or compensation to You.
8. DISCLAIMER OF WARRANTY
THE APPLICATION IS PROVIDED TO YOU "AS IS" AND WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAILBOAT GAMES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY
- WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE
- WARRANTIES OF NON-INFRINGEMENT
- WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE
Sailboat Games does not warrant that the Application will meet Your requirements, operate without interruption, or be free from errors or defects.
9. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAILBOAT GAMES, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- YOUR USE OR INABILITY TO USE THE APPLICATION
- ANY DEFECTS OR ERRORS IN THE APPLICATION
- ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR YOUR DATA
- ANY OTHER MATTER RELATING TO THE APPLICATION
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to You.
10. TERMINATION
This EULA is effective until terminated. Your rights under this EULA will terminate automatically if You fail to comply with any of its terms. Upon termination, You must cease all use of the Application and destroy all copies in Your possession.
11. GOVERNING LAW
This EULA shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles.
12. ENTIRE AGREEMENT
This EULA constitutes the entire agreement between You and Sailboat Games concerning the Application and supersedes all prior agreements, understandings, or representations.
