Terms of Service & End User License Agreement (EULA) - "MUPO"
By installing, copying, or using the video game "MUPO" (hereinafter "Game"), you agree to the terms of this EULA. If you do not agree to these terms, you are not authorized to install or use the Game.
This EULA is entered into between you as the end user (hereinafter "User" or "You") and:

This EULA applies in addition to the Steam Subscriber Agreement (SSA) by Valve. In the event of conflicts between this EULA and the SSA regarding the pure use of the Steam platform, the SSA shall take precedence.
§ 1 License Grant and Scope of Use
1. The Licensor grants you a non-exclusive, non-transferable, and perpetual right (License) to use the Game for your personal, non-commercial private use. The right to use may be revoked by the Licensor for good cause (in particular, in the event of violations of this EULA, cheating, or illegal content).
2. The Game is licensed to you, not sold. The license extends to the software of the main game, updates, patches, and – in each case after their separate purchase or unlocking – to DLCs and all associated digital content. The Licensor reserves the right to further develop the Game through updates and patches to fix errors, improve stability, or adjust gameplay content.
3. You are prohibited from:
- Renting, selling, sublicensing, or otherwise commercially exploiting the Game or parts thereof.
- Removing or modifying copyright notices or brand labels in the Game.
- Decompiling or reverse-engineering the Game, unless permitted under mandatory applicable law (§ 69e UrhG) or for the creation of non-commercial modifications ("Mods") in accordance with paragraph 4.
4. Mods are explicitly permitted, provided they (i) do not unfairly affect gameplay for other users (no cheating in leaderboards or multiplayer), (ii) do not infringe any third-party copyrights, and (iii) do not impair the stability and security of the Game or the online services.
§ 2 Ownership and Intellectual Property Rights
All ownership, copyright, trademark, and other intellectual property rights in and to the Game (including program code, graphics, visual elements, soundtracks, effects, and user interfaces) remain exclusively with the Licensor or its licensors. The Game is protected by national and international laws.
§ 3 Community Content (UGC), Level Editor, and Disclaimer for User Content
1. The Game contains features (e.g., a level editor) that allow users to create and share their own game sections and content (hereinafter "Community Content") via integrated online services or third-party platforms (e.g., Steam Workshop).
2. The Game's online features and Community Content are provided on an "AS IS" and "AS AVAILABLE" basis. The Licensor does not guarantee the quality, accuracy, or safety of content uploaded by users.
3. User Responsibility: You are solely responsible for all Community Content you upload. The Licensor does not pre-screen these contents for legal admissibility (especially copyrights in music, graphics, or texts).
4. Grant of Rights: When you publish Community Content, you retain the copyright. However, you grant the Licensor an irrevocable, perpetual, worldwide, royalty-free, and sublicensable right of use. This includes the right to reproduce and modify the content in the Game, as well as to use it for marketing purposes (e.g., trailers, social media videos, streams) worldwide without mentioning your name.
5. Prohibited Content: It is strictly prohibited to upload Community Content that:
- Violates copyrights, trademarks, or third-party rights (e.g., music or image files without the copyright holder's permission).
- Is unlawful, pornographic, racist, offensive, or glorifies violence.
- Contains malicious code, viruses, or cheats.
6. Indemnification: You warrant that your content does not infringe third-party rights. If the Licensor is held liable by third parties (e.g., copyright holders) for damages or injunctions due to your content, you shall fully indemnify and hold the Licensor harmless from all claims, damages, and costs (including reasonable legal defense fees), unless you are not responsible for the infringement.
§ 4 House Rules, Moderation, and Notice-and-Takedown
1. The Licensor operates the online services at its own discretion. There is no entitlement to the permanent provision of specific Community Content.
2. If the Licensor is notified or has reasonable suspicion that any content violates third-party rights or this EULA, the Licensor reserves the right to temporarily or permanently delete or block this content without prior notice (Notice-and-Takedown procedure).
3. In the event of violations of this EULA, the Licensor is entitled to temporarily or permanently block the affected user from all or individual online and multiplayer features of the Game.
4. Voluntary Community Helpers (Moderators): The Licensor may appoint community members as voluntary moderators (e.g., to review levels or chats). Assuming such a voluntary role is only permitted from the age of 18 (majority).
§ 5 Prohibition of Cheating and Protection of Leaderboards
1. The integrity of the Game and the competition via the leaderboards managed by the Licensor are protected.
2. The use of cheats, hacks, bots, trainers, automation software, or the targeted manipulation of server communication to forge highscores is strictly prohibited.
3. The Licensor reserves the right to delete or reset highscores, save states, or replays at any time and without giving reasons if unfair manipulation or technical errors are suspected.
§ 6 Online Services and Server Availability
1. The Game utilizes its own server services, as well as features of the Steam platform, for online functions and data storage. The Licensor strives for high availability but does not guarantee uninterrupted accessibility of the servers.
2. The Licensor is entitled to modify, limit, or discontinue the provided online services in the course of the Game's further development. In the event of a complete discontinuation of significant online features, users will be informed at least 30 days in advance (e.g., on the Game's Steam community page).
§ 7 Limitation of Liability
1. The Licensor is liable without limitation for damages arising from injury to life, body, or health, as well as for damages based on intent or gross negligence of the Licensor.
2. In the event of a slightly negligent breach of a material contractual obligation (cardinal obligation – i.e., an obligation whose fulfillment is essential to the execution of the contract), the Licensor's liability is limited to typical, foreseeable contractual damages.
3. Otherwise, to the maximum extent permitted by law, the Licensor's liability for light negligence, data loss, server failures, or lost profits – regardless of the legal grounds – is excluded.
§ 8 Data Protection
The processing of personal data in connection with the use of the Game and the online services is carried out in compliance with the General Data Protection Regulation (GDPR). To manage highscores, profiles, and Community Content, data (e.g., your Steam ID, selected usernames, game statistics, and uploaded level data) is processed. § 9 Governing Law, Jurisdiction and Severability Clause
1. The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers within the EU, mandatory national consumer protection rights of their respective country of residence remain unaffected. If you are a merchant, a legal entity under public law, or have no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from this agreement shall be Cologne, Germany.
2. If individual provisions of this EULA are or become invalid, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall apply in place of the invalid provision.
§ 10 Amendments to this EULA
1. The Licensor reserves the right to modify or adapt this EULA at any time if required due to legal changes, technical developments of the Game, or the online services.
2. The modified terms will be announced to the user (e.g., when launching the Game or via Steam). If the user actively continues to use the Game after 14 days following the announcement, this shall be deemed as consent to the new terms. If the user rejects the new terms, the right to use the online services expires.
