Ewan Game License and Service Agreement
This Ewan Game License and Service Agreement (hereinafter referred to as this "Agreement") is entered into by and between you and the provider of Ewan Game services, and shall have contractual effect. Please read and fully understand all terms of this Agreement carefully, especially those that exempt or limit Ewan's liability (hereinafter referred to as the "Disclaimer Clauses"), those that restrict user rights (hereinafter referred to as the "Restriction Clauses"), those concerning dispute resolution methods and jurisdiction, as well as any separate agreement for activating or using a specific service. The aforementioned disclaimer, restriction, dispute resolution, and jurisdiction clauses may be highlighted in bold, color, or other reasonable means to draw your attention, including but not limited to the relevant clauses in Articles 2, 3, 4, 6, and 9 of this Agreement. Please read the foregoing clauses again before confirming your acceptance of this Agreement or before using Ewan Game services.
Unless you have fully read, completely understood, and accepted all terms of this Agreement, you shall have no right to use Ewan Game services. By clicking agree, accept, next step, or by registering for or using Ewan Game services, you shall be deemed to have read and agreed to sign this Agreement.
If you are under 18 years old, please read this Agreement accompanied by your legal guardian, and have your guardian operate on your behalf or operate with your guardian's express consent.
I. Definitions
1.1 This Agreement: Refers to the main text of this Agreement, the TapTap Service Agreement, the TapTap Privacy Policy, the Ewan Game Privacy Protection Guidelines, any specific game privacy policy (if any), game rules, and any revised versions thereof. Once officially published, the above content shall form an inseparable part of this Agreement. This Agreement also includes the Mandatory Clauses for Standardized Online Game Service Agreements.
1.2 Game Rules: Refers to the user rules, player rules, game announcements, tips, notices, and other content regarding Ewan Games that are published and revised by the Ewan Game service provider from time to time.
1.3 Ewan Game Service Provider: Refers to Ewan (Shanghai) Network Technology Co., Ltd., which provides you with Ewan Games and related services. In this Agreement, it is referred to as "Ewan," "we," or "us."
1.4 Ewan Games: Refers collectively to games operated by Ewan, including computer client games, web games, HTML5 games (H5 games), mobile terminal games, TV terminal games, and games in other forms. Ewan Games may be provided in the form of software, in which case Ewan Games also include the relevant software and related documentation.
1.5 Ewan Game Services: Refers to the various online operational services related to games provided by Ewan to you.
1.6 You: Also referred to as the "player" or "user," meaning a natural person authorized to use Ewan Games and related services.
1.7 Game Data: Refers to various data generated by you during the use of Ewan Games and recorded by the server, including but not limited to character data, virtual item data, behavior logs, purchase logs, and other such data.
1.8 Game Virtual Items: Refers to a type of service provided by Ewan and stored in the game program's server in the form of electromagnetic records, capable of realizing specific functions set by the game program or reflecting specific results of the game program's operation. Game virtual items may be presented in text, graphic, or other digital forms. Game virtual items are part of the game services. Common game virtual items include but are not limited to:
(1) Game tokens and various other game currencies. Among them, game tokens refer to a type of virtual item that users directly or indirectly purchase with legal currency at a certain ratio, that is stored in a specific game server, and that can only be used to exchange for other designated virtual items or value-added services within that specific game;
(2) Game equipment, such as weapons;
(3) Heroes, skins, and other various game virtual items.
II. Game Accounts
2.1 If you need to use and enjoy Ewan Games, you must use your TapTap account as your game account and, in accordance with relevant national laws and regulations, log in to the real-name registration system and complete real-name registration. Your application for and use of such TapTap account shall also comply with the TapTap Service Agreement as revised and published by Ewan from time to time, as well as other relevant rules concerning the registration and use of the aforesaid account.
When carrying out real-name registration, you shall provide your true, lawful, accurate, and valid identity information and other relevant information, and shall not use another person's identity information for real-name registration. Otherwise, Ewan shall have the right to take one or more of the measures specified in the second paragraph of Article 6.5 of this Agreement, and may announce the handling result. All consequences arising therefrom shall be borne by you, and Ewan shall also have the right to require you to compensate Ewan for all losses caused thereby.
To satisfy the requirements of relevant laws, regulations, policies, and competent authorities, you shall provide true identity information for account registration, login, and use. We will verify your true identity information through the TapTap real-name authentication system. For the foregoing purpose, you agree that we may verify the real-name authentication status of the TapTap account currently used by you for registration and login through the TapTap real-name authentication system. If such account has completed real-name authentication in the TapTap real-name authentication system, you further agree that the TapTap real-name authentication system may disclose age information to us, so as to determine whether the account shall be included in the anti-addiction system and what anti-addiction measures shall be taken. You also agree that we may submit your name and ID card number through the TapTap real-name authentication system to the national unified electronic identity authentication system for minors' online games for real identity verification.
If such account has not completed real-name authentication in the TapTap real-name authentication system, we will be unable to provide services to you. If you still wish to use our products and services, you shall complete real-name authentication for the TapTap account currently used by you for registration and login in the TapTap real-name authentication system. During the authentication process, the TapTap real-name authentication system will collect your real-name identity information (including your name and ID card number).
2.2 You fully understand and agree that Ewan will, in accordance with relevant national requirements, apply your real-name registration information (including relevant authentication and age information) to the anti-addiction system. That is, Ewan will determine, based on your real-name registration information, whether you are 18 years of age or older, whether the real-name identity information you submitted is standardized, or whether the real-name verification has passed, so as to determine whether anti-addiction restrictions shall be imposed on your game account.
2.3 You fully understand and agree that Ewan has the right, as required by laws and regulations, to verify whether the identity information provided by users at registration is true and valid, and shall actively adopt reasonable technical and managerial measures to ensure the security and effectiveness of user accounts. Users are obligated to properly keep their account names and passwords and use them correctly and securely. If either party fails to fulfill the above obligations, resulting in lost account passwords, stolen accounts, or other such circumstances that damage the civil rights of users or others, that party shall bear the resulting legal liability.
If you discover that someone else is impersonating or misappropriating your game account or password, or any other unauthorized use, you shall immediately notify Ewan by effective means. When notifying Ewan, you shall provide valid personal identity information consistent with your registered identity information. After receiving your valid request and verifying your identity, Ewan will take corresponding measures depending on the circumstances (including but not limited to suspending the login to and use of the account). Any losses suffered by you or other users due to the corresponding measures taken by Ewan according to your request shall be borne by you. If you do not provide valid identity information, or the valid personal identity information you provide is inconsistent with the registered identity information, Ewan shall have the right to refuse your request, and any losses thereby suffered by you shall be borne by you.
2.4 You fully understand and agree that, in order to efficiently utilize server resources, if you have not logged into Ewan Games using your game account for three years, Ewan shall have the right, after prior notice, to delete or otherwise dispose of that account and the game data and related information under that account.
2.5 A game account is an identifier and credential authorized by Ewan under this Agreement for you to log in to and use Ewan Games and related services, and its ownership belongs to Ewan. You only enjoy the right to use the game account in accordance with this Agreement, the TapTap Service Agreement, the relevant account use agreements, and special rules published by Ewan for this purpose. You may not provide your game account to others for use in any way, including but not limited to transfer, lease, lending, or other methods for commercial use such as livestreaming, recording, account boosting, or power-leveling. Otherwise, any legal consequences and liabilities arising therefrom shall be borne by you, and Ewan shall have the right to take measures against your game account, including but not limited to warnings, restricting or prohibiting the use of all or part of the functions of the game account, deleting the game account and game data and other related information, banning the account, or even canceling the account. All consequences arising therefrom shall be borne by you.
2.6 Where Ewan Games provide an account cancellation function, if you need to cancel your game account, you may do so in accordance with the official account cancellation guidelines for that game, and you shall ensure that the relevant conditions for game account cancellation announced by the game are satisfied, and agree to the account cancellation agreement and other related rules announced by the game.
You are also specifically reminded that if you cancel your game account, the game virtual items and other value-added services under that game account (for convenience of description, collectively referred to below as "game benefits") will also be cleared. Therefore, before canceling your game account, please ensure that you have properly handled the game benefits under that account or that the relevant game benefits have been settled. Once you cancel your game account, if any game benefits still remain under that account at that time (including but not limited to game virtual items and other game value-added services that have been generated during the use of this game but have not yet expired or been used, as well as game benefits that may be generated in the future), you shall be deemed to have voluntarily waived such game benefits, and Ewan shall have the right to clear all game benefits under that game account. Any consequences arising therefrom shall be borne by you. The aforesaid game benefits include but are not limited to: game membership rights and interests, levels; all data related to character growth and upgrades (including but not limited to experience points, honor points, reputation points, titles, etc.); unused game virtual items (such as coupons, gold coins, diamonds, etc.); other value-added services that have been purchased but have not expired or have not been fully used; other game benefits already generated but not yet consumed, or future expected game benefits.
III. Collection, Use, and Protection of User Information
3.1 You agree and authorize Ewan to collect your personal information for the purpose of performing this Agreement. During your use of Ewan Game services, Ewan will collect information that you actively provide while using the services or that is generated due to your use of the services, in accordance with the Ewan Game Privacy Protection Guidelines and any specific game privacy policy (if any), in order to provide and optimize our services and protect the security of your account.
3.2 If Ewan pushes various types of information to you, such as activity information and promotional information about Ewan Games, the collection and use of your personal information shall comply with the Ewan Game Privacy Protection Guidelines and any specific game privacy policy (if any).
3.3 You acknowledge and agree that if a competent state authority lawfully requires Ewan to assist in investigating your game account (including real-name identity information) and game-related data (such as recharge, consumption, transaction data, etc.), Ewan may provide the aforesaid related information to the competent state authority.
3.4 You shall fully respect the personal information of any person, including but not limited to other users, that you may learn about, receive, or access through Ewan Games and related services. You shall not collect, copy, store, disseminate, or otherwise use the personal information of other users in any manner. Otherwise, any consequences arising therefrom shall be borne by you.
3.5 Protecting users' personal information and privacy is a basic principle of Ewan. The collection, use, and protection of users' personal information in Ewan Game services shall comply with the agreements such as the Ewan Game Privacy Protection Guidelines and any specific game privacy policy (if any). If you have agreed to Ewan's processing of your personal information in accordance with the foregoing agreements or provisions and then withdraw such consent, according to law, your withdrawal of consent shall not affect the validity of the personal information processing activities already carried out based on your consent before the withdrawal.
IV. Ewan Game Services
4.1 Subject to your compliance with this Agreement and relevant laws and regulations, Ewan grants you a personal, non-transferable, and non-exclusive license to use Ewan Game services. You may use Ewan Game services only for non-commercial purposes, including:
(1) receiving, downloading, installing, launching, upgrading, logging in to, displaying, running, and/or screenshotting Ewan Games;
(2) creating game characters, setting nicknames, viewing game rules, user profiles, and game match results, creating game rooms, setting game parameters, purchasing and using game virtual items in the game, and using chat functions and social sharing functions;
(3) using one or more other functions supported and permitted by Ewan Games.
4.2 During your use of Ewan Game services, you may not, without Ewan's permission, record, livestream, or disseminate Ewan Game content to others in any way, including but not limited to using any third-party software for online livestreaming or dissemination.
4.3 Where Ewan Games are provided in the form of software, your use of Ewan Games and Ewan Game services shall also comply with the provisions of Article 5 of this Agreement regarding software licensing.
4.4 All other rights not expressly authorized in this Article or elsewhere in this Agreement are reserved by Ewan, and you must obtain Ewan's separate written permission when exercising such rights.
4.5 If you violate any provision of this Agreement, Ewan shall have the right to take one or more of the measures specified in the second paragraph of Article 6.5 of this Agreement, may announce the handling result, and/or may require you to compensate Ewan for all losses caused by your breach.
4.6 You fully understand and agree that Ewan has the right, based on reasonable judgment, to handle acts that violate relevant laws and regulations or this Agreement, to take appropriate legal action against any user engaging in illegal or non-compliant acts, and to preserve relevant information and report to relevant authorities in accordance with laws and regulations. The user shall independently bear all legal liabilities arising therefrom.
4.7 You fully understand and agree that if any third-party claim, demand, or loss arises out of or results from your violation of this Agreement or the relevant service terms, you shall bear liability independently. If Ewan thereby suffers losses, you shall also compensate Ewan accordingly.
4.8 You fully understand and agree that game virtual items and other game value-added services are part of Ewan Game services, and Ewan hereby licenses you to obtain the right to use them in accordance with this Agreement. Your purchase and use of game virtual items and other game value-added services shall comply with this Agreement and the requirements of specific game rules. At the same time, game virtual items and other game value-added services may be subject to a certain validity period. Even if you do not use them within the prescribed validity period, once the validity period expires, they will automatically become invalid, except where caused by force majeure or reasons attributable to Ewan. If the relevant game virtual items or other game value-added services do not indicate a period of use, or indicate a period of use as "permanent" or other words having the same or similar meaning as "permanent" (such as "indefinite" or "unlimited"), then their period of use shall be from the date on which you obtain such game virtual items or other game value-added services until the date on which the game ceases operation.
You fully understand and agree that, in order to better provide users with Ewan Game services, Ewan has the right to adjust, update, or optimize game-related content (including but not limited to the design, performance, and related numerical settings of game virtual items).
4.9 You fully understand and agree that, in order to protect the security of your game account and create a fair, healthy, and safe gaming environment, during your use of Ewan Game services, and without violating relevant legal provisions, Ewan may use technical means to learn about your terminal device's random-access memory and the related programs running simultaneously with Ewan Games. Once any unauthorized program that endangers the normal operation of Ewan Game services is discovered, Ewan may take reasonable measures to combat it.
4.10 Ewan will, in accordance with relevant laws and regulations and this Agreement, take practical and effective measures to protect the lawful rights and interests of minors during their use of Ewan Game services, including possibly adopting technical measures, prohibiting minors from accessing unsuitable games or game functions, restricting minors' game time or duration, and preventing minors from becoming addicted to online games. As part of the game rules, Ewan will also publish user guidelines and warning statements for Ewan Games in appropriate places, including game content introductions, proper methods of using the games, and methods of preventing harm. All minor users shall carefully read and follow these guidelines and statements under the guidance of their legal guardians. Other players shall avoid publishing or generating any content harmful to the physical or mental health of minors during the use of Ewan Game services, so as to jointly create a healthy gaming environment.
4.11 You acknowledge and agree that if any of the following circumstances occurs, Ewan shall have the right to include your game account in the corresponding anti-addiction system and take corresponding anti-addiction measures:
(1) the system determines that you are under 18 years old; or
(2) the real-name identity information you submitted is not standardized; or
(3) your real-name verification fails; or
(4) other circumstances required by national laws, regulations, or policies, or where Ewan has reasonable grounds to believe that inclusion in the anti-addiction system is necessary.
For game accounts included in the corresponding anti-addiction system, Ewan has the right, in accordance with relevant national laws, regulations and policy provisions, other provisions of this Agreement, Ewan's game operation strategies, or the reasonable requirements of your legal guardian, to take one or more of the following measures:
(1) provide your legal guardian with information related to your game activities (including but not limited to your game account login information and recharge transaction information), so that your legal guardian can timely or simultaneously understand your gaming situation;
(2) restrict the spending limit of your game account;
(3) adopt technical measures to block certain games or certain functions of games, or limit your game time or duration;
(4) cancel or delete your game account and game data and other related information;
(5) other reasonable measures requested by your legal guardian or deemed appropriate by Ewan to restrict or prohibit your use of Ewan Games;
(6) relevant measures required by national laws, regulations, or policies.
4.12 Ewan's provision of game services to users is itself a commercial act, and users have the right to independently decide whether to pay the corresponding fees in accordance with the charging items and charging standards independently determined by Ewan (including but not limited to purchasing the right to use in-game virtual items and receiving other value-added services and various other charging items) in order to obtain the corresponding game services. If you do not pay the corresponding fees according to the corresponding standards, you will be unable to obtain the corresponding game services.
You acknowledge and agree that changes and adjustments to charging items or charging standards are normal commercial acts, and you may not require Ewan to make compensation or indemnification because of such changes or adjustments.
You acknowledge and agree that if you recharge the game with legal currency to purchase or exchange game virtual items and other value-added services, the game virtual items and other value-added services you purchase or exchange cannot be returned or exchanged into legal currency, except where mandatory laws provide otherwise.
You acknowledge and agree that if a transaction whereby you recharge the game to purchase or exchange game virtual items and other value-added services is canceled due to a refund or other reason, Ewan shall have the right to deduct the game virtual items and other value-added services issued to your game account corresponding to such canceled transaction. If the game virtual items and other value-added services in your game account are insufficient for such deduction, Ewan may give priority to deducting the deficient portion when the game virtual items and other value-added services in your game account increase subsequently.
4.13 Under no circumstances shall Ewan be liable for losses suffered by you during the use of Ewan Game services due to force majeure. Such force majeure events include but are not limited to national laws, regulations, policies, orders of state authorities and other government acts, as well as other unforeseeable, unavoidable, and insurmountable events such as earthquakes, floods, snow disasters, fires, tsunamis, typhoons, strikes, and wars.
4.14 Ewan Games may, due to game software bugs, defects in version updates, third-party virus attacks, or any other factor, cause anomalies in your account data or game data such as game virtual items. Before the cause of such data anomaly is identified, Ewan shall have the right to temporarily freeze the relevant game account. If it is found that the data anomaly was caused by abnormal gaming behavior, Ewan shall have the right to restore the game account data to the original state prior to the occurrence of the anomaly (including recovering transferred data from third parties), without bearing any liability to you. If the data anomaly is caused by your illegal or non-compliant acts or acts in violation of this Agreement, Ewan shall have the right to take one or more of the measures specified in the second paragraph of Article 6.5 of this Agreement.
You understand and agree that where a game is deployed on multiple servers, during game operation, in order to improve playability and interaction and create a better gaming environment, Ewan may, based on the number of active users in the game servers and other circumstances, adjust the number of servers in a timely manner and temporarily or permanently merge or migrate users among multiple servers into the same server (i.e., "server merge").
If the game undergoes a server merge, Ewan will notify you through in-game announcements or other means before the merge and will publish the specific rules concerning the server merge. A server merge may lead to changes in game-related settings, experience, rankings, and other user-related game data, but will not adjust the functions of your game virtual items. For details, please refer to the specific server merge rules officially published by the game. If a server merge results in duplicate character names, team names (if any), or other related content, the game operator may randomly assign new names to distinguish such duplicate content.
4.15 Without Ewan's permission, you may not engage in transactions of game virtual items and other value-added services with other users, or obtain game virtual items and other value-added services from third parties by purchase, gift, or any other means. Ewan is not responsible for third-party transactions (that is, acts by which you obtain game virtual items and other value-added services from third parties through purchase, gift, or other means), and does not accept complaints arising from disputes caused by any third-party transaction.
4.16 You fully understand that there are objective incompatibilities between different operating systems, and such objective circumstances are not caused by Ewan. As a result, your recharges and game data in one operating system may not be smoothly transferred to another operating system. The risks of recharge losses and game data loss caused by your switching between different systems shall be borne by you, and Ewan shall not bear any liability therefor.
4.17 You fully understand that certain Ewan Games may include mandatory battle areas or gameplay. If you do not agree to mandatory battle, please do not enter such game or game area. Your entry shall be deemed as agreement to such gameplay and acceptance of the corresponding consequences.
4.18 When Ewan independently decides to terminate the operation of Ewan Games, or when Ewan Games terminate operation for any other reason, Ewan will handle matters related to the termination of game operations in accordance with the relevant national laws and regulations concerning the termination of online game operations, so as to protect the lawful rights and interests of users.
V. Software License
5.1 The use of Ewan Game services may require downloading and installing related software. You may obtain such software directly from Ewan's relevant websites, or from a third party authorized by Ewan. If you obtain Ewan Games or a game with the same name as Ewan Games from an unauthorized third party, you shall be deemed not to have obtained authorization from Ewan. Ewan cannot guarantee that such game can be used normally and shall not be responsible for any loss caused to you thereby.
5.2 Ewan may have developed different software versions for different terminal devices or operating systems, including but not limited to multiple application versions for Windows, iOS, Android, Nintendo Switch, etc. You shall choose and download the appropriate version for installation according to the actual circumstances. After downloading the installation program, you need to install it correctly in accordance with the steps prompted by the program.
5.3 Where Ewan Games are provided in the form of software, Ewan grants you a personal, non-transferable, and non-exclusive license. You may only download, install, log in to, and use such Ewan Games on a single terminal device for non-commercial purposes.
5.4 In order to provide better-quality and safer services, Ewan may recommend that you install other software during software installation, and you may choose whether or not to install it.
5.5 If you no longer need to use the software or need to install a new version, you may uninstall it yourself. If you are willing to help Ewan improve its products and services, please inform us of the reasons for uninstallation.
5.6 In order to ensure the security of Ewan Game services and the consistency of functions, Ewan has the right to update the software, or change or restrict the effects of certain functions of the software.
5.7 After a new version of the software is released, old versions of the software may become unusable. Ewan does not guarantee the continued availability of old versions of the software or the corresponding customer service. Please check and download the latest version at any time.
VI. User Code of Conduct
6.1 You fully understand and agree that you must be responsible for all actions under your game account, including any content you publish and any consequences arising therefrom.
6.2 In addition to using Ewan Game services in accordance with this Agreement, you may not engage in any acts that infringe the intellectual property rights of Ewan Games, or engage in any other acts that harm the lawful rights and interests of Ewan or any third party.
6.3 When using Ewan Games or Ewan Game services, you must comply with laws and regulations and may not use Ewan Games or Ewan Game services to engage in illegal or non-compliant acts, including but not limited to the following acts:
(1) violating the basic principles established by the Constitution;
(2) endangering national unity, sovereignty, and territorial integrity;
(3) divulging state secrets, endangering national security, or harming national honor and interests;
(4) inciting ethnic hatred or ethnic discrimination, undermining ethnic unity, or infringing ethnic customs and habits;
(5) promoting cults or superstition;
(6) spreading rumors, disrupting social order, or undermining social stability;
(7) promoting obscenity, pornography, gambling, violence, or abetting crime;
(8) insulting or defaming others, or infringing the lawful rights and interests of others;
(9) violating social morality;
(10) containing any other content prohibited by laws, administrative regulations, or state provisions.
6.4 Unless permitted by law or with Ewan's written authorization, you may not engage in the following acts:
(1) deleting copyright information from the game software or its copies;
(2) reverse engineering, reverse assembling, reverse compiling, or otherwise attempting to discover the source code or other confidential content of the game software, including but not limited to game elements that Ewan has not actively disclosed but that are already packaged within the game installation package;
(3) scanning, probing, or testing the game software to detect, discover, or locate bugs or weaknesses that may exist therein;
(4) copying, modifying, adding to, deleting, hooking, or creating any derivative works from the game software, any data released into any terminal memory during software operation, interaction data between the client and server during software operation, or system data necessary for software operation, including but not limited to through the use of plugins, cheats, or unauthorized third-party tools/services to access the software and related systems;
(5) modifying or forging instructions or data in software operation, adding to, deleting, or altering the functions or operational effects of the software, or operating or disseminating software or methods for the aforesaid purposes, regardless of whether such acts are for commercial purposes;
(6) using Ewan Games and Ewan Game services through third-party software, plugins, cheats, or systems not developed or authorized by Ewan, or producing, publishing, or disseminating third-party software, plugins, cheats, or systems not developed or authorized by Ewan;
(7) using, leasing, lending, copying, modifying, linking, reprinting, compiling, publishing, or establishing mirror sites for content in the games over which Ewan owns intellectual property rights;
(8) establishing mirror sites related to Ewan Games, creating web snapshots, or providing services identical or similar to Ewan Game services to others through setting up servers or by other means;
(9) separating any part of Ewan Games for independent use, or using them in any other way inconsistent with this Agreement;
(10) using, modifying, or obscuring the name, trademark, or other intellectual property rights of Ewan Games;
(11) any other acts not expressly authorized by Ewan.
6.5 If you commit any of the following acts during your use of Ewan Game services (hereinafter also referred to as "illegal or non-compliant acts"), Ewan has the right, depending on the severity of the circumstances and in accordance with this Agreement and the relevant game rules, to take one or more of the measures specified in the second paragraph of this Article against you, and may announce the handling result:
(1) using or uploading illegal or inappropriate words, characters, or other content in Ewan Games, including for role naming;
(2) damaging Ewan Games or affecting the normal operation of Ewan Game services in any way, including but not limited to:
1) non-compliant and/or malicious registration and login acts, including but not limited to malicious bulk registration of game accounts, and login acts such as logging into the game by disrupting server authentication or maliciously crowding servers;
2) maliciously carrying out acts that may cause game server downtime or lag, or cause other players to disconnect or experience latency and thus be unable to play normally, such as using DDoS attacks against game servers or other players;
3) exploiting game vulnerabilities for profit, damaging the game environment, or causing adverse effects to other players;
4) passive gameplay that undermines other users' gaming experience, including but not limited to maliciously injuring or killing teammates, malicious teaming, intentionally losing or lowering rank, idling, escaping, intentionally feeding, and other passive gameplay that damages the user experience;
5) other acts in which game data performance is abnormal and affects the fairness of Ewan Games;
(3) using private servers or cheats of any kind;
(4) using game synchronizers (including but not limited to hardware synchronizers such as keyboard or mouse synchronizers that allow you to use one set of keyboard and mouse to simultaneously and synchronously control multiple computers for gaming), as well as using other hardware that causes abnormal efficiency or收益 data performance in the game (including but not limited to "auto clickers"; collectively referred to below as "cheating hardware");
(5) disseminating illegal speech or improper information;
(6) stealing other persons' game accounts or game items;
(7) engaging in game account trading, account sharing, or other acts affecting account security;
(8) without Ewan's permission, engaging in transactions with other users for game virtual items and other game value-added services, or obtaining game virtual items and other game value-added services from third parties through purchase, acceptance of gifts, or other means;
(9) recharging games through discount channels unauthorized or unrecognized by Ewan, engaging in discounted game item transactions (for example, purchasing discounted skins at low prices through non-official Ewan channels), entrusting an unauthorized or unrecognized third party to recharge on your behalf, or using unauthorized or unrecognized third-party software to recharge;
(10) implying or falsely claiming in some way to be an internal employee of Ewan or to possess some special identity, in an attempt to obtain improper benefits or affect the rights and interests of other users;
(11) violating any provision of this Agreement or any provision of national laws and regulations;
(12) other improper acts widely recognized within the industry, or other violations announced through game rules (including but not limited to user rules, player regulations, game announcements, tips, and notices).
The handling measures specified in the preceding paragraph include but are not limited to:
(1) warning; and/or
(2) chat prohibition, including but not limited to region-wide mute, single-region mute, and public-channel mute; and/or
(3) content reset, including but not limited to resetting or forcibly modifying illegal nicknames, room names, images, and other illegal information or content provided or uploaded by you; and/or
(4) reducing or limiting your game benefits, including but not limited to the growth and upgrade-related data of game characters (such as experience points, honor points, reputation points, titles, etc.) and the acquisition of game virtual items and other game value-added services in the game; and/or
(5) deleting or canceling game accounts, game data, or other game-related information; and/or
(6) restricting or prohibiting your entry into specific scenes in the game or your use of specific game functions; and/or
(7) forcibly removing you from the game (i.e., "kick-out"), including but not limited to forcibly exiting the entire game, a single match in the game, or other gaming activities you are currently engaged in; and/or
(8) temporarily or permanently prohibiting your game account from logging into Ewan Games (hereinafter referred to as an "account ban"); and/or
(9) temporarily or permanently prohibiting the specific terminal involved in your illegal or non-compliant act (including but not limited to PC terminals, mobile terminals, etc.) from logging into Ewan Games; and/or
(10) suspending or terminating your use of Ewan Games and related services, or unilaterally notifying you of the termination of this Agreement; and/or
(11) initiating corresponding civil litigation with respect to your illegal or non-compliant acts, pursuing tort liability, breach of contract liability, or other civil liabilities against you, and requiring you to compensate Ewan for losses suffered by Ewan due to your illegal or non-compliant acts (including Ewan's direct economic losses, reputation or goodwill losses, compensation paid by Ewan to third parties, settlement costs, attorney's fees, litigation expenses, and other indirect losses), or transferring the matter to the relevant administrative authorities for administrative penalties, or to judicial authorities for criminal liability; and/or
(12) other handling measures announced by Ewan through game rules (including but not limited to user rules, player regulations, game announcements, tips, and notices).
You acknowledge and agree that, due to the concealment of cheats, game synchronizers, and other cheating hardware, or their ability to disappear after use, Ewan has the right to determine, based on your game data and abnormal performance, whether you have used illegal cheats, game synchronizers, or other cheating hardware.
6.6 You acknowledge and agree that if Ewan imposes an account ban on your game account pursuant to this Agreement, the specific duration of the ban shall be determined by Ewan according to the severity of your violation.
You acknowledge and agree that: (1) during the ban period, the game virtual items and other value-added services in your game account will not be available for use; and (2) if the aforesaid game virtual items and other value-added services have a certain validity period, such validity period may expire during the ban period, and after your game account is unbanned, you will no longer be able to use such expired game virtual items and other value-added services.
VII. Intellectual Property Rights
7.1 Ewan is the intellectual property rights holder of Ewan Games. All copyrights, trademark rights, patent rights, trade secrets, and other intellectual property rights and lawful rights and interests in Ewan Games (including but not limited to Ewan Games as a whole, all artworks, music, textual works, and other game elements and components contained in the game, and the continuous dynamic images presented in the operation of Ewan Games), as well as all information content related to Ewan Games (including text, images, audio, video, charts, interface design, layout framework, relevant data, or electronic documents, etc.), are protected by the laws and regulations of the People's Republic of China and corresponding international treaties. Ewan enjoys the foregoing intellectual property rights and lawful rights and interests, except for rights that the relevant rights holders should enjoy according to law. Without Ewan's prior written consent, you may not commercially use Ewan Games (including but not limited to Ewan Games as a whole, all artworks, music, textual works, and other game elements and components contained in the game, and the continuous dynamic images presented in the operation of Ewan Games) in any manner, or disseminate Ewan Game content through information networks.
7.2 The ownership and intellectual property rights of game data generated by you in the use of Ewan Game services belong to Ewan. Ewan has the right to preserve and dispose of such game data, unless otherwise provided by national laws and regulations.
Ewan enjoys the property rights provided by laws and regulations over the relevant data products and services formed through its lawful processing of game data.
7.3 Ewan Games may involve third-party intellectual property rights, and if such third parties impose requirements on your use of such intellectual property rights in Ewan Games based on this Agreement, Ewan will inform you of such requirements in an appropriate manner, and you shall comply with them accordingly.
VIII. Compliance with Local Laws and Regulations
8.1 During your use of Ewan Game services, you shall comply with relevant local laws and regulations and respect local morals and customs. If your conduct violates local laws and regulations or morals and customs, you shall bear sole responsibility therefor.
8.2 You shall avoid involving Ewan in political and public events due to your use of Ewan Game services, otherwise Ewan shall have the right to suspend or terminate the provision of services to you.
IX. Jurisdiction and Applicable Law
9.1 The place of signing of this Agreement is Jing'an District, Shanghai, People's Republic of China.
9.2 The formation, effectiveness, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of Mainland China (excluding conflict of laws rules).
9.3 Any dispute or controversy arising between you and Ewan out of or in connection with this Agreement shall first be resolved through friendly consultation. If consultation fails, you agree to submit such dispute or controversy to the people's court with jurisdiction in the place where this Agreement is signed.
9.4 The headings of all clauses in this Agreement are for reading convenience only and have no actual meaning in themselves, and may not be used as the basis for interpreting the meaning of this Agreement.
9.5 If any clause of this Agreement is partially invalid for any reason, the remaining clauses shall remain valid and binding upon all parties.
X. Miscellaneous
10.1 Ewan has the right to amend the terms of this Agreement when necessary, and you may review the latest version of the agreement terms on the relevant pages of Ewan Games. After the terms of this Agreement are amended, if you continue to use Ewan Game services, you shall be deemed to have accepted the amended Agreement.
10.2 If you have any comments or suggestions regarding this Agreement or the services, you may contact Ewan Game customer service at Unknown.Evolution@taptap.com, and Ewan will provide you with the necessary assistance.
10.3 Ewan reminds you: Resist unhealthy games and reject pirated games; pay attention to self-protection and beware of fraud; moderate gaming benefits the brain, addiction harms the body; arrange your time reasonably and enjoy a healthy life.
Ewan (Shanghai) Network Technology Co., Ltd.
This Ewan Game License and Service Agreement (hereinafter referred to as this "Agreement") is entered into by and between you and the provider of Ewan Game services, and shall have contractual effect. Please read and fully understand all terms of this Agreement carefully, especially those that exempt or limit Ewan's liability (hereinafter referred to as the "Disclaimer Clauses"), those that restrict user rights (hereinafter referred to as the "Restriction Clauses"), those concerning dispute resolution methods and jurisdiction, as well as any separate agreement for activating or using a specific service. The aforementioned disclaimer, restriction, dispute resolution, and jurisdiction clauses may be highlighted in bold, color, or other reasonable means to draw your attention, including but not limited to the relevant clauses in Articles 2, 3, 4, 6, and 9 of this Agreement. Please read the foregoing clauses again before confirming your acceptance of this Agreement or before using Ewan Game services.
Unless you have fully read, completely understood, and accepted all terms of this Agreement, you shall have no right to use Ewan Game services. By clicking agree, accept, next step, or by registering for or using Ewan Game services, you shall be deemed to have read and agreed to sign this Agreement.
If you are under 18 years old, please read this Agreement accompanied by your legal guardian, and have your guardian operate on your behalf or operate with your guardian's express consent.
I. Definitions
1.1 This Agreement: Refers to the main text of this Agreement, the TapTap Service Agreement, the TapTap Privacy Policy, the Ewan Game Privacy Protection Guidelines, any specific game privacy policy (if any), game rules, and any revised versions thereof. Once officially published, the above content shall form an inseparable part of this Agreement. This Agreement also includes the Mandatory Clauses for Standardized Online Game Service Agreements.
1.2 Game Rules: Refers to the user rules, player rules, game announcements, tips, notices, and other content regarding Ewan Games that are published and revised by the Ewan Game service provider from time to time.
1.3 Ewan Game Service Provider: Refers to Ewan (Shanghai) Network Technology Co., Ltd., which provides you with Ewan Games and related services. In this Agreement, it is referred to as "Ewan," "we," or "us."
1.4 Ewan Games: Refers collectively to games operated by Ewan, including computer client games, web games, HTML5 games (H5 games), mobile terminal games, TV terminal games, and games in other forms. Ewan Games may be provided in the form of software, in which case Ewan Games also include the relevant software and related documentation.
1.5 Ewan Game Services: Refers to the various online operational services related to games provided by Ewan to you.
1.6 You: Also referred to as the "player" or "user," meaning a natural person authorized to use Ewan Games and related services.
1.7 Game Data: Refers to various data generated by you during the use of Ewan Games and recorded by the server, including but not limited to character data, virtual item data, behavior logs, purchase logs, and other such data.
1.8 Game Virtual Items: Refers to a type of service provided by Ewan and stored in the game program's server in the form of electromagnetic records, capable of realizing specific functions set by the game program or reflecting specific results of the game program's operation. Game virtual items may be presented in text, graphic, or other digital forms. Game virtual items are part of the game services. Common game virtual items include but are not limited to:
(1) Game tokens and various other game currencies. Among them, game tokens refer to a type of virtual item that users directly or indirectly purchase with legal currency at a certain ratio, that is stored in a specific game server, and that can only be used to exchange for other designated virtual items or value-added services within that specific game;
(2) Game equipment, such as weapons;
(3) Heroes, skins, and other various game virtual items.
II. Game Accounts
2.1 If you need to use and enjoy Ewan Games, you must use your TapTap account as your game account and, in accordance with relevant national laws and regulations, log in to the real-name registration system and complete real-name registration. Your application for and use of such TapTap account shall also comply with the TapTap Service Agreement as revised and published by Ewan from time to time, as well as other relevant rules concerning the registration and use of the aforesaid account.
When carrying out real-name registration, you shall provide your true, lawful, accurate, and valid identity information and other relevant information, and shall not use another person's identity information for real-name registration. Otherwise, Ewan shall have the right to take one or more of the measures specified in the second paragraph of Article 6.5 of this Agreement, and may announce the handling result. All consequences arising therefrom shall be borne by you, and Ewan shall also have the right to require you to compensate Ewan for all losses caused thereby.
To satisfy the requirements of relevant laws, regulations, policies, and competent authorities, you shall provide true identity information for account registration, login, and use. We will verify your true identity information through the TapTap real-name authentication system. For the foregoing purpose, you agree that we may verify the real-name authentication status of the TapTap account currently used by you for registration and login through the TapTap real-name authentication system. If such account has completed real-name authentication in the TapTap real-name authentication system, you further agree that the TapTap real-name authentication system may disclose age information to us, so as to determine whether the account shall be included in the anti-addiction system and what anti-addiction measures shall be taken. You also agree that we may submit your name and ID card number through the TapTap real-name authentication system to the national unified electronic identity authentication system for minors' online games for real identity verification.
If such account has not completed real-name authentication in the TapTap real-name authentication system, we will be unable to provide services to you. If you still wish to use our products and services, you shall complete real-name authentication for the TapTap account currently used by you for registration and login in the TapTap real-name authentication system. During the authentication process, the TapTap real-name authentication system will collect your real-name identity information (including your name and ID card number).
2.2 You fully understand and agree that Ewan will, in accordance with relevant national requirements, apply your real-name registration information (including relevant authentication and age information) to the anti-addiction system. That is, Ewan will determine, based on your real-name registration information, whether you are 18 years of age or older, whether the real-name identity information you submitted is standardized, or whether the real-name verification has passed, so as to determine whether anti-addiction restrictions shall be imposed on your game account.
2.3 You fully understand and agree that Ewan has the right, as required by laws and regulations, to verify whether the identity information provided by users at registration is true and valid, and shall actively adopt reasonable technical and managerial measures to ensure the security and effectiveness of user accounts. Users are obligated to properly keep their account names and passwords and use them correctly and securely. If either party fails to fulfill the above obligations, resulting in lost account passwords, stolen accounts, or other such circumstances that damage the civil rights of users or others, that party shall bear the resulting legal liability.
If you discover that someone else is impersonating or misappropriating your game account or password, or any other unauthorized use, you shall immediately notify Ewan by effective means. When notifying Ewan, you shall provide valid personal identity information consistent with your registered identity information. After receiving your valid request and verifying your identity, Ewan will take corresponding measures depending on the circumstances (including but not limited to suspending the login to and use of the account). Any losses suffered by you or other users due to the corresponding measures taken by Ewan according to your request shall be borne by you. If you do not provide valid identity information, or the valid personal identity information you provide is inconsistent with the registered identity information, Ewan shall have the right to refuse your request, and any losses thereby suffered by you shall be borne by you.
2.4 You fully understand and agree that, in order to efficiently utilize server resources, if you have not logged into Ewan Games using your game account for three years, Ewan shall have the right, after prior notice, to delete or otherwise dispose of that account and the game data and related information under that account.
2.5 A game account is an identifier and credential authorized by Ewan under this Agreement for you to log in to and use Ewan Games and related services, and its ownership belongs to Ewan. You only enjoy the right to use the game account in accordance with this Agreement, the TapTap Service Agreement, the relevant account use agreements, and special rules published by Ewan for this purpose. You may not provide your game account to others for use in any way, including but not limited to transfer, lease, lending, or other methods for commercial use such as livestreaming, recording, account boosting, or power-leveling. Otherwise, any legal consequences and liabilities arising therefrom shall be borne by you, and Ewan shall have the right to take measures against your game account, including but not limited to warnings, restricting or prohibiting the use of all or part of the functions of the game account, deleting the game account and game data and other related information, banning the account, or even canceling the account. All consequences arising therefrom shall be borne by you.
2.6 Where Ewan Games provide an account cancellation function, if you need to cancel your game account, you may do so in accordance with the official account cancellation guidelines for that game, and you shall ensure that the relevant conditions for game account cancellation announced by the game are satisfied, and agree to the account cancellation agreement and other related rules announced by the game.
You are also specifically reminded that if you cancel your game account, the game virtual items and other value-added services under that game account (for convenience of description, collectively referred to below as "game benefits") will also be cleared. Therefore, before canceling your game account, please ensure that you have properly handled the game benefits under that account or that the relevant game benefits have been settled. Once you cancel your game account, if any game benefits still remain under that account at that time (including but not limited to game virtual items and other game value-added services that have been generated during the use of this game but have not yet expired or been used, as well as game benefits that may be generated in the future), you shall be deemed to have voluntarily waived such game benefits, and Ewan shall have the right to clear all game benefits under that game account. Any consequences arising therefrom shall be borne by you. The aforesaid game benefits include but are not limited to: game membership rights and interests, levels; all data related to character growth and upgrades (including but not limited to experience points, honor points, reputation points, titles, etc.); unused game virtual items (such as coupons, gold coins, diamonds, etc.); other value-added services that have been purchased but have not expired or have not been fully used; other game benefits already generated but not yet consumed, or future expected game benefits.
III. Collection, Use, and Protection of User Information
3.1 You agree and authorize Ewan to collect your personal information for the purpose of performing this Agreement. During your use of Ewan Game services, Ewan will collect information that you actively provide while using the services or that is generated due to your use of the services, in accordance with the Ewan Game Privacy Protection Guidelines and any specific game privacy policy (if any), in order to provide and optimize our services and protect the security of your account.
3.2 If Ewan pushes various types of information to you, such as activity information and promotional information about Ewan Games, the collection and use of your personal information shall comply with the Ewan Game Privacy Protection Guidelines and any specific game privacy policy (if any).
3.3 You acknowledge and agree that if a competent state authority lawfully requires Ewan to assist in investigating your game account (including real-name identity information) and game-related data (such as recharge, consumption, transaction data, etc.), Ewan may provide the aforesaid related information to the competent state authority.
3.4 You shall fully respect the personal information of any person, including but not limited to other users, that you may learn about, receive, or access through Ewan Games and related services. You shall not collect, copy, store, disseminate, or otherwise use the personal information of other users in any manner. Otherwise, any consequences arising therefrom shall be borne by you.
3.5 Protecting users' personal information and privacy is a basic principle of Ewan. The collection, use, and protection of users' personal information in Ewan Game services shall comply with the agreements such as the Ewan Game Privacy Protection Guidelines and any specific game privacy policy (if any). If you have agreed to Ewan's processing of your personal information in accordance with the foregoing agreements or provisions and then withdraw such consent, according to law, your withdrawal of consent shall not affect the validity of the personal information processing activities already carried out based on your consent before the withdrawal.
IV. Ewan Game Services
4.1 Subject to your compliance with this Agreement and relevant laws and regulations, Ewan grants you a personal, non-transferable, and non-exclusive license to use Ewan Game services. You may use Ewan Game services only for non-commercial purposes, including:
(1) receiving, downloading, installing, launching, upgrading, logging in to, displaying, running, and/or screenshotting Ewan Games;
(2) creating game characters, setting nicknames, viewing game rules, user profiles, and game match results, creating game rooms, setting game parameters, purchasing and using game virtual items in the game, and using chat functions and social sharing functions;
(3) using one or more other functions supported and permitted by Ewan Games.
4.2 During your use of Ewan Game services, you may not, without Ewan's permission, record, livestream, or disseminate Ewan Game content to others in any way, including but not limited to using any third-party software for online livestreaming or dissemination.
4.3 Where Ewan Games are provided in the form of software, your use of Ewan Games and Ewan Game services shall also comply with the provisions of Article 5 of this Agreement regarding software licensing.
4.4 All other rights not expressly authorized in this Article or elsewhere in this Agreement are reserved by Ewan, and you must obtain Ewan's separate written permission when exercising such rights.
4.5 If you violate any provision of this Agreement, Ewan shall have the right to take one or more of the measures specified in the second paragraph of Article 6.5 of this Agreement, may announce the handling result, and/or may require you to compensate Ewan for all losses caused by your breach.
4.6 You fully understand and agree that Ewan has the right, based on reasonable judgment, to handle acts that violate relevant laws and regulations or this Agreement, to take appropriate legal action against any user engaging in illegal or non-compliant acts, and to preserve relevant information and report to relevant authorities in accordance with laws and regulations. The user shall independently bear all legal liabilities arising therefrom.
4.7 You fully understand and agree that if any third-party claim, demand, or loss arises out of or results from your violation of this Agreement or the relevant service terms, you shall bear liability independently. If Ewan thereby suffers losses, you shall also compensate Ewan accordingly.
4.8 You fully understand and agree that game virtual items and other game value-added services are part of Ewan Game services, and Ewan hereby licenses you to obtain the right to use them in accordance with this Agreement. Your purchase and use of game virtual items and other game value-added services shall comply with this Agreement and the requirements of specific game rules. At the same time, game virtual items and other game value-added services may be subject to a certain validity period. Even if you do not use them within the prescribed validity period, once the validity period expires, they will automatically become invalid, except where caused by force majeure or reasons attributable to Ewan. If the relevant game virtual items or other game value-added services do not indicate a period of use, or indicate a period of use as "permanent" or other words having the same or similar meaning as "permanent" (such as "indefinite" or "unlimited"), then their period of use shall be from the date on which you obtain such game virtual items or other game value-added services until the date on which the game ceases operation.
You fully understand and agree that, in order to better provide users with Ewan Game services, Ewan has the right to adjust, update, or optimize game-related content (including but not limited to the design, performance, and related numerical settings of game virtual items).
4.9 You fully understand and agree that, in order to protect the security of your game account and create a fair, healthy, and safe gaming environment, during your use of Ewan Game services, and without violating relevant legal provisions, Ewan may use technical means to learn about your terminal device's random-access memory and the related programs running simultaneously with Ewan Games. Once any unauthorized program that endangers the normal operation of Ewan Game services is discovered, Ewan may take reasonable measures to combat it.
4.10 Ewan will, in accordance with relevant laws and regulations and this Agreement, take practical and effective measures to protect the lawful rights and interests of minors during their use of Ewan Game services, including possibly adopting technical measures, prohibiting minors from accessing unsuitable games or game functions, restricting minors' game time or duration, and preventing minors from becoming addicted to online games. As part of the game rules, Ewan will also publish user guidelines and warning statements for Ewan Games in appropriate places, including game content introductions, proper methods of using the games, and methods of preventing harm. All minor users shall carefully read and follow these guidelines and statements under the guidance of their legal guardians. Other players shall avoid publishing or generating any content harmful to the physical or mental health of minors during the use of Ewan Game services, so as to jointly create a healthy gaming environment.
4.11 You acknowledge and agree that if any of the following circumstances occurs, Ewan shall have the right to include your game account in the corresponding anti-addiction system and take corresponding anti-addiction measures:
(1) the system determines that you are under 18 years old; or
(2) the real-name identity information you submitted is not standardized; or
(3) your real-name verification fails; or
(4) other circumstances required by national laws, regulations, or policies, or where Ewan has reasonable grounds to believe that inclusion in the anti-addiction system is necessary.
For game accounts included in the corresponding anti-addiction system, Ewan has the right, in accordance with relevant national laws, regulations and policy provisions, other provisions of this Agreement, Ewan's game operation strategies, or the reasonable requirements of your legal guardian, to take one or more of the following measures:
(1) provide your legal guardian with information related to your game activities (including but not limited to your game account login information and recharge transaction information), so that your legal guardian can timely or simultaneously understand your gaming situation;
(2) restrict the spending limit of your game account;
(3) adopt technical measures to block certain games or certain functions of games, or limit your game time or duration;
(4) cancel or delete your game account and game data and other related information;
(5) other reasonable measures requested by your legal guardian or deemed appropriate by Ewan to restrict or prohibit your use of Ewan Games;
(6) relevant measures required by national laws, regulations, or policies.
4.12 Ewan's provision of game services to users is itself a commercial act, and users have the right to independently decide whether to pay the corresponding fees in accordance with the charging items and charging standards independently determined by Ewan (including but not limited to purchasing the right to use in-game virtual items and receiving other value-added services and various other charging items) in order to obtain the corresponding game services. If you do not pay the corresponding fees according to the corresponding standards, you will be unable to obtain the corresponding game services.
You acknowledge and agree that changes and adjustments to charging items or charging standards are normal commercial acts, and you may not require Ewan to make compensation or indemnification because of such changes or adjustments.
You acknowledge and agree that if you recharge the game with legal currency to purchase or exchange game virtual items and other value-added services, the game virtual items and other value-added services you purchase or exchange cannot be returned or exchanged into legal currency, except where mandatory laws provide otherwise.
You acknowledge and agree that if a transaction whereby you recharge the game to purchase or exchange game virtual items and other value-added services is canceled due to a refund or other reason, Ewan shall have the right to deduct the game virtual items and other value-added services issued to your game account corresponding to such canceled transaction. If the game virtual items and other value-added services in your game account are insufficient for such deduction, Ewan may give priority to deducting the deficient portion when the game virtual items and other value-added services in your game account increase subsequently.
4.13 Under no circumstances shall Ewan be liable for losses suffered by you during the use of Ewan Game services due to force majeure. Such force majeure events include but are not limited to national laws, regulations, policies, orders of state authorities and other government acts, as well as other unforeseeable, unavoidable, and insurmountable events such as earthquakes, floods, snow disasters, fires, tsunamis, typhoons, strikes, and wars.
4.14 Ewan Games may, due to game software bugs, defects in version updates, third-party virus attacks, or any other factor, cause anomalies in your account data or game data such as game virtual items. Before the cause of such data anomaly is identified, Ewan shall have the right to temporarily freeze the relevant game account. If it is found that the data anomaly was caused by abnormal gaming behavior, Ewan shall have the right to restore the game account data to the original state prior to the occurrence of the anomaly (including recovering transferred data from third parties), without bearing any liability to you. If the data anomaly is caused by your illegal or non-compliant acts or acts in violation of this Agreement, Ewan shall have the right to take one or more of the measures specified in the second paragraph of Article 6.5 of this Agreement.
You understand and agree that where a game is deployed on multiple servers, during game operation, in order to improve playability and interaction and create a better gaming environment, Ewan may, based on the number of active users in the game servers and other circumstances, adjust the number of servers in a timely manner and temporarily or permanently merge or migrate users among multiple servers into the same server (i.e., "server merge").
If the game undergoes a server merge, Ewan will notify you through in-game announcements or other means before the merge and will publish the specific rules concerning the server merge. A server merge may lead to changes in game-related settings, experience, rankings, and other user-related game data, but will not adjust the functions of your game virtual items. For details, please refer to the specific server merge rules officially published by the game. If a server merge results in duplicate character names, team names (if any), or other related content, the game operator may randomly assign new names to distinguish such duplicate content.
4.15 Without Ewan's permission, you may not engage in transactions of game virtual items and other value-added services with other users, or obtain game virtual items and other value-added services from third parties by purchase, gift, or any other means. Ewan is not responsible for third-party transactions (that is, acts by which you obtain game virtual items and other value-added services from third parties through purchase, gift, or other means), and does not accept complaints arising from disputes caused by any third-party transaction.
4.16 You fully understand that there are objective incompatibilities between different operating systems, and such objective circumstances are not caused by Ewan. As a result, your recharges and game data in one operating system may not be smoothly transferred to another operating system. The risks of recharge losses and game data loss caused by your switching between different systems shall be borne by you, and Ewan shall not bear any liability therefor.
4.17 You fully understand that certain Ewan Games may include mandatory battle areas or gameplay. If you do not agree to mandatory battle, please do not enter such game or game area. Your entry shall be deemed as agreement to such gameplay and acceptance of the corresponding consequences.
4.18 When Ewan independently decides to terminate the operation of Ewan Games, or when Ewan Games terminate operation for any other reason, Ewan will handle matters related to the termination of game operations in accordance with the relevant national laws and regulations concerning the termination of online game operations, so as to protect the lawful rights and interests of users.
V. Software License
5.1 The use of Ewan Game services may require downloading and installing related software. You may obtain such software directly from Ewan's relevant websites, or from a third party authorized by Ewan. If you obtain Ewan Games or a game with the same name as Ewan Games from an unauthorized third party, you shall be deemed not to have obtained authorization from Ewan. Ewan cannot guarantee that such game can be used normally and shall not be responsible for any loss caused to you thereby.
5.2 Ewan may have developed different software versions for different terminal devices or operating systems, including but not limited to multiple application versions for Windows, iOS, Android, Nintendo Switch, etc. You shall choose and download the appropriate version for installation according to the actual circumstances. After downloading the installation program, you need to install it correctly in accordance with the steps prompted by the program.
5.3 Where Ewan Games are provided in the form of software, Ewan grants you a personal, non-transferable, and non-exclusive license. You may only download, install, log in to, and use such Ewan Games on a single terminal device for non-commercial purposes.
5.4 In order to provide better-quality and safer services, Ewan may recommend that you install other software during software installation, and you may choose whether or not to install it.
5.5 If you no longer need to use the software or need to install a new version, you may uninstall it yourself. If you are willing to help Ewan improve its products and services, please inform us of the reasons for uninstallation.
5.6 In order to ensure the security of Ewan Game services and the consistency of functions, Ewan has the right to update the software, or change or restrict the effects of certain functions of the software.
5.7 After a new version of the software is released, old versions of the software may become unusable. Ewan does not guarantee the continued availability of old versions of the software or the corresponding customer service. Please check and download the latest version at any time.
VI. User Code of Conduct
6.1 You fully understand and agree that you must be responsible for all actions under your game account, including any content you publish and any consequences arising therefrom.
6.2 In addition to using Ewan Game services in accordance with this Agreement, you may not engage in any acts that infringe the intellectual property rights of Ewan Games, or engage in any other acts that harm the lawful rights and interests of Ewan or any third party.
6.3 When using Ewan Games or Ewan Game services, you must comply with laws and regulations and may not use Ewan Games or Ewan Game services to engage in illegal or non-compliant acts, including but not limited to the following acts:
(1) violating the basic principles established by the Constitution;
(2) endangering national unity, sovereignty, and territorial integrity;
(3) divulging state secrets, endangering national security, or harming national honor and interests;
(4) inciting ethnic hatred or ethnic discrimination, undermining ethnic unity, or infringing ethnic customs and habits;
(5) promoting cults or superstition;
(6) spreading rumors, disrupting social order, or undermining social stability;
(7) promoting obscenity, pornography, gambling, violence, or abetting crime;
(8) insulting or defaming others, or infringing the lawful rights and interests of others;
(9) violating social morality;
(10) containing any other content prohibited by laws, administrative regulations, or state provisions.
6.4 Unless permitted by law or with Ewan's written authorization, you may not engage in the following acts:
(1) deleting copyright information from the game software or its copies;
(2) reverse engineering, reverse assembling, reverse compiling, or otherwise attempting to discover the source code or other confidential content of the game software, including but not limited to game elements that Ewan has not actively disclosed but that are already packaged within the game installation package;
(3) scanning, probing, or testing the game software to detect, discover, or locate bugs or weaknesses that may exist therein;
(4) copying, modifying, adding to, deleting, hooking, or creating any derivative works from the game software, any data released into any terminal memory during software operation, interaction data between the client and server during software operation, or system data necessary for software operation, including but not limited to through the use of plugins, cheats, or unauthorized third-party tools/services to access the software and related systems;
(5) modifying or forging instructions or data in software operation, adding to, deleting, or altering the functions or operational effects of the software, or operating or disseminating software or methods for the aforesaid purposes, regardless of whether such acts are for commercial purposes;
(6) using Ewan Games and Ewan Game services through third-party software, plugins, cheats, or systems not developed or authorized by Ewan, or producing, publishing, or disseminating third-party software, plugins, cheats, or systems not developed or authorized by Ewan;
(7) using, leasing, lending, copying, modifying, linking, reprinting, compiling, publishing, or establishing mirror sites for content in the games over which Ewan owns intellectual property rights;
(8) establishing mirror sites related to Ewan Games, creating web snapshots, or providing services identical or similar to Ewan Game services to others through setting up servers or by other means;
(9) separating any part of Ewan Games for independent use, or using them in any other way inconsistent with this Agreement;
(10) using, modifying, or obscuring the name, trademark, or other intellectual property rights of Ewan Games;
(11) any other acts not expressly authorized by Ewan.
6.5 If you commit any of the following acts during your use of Ewan Game services (hereinafter also referred to as "illegal or non-compliant acts"), Ewan has the right, depending on the severity of the circumstances and in accordance with this Agreement and the relevant game rules, to take one or more of the measures specified in the second paragraph of this Article against you, and may announce the handling result:
(1) using or uploading illegal or inappropriate words, characters, or other content in Ewan Games, including for role naming;
(2) damaging Ewan Games or affecting the normal operation of Ewan Game services in any way, including but not limited to:
1) non-compliant and/or malicious registration and login acts, including but not limited to malicious bulk registration of game accounts, and login acts such as logging into the game by disrupting server authentication or maliciously crowding servers;
2) maliciously carrying out acts that may cause game server downtime or lag, or cause other players to disconnect or experience latency and thus be unable to play normally, such as using DDoS attacks against game servers or other players;
3) exploiting game vulnerabilities for profit, damaging the game environment, or causing adverse effects to other players;
4) passive gameplay that undermines other users' gaming experience, including but not limited to maliciously injuring or killing teammates, malicious teaming, intentionally losing or lowering rank, idling, escaping, intentionally feeding, and other passive gameplay that damages the user experience;
5) other acts in which game data performance is abnormal and affects the fairness of Ewan Games;
(3) using private servers or cheats of any kind;
(4) using game synchronizers (including but not limited to hardware synchronizers such as keyboard or mouse synchronizers that allow you to use one set of keyboard and mouse to simultaneously and synchronously control multiple computers for gaming), as well as using other hardware that causes abnormal efficiency or收益 data performance in the game (including but not limited to "auto clickers"; collectively referred to below as "cheating hardware");
(5) disseminating illegal speech or improper information;
(6) stealing other persons' game accounts or game items;
(7) engaging in game account trading, account sharing, or other acts affecting account security;
(8) without Ewan's permission, engaging in transactions with other users for game virtual items and other game value-added services, or obtaining game virtual items and other game value-added services from third parties through purchase, acceptance of gifts, or other means;
(9) recharging games through discount channels unauthorized or unrecognized by Ewan, engaging in discounted game item transactions (for example, purchasing discounted skins at low prices through non-official Ewan channels), entrusting an unauthorized or unrecognized third party to recharge on your behalf, or using unauthorized or unrecognized third-party software to recharge;
(10) implying or falsely claiming in some way to be an internal employee of Ewan or to possess some special identity, in an attempt to obtain improper benefits or affect the rights and interests of other users;
(11) violating any provision of this Agreement or any provision of national laws and regulations;
(12) other improper acts widely recognized within the industry, or other violations announced through game rules (including but not limited to user rules, player regulations, game announcements, tips, and notices).
The handling measures specified in the preceding paragraph include but are not limited to:
(1) warning; and/or
(2) chat prohibition, including but not limited to region-wide mute, single-region mute, and public-channel mute; and/or
(3) content reset, including but not limited to resetting or forcibly modifying illegal nicknames, room names, images, and other illegal information or content provided or uploaded by you; and/or
(4) reducing or limiting your game benefits, including but not limited to the growth and upgrade-related data of game characters (such as experience points, honor points, reputation points, titles, etc.) and the acquisition of game virtual items and other game value-added services in the game; and/or
(5) deleting or canceling game accounts, game data, or other game-related information; and/or
(6) restricting or prohibiting your entry into specific scenes in the game or your use of specific game functions; and/or
(7) forcibly removing you from the game (i.e., "kick-out"), including but not limited to forcibly exiting the entire game, a single match in the game, or other gaming activities you are currently engaged in; and/or
(8) temporarily or permanently prohibiting your game account from logging into Ewan Games (hereinafter referred to as an "account ban"); and/or
(9) temporarily or permanently prohibiting the specific terminal involved in your illegal or non-compliant act (including but not limited to PC terminals, mobile terminals, etc.) from logging into Ewan Games; and/or
(10) suspending or terminating your use of Ewan Games and related services, or unilaterally notifying you of the termination of this Agreement; and/or
(11) initiating corresponding civil litigation with respect to your illegal or non-compliant acts, pursuing tort liability, breach of contract liability, or other civil liabilities against you, and requiring you to compensate Ewan for losses suffered by Ewan due to your illegal or non-compliant acts (including Ewan's direct economic losses, reputation or goodwill losses, compensation paid by Ewan to third parties, settlement costs, attorney's fees, litigation expenses, and other indirect losses), or transferring the matter to the relevant administrative authorities for administrative penalties, or to judicial authorities for criminal liability; and/or
(12) other handling measures announced by Ewan through game rules (including but not limited to user rules, player regulations, game announcements, tips, and notices).
You acknowledge and agree that, due to the concealment of cheats, game synchronizers, and other cheating hardware, or their ability to disappear after use, Ewan has the right to determine, based on your game data and abnormal performance, whether you have used illegal cheats, game synchronizers, or other cheating hardware.
6.6 You acknowledge and agree that if Ewan imposes an account ban on your game account pursuant to this Agreement, the specific duration of the ban shall be determined by Ewan according to the severity of your violation.
You acknowledge and agree that: (1) during the ban period, the game virtual items and other value-added services in your game account will not be available for use; and (2) if the aforesaid game virtual items and other value-added services have a certain validity period, such validity period may expire during the ban period, and after your game account is unbanned, you will no longer be able to use such expired game virtual items and other value-added services.
VII. Intellectual Property Rights
7.1 Ewan is the intellectual property rights holder of Ewan Games. All copyrights, trademark rights, patent rights, trade secrets, and other intellectual property rights and lawful rights and interests in Ewan Games (including but not limited to Ewan Games as a whole, all artworks, music, textual works, and other game elements and components contained in the game, and the continuous dynamic images presented in the operation of Ewan Games), as well as all information content related to Ewan Games (including text, images, audio, video, charts, interface design, layout framework, relevant data, or electronic documents, etc.), are protected by the laws and regulations of the People's Republic of China and corresponding international treaties. Ewan enjoys the foregoing intellectual property rights and lawful rights and interests, except for rights that the relevant rights holders should enjoy according to law. Without Ewan's prior written consent, you may not commercially use Ewan Games (including but not limited to Ewan Games as a whole, all artworks, music, textual works, and other game elements and components contained in the game, and the continuous dynamic images presented in the operation of Ewan Games) in any manner, or disseminate Ewan Game content through information networks.
7.2 The ownership and intellectual property rights of game data generated by you in the use of Ewan Game services belong to Ewan. Ewan has the right to preserve and dispose of such game data, unless otherwise provided by national laws and regulations.
Ewan enjoys the property rights provided by laws and regulations over the relevant data products and services formed through its lawful processing of game data.
7.3 Ewan Games may involve third-party intellectual property rights, and if such third parties impose requirements on your use of such intellectual property rights in Ewan Games based on this Agreement, Ewan will inform you of such requirements in an appropriate manner, and you shall comply with them accordingly.
VIII. Compliance with Local Laws and Regulations
8.1 During your use of Ewan Game services, you shall comply with relevant local laws and regulations and respect local morals and customs. If your conduct violates local laws and regulations or morals and customs, you shall bear sole responsibility therefor.
8.2 You shall avoid involving Ewan in political and public events due to your use of Ewan Game services, otherwise Ewan shall have the right to suspend or terminate the provision of services to you.
IX. Jurisdiction and Applicable Law
9.1 The place of signing of this Agreement is Jing'an District, Shanghai, People's Republic of China.
9.2 The formation, effectiveness, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of Mainland China (excluding conflict of laws rules).
9.3 Any dispute or controversy arising between you and Ewan out of or in connection with this Agreement shall first be resolved through friendly consultation. If consultation fails, you agree to submit such dispute or controversy to the people's court with jurisdiction in the place where this Agreement is signed.
9.4 The headings of all clauses in this Agreement are for reading convenience only and have no actual meaning in themselves, and may not be used as the basis for interpreting the meaning of this Agreement.
9.5 If any clause of this Agreement is partially invalid for any reason, the remaining clauses shall remain valid and binding upon all parties.
X. Miscellaneous
10.1 Ewan has the right to amend the terms of this Agreement when necessary, and you may review the latest version of the agreement terms on the relevant pages of Ewan Games. After the terms of this Agreement are amended, if you continue to use Ewan Game services, you shall be deemed to have accepted the amended Agreement.
10.2 If you have any comments or suggestions regarding this Agreement or the services, you may contact Ewan Game customer service at Unknown.Evolution@taptap.com, and Ewan will provide you with the necessary assistance.
10.3 Ewan reminds you: Resist unhealthy games and reject pirated games; pay attention to self-protection and beware of fraud; moderate gaming benefits the brain, addiction harms the body; arrange your time reasonably and enjoy a healthy life.
