STANDARD END USER LICENSE AGREEMENT (EULA)
IMPORTANT: PLEASE READ THIS AGREEMENT CAREFULLY.
This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "Licensee") and Damian Tran ("Licensor", "Teacher", or "Company") for the software product Hyperplane (the "Game"), which includes computer software and may include associated media, printed materials, and "online" or electronic documentation.
By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Game.
1. GRANT OF LICENSE
Subject to your compliance with the terms of this Agreement, Licensor grants you a personal, non-exclusive, non-transferable, revocable, limited license to install and use the Game for your personal, non-commercial entertainment purposes on a computer or device that you own or control.
2. OWNERSHIP
The Game is licensed, not sold. You acknowledge that Licensor retains all right, title, and interest in and to the Game, including all intellectual property rights, copyrights, trade secrets, trademarks, and other proprietary rights in and to the Game. The Game is protected by the copyright laws of Canada, international copyright treaties, and other intellectual property laws.
3. KEY RESTRICTIONS
You agree not to, and not to aid or allow others to:
Reverse Engineer: Reverse engineer, decompile, disassemble, or otherwise attempt to derive regarding the source code of the Game, except to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
Modify: Modify, adapt, translate, or create derivative works based on the Game.
Distribute: Rent, lease, lend, sell, redistribute, sublicense, or otherwise transfer the Game or your rights under this Agreement to any other party.
Circumvent: Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) or circumvent any digital rights management (DRM) protections.
4. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Licensor does not warrant that the Game will meet your requirements, that the operation of the Game will be uninterrupted or error-free, or that defects in the Game will be corrected.
5. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE GAME, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In any case, Licensor's entire liability under any provision of this Agreement shall be limited to the amount actually paid by you for the Game.
Note for Ontario Residents: Some jurisdictions, including Ontario, do not allow the exclusion or limitation of certain warranties or liabilities under consumer protection legislation. In such jurisdictions, the exclusions and limitations above apply to the fullest extent permitted by law.
6. TERMINATION
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice from Licensor if you fail to comply with any term(s) of this Agreement. Upon termination, you must cease all use of the Game and destroy all copies, full or partial, of the Game.
7. GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, excluding its conflicts of law rules.
Any dispute, controversy, or claim arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario. You hereby consent to the personal jurisdiction and venue of these courts.
8. SEIZURE WARNING
A very small percentage of people may experience a seizure when exposed to certain visual images, including flashing lights or patterns that may appear in video games. Even people who have no history of seizures or epilepsy may have an undiagnosed condition that can cause these "photosensitive epileptic seizures" while watching video games. If you experience any symptoms, immediately stop playing and consult a doctor.
