IMPORTANT — PLEASE READ CAREFULLY BEFORE INSTALLING OR USING THIS SOFTWARE.
BY DOWNLOADING, INSTALLING, LAUNCHING, OR OTHERWISE USING VTUBER AI ASSISTANT
("THE SOFTWARE"), YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND
IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO
THESE TERMS, DO NOT INSTALL OR USE THE SOFTWARE.
THIS SOFTWARE IS LICENSED, NOT SOLD.
ACCEPTANCE OF AGREEMENT: By clicking "Accept," installing, launching, or
otherwise using the Software after being presented with this Agreement, you
agree to be bound by its terms. If you do not agree, you must not install
or use the Software.

1. GRANT OF LICENSE

Subject to your compliance with this Agreement, Draven ("Developer") grants you
a limited, non-exclusive, non-transferable, revocable license to:
(a) Download and install one copy of the Software on devices you own or control;
(b) Use the Software solely for your personal, non-commercial purposes.
This license does not include the right to sublicense, sell, rent, lease,
transfer, assign, or otherwise dispose of the Software, or to use the Software
for any commercial purpose, without the prior written consent of the Developer.

2. OWNERSHIP & INTELLECTUAL PROPERTY

The Software, including all source code, object code, documentation, graphics,
animations, and related materials, is and shall remain the exclusive property of
Draven. All rights not expressly granted in this Agreement are reserved.
The Software is protected by copyright laws and international copyright treaties,
as well as other intellectual property laws and treaties. You acknowledge that no
title to the intellectual property in the Software is transferred to you.

3. RESTRICTIONS

You may NOT, without the express prior written permission of the Developer:
(a) Copy, modify, adapt, translate, reverse engineer, decompile, disassemble,
or create derivative works based upon the Software;
(b) Remove or alter any proprietary notices, labels, or marks on the Software;
(c) Use the Software for any commercial purpose or for any public display;
(d) Transfer, sublicense, rent, lease, or lend the Software to any third party;
(e) Use the Software to develop a competing product or service;
(f) Use the Software in any manner that could damage, disable, overburden, or
impair the Software or servers or networks connected to the Software.

4. AI-GENERATED CONTENT — IMPORTANT DISCLAIMER

VTuber AI Assistant uses artificial intelligence to generate responses in
real time. You acknowledge and agree that:
(a) All AI responses are generated automatically and are NOT pre-written,
curated, or reviewed by the Developer before being displayed;
(b) AI-generated content may contain errors, inaccuracies, hallucinations,
biases, stereotypes, outdated information, or material that some users
may find offensive or inappropriate;
(c) AI responses should NOT be relied upon for medical, legal, financial,
psychological, or any other professional advice. Always consult qualified
professionals for such matters;
(d) The Developer makes no representations or warranties regarding the accuracy,
completeness, or suitability of any AI-generated content;
(e) YOU are solely responsible for how you interpret and act upon AI-generated
content produced by this Software.

5. SAFETY GUARD SYSTEM
================================================================================
The Software includes a built-in Safety Guard content filtering system that
attempts to detect and block illegal, NSFW, violent, hateful, and harmful
content before it is processed by the AI.
(a) The Safety Guard is NOT a guarantee. It may produce false positives
(blocking legitimate content) or false negatives (allowing harmful content
through). No automated filter is perfect.
(b) The Developer shall not be liable for any content — filtered or unfiltered
— generated by the AI or displayed by the Software.
(c) You remain solely responsible for your use of the Software and any content
you submit to or receive from it.

6. OPTIONAL EXTERNAL SERVICES & THIRD-PARTY APIs
================================================================================
VTuber AI Assistant is designed to function fully offline using its bundled AI
(Ollama + qwen2.5:0.5b model). The Software also provides OPTIONAL settings
that allow you to connect to external third-party services and APIs of your
own choosing.
THESE EXTERNAL SERVICES ARE ENTIRELY OPTIONAL. They are NOT required to use
the Software and are NOT provided, operated, endorsed, or controlled by the
Developer. They include, but are not limited to:

BY CHOOSING TO ENABLE AND USE ANY OPTIONAL EXTERNAL SERVICE, YOU AGREE THAT:
(a) You will review and comply with the terms of service and privacy policies
of each third-party service you choose to connect;
(b) Any data you transmit to external services (including conversation history,
API keys, or other personal information) is governed solely by those
services' own privacy policies and terms — NOT by this Agreement;
(c) The Developer is NOT responsible for the availability, accuracy, security,
privacy practices, or any other aspect of third-party services;
(d) Any costs, API fees, rate limits, or account requirements associated with
third-party services are solely your responsibility;
(e) The Developer makes no representations about the suitability or fitness of
any third-party service for your purposes.
When using the Software with its default bundled AI (no external services
configured), all processing occurs entirely on your local device and no data
is transmitted to external servers.

7. PRIVACY & DATA
================================================================================
(a) LOCAL PROCESSING: By default, VTuber AI Assistant processes all AI
requests locally on your device using the bundled Ollama runtime. No
conversation data is transmitted to the Developer or any third party.
(b) EXTERNAL AI SERVICES: If you configure an external AI provider (OpenAI,
Anthropic, a remote Ollama instance, etc.), your conversation data will
be sent to that provider per their privacy policy. The Developer has no
control over how that data is handled.
(c) CAMERA & MICROPHONE: If you enable Face Tracking or Speech-to-Text, the
Software will access your camera and/or microphone. All video and audio
processing for these features occurs locally on your device. No video or
audio data is recorded, saved, or transmitted by the Software itself.
(d) SYSTEM AUDIO: If you enable Live Audio Reactions, the Software captures
system audio output for local analysis. No audio is recorded, stored, or
transmitted by the Software itself.
(e) SCREEN CAPTURE: If you enable Visual Screen Capture, screenshots are
analyzed locally by your configured vision AI. If you use a cloud vision
AI (e.g., GPT-4 Vision), screenshot data will be sent to that provider.
(f) SETTINGS: User preferences and settings are stored locally in your
device's localStorage. No settings data is transmitted to the Developer.
(g) NO TELEMETRY: The Developer does NOT collect analytics, usage data,
crash reports, or any other telemetry from the Software.

8. AGE REQUIREMENTS

You must be at least 13 years of age to use this Software. If you are under
18 years of age (or the age of majority in your jurisdiction), you must have
parental or guardian consent to use this Software.
If you are a parent or guardian and discover that your child is using this
Software without your consent, please contact the Developer.

9. CUSTOM VRM MODELS
================================================================================
The Software allows you to upload and use custom VRM (Virtual Reality Model)
character files. You represent and warrant that:
(a) You have the legal right to use any VRM model you upload;
(b) Any uploaded VRM model does not infringe the intellectual property rights,
privacy rights, or other rights of any third party;
(c) Uploaded VRM models are stored locally on your device and are not
transmitted to the Developer or any third party by the Software itself.
The Developer is not responsible for any VRM models uploaded by users.

10. THIRD-PARTY OPEN SOURCE COMPONENTS

The Software incorporates open-source components and third-party assets, each
governed by their own respective licenses. See APPENDIX A of this document for
the complete list of third-party components, their licenses, and links to their
full license texts.
The inclusion of open-source components under their respective licenses does
NOT grant you any additional rights to the proprietary portions of the Software.

11. DISCLAIMER OF WARRANTIES

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY
KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
THE DEVELOPER DOES NOT WARRANT THAT:
(a) The Software will meet your requirements;
(b) The Software will be uninterrupted, timely, secure, or error-free;
(c) Any errors in the Software will be corrected;
(d) AI-generated content will be accurate, complete, or appropriate.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE
ABOVE EXCLUSION MAY NOT APPLY TO YOU.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR
ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING
OUT OF OR RELATED TO THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED
OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE DEVELOPER'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU
PAID FOR THE SOFTWARE (IF ANY) OR $10.00 USD, WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON LIABILITY, SO THE ABOVE
LIMITATIONS MAY NOT APPLY TO YOU.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Developer from and against
any and all claims, damages, losses, costs, and expenses (including reasonable
attorneys' fees) arising out of or related to:
(a) Your use of the Software;
(b) Your violation of this Agreement;
(c) Your violation of any rights of a third party;
(d) Content you submit to or through the Software;
(e) Your use of any third-party services in connection with the Software.

14. TERMINATION

This Agreement is effective until terminated.
(a) You may terminate this Agreement at any time by uninstalling the Software
and destroying all copies in your possession.
(b) The Developer may terminate this Agreement immediately, without notice,
if you breach any provision of this Agreement.
(c) Upon termination, all licenses granted to you under this Agreement will
immediately cease, and you must uninstall and destroy all copies of the
Software.
(d) Sections 2, 3, 11, 12, 13, and 17 shall survive termination of this
Agreement.

15. UPDATES & MODIFICATIONS

(a) The Developer may update, modify, or discontinue the Software at any time
without notice.
(b) The Developer reserves the right to update this Agreement at any time.
Continued use of the Software after changes to this Agreement constitutes
your acceptance of the modified Agreement.
(c) It is your responsibility to review this Agreement periodically for changes.

16. EXPORT COMPLIANCE

You agree to comply with all applicable export laws and regulations. You
represent that you are not located in, under the control of, or a national or
resident of any country subject to U.S. Government embargo or designated as a
"terrorist supporting" country, and that you are not listed on any U.S.
Government list of prohibited or restricted parties.

17. GOVERNING LAW & DISPUTE RESOLUTION
================================================================================
This Agreement shall be governed by and construed in accordance with applicable
law. Any disputes arising under this Agreement shall be resolved through good-
faith negotiation between the parties. If negotiation fails, disputes shall be
subject to binding arbitration.
Nothing in this section shall prevent either party from seeking injunctive or
other equitable relief in any court of competent jurisdiction to prevent
irreparable harm.

18. SEVERABILITY & ENTIRE AGREEMENT

If any provision of this Agreement is held to be invalid or unenforceable, the
remaining provisions shall remain in full force and effect.
This Agreement constitutes the entire agreement between you and the Developer
regarding the Software and supersedes all prior or contemporaneous
understandings.

19. MISCELLANEOUS

(a) NO WAIVER: The Developer's failure to enforce any provision of this
Agreement shall not constitute a waiver of the Developer's right to enforce
such provision in the future.

psychological, or any other professional advice. Always consult qualified
professionals for such matters;
(d) The Developer makes no representations or warranties regarding the accuracy,
completeness, or suitability of any AI-generated content;
(e) YOU are solely responsible for how you interpret and act upon AI-generated
content produced by this Software.

5. SAFETY GUARD SYSTEM

The Software includes a built-in Safety Guard content filtering system that
attempts to detect and block illegal, NSFW, violent, hateful, and harmful
content before it is processed by the AI.
(a) The Safety Guard is NOT a guarantee. It may produce false positives
(blocking legitimate content) or false negatives (allowing harmful content
through). No automated filter is perfect.
(b) The Developer shall not be liable for any content — filtered or unfiltered
— generated by the AI or displayed by the Software.
(c) You remain solely responsible for your use of the Software and any content
you submit to or receive from it.

own choosing.

the Software and are NOT provided, operated, endorsed, or controlled by the

When using the Software with its default bundled AI (no external services
configured), all processing occurs entirely on your local device and no data
is transmitted to external servers.

7. PRIVACY & DATA

(a) LOCAL PROCESSING: By default, VTuber AI Assistant processes all AI
requests locally on your device using the bundled Ollama runtime. No
conversation data is transmitted to the Developer or any third party.
(b) EXTERNAL AI SERVICES: If you configure an external AI provider (OpenAI,
Anthropic, a remote Ollama instance, etc.), your conversation data will
be sent to that provider per their privacy policy. The Developer has no
control over how that data is handled.
(c) CAMERA & MICROPHONE: If you enable Face Tracking or Speech-to-Text, the
Software will access your camera and/or microphone. All video and audio
processing for these features occurs locally on your device. No video or
audio data is recorded, saved, or transmitted by the Software itself.
(d) SYSTEM AUDIO: If you enable Live Audio Reactions, the Software captures
system audio output for local analysis. No audio is recorded, stored, or
transmitted by the Software itself.
(e) SCREEN CAPTURE: If you enable Visual Screen Capture, screenshots are
analyzed locally by your configured vision AI. If you use a cloud vision
AI (e.g., GPT-4 Vision), screenshot data will be sent to that provider.
(f) SETTINGS: User preferences and settings are stored locally in your
device's localStorage. No settings data is transmitted to the Developer.
(g) NO TELEMETRY: The Developer does NOT collect analytics, usage data,
crash reports, or any other telemetry from the Software.

(c) Uploaded VRM models are stored locally on your device and are not
