END USER LICENSE AGREEMENT
Until Dusk
Arcane Focus Games
Effective Date: April 22, 2026
This End User License Agreement (“Agreement”) is a legal agreement between you (“you” or “User”) and Arcane Focus Games (“Arcane Focus Games,” “we,” “us,” or “our”) governing your access to and use of the video game Until Dusk, including any patches, updates, downloadable content, manuals, and related materials we provide with the game (collectively, the “Game”).
By installing, accessing, copying, or using the Game, you agree to be bound by this Agreement. If you do not agree to this Agreement, do not install, access, or use the Game.
1. License Grant
Subject to your compliance with this Agreement, Arcane Focus Games grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one copy of the Game for your personal, non-commercial entertainment purposes on compatible devices that you own or control.
This license grants you only the right to use the Game as expressly permitted in this Agreement. No ownership rights are transferred to you.
2. Ownership
The Game is licensed, not sold. The Game and all related intellectual property rights, including but not limited to all software, code, artwork, characters, animations, sound effects, music, dialogue, logos, designs, text, and audiovisual content, are owned by Arcane Focus Games and/or its licensors and are protected by applicable intellectual property laws.
Except for the limited license expressly granted in this Agreement, Arcane Focus Games reserves all rights, title, and interest in and to the Game.
3. Restrictions
You may not, except as expressly permitted by applicable law:
copy, reproduce, distribute, sell, lease, rent, license, sublicense, or otherwise transfer the Game;
modify, adapt, translate, or create derivative works based on the Game;
reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from the Game;
remove, alter, or obscure any copyright, trademark, or proprietary notices;
use the Game for any commercial purpose without our prior written consent;
use cheats, bots, automation software, hacks, exploits, or unauthorized third-party tools to alter gameplay or access the Game in an unauthorized manner;
circumvent or disable any security, technological protection, or digital rights management features of the Game;
use the Game in any way that violates applicable law or regulation.
4. No Online Features or User-Generated Content
Until Dusk is a single-player game and does not include multiplayer services, online community features, or user-generated content functionality as part of this Agreement.
Any third-party platform features made available by a storefront, launcher, or operating environment are governed by that third party’s terms, not this Agreement.
5. Updates and Patches
We may provide patches, updates, bug fixes, balancing changes, or other modifications for the Game at our discretion. These updates may be required for continued proper operation of the Game.
Any updates or patches provided by Arcane Focus Games are considered part of the Game and are governed by this Agreement unless accompanied by separate terms.
We are not obligated to provide any specific updates, content, support, maintenance, or continued availability of the Game.
6. Third-Party Platforms
If you obtain or launch the Game through a third-party platform or storefront, your use of that platform may also be subject to separate terms and conditions imposed by that third party.
This Agreement governs the Game itself as between you and Arcane Focus Games. It does not replace any separate agreement you may have with a storefront, operating system provider, hardware manufacturer, or digital distributor.
7. Personal Use Only
The Game is intended solely for personal, private, non-commercial use. You may not exploit the Game or any of its parts for commercial purposes without our prior written permission.
8. Term and Termination
This Agreement begins when you first install, access, or use the Game and continues until terminated.
This Agreement will terminate automatically if you fail to comply with any of its terms. We may also terminate this Agreement if required by law or if continued licensing is no longer commercially or legally feasible.
Upon termination:
your license to use the Game immediately ends;
you must stop using the Game; and
you must uninstall and destroy all copies of the Game in your possession or control, except to the extent applicable law prohibits such a requirement.
Sections of this Agreement that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, governing law, and dispute-related provisions.
9. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND.
ARCANE FOCUS GAMES DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, OR THAT THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE.
WE DO NOT WARRANT THAT THE GAME WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, BE COMPATIBLE WITH ALL SYSTEMS, OR THAT DEFECTS WILL BE CORRECTED.
SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARCANE FOCUS GAMES AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, COMPUTER FAILURE, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE GAME OR THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARCANE FOCUS GAMES’ TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE GAME OR THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE GAME.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
11. Indemnification
You agree, to the maximum extent permitted by law, to defend, indemnify, and hold harmless Arcane Focus Games and its affiliates, licensors, and representatives from and against claims, liabilities, damages, judgments, awards, losses, costs, and expenses arising out of or related to:
your violation of this Agreement;
your misuse of the Game; or
your violation of any applicable law or the rights of a third party.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Missouri, USA, without regard to its conflict of law principles.
Subject to applicable law, any dispute, claim, or controversy arising out of or relating to this Agreement or the Game shall be brought exclusively in the state or federal courts located in Missouri, and you consent to the personal jurisdiction and venue of those courts.
13. Severability
If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.
14. No Waiver
Our failure to enforce any provision of this Agreement shall not be considered a waiver of that provision or of any other provision.
15. Entire Agreement
This Agreement constitutes the entire agreement between you and Arcane Focus Games regarding the Game and supersedes all prior or contemporaneous understandings, agreements, communications, or proposals relating to the Game.
16. Changes to This Agreement
Arcane Focus Games may update or modify this Agreement from time to time. If we do, we will provide the updated version with the Game or through an appropriate distribution channel. Your continued use of the Game after an updated Agreement becomes effective constitutes your acceptance of the revised Agreement.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARCANE FOCUS GAMES’ TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE GAME OR THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE GAME.

your violation of this Agreement;
