End User License Agreement

1.Introduction
This End User License Agreement (“EULA”) is a legal agreement between you (an individual or entity) and 11th Dan / P.W. Maccabe (“Developer”) for the video game Intersecta (“Software”), which includes the software, associated media, printed materials, and online or electronic documentation. By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA.

2.License
Grant Developer grants you a limited, non-exclusive, non-transferable, revocable license to install and use this Software for your personal, non-commercial entertainment purposes on a validly licensed Steam account.

3.Restrictions
You agree that you will not: Reverse engineer, decompile, or disassemble the Software. Modify, translate, or create derivative works without express permission. Use the Software for commercial purposes, including for-profit tournaments. Remove any copyright, trademark, or other proprietary rights notices. Break the law, violate human rights or be offensive to others while using the game Software, the Steam platform, or in connection with the game online.

4.Intellectual Property
All title, ownership rights, and intellectual property rights in and to the Software and all copies thereof (including but not limited to any titles, computer code, themes, objects, characters, character names, stories, dialogue, catchphrases, locations, concepts, artwork, animation, sounds, musical compositions, audio-visual effects, and methods of operation) are owned by P.W. Maccabe and 11th Dan.

5. Data & Privacy [GDPR Europe and CCPA California compliance]
5.1 Data Processing: This Demo utilizes the Steamworks API (provided by Valve Corp) to provide core functionality. While the Developer does not store, host, or collect your personal data on independent private servers, certain information is processed through the Steam platform to facilitate gameplay.
5.2 Use of Steamworks API: By playing the Intersecta Demo, you acknowledge that technical data is transmitted via Steam for the following purposes: Authentication: Verifying your license to access the Demo via your Steam Account. Presence & Status: Updating your Steam profile to show "In-Game" status and play duration. Overlay Functionality: Allowing access to the Steam Overlay features (e.g., friends list, screenshots) using your Steam ID.
5.3 Third Parties: The Developer does not sell, trade, or share any user data with third-party entities. All data handling is governed by the Steam Subscriber Agreement and Valve’s Privacy Policy.



6.Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any term(s) of this EULA.

7. Disclaimer of Warranty & Limitation of Liability
THE SOFTWARE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY. USE OF THE SOFTWARE IS AT YOUR OWN RISK. THE ENTIRE RISK OF SATISFACTORY QUALITY AND PERFORMANCE LIES WITH YOU.
7.1 "As-Is" Basis: The Intersecta Demo is provided to you "AS IS" and "AS AVAILABLE." The Developer does not guarantee that the software will be error-free, that it will not crash, or that it will be compatible with all hardware configurations (including integrated graphics such as AMD Radeon Vega or Intel UHD).
7.2 Technical Performance: You acknowledge that the Demo is a work in progress. The Developer is not liable for any damages resulting from software crashes, data loss, or system instability.
7.3 Use at Your Own Risk: To the maximum extent permitted by law, the Developer shall not be liable for any special, incidental, or consequential damages arising out of the use or inability to use the Demo.

8. Disclaimer of Liability and Warranties (Epic Games)
The [Project Name/Demo] includes the Unreal® Engine code and other code, materials, and information (the “Licensed Technology”) from Epic Games, Inc. (“Epic”). All Licensed Technology is provided on an “as is” and “as available” basis, with all faults and without warranty of any kind.
Epic and Epic’s affiliates disclaim all warranties, conditions, common law duties, and representations (express, implied, oral, and written) with respect to the Licensed Technology, including without limitation all express, implied, and statutory warranties and conditions of any kind, such as title, non-interference with your enjoyment, authority, non-infringement, merchantability, fitness or suitability for any purpose (whether or not Epic knows or has reason to know of any such purpose), system integration, accuracy or completeness, results, reasonable care, workmanlike effort, lack of negligence, and lack of viruses, whether alleged to arise under law, by reason of custom or usage in the trade, or by course of dealing.
To the maximum extent permitted by applicable law, neither Epic, Epic’s licensors, nor its or their affiliates, nor any of Epic’s service providers, shall be liable in any way for loss or damage of any kind resulting from the use or inability to use the Licensed Technology or otherwise in connection with this Agreement, including but not limited to loss of goodwill, work stoppage, computer failure or malfunction, or any and all other commercial damages or losses. In no event will Epic, Epic’s licensors, nor its or their affiliates, nor any of Epic’s service providers be liable for any loss of profits or any indirect, incidental, consequential, special, punitive, or exemplary damages, or any other damages arising out of or in connection with this Agreement or the Licensed Technology, or the delay or inability to use or lack of functionality of the Licensed Technology, even in the event of Epic’s or Epic’s affiliates’ fault, tort (including negligence), strict liability, indemnity, product liability, breach of contract, breach of warranty, or otherwise and even if Epic or Epic’s affiliates have been advised of the possibility of such damages.

9. Health and Safety Warning
A small percentage of individuals may experience epileptic seizures or blackouts when exposed to certain light patterns or flashing lights. If you, or anyone in your family, has an epileptic condition, consult your doctor before playing. Immediately discontinue use and consult your doctor if you experience dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, any involuntary movement, or convulsions.

10. General information
(1) You will not dispute the validity or enforceability of this EULA solely because it was concluded electronically.
(2) You agree that a violation of this EULA may cause damage to the Developer. The Developer is entitled to claim reasonable or equivalent compensation under this EULA or under applicable law.
(3) If any provision of this EULA is unlawful or unenforceable under applicable law, the remainder of this provision will be amended to achieve the effect of the original provision as closely as possible. All other provisions of this EULA shall remain in full force and effect.

11. Execution
By installing, copying, otherwise using the Software, you automatically agree to be bound by the terms of this Agreement. If you do not agree to the terms of this EULA, do not install or use this software. © 11th Dan / P.W.Maccabe 2026
