END USER LICENSE AGREEMENT (EULA)

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PLAYING THIS GAME. BY ACCESSING OR PLAYING ASCENSION TOWER, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT.
1. PARTIES
This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and SmallFish Studios ("SmallFish Studios," "we," "us," or "our"), the developer and publisher of Ascension Tower ("the Game").
2. GRANT OF LICENSE
SmallFish Studios grants you a non-exclusive, non-transferable, revocable, limited license to access and play the Game solely for your personal, non-commercial entertainment purposes. This license does not constitute a sale of the Game or any portion thereof.
3. RESTRICTIONS
You agree that you will not:
Copy, reproduce, distribute, or transmit the Game or any portion of its code, assets, or content without prior written consent from SmallFish Studios;
Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Game;
Sell, sublicense, rent, lease, or otherwise commercially exploit the Game or any of its components;
Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the Game;
Use the Game for any unlawful purpose or in violation of any applicable local, national, or international law or regulation;
Use automated tools, bots, or scripts to exploit or manipulate Game mechanics.
4. INTELLECTUAL PROPERTY
The Game, including all content, artwork, music, code, characters, storylines, and design elements, is the exclusive intellectual property of SmallFish Studios and is protected by copyright law, including the Copyright Act (Canada) and applicable international treaties. All rights not expressly granted in this Agreement are reserved by SmallFish Studios.
5. USER-GENERATED CONTENT & SAVE DATA
Any save data, configurations, or progress generated by you during gameplay is stored locally on your device. SmallFish Studios does not collect, store, or transmit personal data from the Game. You acknowledge that SmallFish Studios is not responsible for any loss of save data resulting from browser clearing, device changes, or other technical issues.
6. UPDATES AND MODIFICATIONS
SmallFish Studios reserves the right to update, modify, patch, or discontinue the Game at any time without notice. Continued use of the Game following any update constitutes acceptance of any revised terms.
7. DISCLAIMER OF WARRANTIES
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SMALLFISH STUDIOS DOES NOT WARRANT THAT THE GAME WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.
8. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SMALLFISH STUDIOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE GAME, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL SMALLFISH STUDIOS' TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO ACCESS THE GAME (IF ANY).
9. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless SmallFish Studios and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Game or your violation of this Agreement.
10. TERMINATION
This Agreement is effective until terminated. SmallFish Studios may terminate this Agreement immediately and without notice if you breach any of its terms. Upon termination, you must cease all use of the Game. Sections 4, 7, 8, 9, and 11 shall survive termination.
11. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
12. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and SmallFish Studios with respect to the Game and supersedes all prior or contemporaneous agreements, representations, or understandings. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
