ENDIX – END USER LICENSE AGREEMENT (EULA) & PRIVACY POLICY

This End User License Agreement (“Agreement”) governs your access to and use of the Endix application and its related online/in-game services (the “Service”).

This Agreement is a legally binding contract between you (“User”, “you”) and Endix (“Endix”, “we”, “us”, “our”).

By installing, launching, creating an account, or using the Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement.




TERMS OF SERVICE

1. Accounts
To access certain features of the Service, you may be required to create an Endix account.
You are responsible for maintaining the confidentiality and security of your account credentials and for all activities conducted through your account. You agree to notify Endix immediately of any unauthorized use or security breach.
Endix reserves the right to suspend, restrict, or terminate accounts that violate this Agreement, compromise the integrity of the Service, or engage in harmful or abusive behavior.




2. Acceptable Use
You agree to use the Service only for its intended purpose and in compliance with all applicable laws and regulations.
You are responsible for your conduct within the Service, including interactions with other users and third-party content.




3. Prohibited Uses
In addition to other restrictions set forth in this Agreement, you are prohibited from using the Service or its content:
  • for any unlawful purpose;
  • to solicit others to perform or participate in unlawful acts;
  • to violate any international, national, or local laws or regulations;
  • to infringe upon or violate the intellectual property rights of Endix or third parties;
  • to harass, abuse, insult, harm, defame, intimidate, or discriminate against others;
  • to submit false, misleading, or deceptive information;
  • to upload or transmit malware, exploits, or any other malicious code;
  • to interfere with or disrupt the Service, servers, or networks connected to the Service;
  • to attempt to bypass, disable, or circumvent security or access controls.
Endix reserves the right to terminate or restrict access to the Service for violations of these prohibited uses.




4. Intellectual Property Rights
“Intellectual Property Rights” include all present and future rights related to copyrights, trademarks, service marks, designs, patents, inventions, goodwill, and other proprietary rights.
All content, software, environments, visuals, trademarks, logos, and materials within the Service are owned by Endix or its licensors. This Agreement does not grant you ownership or license rights except as expressly stated.
Third-party trademarks, game titles, and logos displayed in the Service remain the property of their respective owners.




5. Third-Party Content and Links
The Service may include content or references related to third-party games, platforms, or services (including Steam).
Endix does not control, endorse, or assume responsibility for third-party content. Your interaction with third-party services is governed by their respective terms and policies.




6. Disclaimer of Warranty
The Service is provided on an “as is” and “as available” basis. Your use of the Service is at your own risk.
Endix disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.




7. Limitation of Liability
To the fullest extent permitted by applicable law, Endix and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, data, goodwill, or business opportunity, arising from or related to your use of the Service.
Where liability cannot be excluded, Endix’s total liability shall be limited to the maximum extent permitted by law.




8. Indemnification
You agree to indemnify and hold harmless Endix, its affiliates, directors, officers, employees, agents, suppliers, and licensors from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
  • your use of the Service;
  • your violation of this Agreement;
  • your infringement of any third-party rights; and/or
  • your misconduct within the Service.




9. Severability
If any provision of this Agreement is found to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.




10. Dispute Resolution and Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Cyprus, without regard to conflict-of-law principles.
You agree that the courts located in Cyprus shall have exclusive jurisdiction over disputes arising out of or relating to this Agreement or the Service. The United Nations Convention on Contracts for the International Sale of Goods does not apply.




11. Assignment
You may not assign or transfer this Agreement without prior written consent from Endix. Endix may assign or transfer this Agreement as part of a merger, acquisition, or sale of assets.




12. Changes to These Terms
Endix reserves the right to modify this Agreement at any time. Continued use of the Service after changes take effect constitutes acceptance of the revised Agreement.

PRIVACY POLICY

We respect your privacy and are committed to protecting it through compliance with this Privacy Policy (“Policy”).
This Policy describes how Endix (“Endix”, “we”, “us”, “our”) collects, uses, stores, protects, and discloses Personal Information when you access or use the Service.
This Policy does not apply to the practices of companies or individuals that we do not own, control, or manage.




1. Collection of Personal Information
You may access and use parts of the Service without revealing your identity. However, to create an account and access online or multiplayer features, you may be required to provide certain Personal Information.
Personal Information we may collect includes:

Providing Personal Information is optional, but some features of the Service may not be available without it.




2. Privacy of Children
The Service is not directed to children under the age of 13. We do not knowingly collect Personal Information from children.

We do not sell or rent email data. Users may opt out of marketing communications at any time. Essential transactional or service-related emails may still be sent.

Certain information may be retained where required by law, to resolve disputes, or to enforce agreements.

We do not sell Personal Information.
We may share Personal Information with trusted service providers that assist in operating the Service (such as hosting or infrastructure providers), under strict confidentiality obligations.

In the event of a business transfer (such as a merger or acquisition), Personal Information may be transferred as part of that transaction.

Endix does not control, endorse, or assume responsibility for third-party content, services, or privacy practices. Accessing third-party content is done at your own risk.

  • The right to correct or delete your data
  • The right to restrict or object to certain processing
