END USER LICENSE AGREEMENT FOR Leg Day
This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “you”) and Jakob Delzer (“Licensor”) regarding the video game Leg Day (the “Product”).
1. License Grant: Licensor grants you a personal, non-exclusive, non-transferable, revocable license to use the Product for your personal, non-commercial entertainment on compatible devices.
2. Third-Party Software and Disclaimers (Epic Games / Unreal® Engine):The Product includes the Unreal® Engine code and other Licensed Technology licensed to Licensor by Epic Games, Inc. (“Epic”).
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE PRODUCT IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PRODUCT AND THE LICENSED TECHNOLOGY ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. LICENSOR AND EPIC EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR OR EPIC BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE PRODUCT, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF LICENSOR OR EPIC HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
3. No Contractual Relationship with Epic: You acknowledge and agree that this Agreement is solely between you and Licensor, not Epic Games, Inc. This Agreement does not grant you any rights, license, or relationship directly with Epic.
