2. THIRD-PARTY AI MODELS
The software serves as a platform for running third-party AI models. These models are not owned by SmarterWaysProductions and are subject to their own respective licenses (e.g., Apache 2.0, MIT, or community licenses). You acknowledge that you are solely responsible for complying with the licenses of all models you download, import, or use within Andromeda.
3. DATA PRIVACY AND LOCAL PROCESSING
Andromeda is designed for local data processing on your device. SmarterWaysProductions does not collect, store, or transmit your chat logs, analyzed documents, or personal files to cloud servers controlled by SmarterWaysProductions. You retain full sovereignty over your data.
4. LICENSE GRANT
SmarterWaysProductions grants you a personal, non-exclusive, perpetual right to install and use the software on your devices, distributed via Steam (Valve Corporation).
The following uses are permitted:
- Personal use on your own devices
- Commercial use on your own devices, free of charge up to an annual revenue of €200,000
- Installation on multiple personal devices linked to your Steam account
The following uses are prohibited:
- Resale, redistribution, or sublicensing of the software itself
- Reverse engineering (except as permitted by law)
- Circumventing license protection
Commercial license required: If your business generates more than €200,000 in annual revenue, a commercial license is required — please contact us at contact@smarterwaysproductions.com to obtain one.
While SmarterWaysProductions retains the intellectual property rights to the software code itself (to prevent piracy or resale of the binary), your right to use your copy of the software is unlimited in time and irrevocable, provided you comply with the terms of this agreement.
5. TERMINATION
This license is valid until terminated. Your rights under this license automatically expire if you materially breach the terms of this agreement (e.g., through distribution of cracked copies or infringement of SmarterWaysProductions' intellectual property rights).
6. COMPLIANCE WITH LAWS (EU AI ACT)
You agree to use the software in strict compliance with all applicable laws and regulations, including but not limited to the European Union Artificial Intelligence Act (EU AI Act). You are solely responsible for ensuring that your use of generated content (e.g., labeling of AI-generated text/images) complies with the legal standards in your jurisdiction.
7. SANCTIONS AND USE RESTRICTIONS
The use of this software by governments, military institutions, state authorities, intelligence services, or other public institutions of countries subject to sanctions by the Federal Republic of Germany or the European Union (EU) is expressly prohibited. This applies to all direct and indirect forms of use. Private, non-commercial use by civilian persons in these countries remains expressly permitted, unless this is made impossible by applicable export control laws or technical restrictions. SmarterWaysProductions is not responsible for the end user's compliance with local import regulations.
8. GOVERNING LANGUAGE
This End-User License Agreement is provided in English. In the event of any disputes or discrepancies, the English version shall be the legally binding and prevailing version of this agreement.
