End User License Agreement (EULA) for Iron of Dust

PLEASE READ THIS TEXT CAREFULLY, AS IT EXPLICITY DESCRIBES THE PROHIBITION ON SOFTWARE MODIFICATION.

1. License Grant

The licensor (Fatjon Maloku) hereby grants the end‑user (hereinafter “licensee”) a non‑exclusive, non‑transferable, revocable licence to install and use the game Iron of Dust (hereinafter “software”) solely for personal, non‑commercial purposes on compatible devices.

2. Copyright & Ownership

  • The software and all associated content (graphics, audio, code, documentation, etc.) are the intellectual property of the licensor. Some associated content is inellectual property of FAB markteplace licensors. Unreal Engine 5 is property of Epic Games, Inc. (see Unreal Engine 5 license).
  • The licensee acquires no ownership rights of the software; all rights not expressly granted herein remain with the respective licensor.

3. Usage Restrictions

The licensee may not:

  • Reproduce: Copy, duplicate, or distribute the software (including uploading to file‑sharing services).
  • Modify: Alter the source code, binaries, or assets, unless expressly authorised.
  • Commercially exploit: Use the software for commercial products, streaming, competitions, or the sale of in‑game items.
  • Decompile/Reverse‑Engineer: Attempt to analyse, decompile, or otherwise reverse‑engineer the software.
  • Sublicense
  • Grant any third party rights under this licence.
  • Violate Unreal‑Engine Terms: Breach the Unreal Engine End User License Agreement (UE‑EULA) of Epic Games, Inc.

4. Disclaimer of Warranty

The software is provided “as‑is.” The licensor makes no warranties that the software will:

  • be error‑free, secure, or compatible with any particular hardware or software;
  • meet any specific purpose; or
  • remain uninterrupted or free from data loss or damage resulting from its use.

5. Limitation of Liability

The licensor shall not be liable for indirect, incidental, special, or consequential damages, even if advised of the possibility of such damages. The licensor’s total liability for all claims arising out of this agreement shall be limited to the amount the Licensee paid for the software (if any). Epic Games, Inc. is indemnified against all third-party claims resulting from the use of the software.

6. Termination

  • Immediate termination upon breach of Section 3.
  • Upon termination, all granted rights cease; the Licensee must promptly destroy all copies of the software.

7. Updates & Support

The licensor may, at its discretion, provide updates, patches, or new versions. The Licensee is not obligated to install such updates. Support is offered voluntarily and does not create any entitlement to ongoing assistance.

8. Data Protection

The use of the game may transmit data to third‑party services (e.g., Epic Games Inc., Valve). Such collection, processing, and storage are governed by the Privacy Policy of the third-parties, if data is being collected.

9. Governing Law & Jurisdiction

This agreement is governed by the laws of the Federal Republic of Germany. Exclusive jurisdiction for any dispute shall be Amtsgericht Wittlich, provided the Licensee is a merchant, a company, a public‑law entity, or a special public‑law fund.

10. Miscellaneous

  • Entire Agreement – This EULA constitutes the entire agreement between the parties and supersedes all prior oral or written understandings.
  • Severability – If any provision is found invalid, the remaining provisions remain in full force and effect.
  • Amendments – Any amendment or supplement must be in digital writing and digitaly signed.

Also by installing or using Iron of Dust, the Licensee acknowledges and agrees to all of the above terms.
