END USER LICENSE AGREEMENT

PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE INSTALLING OR USING ECHOES OF MIDNIGHT. BY INSTALLING, COPYING, OR OTHERWISE USING THE GAME, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE THE GAME.
This Agreement is a legal contract between you ("User" or "you") and Dark Tether Games, a business registered in the Republic of Estonia ("Dark Tether Games," "we," "us," or "our"), governing your use of Echoes of Midnight and any related updates, patches, downloadable content, and services (collectively, the "Game").
1. LICENSE GRANT
Dark Tether Games grants you a limited, non-exclusive, non-transferable, revocable license to install and use Echoes of Midnight (the "Game") for your personal, non-commercial use, subject to the terms of this Agreement. This license does not include the right to sublicense, sell, resell, or commercially exploit the Game in any way.
2. OWNERSHIP
The Game, including but not limited to all code, graphics, audio, text, designs, and other content, is the intellectual property of Dark Tether Games and is protected by international copyright, trademark, and other intellectual property laws. This Agreement does not transfer any ownership rights to you.
3. RESTRICTIONS
You agree not to, and shall not permit any third party to:
a) Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Game, except as expressly permitted by applicable law;
b) Distribute, sell, lease, rent, lend, sublicense, or otherwise transfer the Game or any rights therein to any third party;
c) Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in or on the Game;
e) Exploit the Game or any of its parts for any purpose not expressly permitted by this Agreement;
f) Use cheats, hacks, mods, automation software, bots, or any unauthorized third-party software designed to modify or interfere with the Game experience;
g) Harass, threaten, abuse, or engage in any harmful conduct toward other users through the Game's communication features, including but not limited to voice chat and text chat.
4. ONLINE FEATURES AND VOICE CHAT
The Game includes online multiplayer features and proximity-based voice chat. By using these features, you acknowledge and agree that:
a) Your voice may be transmitted to and heard by other players during gameplay as part of the Game's core mechanics;
b) Dark Tether Games is not responsible for the conduct or communications of other players;
c) Dark Tether Games reserves the right to monitor, record, and review communications made through the Game for the purpose of enforcing this Agreement and ensuring player safety;
d) You are solely responsible for the content of your communications while using the Game;
e) Dark Tether Games may suspend or terminate your access to online features for violations of this Agreement or for conduct deemed harmful to other players.
5. USER-GENERATED CONTENT AND STREAMING
Dark Tether Games grants all users unrestricted permission to create, share, and monetize gameplay videos, screenshots, livestreams, reviews, and other derivative content ("User Content") on any platform, including but not limited to YouTube, Twitch, TikTok, and similar services. No prior permission or credit is required, though credit is appreciated. This permission may only be revoked in cases where User Content violates this Agreement or applicable law.
6. PRIVACY AND DATA COLLECTION
Dark Tether Games may collect certain data related to your use of the Game, including but not limited to gameplay analytics, crash reports, and hardware information. This data is collected and processed in accordance with our Privacy Policy, which is incorporated into this Agreement by reference. Voice communications processed through the Game's proximity voice chat system may be temporarily processed on servers to facilitate gameplay but are not permanently stored unless required for moderation purposes.
7. DISCLAIMERS AND MATURE CONTENT
The Game contains mature content including depictions of violence, psychological horror, serial killer themes, restraint, and other content that may be disturbing to some players. By installing and playing the Game, you confirm that you are of legal age in your jurisdiction to access such content, or that you have obtained appropriate parental or guardian consent.
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DARK TETHER GAMES DOES NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DARK TETHER GAMES, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE GAME, REGARDLESS OF THE THEORY OF LIABILITY.
IN NO EVENT SHALL DARK TETHER GAMES' TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE GAME EXCEED THE AMOUNT YOU PAID FOR THE GAME.
9. TERMINATION
This Agreement is effective until terminated. Dark Tether Games may terminate this Agreement at any time if you fail to comply with any of its terms. Upon termination, you must cease all use of the Game and destroy all copies in your possession. Sections 2, 7, 8, 10, and 11 shall survive termination.
10. GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law principles. Any disputes arising out of or relating to this Agreement shall be resolved through binding arbitration in Tallinn, Estonia, in accordance with applicable Estonian arbitration rules. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
11. GENERAL PROVISIONS
a) Entire Agreement: This Agreement constitutes the entire agreement between you and Dark Tether Games regarding the Game and supersedes all prior agreements and understandings.
b) Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
c) Waiver: The failure of Dark Tether Games to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
d) Assignment: You may not assign or transfer this Agreement or any rights hereunder without the prior written consent of Dark Tether Games. Dark Tether Games may assign this Agreement without restriction.
e) Amendments: Dark Tether Games reserves the right to modify this Agreement at any time. Continued use of the Game after such modifications constitutes acceptance of the updated terms.
