This End User License Agreement ("EULA") is a legal agreement between you ("you" or "User") and the developer and publisher of BIG PARTY (Steam App ID 4633150) ("we", "us", or "our"). This EULA governs your access to and use of BIG PARTY, including its online multiplayer features, software, content, updates, servers, communications, and related services (the "Service").
Two clients are distributed under Steam App ID 4633150, and this EULA covers both:
• "BIG PARTY", the original client, whose online multiplayer, lobbies, and proximity voice chat are provided through a third-party online services provider; and
• "BIG PARTY 3D", the 3D client, whose online multiplayer is peer-to-peer, which has push-to-talk voice chat in online and LAN matches, and which has no player-written text chat.
Where a term below applies to only one of them, it says so. Where a feature is described as one the Service "may" include, it exists in some clients and not others; the Privacy Policy for the client you are running describes what that client actually does.
The developer/publisher is the entity identified as such on the BIG PARTY Steam store page or other official distribution page. For player support, privacy requests, legal notices, and safety reports, contact us through the method listed in Section 24.
By installing, accessing, launching, or using the Service, you agree to be bound by this EULA. If you do not agree, do not install, access, launch, or use the Service. This EULA supplements, and does not replace, the Steam Subscriber Agreement and the terms of Valve Corporation; and, where online multiplayer is used, the terms of the third-party online services provider that carries it; and any other applicable platform terms. If there is a conflict, those platform terms control to the extent required by the platform or applicable law.
Children. The Service is not directed to, and is not intended for, children under the age of 13. If you are under 13, do not use the Service. If you are a minor in your jurisdiction, you may use the Service only with the consent and supervision of your parent or legal guardian, who agrees to be bound by this EULA on your behalf. Parents and guardians should note that online multiplayer in both clients is peer-to-peer, which can make a player's IP address available to the other players in a match; the Privacy Policy explains this.
1. Scope
This EULA applies to all users of the Service. Any notices, guidelines, safety rules, community rules, or feature-specific rules that we post in the Service, on official store pages, or through official support channels also form part of this EULA. We may change, add, suspend, restrict, or terminate content, features, names, methods of provision, supported environments, online functions, or terms of the Service as necessary.
2. License Grant
Subject to your compliance with this EULA, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use one copy of the Service for your own private, non-commercial entertainment through your authorized Steam account and supported platform accounts, on devices you own or control. The Service is licensed, not sold.
3. Ownership
We and our licensors retain all right, title, and interest in and to the Service, including all copyrights, trademarks, characters, names, artwork, audio, code, design, gameplay systems, UI, logos, and other intellectual property. No rights are granted to you except as expressly stated in this EULA.
4. Your Environment
The Service is an online multiplayer game. You are responsible, at your own cost, for the devices, internet connection, software, platform accounts, and account security needed to use it. We do not guarantee that the Service will operate in all environments, be continuously available, be compatible with all hardware or software, or be free of bugs, errors, interruptions, exploits, or data loss.
5. Online Multiplayer Conduct
You may share online spaces, matches, rooms, lobbies, servers, chat, voice communication, profiles, usernames, and other online features with other users. You must act with courtesy and help maintain a fair, safe, and playable environment.
The following are prohibited:
abuse, defamation, insults, threats, harassment, stalking, intimidation, discriminatory remarks, sexual harassment, or excessive provocation toward other users, us, moderators, platform staff, or third parties;
doxxing or attempting to identify, locate, publish, threaten to publish, solicit, buy, sell, or misuse non-public personal information about any user, developer, moderator, contractor, representative, or third party;
sharing or requesting real names, home addresses, private email addresses, phone numbers, IP addresses, precise location, family information, employer or school information, private social media accounts, government identifiers, financial information, or similar information;
capturing, logging, publishing, or otherwise misusing an IP address or other network address obtained through a peer-to-peer match, or using one to locate, harass, threaten, or attack another player, or to disrupt their connection;
obstructing gameplay, intentional inactivity, sabotage, disruptive behavior, griefing, trolling, match manipulation, or conduct intended to ruin the experience of others;
use of cheats, bots, macros, automation, modified data, exploits, unauthorized third-party programs, unauthorized overlays, or tools that interfere with the Service;
exploiting bugs, glitches, vulnerabilities, specification issues, network behavior, matchmaking behavior, ranking systems, or server behavior to gain an unfair advantage or harm the Service;
acts that negatively affect servers, communications, matchmaking, rankings, records, rewards, accounts, security, or game balance;
impersonating other users, us, moderators, developers, platform operators, law enforcement, or any third party;
fraud, phishing, scams, account theft, social engineering, extortion, blackmail, swatting threats, or threats of real-world harm;
advertising, spam, solicitation, commercial activity, political campaigning, religious campaigning, dating, or recruitment unrelated to ordinary gameplay;
interfering with the normal use, operation, security, or enjoyment of the Service by us or other users; or
any other act we reasonably deem inappropriate, unsafe, abusive, unfair, unlawful, or harmful to the Service or community.
To maintain fairness, safety, and security, we may review or process play logs, reports, communications, in-game behavior, matchmaking history, usernames, profiles, account identifiers, technical logs, moderation records, and related information as necessary and as described in our Privacy Policy. What is actually available to us for review differs between clients, and the Privacy Policy for the client you are running governs. In BIG PARTY 3D in particular, voice chat is not recorded by the game and does not reach us, so nothing said in a match is available to us to review, at the time or afterwards.
6. Chat and User Communications
Depending on the client you are running, the Service may include text chat, voice chat, usernames, profiles, room names, lobby names, emotes, comments, reports, and similar features. You use these features at your own responsibility.
In BIG PARTY, proximity voice chat is provided through the same third-party online services provider and is enabled in public and private lobbies; it can be turned off, and its microphone, playback device, and volume configured, in the game's settings.
BIG PARTY 3D has push-to-talk voice chat in online and LAN matches, and no player-written text chat. Your microphone is requested the first time you hold the talk key and is not used before that; voice chat can be disabled, and its microphone and levels configured, in the game's settings, and who can hear you (everyone, only players near you, or only your team) is chosen by the host for the match. You may also mute any individual player, from the lobby or from the pause screen during a round; that mute applies on your own device, takes effect at once, and does not require the host's cooperation. Voice travels between the players' devices and is not recorded or stored. In that client the things you transmit to other players are your voice while you hold the talk key, your display name, your chosen character, and your character's actions in a round.
You must not transmit content that is abusive, defamatory, threatening, discriminatory, harassing, obscene, sexual, exploitative, excessively violent, hateful, deceptive, illegal, or otherwise offensive; personal or contact information of any person; advertising, solicitation, scams, phishing, or spam; content that encourages crime, self-harm, dangerous acts, cheating, unauthorized access, or attacks; or content intended to impersonate, harass, identify, locate, shame, threaten, or harm any person.
You should not share your real name, address, phone number, private email address, precise location, school, workplace, private social media accounts, financial information, passwords, or other sensitive information in the Service. We cannot guarantee that other users will not copy, record, stream, screenshot, disclose, or misuse content you share.
Where available, users may mute, block, report, or leave sessions involving unwanted communication. These tools are provided for safety and moderation but do not guarantee prevention of all harmful conduct, and they are not available in every client.
We do not pre-screen all communications. Except in cases of our willful misconduct, gross negligence, or liability that cannot be excluded by law, we are not liable for disputes, damage, or harm arising between users.
7. User-Generated Content
"User-Generated Content" means usernames, display names, profiles, comments, room names, lobby names, messages, reports, and any other content you create, enter, display, submit, or transmit through the Service.
As a general rule, rights in your User-Generated Content belong to you or the rightful rights holder. You grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, transmit, modify for formatting or moderation, remove, restrict, and use such content to the extent necessary to provide, operate, secure, moderate, improve, promote, and support the Service.
You represent that your User-Generated Content does not infringe any third party's rights and does not violate this EULA or applicable law. We may, without prior notice, remove, hide, restrict, preserve, review, or take other action regarding content or accounts that we believe violate this EULA, threaten safety or security, create legal risk, or are the subject of a third-party complaint. We are not obligated to monitor all content.
8. Screenshots, Videos, and Streaming
For personal, non-commercial purposes, you may capture and share screenshots, gameplay videos, streams, reviews, and fan content of the Service, subject to this EULA and the terms of the platforms you use.
You may not share content that violates this EULA, exposes private personal information, harasses or targets another person, promotes cheats or exploits, teaches attacks on the Service, falsely implies official endorsement, or commercially exploits the Service or its materials without our permission.
If you stream, record, screenshot, or share gameplay, you are responsible for complying with applicable laws and platform rules, including privacy, publicity, copyright, and harassment rules. Nothing in this EULA authorizes infringement of third-party rights.
9. Bugs, Glitches, and Security Issues
You may report, discuss, and share general information about bugs, glitches, and specification issues. You may not exploit them for unfair advantage, abuse them to disadvantage others, harm servers, harm balance, manipulate records, compromise security, create or distribute cheats or tools, or share specific methods for server attacks, unauthorized access, reverse engineering, account compromise, or bypassing security.
If you discover a security vulnerability, please report it responsibly through the contact method in Section 24 and do not publicly disclose details that could enable harm until we have had a reasonable opportunity to address it.
10. Prohibited Conduct
In addition to the above, you must not:
violate any law or the rights, privacy, honor, reputation, safety, or security of us, other users, or third parties;
perform unauthorized access, communication interference, packet manipulation, server attacks, scraping, data mining, reverse engineering, analysis, modification, tampering, or circumvention except where expressly permitted by applicable law;
create, use, distribute, advertise, sell, or assist with cheats, bots, automation, modified data, unauthorized tools, exploits, or instructions for abuse;
illegally obtain, modify, transfer, sell, buy, trade, or monetize game data, accounts, rankings, achievements, rewards, items, or in-game currency;
commit fraud, phishing, impersonation, social engineering, harassment, extortion, threats, doxxing, or real-world intimidation;
use the Service for commercial purposes without our written permission;
use the Service to collect information about users, developers, moderators, or third parties outside ordinary gameplay; or
use the Service in a manner not intended by us.
11. Measures for Violations
If we determine that you have violated or may violate this EULA, receive a third-party complaint, detect unsafe conduct, detect security risk, or otherwise deem action necessary, we may, without prior notice:
issue a warning;
remove, hide, restrict, or preserve content;
restrict chat, voice, online play, matchmaking, reporting, profile, or other features;
correct, reset, delete, or restrict rankings, records, rewards, items, game data, or progression;
temporarily suspend or permanently terminate access to the Service;
block or restrict access from specific accounts, devices, networks, regions, or technical environments where appropriate;
provide information to platform operators, service providers, rights holders, or authorities where legally required or where reasonably necessary to protect safety, security, rights, or the Service; or
take other reasonable steps to protect users, us, third parties, platforms, or the Service.
For doxxing, threats, stalking, harassment, swatting threats, extortion, unauthorized access, cheating, security abuse, or other safety-related violations, we may take immediate action and preserve relevant evidence. Except in cases of our willful misconduct, gross negligence, or liability that cannot be excluded by law, we are not liable for damage caused by such measures.
Where a measure is significant and you believe it was applied in error, you may contest it through the contact method in Section 24, and we will review the matter in good faith.
12. Online Services, Servers, and Maintenance
Because the Service relies on online features, all or part of it may become unavailable due to server status, connectivity, maintenance, failures, updates, platform changes, security incidents, provider issues, or operational decisions. We may suspend, interrupt, restrict, change, or terminate all or part of the Service without prior notice. We do not guarantee continuous availability, matchmaking, uninterrupted communications, data preservation, compatibility, or continued server operation.
What your purchase includes. The price of the Service buys the game as software you run yourself: solo play, couch play on one device, and — where the client provides it — LAN multiplayer between devices on your own network. Those are the parts of the Service that run entirely on hardware you control and depend on no online service. Online multiplayer — including online lobbies, any public lobby listing, and platform invites into online matches — is an additional online service provided free of charge alongside that purchase, and is not part of it. It depends on third-party services, including the online services provider that carries online matches and the platform through which you obtained the game, and it may be changed, suspended, restricted, or discontinued under this Section 12 and Section 13 at any time, without notice, and without entitling you to a refund, credit, or other compensation, except where applicable law or the refund policy of the store you purchased through provides otherwise. If online multiplayer is unavailable or discontinued, the licensed game — solo, couch, and LAN play — continues to work and remains what your purchase provides.
13. Updates and Changes
We may update, patch, balance, add to, modify, restrict, or remove features of the Service for any reason. Game balance, maps, characters, minigames, content, controls, online specifications, and technical requirements may change, and we do not guarantee that prior content, balance, functionality, or experience will remain unchanged.
14. Save Data and Game Data
Save data, records, rankings, achievements, rewards, items, progression, settings, matchmaking data, and other data may be lost, corrupted, changed, restricted, or reset due to devices, servers, platforms, connectivity, updates, bugs, violations, security issues, operational needs, or other causes. We do not guarantee the completeness, preservation, accuracy, or recoverability of data, and we may correct, delete, reset, or restrict data where there is unauthorized conduct, a violation of this EULA, a bug fix, security issue, legal requirement, or operational necessity.
15. Paid Content
If the Service offers paid content, downloadable content, in-game items, in-game currency, passes, cosmetics, or other purchases, your purchases are subject to the terms and refund policies of the store, platform, and payment provider you use. Except as required by law or platform terms, purchased content cannot be refunded, exchanged, converted to cash, transferred, sold, or redeemed outside the Service. We may change the content, effects, availability, names, balance, or functionality of paid or free content for operational, legal, security, or balance reasons.
16. Privacy
Your use of the Service is subject to our in-game Privacy Policy, which explains how we collect, use, share, retain, and protect information. The Privacy Policy is incorporated into this EULA by reference. Each client presents the Privacy Policy that applies to it, and the two clients do not process the same information; read the one shown in the client you are running.
We do not require users to provide their real name to play the Service. Users are identified in-game primarily through platform identifiers, display names, session identifiers, and gameplay-related data. However, online play, usernames, platform profiles, voice chat where available, screenshots, streams, reports, and user conduct may reveal information about a user. You are responsible for not sharing personal information in the Service.
Online multiplayer is peer-to-peer. Establishing a peer-to-peer connection requires the participating devices to exchange the network addresses at which they can be reached, which can make your IP address available to the other players in a match, and theirs to you. The Privacy Policy explains when this happens and when a relay prevents it. Misusing an address obtained this way is prohibited under Section 5.
We do not sell your personal information. We may process information as necessary to operate, secure, moderate, improve, support, and protect the Service, including to prevent cheating, abuse, harassment, doxxing, unauthorized access, and other harmful conduct.
17. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, COMPATIBLE, OR FREE OF HARMFUL COMPONENTS, OR THAT DATA WILL BE PRESERVED OR RECOVERABLE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
NOTHING IN THIS SECTION AFFECTS ANY STATUTORY WARRANTY OR CONSUMER GUARANTEE THAT CANNOT BE EXCLUDED UNDER THE LAW OF YOUR PLACE OF RESIDENCE.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, GAME PROGRESS, ACCOUNT ACCESS, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE OR THIS EULA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THIS EULA WILL NOT EXCEED THE TOTAL AMOUNT YOU ACTUALLY PAID FOR THE SERVICE.
NOTHING IN THIS EULA LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR OUR WILLFUL MISCONDUCT OR GROSS NEGLIGENCE, OR FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE WHERE SUCH LIMITATION IS NOT PERMITTED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
19. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your breach of this EULA, your misuse of the Service, your User-Generated Content, your violation of law, your violation of third-party rights, your harassment or doxxing of another person, or your unauthorized access, cheating, security abuse, or harmful conduct.
This Section does not apply to the extent the claim arises from our own acts or omissions, and it does not apply where you are a consumer and applicable consumer-protection law prohibits it.
20. Dispute Resolution; Arbitration; Class Action Waiver
Please read this section carefully — it affects how disputes are resolved.
This Section 20 does not apply to you, and Section 21 governs instead, if you are a consumer resident in the European Union, the United Kingdom, or any other jurisdiction whose law does not permit a pre-dispute agreement to binding arbitration or a waiver of collective redress to be enforced against a consumer.
Before filing any claim, you agree to first contact us through the method in Section 24 and attempt to resolve the dispute informally for at least thirty (30) days.
Where this Section applies, any dispute not resolved informally shall be resolved by binding individual arbitration, before a single arbitrator, administered under the rules of a recognized arbitration provider, rather than in court, except that either party may bring an individual claim in small-claims court where permitted. Each party bears its own costs except as the applicable rules or law provide otherwise.
You and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff, claimant, or class member in any class, collective, consolidated, private attorney general, or representative action, to the maximum extent permitted by law. If this waiver is held unenforceable as to a particular claim, that claim shall proceed in court under Section 21 and shall be severed from any arbitration.
You may opt out of this Section 20 by notifying us through the contact method in Section 24 within thirty (30) days of first accepting this EULA. Your notice need only state your Steam account name and that you opt out of arbitration. Opting out does not affect any other part of this EULA. If you opt out, Section 21 governs disputes in court.
This Section does not prevent either party from seeking emergency or injunctive relief for intellectual property misuse, unauthorized access, security abuse, doxxing, harassment, threats, or other conduct that may cause immediate harm.
21. Governing Law
This EULA is governed by applicable law, except where mandatory consumer-protection law of your place of residence gives you rights that cannot be waived.
Nothing in this EULA deprives you of the protection of the mandatory consumer-protection law of your place of residence, or removes your right to bring proceedings in the courts of your place of residence where that law so provides. Either party may seek injunctive relief in any court of competent jurisdiction.
22. Changes to this EULA
We may revise this EULA as necessary. The revised EULA takes effect when posted, presented in the Service, or notified through the Service, store page, or official channel. Your continued use after it takes effect constitutes acceptance. Where a revision is material, the Service will require you to re-accept the updated terms before continuing to play, and we will not apply a material revision retroactively to a dispute that arose before it took effect.
23. General
If any provision of this EULA is held invalid or unenforceable, that provision shall be limited or severed to the minimum extent necessary and the remaining provisions remain in full force and effect. This EULA, together with the Privacy Policy and any incorporated rules, is the entire agreement between you and us regarding the Service and supersedes prior agreements on its subject matter. Our failure to enforce any provision is not a waiver. You may not assign this EULA; we may assign it in connection with a merger, acquisition, sale of assets, restructuring, or transfer of the Service. Headings are for convenience only.
24. Contact
Inquiries, support requests, privacy requests, bug reports, vulnerability reports, safety reports, legal notices, and other communications regarding the Service shall be made through the method designated by us, such as the BIG PARTY Steam Community Hub or the support method shown on our Steam store page.
Notices required by Section 20 (informal dispute resolution and arbitration opt-out) may be sent through any of those methods, and are effective when received.
We are not obligated to respond to all inquiries, and we may determine the content, timing, and method of any response at our discretion, except where a response is required by applicable law.

use of cheats, bots, macros, automation, modified data, exploits, unauthorized third-party programs, unauthorized overlays, or tools that interfere with the Service;
exploiting bugs, glitches, vulnerabilities, specification issues, network behavior, matchmaking behavior, ranking systems, or server behavior to gain an unfair advantage or harm the Service;
acts that negatively affect servers, communications, matchmaking, rankings, records, rewards, accounts, security, or game balance;
impersonating other users, us, moderators, developers, platform operators, law enforcement, or any third party;
fraud, phishing, scams, account theft, social engineering, extortion, blackmail, swatting threats, or threats of real-world harm;
advertising, spam, solicitation, commercial activity, political campaigning, religious campaigning, dating, or recruitment unrelated to ordinary gameplay;
interfering with the normal use, operation, security, or enjoyment of the Service by us or other users; or
any other act we reasonably deem inappropriate, unsafe, abusive, unfair, unlawful, or harmful to the Service or community.
To maintain fairness, safety, and security, we may review or process play logs, reports, communications, in-game behavior, matchmaking history, usernames, profiles, account identifiers, technical logs, moderation records, and related information as necessary and as described in our Privacy Policy. What is actually available to us for review differs between clients, and the Privacy Policy for the client you are running governs. In BIG PARTY 3D in particular, voice chat is not recorded by the game and does not reach us, so nothing said in a match is available to us to review, at the time or afterwards.
6. Chat and User Communications
Depending on the client you are running, the Service may include text chat, voice chat, usernames, profiles, room names, lobby names, emotes, comments, reports, and similar features. You use these features at your own responsibility.
In BIG PARTY, proximity voice chat is provided through the same third-party online services provider and is enabled in public and private lobbies; it can be turned off, and its microphone, playback device, and volume configured, in the game's settings.
BIG PARTY 3D has push-to-talk voice chat in online and LAN matches, and no player-written text chat. Your microphone is requested the first time you hold the talk key and is not used before that; voice chat can be disabled, and its microphone and levels configured, in the game's settings, and who can hear you (everyone, only players near you, or only your team) is chosen by the host for the match. You may also mute any individual player, from the lobby or from the pause screen during a round; that mute applies on your own device, takes effect at once, and does not require the host's cooperation. Voice travels between the players' devices and is not recorded or stored. In that client the things you transmit to other players are your voice while you hold the talk key, your display name, your chosen character, and your character's actions in a round.
You must not transmit content that is abusive, defamatory, threatening, discriminatory, harassing, obscene, sexual, exploitative, excessively violent, hateful, deceptive, illegal, or otherwise offensive; personal or contact information of any person; advertising, solicitation, scams, phishing, or spam; content that encourages crime, self-harm, dangerous acts, cheating, unauthorized access, or attacks; or content intended to impersonate, harass, identify, locate, shame, threaten, or harm any person.
You should not share your real name, address, phone number, private email address, precise location, school, workplace, private social media accounts, financial information, passwords, or other sensitive information in the Service. We cannot guarantee that other users will not copy, record, stream, screenshot, disclose, or misuse content you share.
Where available, users may mute, block, report, or leave sessions involving unwanted communication. These tools are provided for safety and moderation but do not guarantee prevention of all harmful conduct, and they are not available in every client.
We do not pre-screen all communications. Except in cases of our willful misconduct, gross negligence, or liability that cannot be excluded by law, we are not liable for disputes, damage, or harm arising between users.
7. User-Generated Content
"User-Generated Content" means usernames, display names, profiles, comments, room names, lobby names, messages, reports, and any other content you create, enter, display, submit, or transmit through the Service.
As a general rule, rights in your User-Generated Content belong to you or the rightful rights holder. You grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, transmit, modify for formatting or moderation, remove, restrict, and use such content to the extent necessary to provide, operate, secure, moderate, improve, promote, and support the Service.
You represent that your User-Generated Content does not infringe any third party's rights and does not violate this EULA or applicable law. We may, without prior notice, remove, hide, restrict, preserve, review, or take other action regarding content or accounts that we believe violate this EULA, threaten safety or security, create legal risk, or are the subject of a third-party complaint. We are not obligated to monitor all content.
8. Screenshots, Videos, and Streaming
For personal, non-commercial purposes, you may capture and share screenshots, gameplay videos, streams, reviews, and fan content of the Service, subject to this EULA and the terms of the platforms you use.
You may not share content that violates this EULA, exposes private personal information, harasses or targets another person, promotes cheats or exploits, teaches attacks on the Service, falsely implies official endorsement, or commercially exploits the Service or its materials without our permission.
If you stream, record, screenshot, or share gameplay, you are responsible for complying with applicable laws and platform rules, including privacy, publicity, copyright, and harassment rules. Nothing in this EULA authorizes infringement of third-party rights.
9. Bugs, Glitches, and Security Issues
You may report, discuss, and share general information about bugs, glitches, and specification issues. You may not exploit them for unfair advantage, abuse them to disadvantage others, harm servers, harm balance, manipulate records, compromise security, create or distribute cheats or tools, or share specific methods for server attacks, unauthorized access, reverse engineering, account compromise, or bypassing security.
If you discover a security vulnerability, please report it responsibly through the contact method in Section 24 and do not publicly disclose details that could enable harm until we have had a reasonable opportunity to address it.
10. Prohibited Conduct
In addition to the above, you must not:
violate any law or the rights, privacy, honor, reputation, safety, or security of us, other users, or third parties;
perform unauthorized access, communication interference, packet manipulation, server attacks, scraping, data mining, reverse engineering, analysis, modification, tampering, or circumvention except where expressly permitted by applicable law;
create, use, distribute, advertise, sell, or assist with cheats, bots, automation, modified data, unauthorized tools, exploits, or instructions for abuse;
illegally obtain, modify, transfer, sell, buy, trade, or monetize game data, accounts, rankings, achievements, rewards, items, or in-game currency;
commit fraud, phishing, impersonation, social engineering, harassment, extortion, threats, doxxing, or real-world intimidation;
use the Service for commercial purposes without our written permission;
use the Service to collect information about users, developers, moderators, or third parties outside ordinary gameplay; or
use the Service in a manner not intended by us.
11. Measures for Violations
If we determine that you have violated or may violate this EULA, receive a third-party complaint, detect unsafe conduct, detect security risk, or otherwise deem action necessary, we may, without prior notice:
issue a warning;
remove, hide, restrict, or preserve content;
restrict chat, voice, online play, matchmaking, reporting, profile, or other features;
correct, reset, delete, or restrict rankings, records, rewards, items, game data, or progression;
temporarily suspend or permanently terminate access to the Service;
block or restrict access from specific accounts, devices, networks, regions, or technical environments where appropriate;
provide information to platform operators, service providers, rights holders, or authorities where legally required or where reasonably necessary to protect safety, security, rights, or the Service; or
take other reasonable steps to protect users, us, third parties, platforms, or the Service.
For doxxing, threats, stalking, harassment, swatting threats, extortion, unauthorized access, cheating, security abuse, or other safety-related violations, we may take immediate action and preserve relevant evidence. Except in cases of our willful misconduct, gross negligence, or liability that cannot be excluded by law, we are not liable for damage caused by such measures.
Where a measure is significant and you believe it was applied in error, you may contest it through the contact method in Section 24, and we will review the matter in good faith.
12. Online Services, Servers, and Maintenance
Because the Service relies on online features, all or part of it may become unavailable due to server status, connectivity, maintenance, failures, updates, platform changes, security incidents, provider issues, or operational decisions. We may suspend, interrupt, restrict, change, or terminate all or part of the Service without prior notice. We do not guarantee continuous availability, matchmaking, uninterrupted communications, data preservation, compatibility, or continued server operation.
What your purchase includes. The price of the Service buys the game as software you run yourself: solo play, couch play on one device, and — where the client provides it — LAN multiplayer between devices on your own network. Those are the parts of the Service that run entirely on hardware you control and depend on no online service. Online multiplayer — including online lobbies, any public lobby listing, and platform invites into online matches — is an additional online service provided free of charge alongside that purchase, and is not part of it. It depends on third-party services, including the online services provider that carries online matches and the platform through which you obtained the game, and it may be changed, suspended, restricted, or discontinued under this Section 12 and Section 13 at any time, without notice, and without entitling you to a refund, credit, or other compensation, except where applicable law or the refund policy of the store you purchased through provides otherwise. If online multiplayer is unavailable or discontinued, the licensed game — solo, couch, and LAN play — continues to work and remains what your purchase provides.
13. Updates and Changes
We may update, patch, balance, add to, modify, restrict, or remove features of the Service for any reason. Game balance, maps, characters, minigames, content, controls, online specifications, and technical requirements may change, and we do not guarantee that prior content, balance, functionality, or experience will remain unchanged.
14. Save Data and Game Data
Save data, records, rankings, achievements, rewards, items, progression, settings, matchmaking data, and other data may be lost, corrupted, changed, restricted, or reset due to devices, servers, platforms, connectivity, updates, bugs, violations, security issues, operational needs, or other causes. We do not guarantee the completeness, preservation, accuracy, or recoverability of data, and we may correct, delete, reset, or restrict data where there is unauthorized conduct, a violation of this EULA, a bug fix, security issue, legal requirement, or operational necessity.
15. Paid Content
If the Service offers paid content, downloadable content, in-game items, in-game currency, passes, cosmetics, or other purchases, your purchases are subject to the terms and refund policies of the store, platform, and payment provider you use. Except as required by law or platform terms, purchased content cannot be refunded, exchanged, converted to cash, transferred, sold, or redeemed outside the Service. We may change the content, effects, availability, names, balance, or functionality of paid or free content for operational, legal, security, or balance reasons.
16. Privacy
Your use of the Service is subject to our in-game Privacy Policy, which explains how we collect, use, share, retain, and protect information. The Privacy Policy is incorporated into this EULA by reference. Each client presents the Privacy Policy that applies to it, and the two clients do not process the same information; read the one shown in the client you are running.
We do not require users to provide their real name to play the Service. Users are identified in-game primarily through platform identifiers, display names, session identifiers, and gameplay-related data. However, online play, usernames, platform profiles, voice chat where available, screenshots, streams, reports, and user conduct may reveal information about a user. You are responsible for not sharing personal information in the Service.
Online multiplayer is peer-to-peer. Establishing a peer-to-peer connection requires the participating devices to exchange the network addresses at which they can be reached, which can make your IP address available to the other players in a match, and theirs to you. The Privacy Policy explains when this happens and when a relay prevents it. Misusing an address obtained this way is prohibited under Section 5.
We do not sell your personal information. We may process information as necessary to operate, secure, moderate, improve, support, and protect the Service, including to prevent cheating, abuse, harassment, doxxing, unauthorized access, and other harmful conduct.
17. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, COMPATIBLE, OR FREE OF HARMFUL COMPONENTS, OR THAT DATA WILL BE PRESERVED OR RECOVERABLE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
NOTHING IN THIS SECTION AFFECTS ANY STATUTORY WARRANTY OR CONSUMER GUARANTEE THAT CANNOT BE EXCLUDED UNDER THE LAW OF YOUR PLACE OF RESIDENCE.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, GAME PROGRESS, ACCOUNT ACCESS, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE OR THIS EULA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THIS EULA WILL NOT EXCEED THE TOTAL AMOUNT YOU ACTUALLY PAID FOR THE SERVICE.
NOTHING IN THIS EULA LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR OUR WILLFUL MISCONDUCT OR GROSS NEGLIGENCE, OR FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE WHERE SUCH LIMITATION IS NOT PERMITTED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
19. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your breach of this EULA, your misuse of the Service, your User-Generated Content, your violation of law, your violation of third-party rights, your harassment or doxxing of another person, or your unauthorized access, cheating, security abuse, or harmful conduct.
This Section does not apply to the extent the claim arises from our own acts or omissions, and it does not apply where you are a consumer and applicable consumer-protection law prohibits it.
20. Dispute Resolution; Arbitration; Class Action Waiver
Please read this section carefully — it affects how disputes are resolved.
This Section 20 does not apply to you, and Section 21 governs instead, if you are a consumer resident in the European Union, the United Kingdom, or any other jurisdiction whose law does not permit a pre-dispute agreement to binding arbitration or a waiver of collective redress to be enforced against a consumer.
Before filing any claim, you agree to first contact us through the method in Section 24 and attempt to resolve the dispute informally for at least thirty (30) days.
Where this Section applies, any dispute not resolved informally shall be resolved by binding individual arbitration, before a single arbitrator, administered under the rules of a recognized arbitration provider, rather than in court, except that either party may bring an individual claim in small-claims court where permitted. Each party bears its own costs except as the applicable rules or law provide otherwise.
You and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff, claimant, or class member in any class, collective, consolidated, private attorney general, or representative action, to the maximum extent permitted by law. If this waiver is held unenforceable as to a particular claim, that claim shall proceed in court under Section 21 and shall be severed from any arbitration.
You may opt out of this Section 20 by notifying us through the contact method in Section 24 within thirty (30) days of first accepting this EULA. Your notice need only state your Steam account name and that you opt out of arbitration. Opting out does not affect any other part of this EULA. If you opt out, Section 21 governs disputes in court.
This Section does not prevent either party from seeking emergency or injunctive relief for intellectual property misuse, unauthorized access, security abuse, doxxing, harassment, threats, or other conduct that may cause immediate harm.
21. Governing Law
This EULA is governed by applicable law, except where mandatory consumer-protection law of your place of residence gives you rights that cannot be waived.
Nothing in this EULA deprives you of the protection of the mandatory consumer-protection law of your place of residence, or removes your right to bring proceedings in the courts of your place of residence where that law so provides. Either party may seek injunctive relief in any court of competent jurisdiction.
22. Changes to this EULA
We may revise this EULA as necessary. The revised EULA takes effect when posted, presented in the Service, or notified through the Service, store page, or official channel. Your continued use after it takes effect constitutes acceptance. Where a revision is material, the Service will require you to re-accept the updated terms before continuing to play, and we will not apply a material revision retroactively to a dispute that arose before it took effect.
23. General
If any provision of this EULA is held invalid or unenforceable, that provision shall be limited or severed to the minimum extent necessary and the remaining provisions remain in full force and effect. This EULA, together with the Privacy Policy and any incorporated rules, is the entire agreement between you and us regarding the Service and supersedes prior agreements on its subject matter. Our failure to enforce any provision is not a waiver. You may not assign this EULA; we may assign it in connection with a merger, acquisition, sale of assets, restructuring, or transfer of the Service. Headings are for convenience only.
24. Contact
Inquiries, support requests, privacy requests, bug reports, vulnerability reports, safety reports, legal notices, and other communications regarding the Service shall be made through the method designated by us, such as the BIG PARTY Steam Community Hub or the support method shown on our Steam store page.
Notices required by Section 20 (informal dispute resolution and arbitration opt-out) may be sent through any of those methods, and are effective when received.
We are not obligated to respond to all inquiries, and we may determine the content, timing, and method of any response at our discretion, except where a response is required by applicable law.
