NervousTree Technology Use License and Service Agreement
The establishment, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China, excluding the application of any conflict of laws principles. In the event of any dispute arising from or in connection with the content or execution of this Agreement (including but not limited to contractual or other property rights disputes), the parties shall attempt to resolve the dispute through friendly negotiations. If negotiation fails, both parties agree to submit to the jurisdiction of the people's court where Hainan NervousTree Technology Co., Ltd. is located for handling.
This "NervousTree Technology Use License and Service Agreement" (hereinafter referred to as "this Agreement") is entered into by and between you and the provider of NervousTree services. This Agreement is legally binding. Please carefully read and fully understand the terms of this Agreement, especially those clauses that exempt or limit the liability of NervousTree, limit user rights, stipulate dispute resolution methods and judicial jurisdiction, as well as separate agreements for activating or using certain services. The aforementioned limitation, disclaimer, dispute resolution, and jurisdiction clauses may be brought to your attention by means of red/bold/underlined text or other reasonable methods.
Unless you have read and accepted all the terms of this Agreement, you are not authorized to use NervousTree services. Your use of NervousTree services constitutes your acceptance and agreement to be bound by this Agreement.
If you are under 18 years of age, please read this Agreement with your legal guardian, and pay special attention to the provisions regarding minors. Before using NervousTree services, you should obtain your guardian's consent to your use of NervousTree services in accordance with this Agreement.
Article 1: Parties to the Agreement
Hainan NervousTree Technology Co., Ltd. : The provider of NervousTree game services, which may provide NervousTree services to you through its own websites and platforms, as well as through the websites and platforms of partners.
You (also referred to as "Player" or "User") : A natural person who, through legal channels provided by NervousTree Company, obtains a non-commercial use license from NervousTree Company to install, use NervousTree software, or receive NervousTree services.
Article 2: Definitions and Explanations
NervousTree Software : Refers to game software provided by NervousTree Company (including any adaptable versions operable on mobile smart devices and/or computer terminals, in client or web form), as well as updates, upgrades, patches, expansion packs, etc. related to such game software, and may include related network servers, websites (including but not limited to the game's official website or forums), electronic media, printed materials, or electronic documents.
NervousTree Services : Refers to various online operational services provided by NervousTree Company to you related to the aforementioned NervousTree Software, including the NervousTree Software itself.
Value-Added Service Tokens : Refers to a type of virtual item designed by NervousTree Company to meet players' normal transaction and communication needs within NervousTree services, obtained through exchange for Renminbi (RMB) or other means, which can be used to purchase designated value-added services within the game, limited to use and circulation within specific games.
Article 3: Intellectual Property Statement
NervousTree Company lawfully possesses all legitimate rights and interests in the NervousTree Software (including but not limited to intellectual property rights such as computer software copyrights, artistic work copyrights, and patents, as well as the right to operate such NervousTree Software), or has obtained legal authorization from legitimate rights holders, thereby having the right to provide NervousTree Software and NervousTree Services to users.
The "NervousTree" text, LOGO (graphics), and other text, LOGO (graphics) used in specific services to identify service names and sources (including but not limited to the name, LOGO, ICON of NervousTree services, the name, LOGO, ICON of the NervousTree software developer, etc.) are trademarks or registered trademarks of NervousTree Company and/or its affiliates, partners in China and/or other countries/regions.
NervousTree Services may involve third-party intellectual property rights. If such third parties have requirements regarding your use of such intellectual property in NervousTree Services, NervousTree Company will notify you of such requirements in an appropriate manner, and you shall comply with such requirements.
All ownership and related ownership and intellectual property rights of game data generated during your use of NervousTree Services shall belong to NervousTree Company. To the maximum extent permitted by law, NervousTree Company has the right to preserve and dispose of such game data.
All rights not expressly granted to you under this Agreement are retained by NervousTree Company.
Article 4: NervousTree Software Use License and Restrictions
Subject to your agreement to accept all terms of this Agreement, NervousTree Company agrees to grant you a non-commercial, revocable, changeable, non-exclusive, non-transferable, and non-sublicensable right to use this NervousTree Software and NervousTree Services. You may, within the scope of authorization, install this NervousTree Software on mobile smart devices or computer terminals for personal use, run one copy of this NervousTree Software in the manner designated by NervousTree Company, and enjoy the services provided by NervousTree Company. The license granted by NervousTree Company under this Agreement is for personal use. If you need to use NervousTree Software and NervousTree Services beyond the scope of personal use or use them for any commercial purpose, you must contact NervousTree Company and obtain a separate authorization from NervousTree Company. Any installation, use, access, display, operation, commercial use, etc. without the permission of NervousTree Company constitutes an infringement against NervousTree Company.
Unless otherwise agreed in this Agreement, without the prior written consent of NervousTree Company, you shall not engage in the following acts (whether for profit or non-profit): (1) Copy, transcribe, decompile, disassemble, disseminate, or display all or part of the program, user manual, and other graphic, audio, and visual materials of the NervousTree Software, or reverse engineer any function or program of the NervousTree Software. (2) Publicly display or broadcast all or part of the NervousTree Software/NervousTree Services in various forms and on various platforms (including but not limited to live streaming platforms, websites, APPs, etc.). (3) Rent, sell the NervousTree Software, or engage in any profit-making activities using the NervousTree Software. (4) Modify or obscure the service name, company logo, trademark (or) copyright information, other intellectual property statements, etc. on the NervousTree Software program, images, animations, packaging, manuals, etc. (5) Use NervousTree Company's name, trademark, or other intellectual property in a manner not prescribed by this Agreement. (6) Other acts that violate the Trademark Law, Copyright Law, Computer Software Protection Regulations, relevant laws and regulations, and international treaties.
Article 5: Fee Policy
NervousTree Company has the right to determine the charging methods and fee standards for NervousTree Software and NervousTree Services. NervousTree Company has the right to set different charging methods and fee standards for NervousTree Software and NervousTree Services at different stages, and may adjust the fee policy at any time as needed. Specific charging methods, fee standards, including but not limited to the charging standards for NervousTree Software, the usage rights of virtual items in the game, and value-added services (if any), shall be promulgated by NervousTree Company in a general form common to the online game industry on APP STORE or other APP distribution channels, in-game item malls, item purchase interfaces, game official websites, and other game modules. You are obligated to read carefully before making a choice. Once you choose to download paid NervousTree Software, purchase relevant virtual item usage rights, or accept relevant services, it indicates that you fully understand and accept the corresponding charging methods and fee standards.
NervousTree Company has the right to establish, add, modify value-added services and issue value-added service tokens in the game as needed. Value-added service tokens are obtained through exchange for Renminbi. Once Renminbi is exchanged for value-added service tokens, it is deemed that the Renminbi has been used, and the value-added service tokens cannot be exchanged back into Renminbi. Value-added service tokens are used to purchase usage rights for relevant virtual items or to receive relevant value-added services. In cases where the purchase of usage rights for virtual items or the receipt of other value-added services constitutes a chargeable item, if the valid usage period of the virtual item or the valid service period of the value-added service expires (regardless of whether you have actually used or enjoyed the service), or if the valid usage or service count is exceeded, NervousTree Company has the right to take measures to cancel your usage rights for the aforementioned virtual items or stop providing the value-added services.
Article 6: Game Virtual Items
Game virtual items (or "virtual items" for short) include but are not limited to game characters, resources, props (including but not limited to equipment in the game, etc.). Their ownership belongs to NervousTree Company. You may only use them in accordance with legal provisions and game rules.
For various types of virtual items in the game, if no special usage period is indicated, it is defaulted that you may continue to use them after obtaining the usage rights until the corresponding NervousTree Service terminates. If a special usage period is indicated, the usage period shall be as specially indicated. Upon expiration of the usage period, NervousTree Company has the right to reclaim the usage rights at any time without prior notice to you (such usage period shall not be interrupted or suspended for any reason).
Obtaining in-game virtual items from third parties may involve various risks. You shall not obtain the aforementioned game virtual items from third parties. If you insist on obtaining the aforementioned game virtual items from third parties, you shall bear the corresponding risks. NervousTree Company has the right to directly reclaim, permanently seal, or delete such game virtual items. NervousTree Company is not responsible for third-party transactions and will not accept appeals arising from disputes over any third-party transactions.
Measures taken by NervousTree Company due to your violation of this Agreement or laws may result in virtual items with a usage period or virtual item exchange codes under your current game account expiring and becoming unusable due to the expiration of the usage period during the period NervousTree Company takes the aforementioned measures. Any losses incurred by you as a result shall be borne by you. That is, the duration during which NervousTree Company takes the aforementioned measures is counted within the usage period of the virtual items or virtual item exchange codes; the usage period of the virtual items or virtual item exchange codes will not be extended after the execution of such measures ends.
Article 7: User Account Registration, Use, and Custody
To jointly provide you with product services, improve the quality of product services, or for reasonable considerations regarding the security of product services, we may receive your personal information and other information from affiliated companies, partners, and other trusted third parties in accordance with relevant laws, regulations, regulatory requirements, or with your authorization. Account registration users promise to register accounts with NervousTree Company or other recognized partners using their real identity, and accept NervousTree Services using such accounts (hereinafter also referred to as "User Accounts"). You agree that the accurate personal information you provide shall serve as the sole evidence for establishing the association between you and the game account and your identity. You only have the right to use the game account you create; ownership of the game account belongs to NervousTree Company.
User Account Use and Custody: (1) According to the terms of the essential clauses, NervousTree Company has the right to review whether the identity information you provided during registration is true and effective, and shall actively take reasonable technical and managerial measures to ensure the security and effectiveness of your user account. You are obligated to properly keep your user account and password and to use your user account and password correctly and safely. If either party fails to fulfill the above obligations, leading to loss of the user account password, theft of the user account, or other circumstances causing damage to your or others' civil rights, the party at fault shall bear the resulting legal liability. (2) You have the right and bear responsibility for actions performed using your user account according to law. (3) Once you discover that your user account or password is being illegally used by others or there are abnormal usage conditions, you shall promptly follow the processing methods published by the account service provider and have the right to promptly notify NervousTree Service provider, NervousTree Company, to take measures to suspend the login and use of that user account. (4) When NervousTree Company takes measures to suspend the login and use of a user account based on your notification, NervousTree Company shall require you to provide and verify personal valid identification information or proof consistent with your registered identity information. (5) If NervousTree Company verifies that the personal valid identification information or proof you provide matches the registered identity information, it shall promptly take measures to suspend the login and use of the user account. (6) If NervousTree Company violates the agreement in subparagraph (5) above and fails to promptly take measures to suspend the login and use of the user account, thereby causing losses to you, it shall bear corresponding legal liability. (7) If you fail to provide your personal valid identification information or proof, or if the personal valid identification information or proof you provide does not match the registered identity information, or if you fail to update your user account information in a timely manner after changes, making it impossible to prove your valid identity, NervousTree Company has the right to refuse your above request. (8) When you provide personal valid identification information or proof consistent with your registered identity information to NervousTree Company to protect your legitimate rights and interests, NervousTree Company shall provide necessary assistance and support, such as account registrant proof, original registration information, etc., according to law, and provide relevant evidence information materials to relevant administrative authorities and judicial organs as needed. (9) If you have not logged into the game for 365 consecutive days, then from 24:00 on the 365th day, NervousTree Company has the right to take measures to delete your user account and any records of that user account in the game database (including but not limited to character, level, virtual items, value-added service tokens, etc.). The deleted data cannot be recovered. Such disposal may lead to the loss of your relevant rights and interests under that game account, and NervousTree Company shall not bear any responsibility for this. (10) You are obligated to properly keep your game account and related passwords, and to use your game account and password correctly and safely. The game account registered by you in accordance with this Agreement is only for the purpose of saving and backing up your personal game data. The right to use the game account belongs solely to the initial registrant. Gifting, assigning, transferring, inheriting, or selling is prohibited. You shall not provide your game account to others for use in any way, including but not limited to providing it to others for commercial use, including but not limited to game live streaming, video recording, account boosting/leveling, equipment farming, skill demonstration, etc., regardless of whether for profit or not. Otherwise, NervousTree Company has the right to take measures against your game account, including but not limited to warnings, restricting or prohibiting all or part of the functions of the game account, deleting the game account and game data and other related information, account suspension or even cancellation, etc. All legal consequences and losses arising therefrom shall be borne by you. If you are not the initial registrant of the account, and you fail to properly keep the account and password and use them correctly and safely, leading to loss of the account password, theft of the account, or other circumstances causing damage to your and others' civil rights, you shall bear the resulting legal liability. (11) NervousTree Company prohibits users from privately transferring game accounts, whether for compensation or not, to avoid disputes arising from game account issues. NervousTree Company will not accept appeals arising from disputes over any private user transactions. You shall bear any losses incurred due to violating this requirement, and NervousTree Company reserves the right to pursue legal liability against the violator.
NervousTree Company will use your real-name registration information in the anti-addiction system as required by relevant national authorities. That is, NervousTree Company may determine whether you are over 18 years old based on your real-name registration information, thereby deciding whether to impose anti-addiction restrictions on your game account.
Article 8: User Privacy Information Protection and Collection
When NervousTree Company requires you to provide information related to your personal identity, it shall disclose its privacy protection policy and personal information use policy to you in a clear and conspicuous manner in advance, and take necessary measures to protect the security of your personal information.
Without disclosing individual user privacy information, NervousTree Company has the right to conduct technical analysis on the entire user database and commercially utilize the analyzed and organized user database. Despite NervousTree Company's great efforts to protect user privacy, it cannot guarantee that existing security technical measures will prevent all forms of loss of your technical information, etc.
Without user permission, NervousTree Company shall not disclose or share user registration information such as name, personal valid ID card number, contact information, home address, etc. to any third party, except in the following circumstances: (1) With the explicit authorization of the user or the user's guardian; (2) As required by relevant laws and regulations; (3) As required by judicial authorities or other competent authorities based on legal procedures; (4) As required by relevant government authorities; (5) To protect the public interest; (6) In emergency situations to protect the interests of other users or third parties; (7) When filing a lawsuit or arbitration against you to protect NervousTree's own legitimate rights and interests; (8) As stipulated in this clause or other circumstances deemed necessary by NervousTree.
NervousTree Company may cooperate with third parties to provide related network services to users. In such case, if the third party agrees to assume the same responsibility for protecting user privacy as NervousTree Company, NervousTree Company may provide the user's registration information, etc. to the third party and limit the scope of use by the third party.
NervousTree Company will, as always, take technical and managerial measures according to national regulations to ensure network information security, including preventing computer virus infections and attacks, backing up important databases, saving user registration information and other data, and protecting users' personal information according to law.
Without disclosing individual user privacy information, you agree that NervousTree Company and its related companies or cooperation partners may collect, process, analyze, save, and use such information within a reasonable scope to provide you with other information or services, compile accounting data, conduct surveys or research on network behavior, or for any other legal use. To protect your privacy rights and regulate the use of your personal information, NervousTree Company has formulated a "User Privacy Agreement." Please read the content of this agreement carefully.
In addition to the aforementioned personal information, you agree and authorize NervousTree Company to collect other necessary information from you based on administrative/judicial authority requirements or considerations such as security and user experience optimization. However, NervousTree Company may only collect and use such information for the purpose of performing this Agreement.
Article 9: Obligations of NervousTree Company
NervousTree Company agrees to provide NervousTree Services to users through the internet according to the terms of this Agreement.
NervousTree Company shall keep records of game virtual currency recharges for a period of 180 days from the date of user recharge.
When using NervousTree Company's game virtual currency, you have the right to request NervousTree Company to assist in retrieving recharge records and transfer records of the game virtual currency. NervousTree Company shall require you to provide and verify personal valid identification information or proof consistent with your registered identity information. If NervousTree Company verifies that the personal valid identification information or proof you provide matches the registered identity information, it shall provide assistance. If you fail to provide your personal valid identification information or proof, or if the personal valid identification information or proof you provide does not match the registered identity information, NervousTree Company has the right to refuse your aforementioned request.
If you use a third-party account recognized by NervousTree Company as your game account to use NervousTree Services, you must also strictly comply with the relevant user agreements and usage rules of that third-party account. If issues arise from using such third-party account (including but not limited to account theft, inability to use the account, abnormal account status, etc.), you shall contact the third party yourself to resolve the issue. NervousTree Company may provide limited and reasonable assistance at its discretion.
Article 10: Obligations of the User
You shall equip yourself with the necessary devices for internet access, including but not limited to mobile smart devices (including but not limited to mobile phones, tablets), computers, wireless routers, or other necessary internet access devices.
You shall bear the telecommunications fees, network usage fees, and other costs related to this service incurred for internet access.
Comply with the terms of this Agreement, other relevant rules and system provisions (including but not limited to those published by NervousTree Company on the game's official website or within the game); comply with relevant laws and regulations of the People's Republic of China (if you are a user outside the People's Republic of China, you should also comply with the laws and regulations of your country or region).
Article 11: Improper Game Behavior
You shall bear the responsibility for the content of the information you publish. In particular, you shall not publish content that: (1) Opposes the basic principles established by the Constitution of the People's Republic of China; (2) Endangers national security, leaks state secrets, subverts state power, or undermines national unity; (3) Damages national honor and interests; (4) Incites ethnic hatred or discrimination or undermines ethnic unity; (5) Undermines national religious policies or promotes cults or feudal superstitions; (6) Spreads rumors, disrupts social order, or undermines social stability; (7) Spreads obscenity, pornography, gambling, violence, murder, terror, or incites crime; (8) Insults or defames others or infringes upon the lawful rights and interests of others; (9) Promotes or teaches the use of cheats, private servers, or Trojans; (10) Publishes any homepage address or link that, in NervousTree Company's reasonable judgment, is inappropriate or contains software, files, etc. not recognized by NervousTree Company; (11) Contains other content prohibited by the laws and administrative regulations of the People's Republic of China.
You shall not use NervousTree Software, NervousTree Services, or participate in NervousTree activities through improper or unfair means. You shall not interfere with NervousTree Company's normal provision of software and services, including but not limited to: attacking or intruding into NervousTree Company's website servers, or logging in or attempting to log into servers at a frequency exceeding normal user login requirements within a concentrated period, thereby overloading the website servers; cracking or modifying the NervousTree Software provided by NervousTree Company; attacking or intruding into NervousTree Company's game servers/game server-side programs or overloading the game servers; creating, publishing, disseminating, or using any form of auxiliary tools or programs that hinder game fairness (including but not limited to "cheats," where "cheat" refers to any program independent of the game software that can affect game operations while the game is running, including but not limited to simulating user operations, changing the operating environment, modifying data, etc.). You shall not: exploit program loopholes or bugs to disrupt the normal progress of the game or disseminate such loopholes or bugs; unreasonably interfere with or hinder others' use of the software and services provided by NervousTree Company; use NervousTree Company's software through abnormal or illegal means (including but not limited to using NervousTree Software to log into private game servers); use abnormal methods to log into the game (including but not limited to using third-party software or systems not developed, authorized, or recognized by NervousTree Company to log into the game), use network accelerators or other cheat software or robot programs to maliciously destroy service facilities or disrupt normal service order; modify, translate, annotate, compile, organize, or adapt the NervousTree Software; exploit possible technical defects or loopholes in the software or online game system to profit for oneself or others in various forms (including but not limited to duplicating game virtual items) or engage in other improper acts. You agree to use the monitoring data within the game program as the basis for determining whether you have engaged in game cheating, such as by using cheat programs.
Article 12: Interruption, Suspension, and Termination of Service
Suspension and Termination of Service to Users: (1) If a user publishes illegal information, seriously violates social morality, or engages in other acts prohibited by law, NervousTree Company shall immediately terminate the provision of services to the user. (2) If a user engages in improper conduct while receiving NervousTree Company's services, NervousTree Company has the right to terminate the provision of services to the user. The specific improper conduct must be explicitly defined in this Agreement or constitute a prohibited act that NervousTree Company has clearly informed the user would result in service termination; otherwise, NervousTree Company shall not terminate the provision of services to the user. (3) If a user provides false registration identity information or violates this Agreement, NervousTree Company has the right to suspend all or part of the services provided to the user. NervousTree Company shall notify the user of the suspension measure and inform them of the suspension period. The suspension period should be reasonable. Upon the expiry of the suspension period, NervousTree Company shall promptly resume services to the user. (4) If NervousTree Company suspends or terminates all or part of the services provided to a user according to subparagraphs (1), (2), or (3) of this clause, NervousTree Company shall bear the burden of proof.
Interruption, Suspension, and Termination of Game Server Operations: (1) To ensure the normal operation of game servers, NervousTree Company needs to perform regular or emergency maintenance. Please understand that normal service interruptions or suspensions may occur due to the above circumstances, and NervousTree Company is obligated to minimize the interruption time. NervousTree Company has the right to terminate or interrupt all or part of the services provided by the game server under any of the following circumstances, and shall not bear any responsibility to users or third parties for any inconvenience or damage arising therefrom: ① Scheduled inspections or construction, software/hardware updates, etc. NervousTree Company has the right to suspend services but will complete maintenance and updates as soon as possible; ② Game server damage preventing normal operation; ③ Sudden failure of software/hardware equipment or electronic communication equipment; ④ Network provider line or other failures; ⑤ In emergency situations as required by law or for the personal safety of users or third parties; ⑥ Third-party reasons or other force majeure circumstances. (2) NervousTree Company reserves the right to terminate or partially terminate the provision of NervousTree Services when it deems necessary, providing a 60-day advance notice. Regardless of the reason for terminating NervousTree Services, you shall take appropriate measures to handle your game virtual items, including but not limited to canceling or stopping the use of your user account, game virtual items, etc. You shall not demand any form of compensation or reimbursement from NervousTree Company due to the complete termination of NervousTree Services, except for game virtual currency you have purchased but not yet used. This includes but is not limited to compensation for the inability to continue using your user account, game virtual items, etc.
Article 13: Special Explanation for Combat System
Certain NervousTree Services may contain a combat system where users can freely fight each other. For such NervousTree Services containing a combat system, once you click "Accept" (or other words with similar meaning, such as "Agree") and install the corresponding NervousTree Software, or register, start using, and/or continue using the corresponding NervousTree Software or NervousTree Services, it will be deemed that you agree to all free combat behaviors in the game's combat system and agree to abide by the rules of free combat.
Article 14: Special Explanation for Single-Player Games
For NervousTree Services primarily consisting of single-player games, the recharge system is only usable after accessing the internet or a mobile communication network (such as SMS payment). If you use the recharge system to make a payment, the recharge information will be confirmed via the internet or a mobile communication network (such as SMS payment). For NervousTree Services primarily consisting of single-player games, all game data will be stored on your mobile smart device. If you uninstall or reinstall the NervousTree Software, or if your mobile smart device is damaged, preventing the NervousTree Software from starting normally, your entire game data may be unrecoverable. If you need to save game data on the game server, you need to perform data saving operations while connected to the network.
Article 15: Explanation of Basic Methods for Handling Player Violations
Forced Offline: Force the player to exit the game and return to the login screen.
Character Suspension: Temporarily or permanently prohibit the character from logging into the game.
Account Suspension: Temporarily or permanently prohibit the account from being used.
Article 16: Content of Penalties for In-Game Violations
Properly Handling Relationships Between Players: (1) Account theft (including but not limited to stealing accounts, game data, player personal information) and activities related to account theft (assisting the thief in operating and transferring game items, etc.) may result in the following penalties depending on the actual situation and severity: freezing or recovering game items, deducting in-game values, imprisoning the character, suspending the account, bearing legal liability. (2) Spreading or disseminating information about Trojans, cheats, viruses, private servers, etc., through various means or behaviors may result in the following penalties depending on the actual situation and severity: warning, temporary imprisonment of character, account suspension.
Properly Handling the Relationship Between Players and the Game: (1) Spreading words or actions that harm national dignity and honor or disrupt social order may result in the following penalties depending on the actual situation and severity: muting, forced offline, imprisonment of character, account suspension, bearing legal liability (referral to competent state authorities for handling). (2) Attacking or intruding into game servers by various means, or using abnormal methods to log into the game world servers operated by NervousTree Company may result in the following penalties depending on the actual situation and severity: account suspension, bearing legal liability. (3) Using third-party software to maliciously damage service facilities or disrupt normal service order (including but not limited to using compiled or decompiled programs to modify game data, using cheats such as accelerators or other cheating software or robot programs) may result in the following penalties depending on the actual situation and severity: account suspension, bearing legal liability. (4) Exploiting system anomalies or bugs (directly or indirectly using game bugs, program loopholes, etc.) for profit or to disrupt game order may result in the following penalties depending on the actual situation and severity: forced offline, recovery of benefits gained from the bug, character suspension, account suspension, bearing legal liability. Game items or accounts obtained by players from trading platforms not provided or recognized by NervousTree Company will be deemed as originating in violation of game rules. Illegal transactions may result in the following penalties depending on the actual situation and severity: warning, freezing or recovering game items or in-game currency, deducting in-game values, forced offline, character suspension, account suspension, bearing legal liability. (7) Impersonating NervousTree Company staff, GMs, or the system to spread or disseminate false information to other players, or attempting to defraud by impersonating officials, may result in the following penalties depending on the actual situation and severity: muting, account suspension. (8) Ignoring GM warnings or obstructing operations (including but not limited to insulting GMs, deceiving or attempting to deceive GMs, violating or ignoring prompts from GMs, harassing GMs) may result in the following penalties depending on the actual situation and severity: warning, muting, account suspension. (9) Making false or malicious complaints or reports may result in the following penalties depending on the actual situation and severity: warning, account suspension. (10) Using NervousTree products or receiving NervousTree services with or through third-party software, disrupting game rules and fairness (including but not limited to using scripts, multi-client tools, etc.): may result in the following penalties depending on the actual situation and severity: account suspension.
Other: Other words or actions not listed above that hinder other players' normal gaming or adversely affect game operations may result in the following penalties depending on the actual situation and severity: warning, muting, forced offline, account suspension, character deletion, bearing legal liability (referral to competent state authorities for handling). GMs have the right to immediately suspend the online access rights of any game account that may endanger the interests of the majority of players without prior notice. All GMs will strictly adhere to the principles of neutrality and fairness in handling issues.
Article 17: Game Master (GM) Interaction Management Rules
During gameplay, players may interact with GMs for various reasons. NervousTree Company will provide in-game online questioning as a communication platform between players and GMs for specific games. If you encounter problems in the game, you can submit questions through online questioning, which will provide you with fast and quality service.
We hope that communication between GMs and players will be helpful, but please abide by the relevant rules. NervousTree Company will strictly handle the following behaviors: (1) Impersonating the system or GM: Some players may impersonate the system or GM in the game. If discovered, you can report it to GMs via the game forum and assist in the investigation. Once confirmed, NervousTree Company will take strict disciplinary action against such players. (2) Deceiving or attempting to deceive GMs: In the game, players should not attempt to exploit NervousTree Company's trust by deceiving or attempting to deceive GMs. If discovered, NervousTree Company will take strict disciplinary action against such players. Attempts to deceive GMs include but are not limited to misleading GMs, refusing to provide information, providing false information, and any attempt to "scam" GMs. (3) Violating or ignoring prompts from GMs: In the game, to ensure the common interests of the majority of players and maintain normal game order, GMs may prompt players to perform or stop performing certain actions. Any neglect or obstruction of such work may result in penalties for the player's game character. Therefore, players should maintain a cooperative attitude. (4) Interfering with GM work: In the game, if the following behaviors occur, NervousTree Company will take strict disciplinary action: ① Requesting any virtual game items from GMs (including but not limited to game resources, equipment, etc.); ② Frequently calling GMs or sending requests with no substantive content; ③ Repeatedly sending help requests to GMs that have already been answered or resolved. (5) Insulting or maliciously attacking GMs: In the game, insulting or maliciously attacking GMs is not allowed. If discovered, NervousTree Company will take strict disciplinary action.
If a player is found to violate any of the provisions in paragraph 2 of this article, they may be subject to the following penalties depending on the situation: warning; muting; temporary gameplay suspension; permanent gameplay suspension; temporary login prohibition; permanent login prohibition; forced offline; account suspension; account deletion; forum post deletion; forum account blocking; temporary service interruption; bearing legal liability.
Password Retrieval: In case of forgotten or lost password, please first try to log in to the "NervousTree User Center" page yourself to retrieve it. If you cannot retrieve it, you can collect relevant information for password retrieval and contact a GM. NervousTree Company will have dedicated staff investigate and handle the matter for you. If you log into the game using a partner account recognized by NervousTree Company and forget or lose your password, please promptly contact the entity that provided the account registration service (i.e., the partner recognized by NervousTree Company) for handling. Friendly reminder: No GM or NervousTree Company staff will ask you for your account password, security code, or other information in the game or forum. Please be aware to avoid unnecessary losses.
Article 18: Rules for Handling Game Bugs and Third-Party Software
Game bugs refer to loopholes or unreasonable phenomena in the game system, program, settings, etc. Players are obligated to report bugs appearing in the game to GMs. Players are strictly prohibited from directly or indirectly exploiting game bugs, program loopholes, etc. for profit or to disrupt game order, or using bugs/loopholes for personal gain. If a player engages in such behavior, once confirmed, they may be subject to the following penalties: confiscation of illegitimate gains obtained directly or indirectly by exploiting bugs; deduction of in-game values (including but not limited to experience points); transaction reversal; deduction of proceeds from违规 transactions; transaction function restriction; forced offline; temporary gameplay suspension; permanent gameplay suspension; temporary login prohibition; permanent login prohibition; account deletion; bearing legal liability.
Unauthorized third-party software refers to any file or program that can be used to gain an advantage in the game but is not part of the corresponding NervousTree Software, including cheating cheats and related auxiliary cheats (including but not limited to auto-leveling, auto-questing, acceleration, or other operations beyond the game's intended scope). If the use of cheating cheats or related auxiliary cheats is discovered, we will take strict disciplinary action, including: confiscation of illegitimate gains obtained directly or indirectly by using third-party software; deduction of in-game values (including but not limited to experience points); temporary gameplay suspension; permanent gameplay suspension; forced offline; temporary login prohibition; permanent login prohibition; account deletion; bearing legal liability. Any external third-party software used simultaneously with NervousTree Software may have an adverse impact on the game. The main consequences of using external applications may include choppy data transmission, causing players to frequently disconnect or experience lag. External applications may also infect your mobile smart devices (including but not limited to phones, tablets), computers, etc. with viruses, spyware, and other unknown programs. Third-party software may also steal information stored on your mobile smart devices or computers, such as account numbers, passwords, and other personal information.
Article 19: Rules for Handling Account Theft and Related Activities
To ensure players can enjoy the game pleasantly and protect their legitimate interests from infringement, NervousTree Company will vigorously crack down on and penalize account theft and related activities (including but not limited to stealing user accounts, game data, player personal information, assisting thieves in operations, etc.). Once confirmed or required by competent authorities, NervousTree Company has the right to immediately take disciplinary measures depending on the specific circumstances, including temporarily restricting game behavior, temporarily prohibiting login, permanently prohibiting login, suspending accounts, deleting files, etc. In severe cases, NervousTree Company reserves the right to pursue legal liability against the involved players. In the process of investigating and handling player theft incidents, to quickly investigate and resolve the issue, NervousTree Company may request assistance from relevant players in the investigation, including but not limited to suspending login for investigation, online communication, offline communication, etc.
Article 20: Rules for Handling Dishonest Acts Related to Recharge
Good faith is also a fundamental principle users should follow in recharge-related activities. After successfully recharging for NervousTree Services and obtaining virtual item usage rights or value-added services (hereinafter collectively referred to as "Recharge Benefits"), if you have any misunderstandings, dissatisfaction, suggestions, or other requests regarding NervousTree Services, you can contact NervousTree Company at any time through the customer service section or customer service hotline. If you choose to request a refund through other means instead of the above methods, you should immediately notify NervousTree Company through the customer service section or hotline to deduct the corresponding Recharge Benefits. If you still possess the recharge services after requesting a refund, this constitutes dishonest behavior. NervousTree Company will vigorously crack down on and penalize such behavior, including but not limited to one or more of the following: warning, deducting in-game values, freezing or recovering game virtual items, temporarily suspending gameplay, permanently suspending gameplay, forcing offline, suspending accounts, deleting files, and taking other technical measures to prevent users from engaging in such behavior. In severe cases, NervousTree Company reserves the right to pursue user legal liability (including but not limited to civil liability, criminal liability).
Article 21: Rules for Handling Data Anomalies
If NervousTree Company discovers abnormal user data or other illegal or improper behavior, "other improper behavior" includes but is not limited to: (1) Exploiting bugs or abnormal gameplay methods to enhance game character data or in-game character rankings. NervousTree Company has the right to investigate and take corresponding measures, including but not limited to: (1) Deleting game virtual items; (2) Confiscating illegitimate gains; (3) Rolling back or resetting data; (4) Temporarily prohibiting login; (5) Permanently prohibiting login; (6) Temporarily isolating; (7) Permanently isolating; (8) Forcing offline; (9) Suspending or even deleting user accounts, etc. You have no right to demand that NervousTree Company bear any responsibility as a result.
Article 22: Rules for Handling Acts of Seeking Illegitimate Gains
You understand and agree that NervousTree Company provides NervousTree Services to allow you to experience the rich and colorful game content, not to earn real-world money or seek economic gain by using NervousTree Services. If you engage primarily in trading and profit-making activities in the game rather than experiencing game content, it will破坏 the fairness or balance of the in-game economic system, thereby adversely affecting other users' gaming experience and the game itself. Therefore, you agree not to engage in game behavior for profit. Any profit-oriented game behavior will be considered seeking illegitimate gains. NervousTree Company has the right to simultaneously take the following measures against users seeking illegitimate gains: deducting in-game values from all user accounts involved in seeking illegitimate gains (including but not limited to accounts that obtained or sold game virtual items), recovering game virtual items, temporarily suspending gameplay, permanently suspending gameplay, forcing offline, temporarily isolating, permanently isolating, suspending accounts, deleting files, and taking other technical measures to prevent users from engaging in such behavior. In severe cases, NervousTree Company reserves the right to pursue user legal liability.
Article 23: Character Protection Rules
If you report that your character has been stolen, hacked, or has other abnormal situations, or if NervousTree Company discovers signs that your character may have been stolen, shared, abused, or other abnormal situations, to prevent your game character, game virtual items, etc. from being illegally infringed, NervousTree Company will investigate your character and, depending on the circumstances, take protective measures (including but not limited to temporarily freezing the character) during the investigation. Please follow NervousTree Company's guidance and submit relevant materials to cooperate with NervousTree Company's investigation so that the protective measures on your character can be lifted as soon as possible.
Article 24: Rules for Using Game Footage
Without the prior written permission of NervousTree Company, you shall not publicly display, reproduce, disseminate, or broadcast all or part of the game footage from NervousTree Services through third-party software, websites, or platforms. Otherwise, NervousTree Company has the right to take various handling measures based on the severity of your breach, including but not limited to one or more of the following, and NervousTree Company reserves the right to further pursue your legal liability: temporarily prohibiting login, forcing offline, suspending the account.
Article 25: Damages
If your违规 behavior in the game causes damage to NervousTree Company or a third party, you shall bear corresponding legal liability. Furthermore, regarding your own damage, NervousTree Company has the right to take all reasonable actions, including but not limited to recovering game virtual items, etc., and NervousTree Company has the right to claim compensation from you for the losses incurred and require you to bear NervousTree Company's reasonable collection costs.
Article 26: Force Majeure
NervousTree Company shall not be liable for losses caused by force majeure. Force majeure under this Agreement includes: natural disasters, changes in laws, regulations, or government directives, reasons specific to the nature of network services, such as failures of domestic or foreign basic telecommunications operators, computer, mobile device, or internet-related technical defects, limitations of internet coverage, computer or mobile device viruses, hacker attacks, and other circumstances that are unforeseeable, unavoidable, and insurmountable within legal bounds.
Article 27: Links and Advertising Information
Links provided by NervousTree Company on the game's official website, official game forum, or in the game may link to websites of other individuals, companies, or organizations. These websites are provided for your convenience in searching or obtaining information. NervousTree Company does not guarantee the authenticity, completeness, timeliness, or reliability of the products, services, or information provided on the linked websites of other individuals, companies, or organizations. These individuals, companies, or organizations have no employment, agency, partnership, or other similar relationship with NervousTree Company. NervousTree Company may publish commercial advertisements or other promotional activity information on the game's official website, official game forum, or in the game. These advertisements or promotional activity information are provided by advertisers or commercial service providers, who bear corresponding responsibility. NervousTree Company only provides a medium for publishing the content. Transactions for goods or services purchased through such linked websites or advertisements occur solely between you and the provider of those goods or services. NervousTree Company has no involvement and shall not bear any legal liability for transactions between you and the provider of those goods or services. You should pay special attention to this.
Article 28: Information Storage and Security, and Service Limitations
NervousTree Company will endeavor to maintain the security and convenience of the services provided under this Agreement but assumes no responsibility for the deletion or storage failure of information appearing in the service (including but not limited to information posted by users). NervousTree Company reserves the right to determine whether user behavior complies with the terms of this Agreement. If you violate the terms of this Agreement, NervousTree Company has the right to interrupt the services provided to you under this Agreement.
Article 29: Amendment of Terms
NervousTree Company has the right to amend the terms of this Agreement when necessary. Please check relevant content periodically. If you continue to use the services covered by this Agreement, it will be deemed as your agreement to the amended content. If you do not agree to the amended content, you should uninstall the NervousTree Software, terminate this Agreement, and stop using NervousTree Services.
Article 30: Game Data
Any data information generated and stored on NervousTree Company's servers during your participation in the game, including but not limited to account data, character data, level and virtual item data (excluding personal identification information such as your name, ID card number, phone number, etc.), is part of the game software and is owned and managed by NervousTree Company. You have the right to modify, transfer, discard, etc. the data information belonging to your own user account through legitimate channels, subject to game rules and legal regulations.
Article 31: Notices
All notices sent by NervousTree Company to users may be transmitted via in-game announcements, important page announcements on the game's official website or official forum, email, or regular telephone, YiXin, physical letters, etc. At the same time, you hereby agree that NervousTree Company may send commercial information to your email address, phone, YiXin, or physical address.
Article 32: Intellectual Property Rights and Authorization for User-Provided Content
NervousTree Company respects intellectual property rights and focuses on protecting the various rights enjoyed by users. In NervousTree Services, you may need to provide content to NervousTree Company through uploading, publishing, etc. In this case, you still retain the complete intellectual property rights to such content. You hereby explicitly agree that, while providing the aforementioned content, you irrevocably grant NervousTree Company and its affiliates a worldwide, perpetual, royalty-free license to use, reproduce, modify, sublicense, translate, publish, perform, and display such content, as well as to create derivative works using such content.
Article 33: Miscellaneous
To avoid disputes, regarding data and technical issues related to this Agreement, you agree to use the data stored on NervousTree Company's servers as the criterion for judgment. NervousTree Company guarantees the authenticity of such data. The headings of all clauses in this Agreement are for convenience only and have no inherent meaning and shall not be used as a basis for interpreting the meaning of this Agreement or related clauses. If any clause in this Agreement is deemed wholly or partially invalid or unenforceable for any reason, the other clauses of this Agreement shall remain valid and enforceable. NervousTree Company's failure to exercise, delay in exercising, or insufficient exercise of any right under this Agreement or provided by law shall not be deemed a waiver of such right, nor shall it affect NervousTree Company's right to exercise such right in the future.
The establishment, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China, excluding the application of any conflict of laws principles. In the event of any dispute arising from or in connection with the content or execution of this Agreement (including but not limited to contractual or other property rights disputes), the parties shall attempt to resolve the dispute through friendly negotiations. If negotiation fails, both parties agree to submit to the jurisdiction of the people's court where Hainan NervousTree Technology Co., Ltd. is located for handling.
This "NervousTree Technology Use License and Service Agreement" (hereinafter referred to as "this Agreement") is entered into by and between you and the provider of NervousTree services. This Agreement is legally binding. Please carefully read and fully understand the terms of this Agreement, especially those clauses that exempt or limit the liability of NervousTree, limit user rights, stipulate dispute resolution methods and judicial jurisdiction, as well as separate agreements for activating or using certain services. The aforementioned limitation, disclaimer, dispute resolution, and jurisdiction clauses may be brought to your attention by means of red/bold/underlined text or other reasonable methods.
Unless you have read and accepted all the terms of this Agreement, you are not authorized to use NervousTree services. Your use of NervousTree services constitutes your acceptance and agreement to be bound by this Agreement.
If you are under 18 years of age, please read this Agreement with your legal guardian, and pay special attention to the provisions regarding minors. Before using NervousTree services, you should obtain your guardian's consent to your use of NervousTree services in accordance with this Agreement.
Article 1: Parties to the Agreement
Hainan NervousTree Technology Co., Ltd. : The provider of NervousTree game services, which may provide NervousTree services to you through its own websites and platforms, as well as through the websites and platforms of partners.
You (also referred to as "Player" or "User") : A natural person who, through legal channels provided by NervousTree Company, obtains a non-commercial use license from NervousTree Company to install, use NervousTree software, or receive NervousTree services.
Article 2: Definitions and Explanations
NervousTree Software : Refers to game software provided by NervousTree Company (including any adaptable versions operable on mobile smart devices and/or computer terminals, in client or web form), as well as updates, upgrades, patches, expansion packs, etc. related to such game software, and may include related network servers, websites (including but not limited to the game's official website or forums), electronic media, printed materials, or electronic documents.
NervousTree Services : Refers to various online operational services provided by NervousTree Company to you related to the aforementioned NervousTree Software, including the NervousTree Software itself.
Value-Added Service Tokens : Refers to a type of virtual item designed by NervousTree Company to meet players' normal transaction and communication needs within NervousTree services, obtained through exchange for Renminbi (RMB) or other means, which can be used to purchase designated value-added services within the game, limited to use and circulation within specific games.
Article 3: Intellectual Property Statement
NervousTree Company lawfully possesses all legitimate rights and interests in the NervousTree Software (including but not limited to intellectual property rights such as computer software copyrights, artistic work copyrights, and patents, as well as the right to operate such NervousTree Software), or has obtained legal authorization from legitimate rights holders, thereby having the right to provide NervousTree Software and NervousTree Services to users.
The "NervousTree" text, LOGO (graphics), and other text, LOGO (graphics) used in specific services to identify service names and sources (including but not limited to the name, LOGO, ICON of NervousTree services, the name, LOGO, ICON of the NervousTree software developer, etc.) are trademarks or registered trademarks of NervousTree Company and/or its affiliates, partners in China and/or other countries/regions.
NervousTree Services may involve third-party intellectual property rights. If such third parties have requirements regarding your use of such intellectual property in NervousTree Services, NervousTree Company will notify you of such requirements in an appropriate manner, and you shall comply with such requirements.
All ownership and related ownership and intellectual property rights of game data generated during your use of NervousTree Services shall belong to NervousTree Company. To the maximum extent permitted by law, NervousTree Company has the right to preserve and dispose of such game data.
All rights not expressly granted to you under this Agreement are retained by NervousTree Company.
Article 4: NervousTree Software Use License and Restrictions
Subject to your agreement to accept all terms of this Agreement, NervousTree Company agrees to grant you a non-commercial, revocable, changeable, non-exclusive, non-transferable, and non-sublicensable right to use this NervousTree Software and NervousTree Services. You may, within the scope of authorization, install this NervousTree Software on mobile smart devices or computer terminals for personal use, run one copy of this NervousTree Software in the manner designated by NervousTree Company, and enjoy the services provided by NervousTree Company. The license granted by NervousTree Company under this Agreement is for personal use. If you need to use NervousTree Software and NervousTree Services beyond the scope of personal use or use them for any commercial purpose, you must contact NervousTree Company and obtain a separate authorization from NervousTree Company. Any installation, use, access, display, operation, commercial use, etc. without the permission of NervousTree Company constitutes an infringement against NervousTree Company.
Unless otherwise agreed in this Agreement, without the prior written consent of NervousTree Company, you shall not engage in the following acts (whether for profit or non-profit): (1) Copy, transcribe, decompile, disassemble, disseminate, or display all or part of the program, user manual, and other graphic, audio, and visual materials of the NervousTree Software, or reverse engineer any function or program of the NervousTree Software. (2) Publicly display or broadcast all or part of the NervousTree Software/NervousTree Services in various forms and on various platforms (including but not limited to live streaming platforms, websites, APPs, etc.). (3) Rent, sell the NervousTree Software, or engage in any profit-making activities using the NervousTree Software. (4) Modify or obscure the service name, company logo, trademark (or) copyright information, other intellectual property statements, etc. on the NervousTree Software program, images, animations, packaging, manuals, etc. (5) Use NervousTree Company's name, trademark, or other intellectual property in a manner not prescribed by this Agreement. (6) Other acts that violate the Trademark Law, Copyright Law, Computer Software Protection Regulations, relevant laws and regulations, and international treaties.
Article 5: Fee Policy
NervousTree Company has the right to determine the charging methods and fee standards for NervousTree Software and NervousTree Services. NervousTree Company has the right to set different charging methods and fee standards for NervousTree Software and NervousTree Services at different stages, and may adjust the fee policy at any time as needed. Specific charging methods, fee standards, including but not limited to the charging standards for NervousTree Software, the usage rights of virtual items in the game, and value-added services (if any), shall be promulgated by NervousTree Company in a general form common to the online game industry on APP STORE or other APP distribution channels, in-game item malls, item purchase interfaces, game official websites, and other game modules. You are obligated to read carefully before making a choice. Once you choose to download paid NervousTree Software, purchase relevant virtual item usage rights, or accept relevant services, it indicates that you fully understand and accept the corresponding charging methods and fee standards.
NervousTree Company has the right to establish, add, modify value-added services and issue value-added service tokens in the game as needed. Value-added service tokens are obtained through exchange for Renminbi. Once Renminbi is exchanged for value-added service tokens, it is deemed that the Renminbi has been used, and the value-added service tokens cannot be exchanged back into Renminbi. Value-added service tokens are used to purchase usage rights for relevant virtual items or to receive relevant value-added services. In cases where the purchase of usage rights for virtual items or the receipt of other value-added services constitutes a chargeable item, if the valid usage period of the virtual item or the valid service period of the value-added service expires (regardless of whether you have actually used or enjoyed the service), or if the valid usage or service count is exceeded, NervousTree Company has the right to take measures to cancel your usage rights for the aforementioned virtual items or stop providing the value-added services.
Article 6: Game Virtual Items
Game virtual items (or "virtual items" for short) include but are not limited to game characters, resources, props (including but not limited to equipment in the game, etc.). Their ownership belongs to NervousTree Company. You may only use them in accordance with legal provisions and game rules.
For various types of virtual items in the game, if no special usage period is indicated, it is defaulted that you may continue to use them after obtaining the usage rights until the corresponding NervousTree Service terminates. If a special usage period is indicated, the usage period shall be as specially indicated. Upon expiration of the usage period, NervousTree Company has the right to reclaim the usage rights at any time without prior notice to you (such usage period shall not be interrupted or suspended for any reason).
Obtaining in-game virtual items from third parties may involve various risks. You shall not obtain the aforementioned game virtual items from third parties. If you insist on obtaining the aforementioned game virtual items from third parties, you shall bear the corresponding risks. NervousTree Company has the right to directly reclaim, permanently seal, or delete such game virtual items. NervousTree Company is not responsible for third-party transactions and will not accept appeals arising from disputes over any third-party transactions.
Measures taken by NervousTree Company due to your violation of this Agreement or laws may result in virtual items with a usage period or virtual item exchange codes under your current game account expiring and becoming unusable due to the expiration of the usage period during the period NervousTree Company takes the aforementioned measures. Any losses incurred by you as a result shall be borne by you. That is, the duration during which NervousTree Company takes the aforementioned measures is counted within the usage period of the virtual items or virtual item exchange codes; the usage period of the virtual items or virtual item exchange codes will not be extended after the execution of such measures ends.
Article 7: User Account Registration, Use, and Custody
To jointly provide you with product services, improve the quality of product services, or for reasonable considerations regarding the security of product services, we may receive your personal information and other information from affiliated companies, partners, and other trusted third parties in accordance with relevant laws, regulations, regulatory requirements, or with your authorization. Account registration users promise to register accounts with NervousTree Company or other recognized partners using their real identity, and accept NervousTree Services using such accounts (hereinafter also referred to as "User Accounts"). You agree that the accurate personal information you provide shall serve as the sole evidence for establishing the association between you and the game account and your identity. You only have the right to use the game account you create; ownership of the game account belongs to NervousTree Company.
User Account Use and Custody: (1) According to the terms of the essential clauses, NervousTree Company has the right to review whether the identity information you provided during registration is true and effective, and shall actively take reasonable technical and managerial measures to ensure the security and effectiveness of your user account. You are obligated to properly keep your user account and password and to use your user account and password correctly and safely. If either party fails to fulfill the above obligations, leading to loss of the user account password, theft of the user account, or other circumstances causing damage to your or others' civil rights, the party at fault shall bear the resulting legal liability. (2) You have the right and bear responsibility for actions performed using your user account according to law. (3) Once you discover that your user account or password is being illegally used by others or there are abnormal usage conditions, you shall promptly follow the processing methods published by the account service provider and have the right to promptly notify NervousTree Service provider, NervousTree Company, to take measures to suspend the login and use of that user account. (4) When NervousTree Company takes measures to suspend the login and use of a user account based on your notification, NervousTree Company shall require you to provide and verify personal valid identification information or proof consistent with your registered identity information. (5) If NervousTree Company verifies that the personal valid identification information or proof you provide matches the registered identity information, it shall promptly take measures to suspend the login and use of the user account. (6) If NervousTree Company violates the agreement in subparagraph (5) above and fails to promptly take measures to suspend the login and use of the user account, thereby causing losses to you, it shall bear corresponding legal liability. (7) If you fail to provide your personal valid identification information or proof, or if the personal valid identification information or proof you provide does not match the registered identity information, or if you fail to update your user account information in a timely manner after changes, making it impossible to prove your valid identity, NervousTree Company has the right to refuse your above request. (8) When you provide personal valid identification information or proof consistent with your registered identity information to NervousTree Company to protect your legitimate rights and interests, NervousTree Company shall provide necessary assistance and support, such as account registrant proof, original registration information, etc., according to law, and provide relevant evidence information materials to relevant administrative authorities and judicial organs as needed. (9) If you have not logged into the game for 365 consecutive days, then from 24:00 on the 365th day, NervousTree Company has the right to take measures to delete your user account and any records of that user account in the game database (including but not limited to character, level, virtual items, value-added service tokens, etc.). The deleted data cannot be recovered. Such disposal may lead to the loss of your relevant rights and interests under that game account, and NervousTree Company shall not bear any responsibility for this. (10) You are obligated to properly keep your game account and related passwords, and to use your game account and password correctly and safely. The game account registered by you in accordance with this Agreement is only for the purpose of saving and backing up your personal game data. The right to use the game account belongs solely to the initial registrant. Gifting, assigning, transferring, inheriting, or selling is prohibited. You shall not provide your game account to others for use in any way, including but not limited to providing it to others for commercial use, including but not limited to game live streaming, video recording, account boosting/leveling, equipment farming, skill demonstration, etc., regardless of whether for profit or not. Otherwise, NervousTree Company has the right to take measures against your game account, including but not limited to warnings, restricting or prohibiting all or part of the functions of the game account, deleting the game account and game data and other related information, account suspension or even cancellation, etc. All legal consequences and losses arising therefrom shall be borne by you. If you are not the initial registrant of the account, and you fail to properly keep the account and password and use them correctly and safely, leading to loss of the account password, theft of the account, or other circumstances causing damage to your and others' civil rights, you shall bear the resulting legal liability. (11) NervousTree Company prohibits users from privately transferring game accounts, whether for compensation or not, to avoid disputes arising from game account issues. NervousTree Company will not accept appeals arising from disputes over any private user transactions. You shall bear any losses incurred due to violating this requirement, and NervousTree Company reserves the right to pursue legal liability against the violator.
NervousTree Company will use your real-name registration information in the anti-addiction system as required by relevant national authorities. That is, NervousTree Company may determine whether you are over 18 years old based on your real-name registration information, thereby deciding whether to impose anti-addiction restrictions on your game account.
Article 8: User Privacy Information Protection and Collection
When NervousTree Company requires you to provide information related to your personal identity, it shall disclose its privacy protection policy and personal information use policy to you in a clear and conspicuous manner in advance, and take necessary measures to protect the security of your personal information.
Without disclosing individual user privacy information, NervousTree Company has the right to conduct technical analysis on the entire user database and commercially utilize the analyzed and organized user database. Despite NervousTree Company's great efforts to protect user privacy, it cannot guarantee that existing security technical measures will prevent all forms of loss of your technical information, etc.
Without user permission, NervousTree Company shall not disclose or share user registration information such as name, personal valid ID card number, contact information, home address, etc. to any third party, except in the following circumstances: (1) With the explicit authorization of the user or the user's guardian; (2) As required by relevant laws and regulations; (3) As required by judicial authorities or other competent authorities based on legal procedures; (4) As required by relevant government authorities; (5) To protect the public interest; (6) In emergency situations to protect the interests of other users or third parties; (7) When filing a lawsuit or arbitration against you to protect NervousTree's own legitimate rights and interests; (8) As stipulated in this clause or other circumstances deemed necessary by NervousTree.
NervousTree Company may cooperate with third parties to provide related network services to users. In such case, if the third party agrees to assume the same responsibility for protecting user privacy as NervousTree Company, NervousTree Company may provide the user's registration information, etc. to the third party and limit the scope of use by the third party.
NervousTree Company will, as always, take technical and managerial measures according to national regulations to ensure network information security, including preventing computer virus infections and attacks, backing up important databases, saving user registration information and other data, and protecting users' personal information according to law.
Without disclosing individual user privacy information, you agree that NervousTree Company and its related companies or cooperation partners may collect, process, analyze, save, and use such information within a reasonable scope to provide you with other information or services, compile accounting data, conduct surveys or research on network behavior, or for any other legal use. To protect your privacy rights and regulate the use of your personal information, NervousTree Company has formulated a "User Privacy Agreement." Please read the content of this agreement carefully.
In addition to the aforementioned personal information, you agree and authorize NervousTree Company to collect other necessary information from you based on administrative/judicial authority requirements or considerations such as security and user experience optimization. However, NervousTree Company may only collect and use such information for the purpose of performing this Agreement.
Article 9: Obligations of NervousTree Company
NervousTree Company agrees to provide NervousTree Services to users through the internet according to the terms of this Agreement.
NervousTree Company shall keep records of game virtual currency recharges for a period of 180 days from the date of user recharge.
When using NervousTree Company's game virtual currency, you have the right to request NervousTree Company to assist in retrieving recharge records and transfer records of the game virtual currency. NervousTree Company shall require you to provide and verify personal valid identification information or proof consistent with your registered identity information. If NervousTree Company verifies that the personal valid identification information or proof you provide matches the registered identity information, it shall provide assistance. If you fail to provide your personal valid identification information or proof, or if the personal valid identification information or proof you provide does not match the registered identity information, NervousTree Company has the right to refuse your aforementioned request.
If you use a third-party account recognized by NervousTree Company as your game account to use NervousTree Services, you must also strictly comply with the relevant user agreements and usage rules of that third-party account. If issues arise from using such third-party account (including but not limited to account theft, inability to use the account, abnormal account status, etc.), you shall contact the third party yourself to resolve the issue. NervousTree Company may provide limited and reasonable assistance at its discretion.
Article 10: Obligations of the User
You shall equip yourself with the necessary devices for internet access, including but not limited to mobile smart devices (including but not limited to mobile phones, tablets), computers, wireless routers, or other necessary internet access devices.
You shall bear the telecommunications fees, network usage fees, and other costs related to this service incurred for internet access.
Comply with the terms of this Agreement, other relevant rules and system provisions (including but not limited to those published by NervousTree Company on the game's official website or within the game); comply with relevant laws and regulations of the People's Republic of China (if you are a user outside the People's Republic of China, you should also comply with the laws and regulations of your country or region).
Article 11: Improper Game Behavior
You shall bear the responsibility for the content of the information you publish. In particular, you shall not publish content that: (1) Opposes the basic principles established by the Constitution of the People's Republic of China; (2) Endangers national security, leaks state secrets, subverts state power, or undermines national unity; (3) Damages national honor and interests; (4) Incites ethnic hatred or discrimination or undermines ethnic unity; (5) Undermines national religious policies or promotes cults or feudal superstitions; (6) Spreads rumors, disrupts social order, or undermines social stability; (7) Spreads obscenity, pornography, gambling, violence, murder, terror, or incites crime; (8) Insults or defames others or infringes upon the lawful rights and interests of others; (9) Promotes or teaches the use of cheats, private servers, or Trojans; (10) Publishes any homepage address or link that, in NervousTree Company's reasonable judgment, is inappropriate or contains software, files, etc. not recognized by NervousTree Company; (11) Contains other content prohibited by the laws and administrative regulations of the People's Republic of China.
You shall not use NervousTree Software, NervousTree Services, or participate in NervousTree activities through improper or unfair means. You shall not interfere with NervousTree Company's normal provision of software and services, including but not limited to: attacking or intruding into NervousTree Company's website servers, or logging in or attempting to log into servers at a frequency exceeding normal user login requirements within a concentrated period, thereby overloading the website servers; cracking or modifying the NervousTree Software provided by NervousTree Company; attacking or intruding into NervousTree Company's game servers/game server-side programs or overloading the game servers; creating, publishing, disseminating, or using any form of auxiliary tools or programs that hinder game fairness (including but not limited to "cheats," where "cheat" refers to any program independent of the game software that can affect game operations while the game is running, including but not limited to simulating user operations, changing the operating environment, modifying data, etc.). You shall not: exploit program loopholes or bugs to disrupt the normal progress of the game or disseminate such loopholes or bugs; unreasonably interfere with or hinder others' use of the software and services provided by NervousTree Company; use NervousTree Company's software through abnormal or illegal means (including but not limited to using NervousTree Software to log into private game servers); use abnormal methods to log into the game (including but not limited to using third-party software or systems not developed, authorized, or recognized by NervousTree Company to log into the game), use network accelerators or other cheat software or robot programs to maliciously destroy service facilities or disrupt normal service order; modify, translate, annotate, compile, organize, or adapt the NervousTree Software; exploit possible technical defects or loopholes in the software or online game system to profit for oneself or others in various forms (including but not limited to duplicating game virtual items) or engage in other improper acts. You agree to use the monitoring data within the game program as the basis for determining whether you have engaged in game cheating, such as by using cheat programs.
Article 12: Interruption, Suspension, and Termination of Service
Suspension and Termination of Service to Users: (1) If a user publishes illegal information, seriously violates social morality, or engages in other acts prohibited by law, NervousTree Company shall immediately terminate the provision of services to the user. (2) If a user engages in improper conduct while receiving NervousTree Company's services, NervousTree Company has the right to terminate the provision of services to the user. The specific improper conduct must be explicitly defined in this Agreement or constitute a prohibited act that NervousTree Company has clearly informed the user would result in service termination; otherwise, NervousTree Company shall not terminate the provision of services to the user. (3) If a user provides false registration identity information or violates this Agreement, NervousTree Company has the right to suspend all or part of the services provided to the user. NervousTree Company shall notify the user of the suspension measure and inform them of the suspension period. The suspension period should be reasonable. Upon the expiry of the suspension period, NervousTree Company shall promptly resume services to the user. (4) If NervousTree Company suspends or terminates all or part of the services provided to a user according to subparagraphs (1), (2), or (3) of this clause, NervousTree Company shall bear the burden of proof.
Interruption, Suspension, and Termination of Game Server Operations: (1) To ensure the normal operation of game servers, NervousTree Company needs to perform regular or emergency maintenance. Please understand that normal service interruptions or suspensions may occur due to the above circumstances, and NervousTree Company is obligated to minimize the interruption time. NervousTree Company has the right to terminate or interrupt all or part of the services provided by the game server under any of the following circumstances, and shall not bear any responsibility to users or third parties for any inconvenience or damage arising therefrom: ① Scheduled inspections or construction, software/hardware updates, etc. NervousTree Company has the right to suspend services but will complete maintenance and updates as soon as possible; ② Game server damage preventing normal operation; ③ Sudden failure of software/hardware equipment or electronic communication equipment; ④ Network provider line or other failures; ⑤ In emergency situations as required by law or for the personal safety of users or third parties; ⑥ Third-party reasons or other force majeure circumstances. (2) NervousTree Company reserves the right to terminate or partially terminate the provision of NervousTree Services when it deems necessary, providing a 60-day advance notice. Regardless of the reason for terminating NervousTree Services, you shall take appropriate measures to handle your game virtual items, including but not limited to canceling or stopping the use of your user account, game virtual items, etc. You shall not demand any form of compensation or reimbursement from NervousTree Company due to the complete termination of NervousTree Services, except for game virtual currency you have purchased but not yet used. This includes but is not limited to compensation for the inability to continue using your user account, game virtual items, etc.
Article 13: Special Explanation for Combat System
Certain NervousTree Services may contain a combat system where users can freely fight each other. For such NervousTree Services containing a combat system, once you click "Accept" (or other words with similar meaning, such as "Agree") and install the corresponding NervousTree Software, or register, start using, and/or continue using the corresponding NervousTree Software or NervousTree Services, it will be deemed that you agree to all free combat behaviors in the game's combat system and agree to abide by the rules of free combat.
Article 14: Special Explanation for Single-Player Games
For NervousTree Services primarily consisting of single-player games, the recharge system is only usable after accessing the internet or a mobile communication network (such as SMS payment). If you use the recharge system to make a payment, the recharge information will be confirmed via the internet or a mobile communication network (such as SMS payment). For NervousTree Services primarily consisting of single-player games, all game data will be stored on your mobile smart device. If you uninstall or reinstall the NervousTree Software, or if your mobile smart device is damaged, preventing the NervousTree Software from starting normally, your entire game data may be unrecoverable. If you need to save game data on the game server, you need to perform data saving operations while connected to the network.
Article 15: Explanation of Basic Methods for Handling Player Violations
Forced Offline: Force the player to exit the game and return to the login screen.
Character Suspension: Temporarily or permanently prohibit the character from logging into the game.
Account Suspension: Temporarily or permanently prohibit the account from being used.
Article 16: Content of Penalties for In-Game Violations
Properly Handling Relationships Between Players: (1) Account theft (including but not limited to stealing accounts, game data, player personal information) and activities related to account theft (assisting the thief in operating and transferring game items, etc.) may result in the following penalties depending on the actual situation and severity: freezing or recovering game items, deducting in-game values, imprisoning the character, suspending the account, bearing legal liability. (2) Spreading or disseminating information about Trojans, cheats, viruses, private servers, etc., through various means or behaviors may result in the following penalties depending on the actual situation and severity: warning, temporary imprisonment of character, account suspension.
Properly Handling the Relationship Between Players and the Game: (1) Spreading words or actions that harm national dignity and honor or disrupt social order may result in the following penalties depending on the actual situation and severity: muting, forced offline, imprisonment of character, account suspension, bearing legal liability (referral to competent state authorities for handling). (2) Attacking or intruding into game servers by various means, or using abnormal methods to log into the game world servers operated by NervousTree Company may result in the following penalties depending on the actual situation and severity: account suspension, bearing legal liability. (3) Using third-party software to maliciously damage service facilities or disrupt normal service order (including but not limited to using compiled or decompiled programs to modify game data, using cheats such as accelerators or other cheating software or robot programs) may result in the following penalties depending on the actual situation and severity: account suspension, bearing legal liability. (4) Exploiting system anomalies or bugs (directly or indirectly using game bugs, program loopholes, etc.) for profit or to disrupt game order may result in the following penalties depending on the actual situation and severity: forced offline, recovery of benefits gained from the bug, character suspension, account suspension, bearing legal liability. (5) Using game functions to破坏 game balance or damage the legitimate interests of other players or the company (including but not limited to gold farming studios, illegal offline trading, etc.) may result in the following penalties depending on the actual situation and severity: account suspension, bearing legal liability. (6) Using game functions for illegal physical goods trading or other acts violating national laws and regulations. NervousTree does not recognize transaction results from trading platforms not provided or recognized by NervousTree Company. Game items or accounts obtained by players from trading platforms not provided or recognized by NervousTree Company will be deemed as originating in violation of game rules. Illegal transactions may result in the following penalties depending on the actual situation and severity: warning, freezing or recovering game items or in-game currency, deducting in-game values, forced offline, character suspension, account suspension, bearing legal liability. (7) Impersonating NervousTree Company staff, GMs, or the system to spread or disseminate false information to other players, or attempting to defraud by impersonating officials, may result in the following penalties depending on the actual situation and severity: muting, account suspension. (8) Ignoring GM warnings or obstructing operations (including but not limited to insulting GMs, deceiving or attempting to deceive GMs, violating or ignoring prompts from GMs, harassing GMs) may result in the following penalties depending on the actual situation and severity: warning, muting, account suspension. (9) Making false or malicious complaints or reports may result in the following penalties depending on the actual situation and severity: warning, account suspension. (10) Using NervousTree products or receiving NervousTree services with or through third-party software, disrupting game rules and fairness (including but not limited to using scripts, multi-client tools, etc.): may result in the following penalties depending on the actual situation and severity: account suspension.
Other: Other words or actions not listed above that hinder other players' normal gaming or adversely affect game operations may result in the following penalties depending on the actual situation and severity: warning, muting, forced offline, account suspension, character deletion, bearing legal liability (referral to competent state authorities for handling). GMs have the right to immediately suspend the online access rights of any game account that may endanger the interests of the majority of players without prior notice. All GMs will strictly adhere to the principles of neutrality and fairness in handling issues.
Article 17: Game Master (GM) Interaction Management Rules
During gameplay, players may interact with GMs for various reasons. NervousTree Company will provide in-game online questioning as a communication platform between players and GMs for specific games. If you encounter problems in the game, you can submit questions through online questioning, which will provide you with fast and quality service.
We hope that communication between GMs and players will be helpful, but please abide by the relevant rules. NervousTree Company will strictly handle the following behaviors: (1) Impersonating the system or GM: Some players may impersonate the system or GM in the game. If discovered, you can report it to GMs via the game forum and assist in the investigation. Once confirmed, NervousTree Company will take strict disciplinary action against such players. (2) Deceiving or attempting to deceive GMs: In the game, players should not attempt to exploit NervousTree Company's trust by deceiving or attempting to deceive GMs. If discovered, NervousTree Company will take strict disciplinary action against such players. Attempts to deceive GMs include but are not limited to misleading GMs, refusing to provide information, providing false information, and any attempt to "scam" GMs. (3) Violating or ignoring prompts from GMs: In the game, to ensure the common interests of the majority of players and maintain normal game order, GMs may prompt players to perform or stop performing certain actions. Any neglect or obstruction of such work may result in penalties for the player's game character. Therefore, players should maintain a cooperative attitude. (4) Interfering with GM work: In the game, if the following behaviors occur, NervousTree Company will take strict disciplinary action: ① Requesting any virtual game items from GMs (including but not limited to game resources, equipment, etc.); ② Frequently calling GMs or sending requests with no substantive content; ③ Repeatedly sending help requests to GMs that have already been answered or resolved. (5) Insulting or maliciously attacking GMs: In the game, insulting or maliciously attacking GMs is not allowed. If discovered, NervousTree Company will take strict disciplinary action.
If a player is found to violate any of the provisions in paragraph 2 of this article, they may be subject to the following penalties depending on the situation: warning; muting; temporary gameplay suspension; permanent gameplay suspension; temporary login prohibition; permanent login prohibition; forced offline; account suspension; account deletion; forum post deletion; forum account blocking; temporary service interruption; bearing legal liability.
Password Retrieval: In case of forgotten or lost password, please first try to log in to the "NervousTree User Center" page yourself to retrieve it. If you cannot retrieve it, you can collect relevant information for password retrieval and contact a GM. NervousTree Company will have dedicated staff investigate and handle the matter for you. If you log into the game using a partner account recognized by NervousTree Company and forget or lose your password, please promptly contact the entity that provided the account registration service (i.e., the partner recognized by NervousTree Company) for handling. Friendly reminder: No GM or NervousTree Company staff will ask you for your account password, security code, or other information in the game or forum. Please be aware to avoid unnecessary losses.
Article 18: Rules for Handling Game Bugs and Third-Party Software
Game bugs refer to loopholes or unreasonable phenomena in the game system, program, settings, etc. Players are obligated to report bugs appearing in the game to GMs. Players are strictly prohibited from directly or indirectly exploiting game bugs, program loopholes, etc. for profit or to disrupt game order, or using bugs/loopholes for personal gain. If a player engages in such behavior, once confirmed, they may be subject to the following penalties: confiscation of illegitimate gains obtained directly or indirectly by exploiting bugs; deduction of in-game values (including but not limited to experience points); transaction reversal; deduction of proceeds from违规 transactions; transaction function restriction; forced offline; temporary gameplay suspension; permanent gameplay suspension; temporary login prohibition; permanent login prohibition; account deletion; bearing legal liability.
Unauthorized third-party software refers to any file or program that can be used to gain an advantage in the game but is not part of the corresponding NervousTree Software, including cheating cheats and related auxiliary cheats (including but not limited to auto-leveling, auto-questing, acceleration, or other operations beyond the game's intended scope). If the use of cheating cheats or related auxiliary cheats is discovered, we will take strict disciplinary action, including: confiscation of illegitimate gains obtained directly or indirectly by using third-party software; deduction of in-game values (including but not limited to experience points); temporary gameplay suspension; permanent gameplay suspension; forced offline; temporary login prohibition; permanent login prohibition; account deletion; bearing legal liability. Any external third-party software used simultaneously with NervousTree Software may have an adverse impact on the game. The main consequences of using external applications may include choppy data transmission, causing players to frequently disconnect or experience lag. External applications may also infect your mobile smart devices (including but not limited to phones, tablets), computers, etc. with viruses, spyware, and other unknown programs. Third-party software may also steal information stored on your mobile smart devices or computers, such as account numbers, passwords, and other personal information.
Article 19: Rules for Handling Account Theft and Related Activities
To ensure players can enjoy the game pleasantly and protect their legitimate interests from infringement, NervousTree Company will vigorously crack down on and penalize account theft and related activities (including but not limited to stealing user accounts, game data, player personal information, assisting thieves in operations, etc.). Once confirmed or required by competent authorities, NervousTree Company has the right to immediately take disciplinary measures depending on the specific circumstances, including temporarily restricting game behavior, temporarily prohibiting login, permanently prohibiting login, suspending accounts, deleting files, etc. In severe cases, NervousTree Company reserves the right to pursue legal liability against the involved players. In the process of investigating and handling player theft incidents, to quickly investigate and resolve the issue, NervousTree Company may request assistance from relevant players in the investigation, including but not limited to suspending login for investigation, online communication, offline communication, etc.
Article 20: Rules for Handling Dishonest Acts Related to Recharge
Good faith is also a fundamental principle users should follow in recharge-related activities. After successfully recharging for NervousTree Services and obtaining virtual item usage rights or value-added services (hereinafter collectively referred to as "Recharge Benefits"), if you have any misunderstandings, dissatisfaction, suggestions, or other requests regarding NervousTree Services, you can contact NervousTree Company at any time through the customer service section or customer service hotline. If you choose to request a refund through other means instead of the above methods, you should immediately notify NervousTree Company through the customer service section or hotline to deduct the corresponding Recharge Benefits. If you still possess the recharge services after requesting a refund, this constitutes dishonest behavior. NervousTree Company will vigorously crack down on and penalize such behavior, including but not limited to one or more of the following: warning, deducting in-game values, freezing or recovering game virtual items, temporarily suspending gameplay, permanently suspending gameplay, forcing offline, suspending accounts, deleting files, and taking other technical measures to prevent users from engaging in such behavior. In severe cases, NervousTree Company reserves the right to pursue user legal liability (including but not limited to civil liability, criminal liability).
Article 21: Rules for Handling Data Anomalies
If NervousTree Company discovers abnormal user data or other illegal or improper behavior, "other improper behavior" includes but is not limited to: (1) Exploiting bugs or abnormal gameplay methods to enhance game character data or in-game character rankings. NervousTree Company has the right to investigate and take corresponding measures, including but not limited to: (1) Deleting game virtual items; (2) Confiscating illegitimate gains; (3) Rolling back or resetting data; (4) Temporarily prohibiting login; (5) Permanently prohibiting login; (6) Temporarily isolating; (7) Permanently isolating; (8) Forcing offline; (9) Suspending or even deleting user accounts, etc. You have no right to demand that NervousTree Company bear any responsibility as a result.
Article 22: Rules for Handling Acts of Seeking Illegitimate Gains
You understand and agree that NervousTree Company provides NervousTree Services to allow you to experience the rich and colorful game content, not to earn real-world money or seek economic gain by using NervousTree Services. If you engage primarily in trading and profit-making activities in the game rather than experiencing game content, it will破坏 the fairness or balance of the in-game economic system, thereby adversely affecting other users' gaming experience and the game itself. Therefore, you agree not to engage in game behavior for profit. Any profit-oriented game behavior will be considered seeking illegitimate gains. NervousTree Company has the right to simultaneously take the following measures against users seeking illegitimate gains: deducting in-game values from all user accounts involved in seeking illegitimate gains (including but not limited to accounts that obtained or sold game virtual items), recovering game virtual items, temporarily suspending gameplay, permanently suspending gameplay, forcing offline, temporarily isolating, permanently isolating, suspending accounts, deleting files, and taking other technical measures to prevent users from engaging in such behavior. In severe cases, NervousTree Company reserves the right to pursue user legal liability.
Article 23: Character Protection Rules
If you report that your character has been stolen, hacked, or has other abnormal situations, or if NervousTree Company discovers signs that your character may have been stolen, shared, abused, or other abnormal situations, to prevent your game character, game virtual items, etc. from being illegally infringed, NervousTree Company will investigate your character and, depending on the circumstances, take protective measures (including but not limited to temporarily freezing the character) during the investigation. Please follow NervousTree Company's guidance and submit relevant materials to cooperate with NervousTree Company's investigation so that the protective measures on your character can be lifted as soon as possible.
Article 24: Rules for Using Game Footage
Without the prior written permission of NervousTree Company, you shall not publicly display, reproduce, disseminate, or broadcast all or part of the game footage from NervousTree Services through third-party software, websites, or platforms. Otherwise, NervousTree Company has the right to take various handling measures based on the severity of your breach, including but not limited to one or more of the following, and NervousTree Company reserves the right to further pursue your legal liability: temporarily prohibiting login, forcing offline, suspending the account.
Article 25: Damages
If your违规 behavior in the game causes damage to NervousTree Company or a third party, you shall bear corresponding legal liability. NervousTree Company shall not be liable for losses caused by force majeure. Force majeure under this Agreement includes: natural disasters, changes in laws, regulations, or government directives, reasons specific to the nature of network services, such as failures of domestic or foreign basic telecommunications operators, computer, mobile device, or internet-related technical defects, limitations of internet coverage, computer or mobile device viruses, hacker attacks, and other circumstances that are unforeseeable, unavoidable, and insurmountable within legal bounds.
Article 27: Links and Advertising Information
Links provided by NervousTree Company on the game's official website, official game forum, or in the game may link to websites of other individuals, companies, or organizations. These websites are provided for your convenience in searching or obtaining information. NervousTree Company does not guarantee the authenticity, completeness, timeliness, or reliability of the products, services, or information provided on the linked websites of other individuals, companies, or organizations. These individuals, companies, or organizations have no employment, agency, partnership, or other similar relationship with NervousTree Company. NervousTree Company may publish commercial advertisements or other promotional activity information on the game's official website, official game forum, or in the game. These advertisements or promotional activity information are provided by advertisers or commercial service providers, who bear corresponding responsibility. NervousTree Company only provides a medium for publishing the content. Transactions for goods or services purchased through such linked websites or advertisements occur solely between you and the provider of those goods or services. NervousTree Company has no involvement and shall not bear any legal liability for transactions between you and the provider of those goods or services. You should pay special attention to this.
Article 28: Information Storage and Security, and Service Limitations
NervousTree Company will endeavor to maintain the security and convenience of the services provided under this Agreement but assumes no responsibility for the deletion or storage failure of information appearing in the service (including but not limited to information posted by users). NervousTree Company reserves the right to determine whether user behavior complies with the terms of this Agreement. If you violate the terms of this Agreement, NervousTree Company has the right to interrupt the services provided to you under this Agreement.
Article 29: Amendment of Terms
NervousTree Company has the right to amend the terms of this Agreement when necessary. Please check relevant content periodically. If you continue to use the services covered by this Agreement, it will be deemed as your agreement to the amended content. If you do not agree to the amended content, you should uninstall the NervousTree Software, terminate this Agreement, and stop using NervousTree Services.
Article 30: Game Data
Any data information generated and stored on NervousTree Company's servers during your participation in the game, including but not limited to account data, character data, level and virtual item data (excluding personal identification information such as your name, ID card number, phone number, etc.), is part of the game software and is owned and managed by NervousTree Company. You have the right to modify, transfer, discard, etc. the data information belonging to your own user account through legitimate channels, subject to game rules and legal regulations.
Article 31: Notices
All notices sent by NervousTree Company to users may be transmitted via in-game announcements, important page announcements on the game's official website or official forum, email, or regular telephone, YiXin, physical letters, etc. At the same time, you hereby agree that NervousTree Company may send commercial information to your email address, phone, YiXin, or physical address.
Article 32: Intellectual Property Rights and Authorization for User-Provided Content
NervousTree Company respects intellectual property rights and focuses on protecting the various rights enjoyed by users. In NervousTree Services, you may need to provide content to NervousTree Company through uploading, publishing, etc. In this case, you still retain the complete intellectual property rights to such content. You hereby explicitly agree that, while providing the aforementioned content, you irrevocably grant NervousTree Company and its affiliates a worldwide, perpetual, royalty-free license to use, reproduce, modify, sublicense, translate, publish, perform, and display such content, as well as to create derivative works using such content.
Article 33: Miscellaneous
To avoid disputes, regarding data and technical issues related to this Agreement, you agree to use the data stored on NervousTree Company's servers as the criterion for judgment. NervousTree Company guarantees the authenticity of such data. The headings of all clauses in this Agreement are for convenience only and have no inherent meaning and shall not be used as a basis for interpreting the meaning of this Agreement or related clauses. If any clause in this Agreement is deemed wholly or partially invalid or unenforceable for any reason, the other clauses of this Agreement shall remain valid and enforceable. NervousTree Company's failure to exercise, delay in exercising, or insufficient exercise of any right under this Agreement or provided by law shall not be deemed a waiver of such right, nor shall it affect NervousTree Company's right to exercise such right in the future.
