END USER LICENSE AGREEMENT (EULA)

This End User License Agreement ("Agreement") is between you ("User") and Martijn van Berkel, an individual residing in the Netherlands ("Developer"), regarding your use of Signal From The Stars ("Game"), including all associated code, assets, data files, and binary distributions.
By downloading, installing, or using the Game, you agree to this Agreement. If you do not agree, do not use the Game.
1. LICENSE
This software is proprietary. A valid purchase or license grant provides you with a personal, non-exclusive, non-transferable, revocable right to use the Game for personal, non-commercial purposes, on devices you own or control. You may stream, record, and share videos or screenshots of the Game, including on monetized channels. No other rights are granted.
2. OWNERSHIP
The Game and all related intellectual property rights remain the exclusive property of the Developer. This Agreement does not transfer any ownership rights to you.
3. RESTRICTIONS
Except as explicitly permitted by the Developer or by applicable law, you may not:
- Copy, modify, or redistribute the Game.
- Sell, rent, lease, sublicense, or otherwise transfer the Game, except as permitted by the Platform's own features (e.g. official gifting).
- Reverse engineer or decompile the Game.
4. THIRD-PARTY COMPONENTS
This Game includes third-party components licensed under their own respective licenses. These third-party licenses are included in the source/installation distribution and listed separately. Third-party components remain subject to their original terms and are not covered by this proprietary license.
5. AGE REQUIREMENT
If you are under the age of majority in your country of residence, you may only use the Game with the consent of a parent or legal guardian.
6. NO WARRANTY
THE GAME IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE GAME WILL FUNCTION WITHOUT INTERRUPTION OR ERROR.
Nothing in this section excludes or limits any statutory guarantee or consumer right that cannot lawfully be excluded under applicable law (including EU consumer protection law).
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, SAVED GAMES, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE USE OF, INABILITY TO USE, OR PERFORMANCE OF THE GAME, EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IF THE DEVELOPER IS FOUND LIABLE FOR ANY CLAIM, TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE GAME.
NOTHING IN THIS AGREEMENT EXCLUDES OR LIMITS LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
8. INDEMNIFICATION
You agree to indemnify and hold the Developer harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Game or your violation of this Agreement.
9. PLATFORM TERMS
Your use of the Game is also subject to the terms of the platform through which you obtained it ("Platform") (e.g. Steam Subscriber Agreement, Apple Media Services Terms and Conditions, Google Play Terms of Service). Where those terms conflict with this Agreement on matters the platform governs (such as payments or refunds), the platform's terms control.
10. TERMINATION
This Agreement terminates automatically if you materially breach its terms. Upon termination, you must stop using the Game and delete all copies in your possession.
11. GOVERNING LAW
This Agreement is governed by the laws of the Netherlands, without regard to conflict-of-law principles. This does not deprive you of any protection under mandatory consumer-protection laws of your country of residence.
12. MISCELLANEOUS
Severability: if any provision of this Agreement is found invalid or unenforceable, the remaining provisions remain in full effect.
Entire Agreement: this Agreement, together with the applicable Platform Terms and third-party license notices referenced above, constitutes the entire agreement between you and the Developer regarding the Game.
No Waiver: failure to enforce any provision does not waive the Developer's right to enforce it later.
