Online Mode Terms of Service and Privacy Policy

This document ("Agreement") is between you and First Day Entertainment Inc. ("we", "us") and governs your use of the Online Mode of Deskrawl (the "Game"). Part A sets out the Terms of Service; Part B is the Privacy Policy explaining what data Online Mode processes. By connecting to or playing Online Mode, you agree to this Agreement. If you do not agree, do not use Online Mode. This Agreement applies only to Online Mode; playing the Game offline is not governed by it.
PART A — TERMS OF SERVICE
1. LICENSE
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use Online Mode for your own non-commercial entertainment. You may not sell, rent, or share access to Online Mode, or decompile, reverse-engineer, or tamper with the Game client or our servers in connection with Online Mode.
2. OWNERSHIP
The Game and everything in it — code, art, music, characters, items, and other content — is owned by First Day Entertainment Inc. or its licensors and is protected by copyright and other laws. This Agreement gives you a license to use Online Mode, not ownership of the Game or any of its content.
3. CONTENT CREATION AND STREAMING
You may create and share screenshots, videos, and livestreams of Deskrawl gameplay, including monetized videos and streams on platforms such as YouTube and Twitch. You may not sell or redistribute the Game's assets themselves, present them as your own work, or charge for access to the Game.
4. ONLINE MODE AND SERVICE AVAILABILITY
Online Mode requires an internet connection and depends on our servers, Steam, and infrastructure outside our control.
- We do not guarantee that Online Mode will be available at all times, uninterrupted, or error-free.
- Connection problems, outages, maintenance, bugs, or other failures may interrupt play. In extreme cases, these may cause loss of characters, items, or other progress. We are not obligated to restore lost progress, though we may try to help where reasonably possible.
- We may modify, suspend, or discontinue Online Mode (in whole or in part) at any time. If we permanently shut down Online Mode, we will give at least 60 days' advance notice (for example, via the Steam store page or in-game notice). When Online Mode ends, online characters, items, and other online data may be deleted, and we owe no compensation for them except where required by law.
5. VIRTUAL ITEMS
In-game items, currency, and other virtual content are licensed to you, not sold. Outside of features Valve provides (such as the Steam Community Market), virtual items have no cash value and cannot be redeemed for money. Selling or trading items or accounts outside of Steam's official systems is prohibited.
6. FAIR PLAY AND CHEATING
You agree not to cheat. This includes using hacks, bots, exploits, automation tools, memory editing, or tampering with the game client, save data, or network traffic to gain an unfair advantage in Online Mode, and abusing bugs instead of reporting them.
If we determine that you have cheated, we may ban your account from Online Mode without warning. A ban may include loss of access to online characters, progress, and virtual items. We may also restrict accounts involved in marketplace fraud or abuse. If you believe a ban was issued in error, you may appeal by contacting us (see Contact below) within 14 days of the ban.
7. STEAM AND THE STEAM COMMUNITY MARKET
The Game is distributed through Steam and uses Steam services, including the Steam Community Market, which allows certain in-game items to be bought and sold between players for real money.
- Your use of Steam and the Steam Community Market is governed by the Steam Subscriber Agreement and Valve's other terms, in addition to this Agreement.
- All marketplace transactions are processed by Valve, not by us. We do not handle your payments and are not a party to trades between players.
- Item prices on the marketplace are set by players. We make no promise that any item has, will keep, or will gain any monetary value.
- Deliberate market-price manipulation and fraudulent marketplace transactions are prohibited and may result in account sanctions.
- We may change the Game's design, balance, drop rates, and economy at any time. Such changes may affect the desirability or market value of items, and we are not liable for any such effect.
8. USER CONDUCT
Do not harass other players, disrupt the service, attack or overload our servers, or use the Game for anything unlawful. We may suspend or ban accounts that violate this section.
9. UPDATES
We may release updates, patches, and balance changes at any time, and an update may be required to continue playing Online Mode. Updates may add, change, or remove content and features.
10. REFUNDS
Refunds of the Game purchase are handled exclusively by Steam under Valve's refund policy. To request a refund, contact Steam Support; we cannot process Steam purchase refunds directly.
11. TERMINATION
This Agreement is effective until terminated. It terminates automatically if you materially breach it, and we may suspend or terminate your access to Online Mode for violations of this Agreement. You may terminate it at any time by ceasing to use Online Mode. Termination of this Agreement does not affect your ability to play the Game offline. Sections 2, 5, 12, and 13 — and Part B, for data we still hold — survive termination.
12. DISCLAIMER OF WARRANTIES
The Game and Online Mode are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Game will be uninterrupted, error-free, or that progress or items will never be lost.
13. LIMITATION OF LIABILITY
To the maximum extent permitted by law, First Day Entertainment Inc. is not liable for any indirect, incidental, special, or consequential damages — including lost progress, lost virtual items, or lost real-world value of marketplace items — arising from your use of the Game. Our total liability under this Agreement will not exceed the amount you paid for the Game. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; nothing in this Agreement limits rights you have under mandatory consumer protection law.
PART B — PRIVACY POLICY
Short version: Online Mode knows you only as a Steam ID with an inventory. We collect the minimum needed to run the service, and nothing that identifies you personally.
14. DATA WE COLLECT
- Steam ID. When you connect, Steam authenticates you and gives us your Steam ID — a pseudonymous account number. It is the only identifier we store; we never receive your real name, email, or payment details from Steam.
- Game data. Characters, inventory, stash, currency, progression, and game settings synced with our servers, including item records needed for Steam Community Market eligibility.
- Connection and integrity data. Like any online service, our servers process your IP address and connection timestamps to deliver the connection and keep short-lived operational logs. If cheat detection triggers, we record the relevant evidence (for example, impossible progression or item-validation failures) tied to your Steam ID.
15. HOW WE USE DATA
We use the data in Section 14 only to:
- operate Online Mode — authenticate you, save and sync your characters and inventory;
- validate items for the Steam Community Market;
- enforce fair play — detect cheating, apply bans, and handle appeals;
- keep the service secure and diagnose technical problems.
We do not sell personal data, and we do not use it for advertising or marketing.
16. SHARING AND THIRD PARTIES
We share data with no one, with these exceptions:
- Valve Corporation. Steam handles authentication and all marketplace transactions under Valve's own privacy policy. Marketplace transaction records are held by Valve, not us.
- Infrastructure. Our servers run on Cloudflare, which processes data on our behalf as a hosting provider and does not use it for its own purposes.
- Legal requirements. We may disclose data if validly required by law.
17. DATA RETENTION AND DELETION
We keep your game data for as long as you use Online Mode. You may request deletion of your online data at any time by emailing us from a way that lets us verify your Steam account; deletion is irreversible and removes your online characters, inventory, and progress. Operational connection logs are deleted automatically on a rolling basis. Ban and enforcement records are retained for as long as needed to enforce the ban.
18. YOUR PRIVACY RIGHTS
You may request a copy of the data we hold about your Steam ID, or its correction or deletion, by contacting us (see Contact below). We respond within 30 days.
- EU/EEA/UK: We process data to perform this Agreement (running Online Mode) and for our legitimate interests in security and fair play. You have GDPR rights of access, rectification, erasure, restriction, portability, and objection, and may lodge a complaint with your local data protection authority.
- California: We do not sell or share personal information as defined by the CCPA. You may exercise your rights to know and to delete via the contact below, without discrimination.
- Data held by Valve (including marketplace records) must be requested through Steam.
GENERAL
19. CHANGES TO THIS AGREEMENT
We may update this Agreement, including the Privacy Policy, from time to time. Material changes will be announced (for example, via the Steam store page or in-game notice), and the "Last updated" date above will change. Continuing to play Online Mode after a change takes effect means you accept the updated Agreement.
20. GOVERNING LAW
This Agreement is governed by the laws of the State of California, United States, without regard to conflict-of-law rules.
21. MISCELLANEOUS
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions stay in full effect. Our failure to enforce a provision is not a waiver of it. This Agreement, together with the applicable Valve terms, is the entire agreement between you and us regarding Online Mode. If this Agreement is translated, the English version prevails in case of conflict.
