This End User License Agreement ("Agreement") is a binding legal agreement between you, the user, and ActiDimension Technology Ltd. ("ActiDimension"), the developer and publisher of the video game titled "Dig Raider: Anomaly Extraction" ("Game").
By installing, copying, downloading, accessing, or otherwise using the Game, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Game.
1. Grant of License
ActiDimension grants you a non-exclusive, non-transferable, revocable license to use the Game solely for personal, non-commercial purposes on your personal computer or authorized platform. You may not use the Game for any other purpose, or in connection with any commercial endeavor, without the prior written consent of ActiDimension.
2. Ownership and Intellectual Property
ActiDimension retains all right, title, and interest in and to the Game, including, without limitation, all intellectual property rights therein and thereto (including but not limited to characters, themes, dialogue, artwork, and music). This Agreement grants you no rights to patents, copyrights, trademarks, or any other intellectual property rights in the Game.
3. General Restrictions
You may not:()
a. Copy, reproduce, distribute, or publicly display the Game except as expressly authorized by this Agreement;()
b. Modify, translate, adapt, or otherwise create derivative works or improvements, whether or not pa()tentable, of the Game;()
c. Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive or gain access to the source code of the G()ame or any part thereof;()
d. Remove, delete, alter, or obscure any trademarks or any copyright, trademark, patent, or other intellectual() property or proprietary rights notices from the Game.
4. Anti-Cheating and User Conduct
As "Dig Raider: Anomaly Extraction" is a competitive multiplayer game, you agree to adhere to the following rules of conduct. ActiDimension reserves the right to suspend or terminate your access to the Game if you engage in any of the following:
a. Cheating: Using, creating, or distributing "auto-hit" programs, "speed hacks," "wall hacks," "aim-bots," or any other software or hardware intended to gain an unfair advantage over other players.
b. Exploitation: Purposefully exploiting bugs or glitches in the game design to gain an unintended advantage.
c. Disruption: Using scripts or software to interfere with the Game’s servers or the experience of other players.
d. Toxicity: Engaging in harassment, hate speech, or intentionally disruptive behavior within the game's social or competitive systems.
5. Online Features and Data Collection
The Game includes online multiplayer features. By using these features, you acknowledge that:
a. Use of online features requires an internet connection and may be subject to third-party platform terms (e.g., Steam Subscriber Agreement).
b. ActiDimension may collect non-personal technical data (such as crash logs and hardware specifications) to improve game performance and ensure fair play (Anti-Cheat).
c. Personal data collection is governed by our Privacy Policy and relevant third-party platform policies.
6. Termination
This Agreement is effective until terminated. You may terminate this Agreement at any time by deleting the Game and all copies thereof. The Agreement will terminate immediately and automatically without notice from ActiDimension if you fail to comply with any term of this Agreement, including the anti-cheating provisions in Section 4.
7. Disclaimer of Warranty
The Game is provided "as is", with all faults and without warranty of any kind. ActiDimension disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will ActiDimension be liable for any special, incidental, indirect, or consequential damages whatsoever (including loss of data or loss of profit) arising out of your use of or inability to use the Game.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without giving effect to any principles of conflicts of law.
10. Severability
If any provision of this Agreement is held to be illegal or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.
11. Entire Agreement
This Agreement constitutes the entire agreement between the parties regarding the Game and supersedes all prior understandings (including previous versions of this EULA or descriptions).
By installing or using the Game, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions.
By installing, copying, downloading, accessing, or otherwise using the Game, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Game.
