END USER LICENSE AGREEMENT
This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and the game developer, located in South Perth, Western Australia ("Licensor") for the software product Escape The Complex which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("Software Product").
By installing, copying, or otherwise using the Software Product, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software Product.
1. GRANT OF LICENSE
Subject to the terms and conditions of this Agreement, the Licensor hereby grants you a personal use, single-user, non-exclusive, non-transferable license to use the Software Product.
2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
Reverse Engineering: You may not reverse engineer, decompile, or disassemble the Software Product, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
Modification: You may not modify, adapt, or create derivative works based upon the Software Product or any part thereof.
Distribution: You may not distribute copies of the Software Product to third parties.
Sublicense: You may not sublicense, rent, lease, or lend the Software Product.
Separation of Components: The Software Product is licensed as a single product. Its component parts may not be separated for use on more than one computer.
Compliance with Laws: You must comply with all applicable laws regarding use of the Software Product.
3. COPYRIGHT
All title, including but not limited to copyrights, in and to the Software Product and any copies thereof are owned by the Licensor. All title and intellectual property rights in and to the content which may be accessed through use of the Software Product is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties.
4. NO WARRANTIES
THE SOFTWARE PRODUCT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY AGAINST INFRINGEMENT, WITH REGARD TO THE SOFTWARE PRODUCT.
THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE PRODUCT IS WITH YOU. SHOULD THE SOFTWARE PRODUCT PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION.
5. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT, EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN ANY CASE, THE LICENSOR'S ENTIRE LIABILITY UNDER ANY PROVISION OF THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE PRODUCT.
6. UPDATES
The Licensor may provide updates or patches that must be installed for continued use of the Software Product. The Licensor is under no obligation to provide updates or patches. The product is provided "AS IS".
7. TERMINATION
Without prejudice to any other rights, the Licensor may terminate this Agreement if you fail to comply with the terms and conditions of this Agreement. In such event, you must destroy all copies of the Software Product and all of its component parts.
Upon termination, all rights granted to you under this Agreement shall terminate and revert to the Licensor.
8. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of Western Australia, Australia, without giving effect to any principles of conflicts of law. You agree that any legal action or proceeding between you and the Licensor shall be brought exclusively in the courts located in Western Australia, Australia.
