END USER LICENSE AGREEMENT (EULA) for Neverquest

This End User License Agreement ("Agreement") is a binding legal agreement between you ("User" or "you") and [Benjamin Hildebrandt DBA Equinox Games] ("Developer") for the game Neverquest (the "Game").

By installing, accessing, or playing the Game, you agree to be bound by the terms of this Agreement. If you do not agree, do not install or use the Game.

1. LICENSE GRANT
The Developer grants you a non-exclusive, non-transferable, limited right and license to install and use one copy of the Game for your personal, non-commercial entertainment use on a device that meets the Game’s system requirements.

2. EARLY ACCESS ACKNOWLEDGMENT
You acknowledge that the Game is currently in an Early Access state. The Game may contain bugs, may not be fully functional, and is subject to significant changes. The Developer is not obligated to provide any specific updates or future content, and "game-breaking" bugs do not entitle the User to a refund outside of the standard Steam Refund Policy.

3. BACKEND SERVICES & DATA (Azure PlayFab)
Account Requirement: To access certain features (including guilds, raiding, and leaderboards), the Game requires a connection to a third-party backend service (Azure PlayFab).

Data Collection: By using these features, you agree to the collection of certain data (such as IP addresses, unique device IDs, and gameplay statistics) necessary for the operation of these services. Your player information is stored securely using PlayFab, which is wholly owned by Microsoft. Please refer to our Privacy Policy for full details.

Connectivity: A persistent internet connection is required for all cloud-synchronized features. The Developer is not responsible for data loss or service interruptions caused by third-party outages. Connectivity is only required for certain leaderboard features. No core gameplay requires an internet connection.

4. VIRTUAL ITEMS & GAMEPLAY DATA
All in-game progress, items, character levels, and guild affiliations are the property of the Developer. The Developer reserves the right to reset, modify, or delete gameplay data at any time during the Early Access period for the purposes of balancing, testing, or technical necessity. Character information will not be backed up during the early access period.

5. RESTRICTIONS
You agree not to:

Reverse engineer, decompile, or disassemble the Game’s code.

Exploit, cheat, or use unauthorized third-party software to modify the Game’s data.

Distribute, rent, or lease the Game or any of its assets (including pixel art and music) without express permission.

Modify game files to change statistics of playable characters.

Modify game files to change statistics of playable items.

6. DISCLAIMER OF WARRANTIES
THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE GAME IS WITH YOU.

7. LIMITATION OF LIABILITY
IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF THE USE OF OR INABILITY TO USE THE GAME, EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Maryland, USA, without regard to conflict of law principles.
