END USER LICENSE AGREEMENT (EULA)
This End User License Agreement (hereinafter referred to as "this Agreement") applies to the computer game software "たろうくんはいってきました" (hereinafter referred to as "this Game") provided by YAMI Co., Ltd. (hereinafter referred to as "the Company"). By installing, launching, or using this Game, the user shall be deemed to have agreed to this Agreement.
Article 1 (Grant of License)
The Company grants the user a non-exclusive, non-transferable, and limited right to use this Game for personal and non-commercial purposes in accordance with this Agreement. The user may not sell, lease, redistribute, or allow any third party to use this Game.
Article 2 (Prohibited Matters)
The user must not engage in any of the following acts regarding this Game:
1. Reverse engineering, decompiling, or disassembling.
2. Cheating, hacking, exploiting bugs, or using unauthorized tools.
3. Unauthorized access to or interference with the game servers.
4. Transferring, leasing, selling, buying, or sharing the account.
5. Inconvenition, defamation, or harassment directed at other users.
6. Modification or secondary distribution of this Game.
7. Acts that violate laws and regulations or public order and morals.
8. Any other acts deemed inappropriate by the Company.
Article 3 (Intellectual Property Rights)
Copyrights and all other intellectual property rights relating to this Game and all content associated with this Game (including characters, stories, music, images, programs, etc.) belong to the Company or the legitimate rights holders.
Article 4 (Account Management)
The user shall manage their account under their own responsibility and shall not allow any third party to use their ID, password, etc. The Company shall bear no responsibility whatsoever for any damages resulting from unauthorized use or inadequate management of the account.
Article 5 (User Content)
The user shall guarantee that they legally hold the rights to any texts, images, or other content posted or generated within this Game (hereinafter referred to as "User Content"). The user grants the Company a royalty-free, non-exclusive, worldwide, and perpetual right to use the User Content for the purposes of operating, distributing, promoting, and improving this Game. If the Company determines that the User Content violates this Agreement, the Company may delete or hide the said content.
Article 6 (Modification, Suspension, and Termination of the Service)
The Company may modify, add to, suspend, or terminate all or part of this Game without prior notice to the user. The Company shall bear no responsibility whatsoever for any damages incurred by the user as a result.
Article 7 (Disclaimer)
The Company makes no warranties regarding the completeness, accuracy, usefulness, fitness for a particular purpose, or continuity of operation of this Game. The Company shall not be liable for data loss, failure, communication trouble, or any other damages incurred in connection with the use of this Game; provided, however, that this shall not apply in cases where there is intentional misconduct or gross negligence on the part of the Company.
Article 8 (Limitation of Liability for Damages)
Except in cases of intentional misconduct or gross negligence by the Company, the Company's liability for damages shall be limited to direct and ordinary damages. Furthermore, the Company's liability shall be limited to the scope of damages actually incurred by the user.
Article 9 (Account Suspension and Restrictions on Use)
If a user violates this Agreement, the Company may, without prior notice, take necessary measures such as suspending or deleting the account.
Article 10 (Refunds and Purchases)
Purchases and billing regarding this Game shall be subject to the refund policies separately defined by the Company or the distribution platform (Steam). The Company will handle refunds to the extent that it does not violate laws and regulations or Steam's policies.
Article 11 (VAC / Anti-Cheat)
The user agrees that if fraudulent activity is detected, measures such as account restrictions or suspension of use may be taken.
Article 12 (Exclusion of Anti-Social Forces)
The user represents and warrants that they do not currently fall under anti-social forces and will not fall under them in the future.
Article 13 (Governing Law and Jurisdiction)
This Agreement shall be governed by and construed in accordance with the laws of Japan. Any and all disputes arising between the Company and the user in connection with this Game shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
